which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Safe Drinking Water Act with respect to replacement of lead service lines, and for other purposes.</official-title></form><legis-body id="H5A0949475AD74D48A2E58B5AE4C930F4" style="OLC"><section id="HE87FBBCAE8C24D049A8841787A8047AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Get the Lead Out Act</short-title></quote>. </text></section><section id="H96F5BBF656A54596B01FBB8C02C73B32"><enum>2.</enum><header>Plans for replacement of lead service lines</header><subsection id="HDA453D1F7CE7426E8352CBDF3FD74B05"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H780E7BFAB3804BD4821521FEA1C64A02" display-inline="no-display-inline"><section id="HBDC6C13B56074076B3179863A99037A6"><enum>1459E.</enum><header>Replacement of lead service lines</header><subsection id="H7897E5C8B3734A4299BFB5F3A58D10FB"><enum>(a)</enum><header>Plans</header><paragraph id="H4AA0D777CCFA4D5DB5BA46C9565A2163"><enum>(1)</enum><header>Submission</header><subparagraph id="H24E699492BD842AE8C4B0911DAE2AC0E"><enum>(A)</enum><header>Systems serving 3,300 or more</header><clause id="HAF17A2040273417B931EBCC83B948214"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), each community water system serving a population of 3,300 or more shall—</text><subclause id="H3E8C77CEFAB14E5F8A2438D9BD43CCF1"><enum>(I)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this section, submit to the Administrator a plan to inventory and fully replace all of the lead service lines of the community water system, including the portions of such lead service lines that are owned by the community water system and any remaining portions of such lead service lines; and</text></subclause><subclause id="HACAFF683D2C14214979C178F752C64E5"><enum>(II)</enum><text>not later than 3 years after the date of enactment of this section, complete such inventory.</text></subclause></clause><clause id="HB9014C41EA6545BCB81E8421AF0A9373"><enum>(ii)</enum><header>Exception</header><text>The plan of a community water system under clause (i) shall not allow the partial replacement of the lead service lines of the system, except in the case of an emergency, in which case the community water system shall ensure prompt full replacement of the lead service lines of the system not more than 90 days after the end of the emergency.</text></clause><clause id="H2FF7F3F7B2664768B82E719011E23162"><enum>(iii)</enum><header>Procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Administrator shall establish procedures to ensure that inventories conducted pursuant to a plan under clause (i) are rigorous and complete.</text></clause></subparagraph><subparagraph id="HB2652E4308F2457E828A031E6C08B2EB"><enum>(B)</enum><header>Small systems</header><text display-inline="yes-display-inline">Each community water system serving fewer than 3,300 persons shall—</text><clause id="HE0DB27BF3DCC4553837DA73DAA6A7589"><enum>(i)</enum><text display-inline="yes-display-inline">by such deadline as the Administrator determines appropriate, but not later than 5 years after the date of enactment of this section, submit to the Administrator a plan to inventory and fully replace all the lead service lines of the community water system, as described in subparagraph (A)(i) and subject to subparagraph (A)(ii); and</text></clause><clause id="H33537DE540FE4DDCA381A67EFC7EF3F0"><enum>(ii)</enum><text display-inline="yes-display-inline">not later than 5 years after the date of enactment of this section, complete such inventory.</text></clause></subparagraph></paragraph><paragraph id="H92A6F2A7042A4B50835F7027C49E52BF"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Each plan submitted under this subsection shall include a plan and schedule for—</text><subparagraph id="H3AB6F0AEF2D2499EAA5C892D9C696052"><enum>(A)</enum><text>notifying persons served by the applicable community water system that the community water system will install interim filters that meet the criteria under paragraph (3) on all primary drinking water taps served by the community water system with lead service lines;</text></subparagraph><subparagraph id="H07E02999DE17405182F010E2967F97CB"><enum>(B)</enum><text display-inline="yes-display-inline">installing such interim filters and providing replacement filter cartridges in accordance with manufacturer instructions for so long as such interim filters are in use; </text></subparagraph><subparagraph id="H4095550C5079444CA67E18B332FC9863"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 10 years after such plan is approved under subsection (b), fully replacing all of the lead service lines of the community water system; and</text></subparagraph><subparagraph id="H03A4D0AA416648679C12C54F13437413"><enum>(D)</enum><text display-inline="yes-display-inline">including local community-based or other local organizations, as deemed appropriate by the community water system, in training the public in the proper use and maintenance of the interim filters.