and</text></subparagraph><subparagraph id="HA153B1B13B314DBDB062FC83A2ADC93C"><enum>(B)</enum><text>by striking <quote>2020 and 2021</quote> and inserting <quote>2022 through 2031</quote>.</text></subparagraph></paragraph></section><section id="HF10181B5111942B5832AC956D2263E7F"><enum>102.</enum><header>Grants for State programs</header><text display-inline="no-display-inline">Section 1443(a)(7) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-2">42 U.S.C. 300j–2(a)(7)</external-xref>) is amended by striking <quote>and 2021</quote> and inserting <quote>through 2031</quote>.</text></section><section id="H753B1DB514A74D75844F2DCF25167D4D"><enum>103.</enum><header>American iron and steel products</header><text display-inline="no-display-inline">Section 1452(a)(4)(A) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)(4)(A)</external-xref>) is amended by striking <quote>During fiscal years 2019 through 2023, funds</quote> and inserting <quote>Funds</quote>.</text></section><section id="HDC6A74877C8441F3B6514B6DA4D3FDB6"><enum>104.</enum><header>Assistance for disadvantaged communities</header><text display-inline="no-display-inline">Section 1452(d)(2)(A) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(d)(2)(A)</external-xref>) is amended by striking <quote>35 percent</quote> and inserting <quote>40 percent</quote>. </text></section><section id="HDD6856D78B07420A8D69874D2376830F" display-inline="no-display-inline" section-type="subsequent-section"><enum>105.</enum><header>Allotments for territories</header><text display-inline="no-display-inline">Section 1452(j) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(j)</external-xref>) is amended by striking <quote>0.33 percent</quote> and inserting <quote>1.5 percent</quote>. </text></section><section id="HD0C0AFD866C54FB88E8F12DCE2E05DF2" commented="no"><enum>106.</enum><header>Drinking water SRF funding</header><text display-inline="no-display-inline">Section 1452(m)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(m)(1)</external-xref>) is amended—</text><paragraph id="H01D9612499914E2BAFFC7C553B7414F4" commented="no"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote>;</text></paragraph><paragraph id="H96E36DDCC3654CC5AF7181276E0BD357" commented="no"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>2021.</quote> and inserting <quote>2021;</quote>; and</text></paragraph><paragraph id="HC63438A0055C4647A0FA59B644A9F5F4" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H9A1B1F38D50943AAB9995B91EF35EF4E" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><subparagraph id="HB760B08C585643B6BD4D77F511284D7D" commented="no"><enum>(D)</enum><text>$4,140,000,000 for fiscal year 2022;</text></subparagraph><subparagraph id="H5F87737138B64D74AECEC7E976AB5E66" commented="no"><enum>(E)</enum><text>$4,800,000,000 for fiscal year 2023; and</text></subparagraph><subparagraph id="H888C331FC9EF4005B9A47D01E986C5B6" commented="no"><enum>(F)</enum><text>$5,500,000,000 for each of fiscal years 2024 through 2031.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF414D0E10361429F9B096AAD55FD170B" section-type="subsequent-section"><enum>107.</enum><header>Lead service line replacement</header><subsection id="HC5D21C310E0643F9BE125D2BACFB2D58"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H54061F2DE3A04A178D106B8918B1F006" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H8E826CB0AA364D779864C41F05B0FE06" commented="no"><enum>(u)</enum><header>Lead service line replacement</header><paragraph id="HF075BFEEB11440C8AF291E1C4AE231F4" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the capitalization grants to eligible States under subsection (a)(1), the Administrator shall offer to enter into agreements with States, Indian Tribes, and the territories described in subsection (j) to make grants, including letters of credit, to such States, Indian Tribes, and territories under this subsection to fund the replacement of lead service lines.</text></paragraph><paragraph id="H1AE14044627045698A40D4B86793A484" commented="no"><enum>(2)</enum><header>Allotments</header><subparagraph id="H559E831E809A43BD99C33F004493EE34" commented="no"><enum>(A)</enum><header>States</header><text display-inline="yes-display-inline">Funds made available to carry out this subsection shall be—</text><clause id="H7F1E562E97034271A0FA82AFC0EC9CDF"><enum>(i)</enum><text>allotted and reallotted to the extent practicable to States as if allotted or reallotted under subsection (a)(1) as a capitalization grant under such subsection; and</text></clause><clause id="H7DD69710AB2C44C6AA3C5EDDD1755BA9"><enum>(ii)</enum><text display-inline="yes-display-inline">deposited into the State loan fund of a State receiving such funds pursuant to an agreement entered into pursuant to this subsection.</text></clause></subparagraph><subparagraph id="H9E962B452A334016B2BD489635437ECE" commented="no"><enum>(B)</enum><header>Indian Tribes</header><text>The Administrator shall set aside 1<fraction>1/2</fraction> percent of the amounts made available each fiscal year to carry out this subsection to make grants to Indian Tribes.</text></subparagraph><subparagraph id="H88AFAA8C5A614F50A40ED24C1CDC2066" commented="no"><enum>(C)</enum><header>Other areas</header><text display-inline="yes-display-inline">Funds made available to carry out this subsection shall be allotted to territories described in subsection (j) in accordance with such subsection.</text></subparagraph></paragraph><paragraph id="H704D2C4BA79E417C811AA9D82DD9A22C" commented="no"><enum>(3)</enum><header>Grants</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, funds made available under this subsection shall be used only for providing grants for the replacement of lead service lines.</text></paragraph><paragraph id="H195C94F04B40490DA20951007F7B8012" commented="no"><enum>(4)</enum><header>Priority</header><text>Each State, Indian Tribe, and territory that has entered into an agreement pursuant to this subsection shall annually prepare a plan that identifies the intended uses of the amounts made available to such State, Indian Tribe, or territory under this subsection, and any such plan shall—</text><subparagraph id="H7AA757A492CF4C77BC668B6B45A55577" commented="no"><enum>(A)</enum><text>not be required to comply with subsection (b)(3); and</text></subparagraph><subparagraph id="HBCF6174C5E19410CABE5540D24008BDC" commented="no"><enum>(B)</enum><text>provide, to the maximum extent practicable, that priority for the use of funds be given to projects that replace lead service lines serving disadvantaged communities and environmental justice communities.