R. 3345</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="K000385">Ms. Kelly of Illinois</sponsor> (for herself, <cosponsor name-id="H001056">Ms. Herrera Beutler</cosponsor>, <cosponsor name-id="U000040">Ms. Underwood</cosponsor>, <cosponsor name-id="P000617">Ms. Pressley</cosponsor>, and <cosponsor name-id="G000588">Mr. Gonzalez of Ohio</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the American Rescue Plan Act of 2021 and title XIX of the Social Security Act to promote extended coverage of pregnant and postpartum women under the Medicaid program.</official-title></form><legis-body id="HB016D70BBF02455FBAF72778750E045D" style="OLC"><section id="HAF9046F3D2D7441C911074DE730EE99F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Medicaid Offer Maternity Services Act of 2021</short-title></quote> or the <quote><short-title>Helping MOMS Act of 2021</short-title></quote>.</text></section><section id="H63B29D42C7D2436AB4DD751E60180C8B"><enum>2.</enum><header>Promoting extended coverage of pregnant and postpartum women under the Medicaid program</header><subsection id="HBDF760A14F58496FA1675ECA8F014EE7"><enum>(a)</enum><header>Eliminating time limit on State option To elect extended coverage</header><text display-inline="yes-display-inline">Section 9812(b) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) is amended by striking <quote>during the 5-year period</quote>.</text></subsection><subsection id="H134D9114153540DAB48FCF637C482879"><enum>(b)</enum><header>Increasing FMAP for pregnancy-Related services for certain States</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="H7E501146F27746E090E8DFBBD7835AC5"><enum>(1)</enum><text>in subsection (b), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (jj)</quote>;</text></paragraph><paragraph id="HBA6C57DB129A428F9238D11957257D33"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (ff), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (jj)</quote>; and</text></paragraph><paragraph id="H29E3119C4B6F4E3098DBAB369963AA9D"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H81F1C3DB9C0F4A7EBC6781DE3D8AC0C8" display-inline="no-display-inline"><subsection id="H94A518F6AD334EE5B35080BEC3C1032D"><enum>(jj)</enum><header>Temporary increase in FMAP for pregnancy-Related services for certain States</header><text display-inline="yes-display-inline">For each quarter occurring during the 4-quarter period beginning with the first calendar quarter during which a State makes the election described in section 1902(e)(16), the Federal medical assistance percentage for such State that would otherwise apply (including, if applicable, such percentage that would otherwise apply under subsection (y) or (z)) with respect to amounts expended by the State for medical assistance for pregnancy-related services (including prenatal, delivery, and post partum services) furnished during such quarter shall, after application of any increase, if applicable, under section 6008 of the Families First Coronavirus Response Act or under subsection (ii), be increased by 5 percentage points. Application of the previous sentence may not result in the Federal medical assistance percentage for a State exceeding 100 percent. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