</text></subparagraph></paragraph><paragraph id="H7501F8B119A24AE3BF535D60AD720551"><enum>(3)</enum><header>Filter criteria</header><text display-inline="yes-display-inline">Interim filters, and any replacement thereof, installed pursuant to a plan under this section—</text><subparagraph id="HFB65BD4A78C54046B33B27036E4D8D20"><enum>(A)</enum><text display-inline="yes-display-inline">shall—</text><clause id="HEF2CBF1CA278416FA3C99CBC9C953110"><enum>(i)</enum><text display-inline="yes-display-inline">be certified for lead reduction in compliance with NSF International/American National Standards Institute (<quote>ANSI</quote>) Standard 53–2017, <quote>Drinking Water Treatment Units—Health Effects</quote>, published by NSF International; and</text></clause><clause id="H077E4493800045339589A3F3679FCA70"><enum>(ii)</enum><text> incorporate an integral performance indication device as specified in section 6.1 of NSF/ANSI standard 53–2017; or</text></clause></subparagraph><subparagraph id="H16FAEAC65579436FB556273ABAABDA1E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">shall be certified as compliant with any standards for lead reduction adopted by NSF International, ANSI, or the Agency that are more stringent than the standards under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HEBC5BE775004458781FA636AD739ED69"><enum>(b)</enum><header>Approval</header><text display-inline="yes-display-inline">Not later than 6 months after a community water system submits a plan under this section, the Administrator shall approve the plan or notify the community water system in writing of revisions the Administrator determines necessary to approve the plan. </text></subsection><subsection id="HCD9E518202624FBDABBD73E854CB691B" commented="no"><enum>(c)</enum><header>Implementation</header><paragraph id="H3CE5C32F4DF842168C7A50BA61F3C34E"><enum>(1)</enum><header>In general</header><text>Not later than 10 years after a plan under this section of a community water system is approved by the Administrator, the community water system shall submit to the Administrator a certification that all the lead service lines of the community water system have been fully replaced pursuant to such plan except for any lead service line that—</text><subparagraph id="H19BC0034870D491EBB4A20A091E2AD43"><enum>(A)</enum><text>is not owned by the community water system; and</text></subparagraph><subparagraph id="H0345172BF2954B8CA77F030948905408"><enum>(B)</enum><text>with respect to which the owner has declined replacement by the community water system at the system’s expense.</text></subparagraph></paragraph><paragraph id="H62A0211A776B410491FFAEBFAEEBBFB7"><enum>(2)</enum><header>Payment</header><text>The community water system—</text><subparagraph id="HB4279EFCB7A74E2189D6F93F003FC458"><enum>(A)</enum><text>shall pay the full costs of all lead service line replacements and filters required pursuant to the system’s plan under subsection (a); and</text></subparagraph><subparagraph id="H077B657041794D228F36568348972DC6"><enum>(B)</enum><text display-inline="yes-display-inline">may incorporate into its rate base the costs of replacement and filters not fully covered by grants and other Federal and non-Federal assistance.