</text></subparagraph></paragraph><paragraph id="HC326B505BC594D49BB2F2A17A174552A" commented="no"><enum>(5)</enum><header>Plan for replacement</header><text display-inline="yes-display-inline">Each State, Indian Tribe, and territory that has entered into an agreement pursuant to this subsection shall require each recipient of funds made available pursuant to this subsection to submit to the State, Indian Tribe, or territory a plan to replace all lead service lines in the applicable public water system within 10 years of receiving such funds.</text></paragraph><paragraph id="H546AE5A0A4CA46BDBD494CA8FDD97C8C" commented="no"><enum>(6)</enum><header>American made iron and steel and prevailing wages</header><text>The requirements of paragraphs (4) and (5) of subsection (a) shall apply to any project carried out in whole or in part with funds made available under or pursuant to this subsection.</text></paragraph><paragraph id="H7CE80B8C1F1E4292BF9D25781F6E4587" commented="no"><enum>(7)</enum><header>Limitation</header><subparagraph id="H92106EE278374DBABFF67545C0F745D2" commented="no"><enum>(A)</enum><header>Prohibition on partial line replacement</header><text>No funds made available pursuant to this subsection may be used for partial lead service line replacement if, at the conclusion of the service line replacement, drinking water is delivered through a publicly or privately owned portion of a lead service line.</text></subparagraph><subparagraph id="H927E180D11244771A96B7C3F0EA8F648" commented="no"><enum>(B)</enum><header>No private owner contribution</header><text>Any recipient of funds made available pursuant to this subsection for lead service line replacement shall offer to replace any privately owned portion of any lead service line with respect to which such funds are used at no cost to the private owner.</text></subparagraph></paragraph><paragraph id="HEC5303424A14438C94F67A2DDF110C01" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>Disadvantaged community assistance</header><text display-inline="yes-display-inline">All funds made available pursuant to this subsection to fund the replacement of lead service lines may be used to replace lead service lines serving disadvantaged communities. </text></paragraph><paragraph id="H8E5A55023FC84DA8B99B3AF01C804758" commented="no"><enum>(9)</enum><header>State contribution not required</header><text display-inline="yes-display-inline">No agreement entered into pursuant to paragraph (1) shall require that a State deposit, at any time, in the applicable State loan fund from State moneys any contribution in order to receive funds under this subsection.</text></paragraph><paragraph id="H6ACB78A23D8A432A9E5DE9E8EEC03484" commented="no"><enum>(10)</enum><header>Authorization of appropriations</header><subparagraph id="H4EF00274AFDF4C53AA29A292ABDC7A14" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this subsection $4,500,000,000 for each of fiscal years 2022 through 2031. Such sums shall remain available until expended.</text></subparagraph><subparagraph id="HD18FEB90AF0642ADAB37EC798C782ED2" commented="no"><enum>(B)</enum><header>Additional amounts</header><text>To the extent amounts authorized to be appropriated under this subsection in any fiscal year are not appropriated in that fiscal year, such amounts are authorized to be appropriated in a subsequent fiscal year. Such sums shall remain available until expended.</text></subparagraph></paragraph><paragraph id="H5EBF44D68C094C69A23BE3CE97A4F339" commented="no"><enum>(11)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="HBEFEFD33503F43D491B9AFABBE73D06B" commented="no"><enum>(A)</enum><header>Disadvantaged community</header><text display-inline="yes-display-inline">The term <term>disadvantaged community</term> has the meaning given such term in subsection (d)(3).</text></subparagraph><subparagraph id="H4D8465509532462C92FBD15219C145E0" commented="no"><enum>(B)</enum><header>Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> means any population of color, community of color, indigenous community, or low-income community that experiences a disproportionate burden of the negative human health and environmental impacts of pollution or other environmental hazards.</text></subparagraph><subparagraph id="H03A197CF8C9B44FEABA5E60CC25959A9"><enum>(C)</enum><header>Lead service line</header><text>The term <term>lead service line</term> means a pipe and its fittings, which are not lead free (as defined in section 1417(d)), that connect the drinking water main to the building inlet.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H1EB5A816CF9349E399A1B1C26D3CE86E"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1452(m)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(m)(1)</external-xref>) is amended by striking <quote>(a)(2)(G) and (t)</quote> and inserting <quote>(a)(2)(G), (t), and (u)</quote>.</text></subsection></section><section id="H097CBF1BF9E7435D933ABB88431D37D7"><enum>108.</enum><header>Drinking water assistance to colonias</header><text display-inline="no-display-inline">Section 1456 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-16">42 U.S.C. 300j–16</external-xref>) is amended—</text><paragraph id="H71248B31845742C48FFAA1B9536FC352"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HF4BA014C48634707930E3878011BF0B8"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph><subparagraph id="H7022FA4FF38B4F8798EF6DDBAAFBF64D"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following new paragraph:</text><quoted-block style="OLC" id="H3126952E187D4E2DB69E29C24EBA907B" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H92F7F5804B2544BEB558BFEE8CD335A3"><enum>(2)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means each of the following:</text><subparagraph id="H271039862AF8439C8368C2D05337D3ED"><enum>(A)</enum><text>A border State.</text></subparagraph><subparagraph id="H2A0AF91F990E4001894B03F7C55A969A"><enum>(B)</enum><text>A local government with jurisdiction over an eligible community.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFF4B35F218004D48811F8E8EB36EBD25"><enum>(2)</enum><text>in subsection (b), by striking <quote>border State</quote> and inserting <quote>covered entity</quote>;</text></paragraph><paragraph id="HAE25EC264E154491A820692EE7C52C19"><enum>(3)</enum><text>in subsection (d), by striking <quote>shall not exceed 50 percent</quote> and inserting <quote>may not be less than 80 percent</quote>; and </text></paragraph><paragraph id="H69FB39B7155E428E8248BEBB89173B23"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H41C99B52DC7F41F78BD977637F21DC78"><enum>(A)</enum><text>by striking <quote>$25,000,000</quote> and inserting <quote>$100,000,000</quote>; and</text></subparagraph><subparagraph id="HD07D67B223404FF8BAFDF906DAC96E5A"><enum>(B)</enum><text>by striking <quote>1997 through 1999</quote> and inserting <quote>2022 through 2026</quote>.