and</text></paragraph><paragraph id="H04A6D3B1439D4BCA84EE7B854B5D33E4" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H08C19FEEA523442089B6CE088DA58BED" style="OLC"><subparagraph id="HA13989F4C7C74D01844487A40961B0F3" commented="no"><enum>(D)</enum><text>$4,140,000,000 for fiscal year 2022;</text></subparagraph><subparagraph id="HA9FC5FAA2C0F45C0B9288C3A60F5042A" commented="no"><enum>(E)</enum><text>$4,800,000,000 for fiscal year 2023; and</text></subparagraph><subparagraph id="H3B00C32E47CB4FA5B59D83E3A30E9AB9" commented="no"><enum>(F)</enum><text>$5,500,000,000 for each of fiscal years 2024 through 2031.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF92DE25F83E44730B3A6E750AEA0B9CF" section-type="subsequent-section"><enum>106.</enum><header>Lead service line replacement</header><subsection id="HBF0AC471E2FA4F33A910784930CC57DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H76A5B92D0ECA480992FBAEC5CC95D03A" display-inline="no-display-inline"><subsection id="H4C4AFBFBFD64465E93419433AE18470A" commented="no"><enum>(u)</enum><header>Lead service line replacement</header><paragraph id="H7C31DC6771F443AAA5D6E460E98B5C7B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the capitalization grants to eligible States under subsection (a)(1), the Administrator shall offer to enter into agreements with eligible States, Indian Tribes, and the territories described in subsection (j) to make capitalization grants, including letters of credit, to such States, Indian Tribes, and territories under this subsection to fund the replacement of lead service lines. </text></paragraph><paragraph id="H6C5807B210BC460FA0E3EE80BCC81F85" commented="no"><enum>(2)</enum><header>Allotments</header><subparagraph id="HBA3E78E224244DF383F11115929E882B" commented="no"><enum>(A)</enum><header>States</header><text display-inline="yes-display-inline">Funds made available under this subsection shall be allotted and reallotted to the extent practicable, to States as if allotted or reallotted under subsection (a)(1) as a capitalization grant under such subsection.</text></subparagraph><subparagraph id="H87953264BFFD4D03ABCF153E25C45F15" commented="no"><enum>(B)</enum><header>Indian Tribes</header><text>The Administrator shall set aside 1<fraction>1/2</fraction> percent of the amounts made available each fiscal year to carry out this subsection to make grants to Indian Tribes.</text></subparagraph><subparagraph id="HACF210F290D54887B9B353F296CCD0B0" commented="no"><enum>(C)</enum><header>Other areas</header><text display-inline="yes-display-inline">The funds made available under this subsection shall be allotted to territories described in subsection (j) in accordance with such subsection.</text></subparagraph></paragraph><paragraph id="HBC5C65723D2D4072BABB03141EF78FF4" commented="no"><enum>(3)</enum><header>Priority</header><text>Each State that has entered into a capitalization agreement pursuant to this section shall annually prepare a plan that identifies the intended uses of the amounts made available pursuant to this subsection, which shall—</text><subparagraph id="H57B1B5F659BC4B9E9C9B13E83C590094" commented="no"><enum>(A)</enum><text>comply with the requirements of subsection (b)(2); and</text></subparagraph><subparagraph id="HEDE584BECAEA4F7B833EE70AB2AE02EB" commented="no"><enum>(B)</enum><text>provide, to the maximum extent practicable, that priority for the use of funds be given to projects that replace lead service lines serving disadvantaged communities and environmental justice communities.</text></subparagraph></paragraph><paragraph id="H21325703D1264633A5D1D736356F07B9" commented="no"><enum>(4)</enum><header>American made iron and steel and prevailing wages</header><text>The requirements of paragraphs (4) and (5) of subsection (a) shall apply to any project carried out in whole or in part with funds made available under this subsection.</text></paragraph><paragraph id="H0A447A3E752349D89BB77E900D277934" commented="no"><enum>(5)</enum><header>Limitation</header><subparagraph id="H87A5C4ECADBD48AEB8F16A9C5687CC20" commented="no"><enum>(A)</enum><header>Prohibition on partial line replacement</header><text>None of the funds made available under this subsection may be used for partial lead service line replacement if, at the conclusion of the service line replacement, drinking water is delivered through a publicly or privately owned portion of a lead service line.</text></subparagraph><subparagraph id="H26832D8C41654D7095720DB2399C5D18" commented="no"><enum>(B)</enum><header>No private owner contribution</header><text>Any recipient of funds made available under this subsection shall offer to replace any privately owned portion of the lead service line at no cost to the private owner.