R. 3353</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="R000515">Mr. Rush</sponsor> (for himself, <cosponsor name-id="B001248">Mr. Burgess</cosponsor>, <cosponsor name-id="B001303">Ms. Blunt Rochester</cosponsor>, and <cosponsor name-id="M001180">Mr. McKinley</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fairness to Contact Lens Consumers Act to modernize verification of contact lens prescriptions, and for other purposes.</official-title></form><legis-body id="H45FA6047219D4D23948EBCCCD66ECB6F" style="OLC"><section id="H994BA2D173AB4C058D2735D540CD3B62" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contact Lens Prescription Verification Modernization Act</short-title></quote>.</text></section><section id="H79B56C250C364FC889FD3FE195A9C78C"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 4 of the Fairness to Contact Lens Consumers Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7603">15 U.S.C. 7603</external-xref>) is amended—</text><paragraph id="HEA573495612C4B51A18DEC5C8D4B9D7B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H7A79DC5AE93D4A1792EEE78B5EE2C5BE"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></subparagraph><subparagraph id="HC7944E13A4AB4C12B5E50041949CB318"><enum>(B)</enum><text>by moving such redesignated subparagraphs 2 ems to the right;</text></subparagraph><subparagraph id="H58016565BC59467590979ED3F33D1E57"><enum>(C)</enum><text>by striking <quote>A seller may</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="OLC">Sellers generally.</header-in-text>—A seller may</quote>; and</text></subparagraph><subparagraph id="H393712AF1EF749D09F1565900C59CB60"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H005337CA2DB74756B6F448E4B8D1BB7D" style="OLC"><paragraph id="HF8BF6670B8904907897C2BADAD9ECE16"><enum>(2)</enum><header>Online sellers</header><text display-inline="yes-display-inline">An online seller of contact lenses shall provide a method that enables an individual to electronically transmit, in accordance with HIPAA privacy regulation (as defined in section 1180(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-9">42 U.S.C. 1320d–9(b)(3)</external-xref>)), a copy of a contact lens prescription for such individual.</text></paragraph><paragraph id="H56F5EB2D8AA54D809283267A398DD193"><enum>(3)</enum><header>Encryption required</header><text display-inline="yes-display-inline">Any protected health information (as defined for purposes of the HIPAA privacy regulation) that an online seller sends pursuant to this section by email shall be encrypted.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4C517294B7204A0FA50021030CCE30DF"><enum>(2)</enum><text>in subsection (c)(6), by striking <quote>and telephone number</quote> and inserting the following: <quote>, telephone number, and email address</quote>; and</text></paragraph><paragraph commented="no" id="H99C40B439FF04DB8BFAC6927CF0CAB2D"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (g), by striking the period at the end and inserting the following: <quote>but does not include a call made using an artificial or prerecorded voice.</quote>.</text></paragraph></section></legis-body></bill>