</text></subparagraph></paragraph></section><section id="HE5BB89D38B14479CA0492BADFE8EDD81" display-inline="no-display-inline" section-type="subsequent-section"><enum>109.</enum><header>PFAS treatment grants</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HB2625C11421249B4B7A01906F3852B4B" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><section id="H7EB39643D7F9478690F2DE23C7413E01"><enum>1459E.</enum><header>Assistance for community water systems affected by PFAS</header><subsection id="H108E1E1C02704AC6A5AEEA759C45FC64"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this section, the Administrator shall establish a program to award grants to affected community water systems to pay for capital costs associated with the implementation of eligible treatment technologies.</text></subsection><subsection id="H7D1A4128099243649B43794B379910FE"><enum>(b)</enum><header>Applications</header><paragraph id="H6338EF7F869D4D7E8B98240CA4006D8F"><enum>(1)</enum><header>Guidance</header><text>Not later than 12 months after the date of enactment of this section, the Administrator shall publish guidance describing the form and timing for community water systems to apply for grants under this section.</text></paragraph><paragraph id="HCEB20A369A134EBF814B3ACC71623843"><enum>(2)</enum><header>Required information</header><text>The Administrator shall require a community water system applying for a grant under this section to submit—</text><subparagraph id="HA49DF5A4A5EE441B8FD7EB67252DBB7D"><enum>(A)</enum><text display-inline="yes-display-inline">information showing the presence of a perfluoroalkyl or polyfluoroalkyl substance in water of the community water system; and</text></subparagraph><subparagraph id="H58EDEFEF58824EDAAA5F5B7DE70F0FF4" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a certification that the treatment technology in use by the community water system at the time of application is not sufficient to meet all applicable standards, and all applicable health advisories published pursuant to section 1412(b)(1)(F), for perfluoroalkyl and polyfluoroalkyl substances.</text></subparagraph></paragraph></subsection><subsection id="HC1256395BD8E472D85BB602A7B173A8C"><enum>(c)</enum><header>List of eligible treatment technologies</header><text>Not later than 150 days after the date of enactment of this section, and every 2 years thereafter, the Administrator shall publish a list of treatment technologies that the Administrator determines are the most effective at removing perfluoroalkyl and polyfluoroalkyl substances from drinking water.</text></subsection><subsection id="H6748640E467540FB82908A937EED0FA5"><enum>(d)</enum><header>Priority for funding</header><text>In awarding grants under this section, the Administrator shall prioritize an affected community water system that—</text><paragraph id="H27B988CFCC8B4503B22B582C58C65E13"><enum>(1)</enum><text>serves a disadvantaged community;</text></paragraph><paragraph id="HD8B5A51D522C49BBAC3915147C2C8295"><enum>(2)</enum><text>will provide at least a 10-percent cost share for the cost of implementing an eligible treatment technology;</text></paragraph><paragraph id="H852B4E8C93004B1FBE300E2C61FF315B"><enum>(3)</enum><text>demonstrates the capacity to maintain the eligible treatment technology to be implemented using the grant; or</text></paragraph><paragraph id="HC498F7743BF44BA38E92AA41A7F859A4" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">is located within an area with respect to which the Administrator has published a determination under the first sentence of section 1424(e) relating to an aquifer that is the sole or principal drinking water source for the area.</text></paragraph></subsection><subsection id="H0D9F52A9F7AA41C3A7E3C57459AB00FA"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="HEABC17D275C44EB1AC6575751A53A5E1"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $500,000,000 for each of the fiscal years 2022 through 2031.</text></paragraph><paragraph id="H2776F3AAA35F44B5AB9B27E583861FB9"><enum>(2)</enum><header>Special rule</header><text>Of the amounts authorized to be appropriated by paragraph (1), $25,000,000 are authorized to be appropriated for each of fiscal years 2022 and 2023 for grants under subsection (a) to pay for capital costs associated with the implementation of eligible treatment technologies during the period beginning on October 1, 2014, and ending on the date of enactment of this section.</text></paragraph></subsection><subsection id="HC99FC9906D5D4218AF57EFD98B938954"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF2566BB3459341D28A24C2329B4E5468"><enum>(1)</enum><header>Affected community water system</header><text display-inline="yes-display-inline">The term <term>affected community water system</term> means a community water system that is affected by the presence of a perfluoroalkyl or polyfluoroalkyl substance in the water in the community water system.</text></paragraph><paragraph id="HB2787381617444E3AA7AC295934C47A0"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> has the meaning given that term in section 1452.</text></paragraph><paragraph id="HB719D5417B4D447ABDF53655139C9ACC"><enum>(3)</enum><header>Eligible treatment technology</header><text>The term <term>eligible treatment technology</term> means a treatment technology included on the list published under subsection (c).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H877360D8AA234681975ADE90E2A279B3"><enum>110.</enum><header>Voluntary school and child care program lead testing grant program</header><text display-inline="no-display-inline">Section 1464(d)(8) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24(d)(8)</external-xref>) is amended by striking <quote>and 2021</quote> and inserting <quote>through 2031</quote>.</text></section><section id="H44CF8D9773C242B4B35F0CD399E860B1"><enum>111.</enum><header>Grant program for installation of filtration stations at schools and child care programs</header><text display-inline="no-display-inline">Section 1464 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HC7BB9F14D1E44135B3B632F97620BDD7" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H6E9E9AAD708442EC85F577E7E1172726"><enum>(e)</enum><header>Grant program for installation and maintenance of filtration stations</header><paragraph id="HE8359F78F9DC414BBD9D0F796A453526"><enum>(1)</enum><header>Program</header><text display-inline="yes-display-inline">The Administrator shall establish a program to make grants to States to assist local educational agencies in voluntary installation and maintenance of filtration stations at schools and child care programs under the jurisdiction of the local educational agencies.