</text></subparagraph></paragraph></subsection><subsection id="H01FD880562494797A37C8EC196243B3B"><enum>(d)</enum><header>Extension</header><paragraph id="H1FA0B5B9E5DA4B2996F73E599F40948B"><enum>(1)</enum><header>Application</header><text>A community water system may submit an application to the Administrator for an extension of the 10-year deadline applicable under subsection (c). </text></paragraph><paragraph id="HB24FA2AB83504FDE84C19C1DAD4F2E75"><enum>(2)</enum><header>Approval</header><text>The Administrator shall approve an application for an extension under paragraph (1) only if—</text><subparagraph id="HCBF3057B348C4AECBFB13E22A2973593"><enum>(A)</enum><text display-inline="yes-display-inline">the community water system submitting the application has held a public hearing and solicited public comment prior to submitting the application; </text></subparagraph><subparagraph id="HD51D836DFA2049F087A348A09FAB96BF"><enum>(B)</enum><text>the Administrator determines that lead service line replacement by the community water system is not feasible by the 10-year deadline applicable under subsection (c); and</text></subparagraph><subparagraph id="H18A5164F845144DAA3F706098832E22B"><enum>(C)</enum><text display-inline="yes-display-inline">the community water system submitting the application has more than 100,000 known or suspected lead service lines.</text></subparagraph></paragraph><paragraph id="HAF5AE7A0722D4220A1677957EC98E6CA"><enum>(3)</enum><header>Period of extension</header><text>The Administrator may only grant an extension under this subsection for the minimum period of time necessary for the applicable community water system to replace all of the lead service lines of the community water system.</text></paragraph></subsection><subsection id="HA35C7CDA94B543F79729098228E33A99" commented="no"><enum>(e)</enum><header>Enforcement authority</header><text display-inline="yes-display-inline">The Administrator may take action to enforce a requirement of this section pursuant to section 1414(a)(2) with respect to a community water system in a State regardless of whether the State has primary enforcement responsibility for public water systems.</text></subsection><subsection id="HF46689EBC2F94317BE97EF7519B12DD6"><enum>(f)</enum><header>Definition</header><text>In this section, the term <term>lead service line</term> has the meaning given such term in section 1459B(a).</text></subsection><subsection id="HE499C88FBFFB42319BA342A1426E3DE3"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2022 and 2023. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H38357BF4D5354515899C42E69C523A0A"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 1414(i)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-3">42 U.S.C. 300g–3(i)(1)</external-xref>) is amended by striking <quote>or 1445</quote> and inserting <quote>1445, or 1459E</quote>.</text></subsection></section><section id="H4041093BEB1F41B89E1608CE09BE8C37"><enum>3.</enum><header>State revolving loan funds</header><subsection id="H448C5B9FDEF94ABFA162584A79660312"><enum>(a)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Paragraph (2) of section 1452(a) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1C8A7B50AA224E83906BA18ADCF09C2A" display-inline="no-display-inline"><subparagraph id="H559EB8C504F3488B9A81BCF8011617C3"><enum>(H)</enum><header>Replacement of lead service lines</header><text display-inline="yes-display-inline">Financial assistance under this section may also be used for replacement of lead service lines in accordance with section 1459E, with priority given to loans and loan guarantees for disadvantaged communities (as defined in subsection (d)(3)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H669F3B5BD5B243B496D2E30495CA5A00"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 1452(m) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(m)</external-xref>) is amended—</text><paragraph id="H15F05ED2980548A4BC4817604B28EDC8"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H9DE2735A4C434B5DB24CEA472CB69C95"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H8D840BABFBFB45FF8A726E6C98952095"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HCC9DD712101041219961076E7A37D117"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HD12659FAD73C40BF98789ACE908E5189" display-inline="no-display-inline"><subparagraph id="H628553AD24E74BFB91C976AE1E3134D3"><enum>(D)</enum><text display-inline="yes-display-inline">$6,600,000,000 for each of fiscal years 2022 through 2031.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0239EBBF2537481EA9071A4B9EF6ADD7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HEC78999B6AB645E9B22FAA4092E97C09" display-inline="no-display-inline"><paragraph id="HFA5B15DE80A44E9787085C53C1805571"><enum>(3)</enum><text display-inline="yes-display-inline">Of the amount authorized by paragraph (1)(D) to be appropriated for each of fiscal years 2022 through 2031, $4,650,000,000 shall be for replacement of lead service lines as described in subsection (a)(2)(H).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