</text></paragraph><paragraph id="H33AABE66762644B7926900A9CF28C54F" commented="no"><enum>(2)</enum><header>Direct grants to local educational agencies</header><text display-inline="yes-display-inline">The Administrator may make a grant described in paragraph (1) directly available to—</text><subparagraph id="H173CA2AB348A41428E235252D32BF7B9" commented="no"><enum>(A)</enum><text>any local educational agency described in clause (i) or (iii) of subsection (d)(1)(B) located in a State that does not participate in the program established under paragraph (1); or </text></subparagraph><subparagraph id="HE7FE441C2B5A4D62831BBE5DC9EB5C9F" commented="no"><enum>(B)</enum><text>any local educational agency described in clause (ii) of subsection (d)(1)(B). </text></subparagraph></paragraph><paragraph id="H0969B0CDD4354E33B6407A27AF5B5EDB"><enum>(3)</enum><header>Use of funds</header><text>Grants made under the program established under this subsection may be used to pay the costs of—</text><subparagraph id="H0E398136D02B49E0B77EBCE800B0F2F0"><enum>(A)</enum><text display-inline="yes-display-inline">installation and maintenance of filtration stations at schools and child care programs; and</text></subparagraph><subparagraph id="HA0E072B370884757B639377B4AF25A45"><enum>(B)</enum><text display-inline="yes-display-inline">annual testing of drinking water at such schools and child care programs following the installation of filtration stations.</text></subparagraph></paragraph><paragraph id="HF16384A2E1AD464C82CB25393B414AAE"><enum>(4)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under the program established under this subsection, the Administrator shall give priority to States and local educational agencies that will assist in voluntary installation and maintenance of filtration stations at schools and child care programs that are in low-income areas.</text></paragraph><paragraph id="H051F2DDCB6864C7FA3B1079465DA5179"><enum>(5)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator shall establish guidance to carry out the program established under this subsection.</text></paragraph><paragraph id="HE8E0A85ED1A44A25969BE716F3524B6C"><enum>(6)</enum><header>No prior testing required</header><text display-inline="yes-display-inline">The program established under this subsection shall not require testing for lead contamination in drinking water at schools and child care programs prior to participation in such program.</text></paragraph><paragraph id="HD9808EB055204CA99E27C5AB32C38E89"><enum>(7)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HEBD25D09E6404A0CA5729ACD5E5321B8"><enum>(A)</enum><header>Child care program and local educational agency</header><text>The terms <term>child care program</term> and <term>local educational agency</term> have the meaning given such terms in subsection (d).</text></subparagraph><subparagraph id="H778181FFCBA64BE3BE3B8D735045E6E5"><enum>(B)</enum><header>Filtration station</header><text>The term <term>filtration station</term> means an apparatus that—</text><clause id="HCE090577C5724144A5B53760007B17F2"><enum>(i)</enum><text>is connected to building plumbing;</text></clause><clause id="HCE6F5246CBF74374A2575E34869C0F9C"><enum>(ii)</enum><text>is certified to the latest version of NSF/ANSI 53 for lead reduction and NSF/ANSI 42 for particulate reduction (Class I) by a certification body accredited by the American National Standards Institute National Accreditation Board;</text></clause><clause id="H8E531EBB069F4C4EA08A587EE6448C25"><enum>(iii)</enum><text>has an indicator to show filter performance;</text></clause><clause id="HBE36EA2B7E9F4D5BB299E38CCA119D15"><enum>(iv)</enum><text>can fill bottles or containers for water consumption; and</text></clause><clause id="H462BFDCBD9374B10A33BBF24D06B7530"><enum>(v)</enum><text>allows users to drink directly from a stream of flowing water.</text></clause></subparagraph></paragraph><paragraph id="H4A3CC677A3944F4A8E5CA2FE21F1AC8F"><enum>(8)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $50,000,000 for each of fiscal years 2022 through 2031.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H0B2C5C4FCFAA497592864892E9C8B9A5"><enum>112.</enum><header>Drinking water fountain replacement for schools</header><text display-inline="no-display-inline">Section 1465(d) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25(d)</external-xref>) is amended by striking <quote>2021</quote> and inserting <quote>2031</quote>.</text></section><section id="H83B0E4E8F06846C7B5B627F65DF8F4C7"><enum>113.</enum><header>Indian reservation drinking water program</header><text display-inline="no-display-inline">Section 2001(d) of America’s Water Infrastructure Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>) is amended by striking <quote>2022</quote> and inserting <quote>2031</quote>.</text></section><section id="HB0C4E9F7AAEF4230B6740E6843DB3DB1" section-type="subsequent-section"><enum>114.</enum><header>Assistance for areas affected by natural disasters</header><text display-inline="no-display-inline">Section 2020 of America’s Water Infrastructure Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>) is amended—</text><paragraph id="H4EC30CD43EB74BF7A829439FEFFB8AA5"><enum>(1)</enum><text>in subsection (b)(1), by striking <quote>subsection (e)(1)</quote> and inserting <quote>subsection (f)(1)</quote>;</text></paragraph><paragraph id="H41B9A69345964F608F7DB64F46F3F0ED"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (d) through (f), respectively;</text></paragraph><paragraph id="HB7C7911C29B74F6AAE11834CB767C5E0"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" compliance with national primary drinking water regulations.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HBF1FD300048341A2ADE887CBCDAB9D35"><enum>(4)</enum><text>in subsection (f), as so redesignated—</text><subparagraph id="H7B18319B67794AA89A121CD4DD5222A6"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">State revolving fund capitalization</header-in-text></quote>; and</text></subparagraph><subparagraph id="HAE641F67D7E841A6A1E43BC0F49F82E5"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H5694106622934871826CAB21F095AC52"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by id="HA280E20226C84FA2BD0E227413FDBB25"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1412(b)(6) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(6)</external-xref>) is repealed.</text></subsection><subsection display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block act-name="" display-inline="no-display-inline" id="H71DA50769EDF4C5F9F48989A709DF8B7" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph commented="no" display-inline="no-display-inline" id="H1FD0349007C54F3CB69EF7C254F3ED8A"><enum>(16)</enum><header display-inline="yes-display-inline">Perfluoroalkyl and polyfluoroalkyl substances</header><subparagraph commented="no" display-inline="no-display-inline" id="HA5D0F3B6D2884D50B365632F522C55D4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Administrator shall, after notice and opportunity for public comment, promulgate a national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances, which shall, at a minimum, include standards for—</text><clause commented="no" display-inline="no-display-inline" id="HD65688C67943492CA46BA03CFF526ABB"><enum>(i)</enum><text display-inline="yes-display-inline">perfluorooctanoic acid (commonly referred to as <quote>PFOA</quote>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H68A73567A5EA453EA3C11E77B72EF0D4"><enum>(ii)</enum><text display-inline="yes-display-inline">perfluorooctane sulfonic acid (commonly referred to as <quote>PFOS</quote>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H772B227D4BB146A5A700082698F767B3"><enum>(B)</enum><header display-inline="yes-display-inline">Alternative procedures</header><clause commented="no" display-inline="no-display-inline" id="H19FBAF15302E47909A8F4E03D806A14E"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the validation by the Administrator of an equally effective quality control and testing procedure to ensure compliance with the national primary drinking water regulation promulgated under subparagraph (A) to measure the levels described in clause (ii) or other methods to detect and monitor perfluoroalkyl and polyfluoroalkyl substances in drinking water, the Administrator shall add the procedure or method as an alternative to the quality control and testing procedure described in such national primary drinking water regulation by publishing the procedure or method in the Federal Register in accordance with section 1401(1)(D).</text></clause><clause commented="no" display-inline="no-display-inline" id="HD51DDCB67A9248C5BC50B58FA03BC0CA"><enum>(ii)</enum><header display-inline="yes-display-inline">Levels described</header><text display-inline="yes-display-inline">The levels referred to in clause (i) are—</text><subclause commented="no" display-inline="no-display-inline" id="H5DE2AFDE2D314889A5D43B5B33BDC7F4"><enum>(I)</enum><text display-inline="yes-display-inline">the level of a perfluoroalkyl or polyfluoroalkyl substance;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HDEF8D57E4ABA428D95BBF27BC79AE1EB"><enum>(II)</enum><text display-inline="yes-display-inline">the total levels of perfluoroalkyl and polyfluoroalkyl substances; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6D36F9F02A224401B1E14C061882A2C8"><enum>(III)</enum><text display-inline="yes-display-inline">the total levels of organic fluorine.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEDB1BD5DE26F472B95B49C5015DD3DF0"><enum>(C)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The Administrator may include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances on—</text><clause commented="no" display-inline="no-display-inline" id="H96697FC1FB864A7AB8C580FF9D095529"><enum>(i)</enum><text display-inline="yes-display-inline">the list of contaminants for consideration of regulation under paragraph (1)(B)(i), in accordance with such paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H857D775AAA8C48689260AD4EBFA3D42E"><enum>(ii)</enum><text display-inline="yes-display-inline">the list of unregulated contaminants to be monitored under section 1445(a)(2)(B)(i), in accordance with such section.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A524D357B154604AD0D2CF3E7FB617C"><enum>(D)</enum><header display-inline="yes-display-inline">Monitoring</header><text display-inline="yes-display-inline">When establishing monitoring requirements for public water systems as part of a national primary drinking water regulation under subparagraph (A) or subparagraph (G)(ii), the Administrator shall tailor the monitoring requirements for public water systems that do not detect or are reliably and consistently below the maximum contaminant level (as defined in section 1418(b)(2)(B)) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances subject to the national primary drinking water regulation.</text></subparagraph><subparagraph commented="no" id="H5563518803CF412B88EEABA1431AD688"><enum>(E)</enum><header>Health protection</header><text display-inline="yes-display-inline">The national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD7DA615055444578AC007E05367773F"><enum>(F)</enum><header display-inline="yes-display-inline">Health risk reduction and cost analysis</header><text display-inline="yes-display-inline">In meeting the requirements of paragraph (3)(C), the Administrator may rely on information available to the Administrator with respect to one or more specific perfluoroalkyl or polyfluoroalkyl substances to extrapolate reasoned conclusions regarding the health risks and effects of a class of perfluoroalkyl or polyfluoroalkyl substances of which the specific perfluoroalkyl or polyfluoroalkyl substances are a part.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD5758573B6754ADD9A29BE7469A312F1"><enum>(G)</enum><header display-inline="yes-display-inline">Regulation of additional substances</header><clause commented="no" display-inline="no-display-inline" id="H7A16EAA6168248A0BAB28BACDE2734F1"><enum>(i)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">The Administrator shall make a determination under paragraph (1)(A), using the criteria described in clauses (i) through (iii) of that paragraph, whether to include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances in the national primary drinking water regulation under subparagraph (A) not later than 18 months after the later of—</text><subclause commented="no" display-inline="no-display-inline" id="HD2979CD2AE7E40F68262B4B6266C4F50"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is listed on the list of contaminants for consideration of regulation under paragraph (1)(B)(i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7CAC9CB7668F4876BEC66251A5114C85"><enum>(II)</enum><text display-inline="yes-display-inline">the date on which—</text><item commented="no" display-inline="no-display-inline" id="HD5376D7169264047A2A14C304ED3BEC6"><enum>(aa)</enum><text display-inline="yes-display-inline">the Administrator has received the results of monitoring under section 1445(a)(2)(B) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; or</text></item><item commented="no" display-inline="no-display-inline" id="H482928BAACE0412DA3EC11AC1C367148"><enum>(bb)</enum><text display-inline="yes-display-inline">the Administrator has received reliable water data or water monitoring surveys for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances from a Federal or State agency that the Administrator determines to be of a quality sufficient to make a determination under paragraph (1)(A).</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HAE0AAD0D81BA477A81DD034A42108319"><enum>(ii)</enum><header display-inline="yes-display-inline">Primary drinking water regulations</header><subclause commented="no" display-inline="no-display-inline" id="H9C80F577073149DDA9BC9CD56888706B"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances that the Administrator determines to regulate under clause (i), the Administrator—</text><item commented="no" display-inline="no-display-inline" id="H10602F41047F47AE9CC0D647DD3E2ACA"><enum>(aa)</enum><text display-inline="yes-display-inline">not later than 18 months after the date on which the Administrator makes the determination, shall propose a national primary drinking water regulation for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></item><item commented="no" display-inline="no-display-inline" id="H462B2B5EAD62461FAB0615394BDAF091"><enum>(bb)</enum><text display-inline="yes-display-inline">may publish the proposed national primary drinking water regulation described in item (aa) concurrently with the publication of the determination to regulate the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H72409F43A4014A6AB74E3FB15EA33A04"><enum>(II)</enum><header display-inline="yes-display-inline">Deadline</header><item commented="no" display-inline="no-display-inline" id="H22421E9A616B4E9EBBE8373F6FA27087"><enum>(aa)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator publishes a proposed national primary drinking water regulation under clause (i)(I) and subject to item (bb), the Administrator shall take final action on the proposed national primary drinking water regulation.</text></item><item commented="no" display-inline="no-display-inline" id="H5738D878FE0D466AB88FE3A80AAE8D14"><enum>(bb)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Administrator, on publication of notice in the Federal Register, may extend the deadline under item (aa) by not more than 6 months.</text></item></subclause></clause></subparagraph><subparagraph id="HA2E2A8B4A4BA447A977E22E00530B578"><enum>(H)</enum><header>Health advisory</header><clause commented="no" id="H74176E6280694CFFB965F39F2A15BBC3"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Administrator shall publish a health advisory under paragraph (1)(F) for a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances not subject to a national primary drinking water regulation not later than 1 year after the later of—</text><subclause commented="no" id="H94143BB40007487E951988CC48DD6EB5"><enum>(I)</enum><text>the date on which the Administrator finalizes a toxicity value for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></subclause><subclause commented="no" id="H64F72A06535A492AB800599AD390C4FA"><enum>(II)</enum><text>the date on which the Administrator validates an effective quality control and testing procedure for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause><clause id="H22D82DBF661D48BE9B2A37DC06A75EA9"><enum>(ii)</enum><header>Waiver</header><text>The Administrator may waive the requirements of clause (i) with respect to a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl and polyfluoroalkyl substances if the Administrator determines that there is a substantial likelihood that the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances will not occur in drinking water with sufficient frequency to justify the publication of a health advisory, and publishes such determination, including the information and analysis used, and basis for, such determination, in the Federal Register.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="HAD0D3839BD9B47BEB62BCA8874B7B6D6"><enum>203.</enum><header>National primary drinking water regulations for microcystin toxin</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H070539F929434C44BC66BD86C3DE5D9E" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H753B184024774A5AB99196BF31234076"><enum>(17)</enum><header>Microcystin toxin</header><subparagraph id="HDB225973F48B4CAE92A40C4B7FD2D60E"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other deadline established in this subsection, not later than 2 years after the date of enactment of the <short-title>Assistance, Quality, and Affordability Act of 2021</short-title>, the Administrator shall publish a maximum contaminant level goal and promulgate a national primary drinking water regulation for microcystin toxin.</text></subparagraph><subparagraph id="H3DA24E3318674D8EBDB3744A318F3EE6" commented="no"><enum>(B)</enum><header>Health protection</header><text display-inline="yes-display-inline">The maximum contaminant level goal and national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H59E41A83DACC4A089981135B19A6DFD6"><enum>204.</enum><header>National primary drinking water regulations for 1,4–dioxane</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H1762719F700349E0ABA7750B334F56EF" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HD946D5AAE63C42A3A8DFBEBC0FDDF8F5"><enum>(18)</enum><header>1,4–dioxane</header><subparagraph id="HB985AF64F9AC48259ABA8CA63922D863"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other deadline established in this subsection, not later than 2 years after the date of enactment of the <short-title>Assistance, Quality, and Affordability Act of 2021</short-title>, the Administrator shall publish a maximum contaminant level goal and promulgate a national primary drinking water regulation for of small system variances</header><subsection id="H8F7CA61B9A62476A80D60EA5675AE129"><enum>(a)</enum><header>Small system variances</header><text>Section 1415 (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-4">42 U.S.C. 300g–4</external-xref>) of the Safe Drinking Water Act is amended by striking subsection (e).</text></subsection><subsection id="H25A15753D4174C07B122914208473220"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HE35C2FBCA5D74D74A9AFDA808F97339E"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1412(b)(15) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(15)</external-xref>) is amended by striking subparagraph (D).</text></paragraph><paragraph id="H76AFE70764A64196B702AD0356A64CBE"><enum>(2)</enum><text>Section 1414(c)(1)(B) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-3">42 U.S.C. 300g–3(c)(1)(B)</external-xref>) is amended by striking <quote>, (a)(2), or (e)</quote> and inserting <quote>or (a)(2)</quote>.</text></paragraph><paragraph id="HA59ADED2198C42FBB2619AE5966E0A05"><enum>(3)</enum><text>Section 1416(b)(2) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-5">42 U.S.C. 300g–5(b)(2)</external-xref>) is amended by striking subparagraph (D).</text></paragraph><paragraph id="HAD66DD61A48048FA81C01AC741B99391"><enum>(4)</enum><text>Section 1445(h) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-4">42 U.S.C. 300j–4(h)</external-xref>) is amended—</text><subparagraph id="HF06C04EF266140E0BF45FD1AA9BCF54D"><enum>(A)</enum><text>by striking <quote>sections 1412(b)(4)(E) and 1415(e) (relating to small system variance program)</quote> and inserting <quote>section 1412(b)(4)(E)</quote>; and</text></subparagraph><subparagraph id="HBA5B07BD7EA44FECB8D47319BD447ED7"><enum>(B)</enum><text>by striking <quote>guidance under sections 1412(b)(4)(E) and 1415(e)</quote> and inserting <quote>guidance under section 1412(b)(4)(E)</quote>.</text></subparagraph></paragraph></subsection></section></title><title id="H2F512CF27C904167A35894B5F02B2A15" commented="no"><enum>III</enum><header>Affordability</header><section id="HD9EA8B60B0684764B1BFDE53320ACD55" commented="no"><enum>301.</enum><header>Emergency relief program</header><text display-inline="no-display-inline">Part F of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-21">42 U.S.C. 300j–21 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HEDAD6D0F1CAE46C3ACA525407AB57860" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><section id="H830184A97F9E427A878D27BC956AA36E" commented="no"><enum>1466.</enum><header>Emergency relief program</header><subsection id="H0896A58024B6453F82143AC090AB629B" commented="no"><enum>(a)</enum><header>Emergency relief program</header><text display-inline="yes-display-inline">The Administrator shall establish and carry out a residential emergency relief program to provide payments to public water systems to reimburse such public water systems for providing forgiveness of arrearages and fees incurred by eligible residential customers before the date of enactment of this section to help such eligible residential customers retain, or reconnect or restore, water service.</text></subsection><subsection id="H23160E0754D7458E955D44704B90B650" commented="no"><enum>(b)</enum><header>Conditions</header><text>To receive funds under this section, a public water system shall agree to—</text><paragraph id="H92F5B5C296B74173B03F16237D509BDC" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">except as otherwise provided in this section, use such funds to forgive all arrearages and fees relating to nonpayment or arrearages incurred by eligible residential customers before the date of enactment of this section;</text></paragraph><paragraph id="HB8C893F4858442D3A1CEEC4A4F8E2642" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">if forgiveness of all arrearages and fees described in paragraph (1) is not possible given the amount of funds received, except as otherwise provided in this section, use such funds to reduce such arrearages and fees for each eligible residential customer by, to the extent practicable, a consistent percentage;</text></paragraph><paragraph id="HB4A5B198F71248A8B45036A4CB480E91" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">take no action that negatively affects the credit score of an eligible residential customer, or pursue any type of collection action against such eligible residential customer, during the 5-year period that begins on the date on which the public water system receives such funds; </text></paragraph><paragraph id="H046C00F5AF584645A4FF2E8847B02D38" commented="no"><enum>(4)</enum><text>not disconnect or interrupt the service of any eligible residential customer as a result of nonpayment or arrearages during such 5-year period; and</text></paragraph><paragraph id="HCB58F00BDE8C40F0B34AB62348FC203C"><enum>(5)</enum><text display-inline="yes-display-inline">provide to the Administrator such information as the Administrator determines appropriate.</text></paragraph></subsection><subsection id="HC6963583783648F393B35FB6D9A9D266" commented="no"><enum>(c)</enum><header>Eligible customers</header><text>To be eligible for forgiveness or reduction of arrearages and fees pursuant to the program established under subsection (a), a residential customer of a public water system shall have accrued new arrearages on or after March 1, 2020.</text></subsection><subsection id="H964DC7405A9D4095A93F1A8BC428D0AA"><enum>(d)</enum><header>Reconnection expenses</header><text display-inline="yes-display-inline">The Administrator, or a State that is, pursuant to subsection (e), implementing the program established under subsection (a), may authorize a public water system receiving funds under this section to use up to 5 percent of such funds for expenses relating to reconnecting or restoring water service, including expenses relating to plumbing repairs and pipe flushing, as needed, for eligible residential customers. </text></subsection><subsection id="HEEE76EA4CA6A41E7A8E2BFFA8AF7D77E" commented="no"><enum>(e)</enum><header>Administrative expenses</header><text>The Administrator may authorize—</text><paragraph id="H16110659B1A242D5A842C2B7B5F191CA" commented="no"><enum>(1)</enum><text>States to implement the program established under subsection (a); and</text></paragraph><paragraph id="H3096E7AEC7FC496384E510A66960D77E" commented="no"><enum>(2)</enum><text>a State implementing such program to use up to 4 percent of funds made available to carry out such program in such State for administrative expenses.</text></paragraph></subsection><subsection id="H70971DD34D3949CD9240F13902E41D51"><enum>(f)</enum><header>Submissions to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, and every other month thereafter until all amounts made available under this section are expended, the Administrator shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that describes—</text><paragraph id="H08DBC69DED504C66BA70F40FC4C4681D"><enum>(1)</enum><text>each public water system that received a payment under or pursuant to this section;</text></paragraph><paragraph id="H7DE383295FE144108496B1D8B52038FC"><enum>(2)</enum><text>the total amount of each payment provided under or pursuant to this section;</text></paragraph><paragraph id="HE21D059F871943F1923134DFFAEAF06A"><enum>(3)</enum><text>for each public water system receiving a payment under or pursuant to this section—</text><subparagraph id="H994608D1806C42998333C0600B148E9D" commented="no"><enum>(A)</enum><text>the amount of arrearages and fees forgiven or reduced;</text></subparagraph><subparagraph id="H0A602842D42B41398EE8994965E56C2A"><enum>(B)</enum><text>the number of eligible residential customers benefitting from forgiveness or reduction of arrearages and fees under this section;</text></subparagraph><subparagraph id="H6FB30BCA31B44D1B9A127D06CC15DCF6"><enum>(C)</enum><text>the amount of arrearages and fees of customers described in subparagraph (B) incurred before the date of enactment of this section that remain outstanding;</text></subparagraph><subparagraph id="H19AF12F7CBB44C9B8AF3B304D40A5F3E"><enum>(D)</enum><text>the number of eligible residential customers that did not benefit from forgiveness or reduction of arrearages and fees under this section; and</text></subparagraph><subparagraph id="HDCCE1C0B332E40F89FD090DA19D282A5"><enum>(E)</enum><text display-inline="yes-display-inline">the amount of arrearages and fees of customers described in subparagraph (D) incurred before the date of enactment of this section that remain outstanding; and</text></subparagraph></paragraph><paragraph id="H5E0E7969668D4209818E220D50DC51F5"><enum>(4)</enum><text>a summary of any other information provided to the Administrator by public water systems that receive a payment pursuant to this section.</text></paragraph></subsection><subsection id="H1DD1B9D531594D2989172235A8A6B5BC" commented="no"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $4,000,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H27DE515720074D4FAF77B2A71113C1F5"><enum>IV</enum><header>Other matters</header><section id="HD56EF84CC0F245F8AB2343E08801F2CD"><enum>401.</enum><header>Small urban and rural water system consolidation report</header><subsection id="HC8760AE5734D404A8335BF64B25F244B"><enum>(a)</enum><header>Report</header><paragraph id="H15BEC92CB2D343C58932B6C17785D771"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on issues relating to the potential for consolidation of distressed small water systems.</text></paragraph><paragraph id="H38721A439C7F42379A774C7B9EF70AF3"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The report submitted under paragraph (1) shall include—</text><subparagraph id="HBC12BD9C1CA749F1843F91691F22382B" display-inline="no-display-inline"><enum>(A)</enum><text>information on—</text><clause id="HB099AC218CD64EAB8627EB63F1E109F2"><enum>(i)</enum><text>the amount of debt of covered small water systems;</text></clause><clause id="HBA01500D259D451C8EFB5B1F406DE73C"><enum>(ii)</enum><text>whether the budgets of covered small water systems are balanced;</text></clause><clause id="H2FF5EFDF5CB44048A03E2D427EC8875C"><enum>(iii)</enum><text>the degree to which covered small water systems defer infrastructure improvements;</text></clause><clause id="HE1D4DEDBF983424DAC08FBBE678F4158"><enum>(iv)</enum><text display-inline="yes-display-inline">the degree to which covered small water systems are not in compliance with applicable Federal and State water quality standards;</text></clause><clause id="HA23B34A6E3734C4EBD12600055187C3E"><enum>(v)</enum><text display-inline="yes-display-inline">how rates charged by covered small water systems for service relate to the costs for maintenance of, and improvements to, such systems; and</text></clause><clause id="H7672884A9E0A4FDD9DA31D59D9145391" commented="no"><enum>(vi)</enum><text>how the management, financial, and technical capacity of covered small water systems affects the ability of such systems to provide service at affordable rates;</text></clause></subparagraph><subparagraph id="H147B26FD67F14D06923ECE186FD388EE"><enum>(B)</enum><text>an evaluation of—</text><clause id="H76BA853EB93C44E2B29AFB269B21B9D6"><enum>(i)</enum><text display-inline="yes-display-inline">whether covered small water system infrastructure is failing, resulting in a temporary or permanent loss of essential functions or services; and</text></clause><clause id="H0447555CB7304D77B715409752E5B482" commented="no"><enum>(ii)</enum><text>how to prevent covered small water systems from becoming distressed small water systems;</text></clause></subparagraph><subparagraph id="H01DFB6953EF3467E979DB1BE4433F471"><enum>(C)</enum><text>policy recommendations for how Congress may support the consolidation of distressed small water systems; and</text></subparagraph><subparagraph id="HA3CF5CD5F7664EA0A79C807306463E89"><enum>(D)</enum><text>best practices and guidelines the Administrator of the Environmental Protection Agency may use to assist State and local governments with facilitating the consolidation of distressed small water systems.</text></subparagraph></paragraph></subsection><subsection id="H85D6D9E3023A4DC892B89ACA3FA77E09"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H5B37A127AC29432486A0076450387D01"><enum>(1)</enum><header>Consolidation</header><text display-inline="yes-display-inline">The term <term>consolidation</term> means, with respect to a public water system, any of the actions described in subparagraphs (A) through (D) of section 1414(h)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-3">42 U.S.C. 300g–3(h)(1)</external-xref>).</text></paragraph><paragraph id="HD18AB49DE54946518768B16333006E2C"><enum>(2)</enum><header>Covered small water system</header><text>The term <term>covered small water system</term> means a public water system that serves—</text><subparagraph id="HFADEFE46B78D46B1B91AFB7B03201342" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">fewer than 50,000 individuals; and</text></subparagraph><subparagraph id="HEAB1F16D1E354C2BBAA131FC02F2C94D"><enum>(B)</enum><text display-inline="yes-display-inline">a disadvantaged community or an environmental justice community.</text></subparagraph></paragraph><paragraph id="H9C112463901246B5A17B50EA81438561"><enum>(3)</enum><header>Disadvantaged community</header><text display-inline="yes-display-inline">The term <term>disadvantaged community</term> has the meaning given such term in section 1452(d)(3) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(d)(3)</external-xref>).</text></paragraph><paragraph id="H1673541CC5F44B59A6CEC401095DBA5C"><enum>(4)</enum><header>Distressed small water system</header><text display-inline="yes-display-inline">The term <term>distressed small water system</term> means a covered small water system—</text><subparagraph id="HA6F6C476D0754F8ABB4704BE3939D362" commented="no"><enum>(A)</enum><text>that is unable to carry out necessary maintenance of, and improvements to, such system in order to—</text><clause id="HFC9CBBF2115344E786E5ED9DB2F3946E" commented="no"><enum>(i)</enum><text>comply with applicable Federal and State water quality standards; or</text></clause><clause id="HB57B1E2DC95D47DCBF6320048333785A" commented="no"><enum>(ii)</enum><text>provide reliable and affordable service to customers while complying with such water quality standards; and</text></clause></subparagraph><subparagraph id="H9E92D189BEB844D2A241199CAE4B186E"><enum>(B)</enum><text>with respect to which consolidation may be necessary to address the issues described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H2AA8BA8AEA034647B45E39C68B3CD9C6"><enum>(5)</enum><header>Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> has the meaning given such term in section 1452(u)(11) of the Safe Drinking Water Act.</text></paragraph><paragraph id="HA390F504E2924F6A90B8010EBEC0D7B5"><enum>(6)</enum><header>Public water system</header><text display-inline="yes-display-inline">The term <term>public water system</term> has the meaning given such term in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>).