</text></subparagraph></paragraph><paragraph id="H941ECA45474E4D74BB62E22E98421846" commented="no"><enum>(6)</enum><header>State contribution</header><text display-inline="yes-display-inline">Notwithstanding subsection (e), agreements under paragraph (1) shall not require that the State deposit in the State loan fund from State moneys any contribution before receiving funds pursuant to this subsection. </text></paragraph><paragraph id="H3CFC107902FF46AA8F677619375CB251" commented="no"><enum>(7)</enum><header>Authorization of appropriations</header><subparagraph id="HAE3585EF0BF5403BB47519B4D5752517" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this subsection $4,500,000,000 for each of fiscal years 2022 through 2031. Such sums shall remain available until expended.</text></subparagraph><subparagraph id="H1407BD1507854611B2F270553A8A395C" commented="no"><enum>(B)</enum><header>Additional amounts</header><text>To the extent amounts authorized to be appropriated under this subsection in any fiscal year are not appropriated in that fiscal year, such amounts are authorized to be appropriated in a subsequent fiscal year. Such sums shall remain available until expended.</text></subparagraph></paragraph><paragraph id="HB60CCCD5C3ED4873A88E8B7B6F6B166E" commented="no"><enum>(8)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="HE233B365F0F24A99A38AEBBD04B4B361" commented="no"><enum>(A)</enum><header>Disadvantaged community</header><text display-inline="yes-display-inline">The term <term>disadvantaged community</term> has the meaning given such term in subsection (d)(3).</text></subparagraph><subparagraph id="H2DA106E7FFD04E9B9034408ACDDB4AD7" commented="no"><enum>(B)</enum><header>Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> means any population of color, community of color, indigenous community, or low-income community that experiences a disproportionate burden of the negative human health and environmental impacts of pollution or other environmental hazards.</text></subparagraph><subparagraph id="H6F044B6EFC3D420491368FCE973A9495"><enum>(C)</enum><header>Lead service line</header><text>The term <term>lead service line</term> means a pipe and its fittings, which are not lead free (as defined in section 1417(d)), that connect the drinking water main to the building inlet.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H073FA3158DDD42C491469FD4C511C9A9"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1452(m)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(m)(1)</external-xref>) is amended by striking <quote>(a)(2)(G) and (t)</quote> and inserting <quote>(a)(2)(G), (t), and (u)</quote>.</text></subsection></section><section id="HE42EB24D01F04F589A928C3F02363844" display-inline="no-display-inline" section-type="subsequent-section"><enum>107.</enum><header>PFAS treatment grants</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HE69EFDDC79FC4C89A92843732A2CE78A" style="OLC"><section id="H7548BD1F04F9409C9E2F4EE06D58CEEC"><enum>1459E.</enum><header>Assistance for community water systems affected by PFAS</header><subsection id="H9662DF2A53034615804B22B2B623BDAE"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this section, the Administrator shall establish a program to award grants to affected community water systems to pay for capital costs associated with the implementation of eligible treatment technologies.</text></subsection><subsection id="H89973A8C009242EB872D43248E94880B"><enum>(b)</enum><header>Applications</header><paragraph id="HF647191CA1B34E159DE7CE6B2114584D"><enum>(1)</enum><header>Guidance</header><text>Not later than 12 months after the date of enactment of this section, the Administrator shall publish guidance describing the form and timing for community water systems to apply for grants under this section.</text></paragraph><paragraph id="HB9BD532553C94B2482946BA1AC6531BA"><enum>(2)</enum><header>Required information</header><text>The Administrator shall require a community water system applying for a grant under this section to submit—</text><subparagraph id="HF37649981A2C4D68AD28F781F2B1F9DA"><enum>(A)</enum><text display-inline="yes-display-inline">information showing the presence of a perfluoroalkyl or polyfluoroalkyl substance in water of the community water system; and</text></subparagraph><subparagraph id="H2A039600B00E42049FF6FB84832A6F1F"><enum>(B)</enum><text display-inline="yes-display-inline">a certification that the treatment technology in use by the community water system at the time of application is not sufficient to remove all detectable amounts of perfluoroalkyl and polyfluoroalkyl substances.</text></subparagraph></paragraph></subsection><subsection id="H13107A9BFE31463B8766A55E40B3E537"><enum>(c)</enum><header>List of eligible treatment technologies</header><text>Not later than 150 days after the date of enactment of this section, and every 2 years thereafter, the Administrator shall publish a list of treatment technologies that the Administrator determines are effective at removing all detectable amounts of perfluoroalkyl and polyfluoroalkyl substances from drinking water.</text></subsection><subsection id="HA73B60A56CBA49738C57801C8AD35A0B"><enum>(d)</enum><header>Priority for funding</header><text>In awarding grants under this section, the Administrator shall prioritize affected community water systems that—</text><paragraph id="H635A8BFF949340D0973C4C576EC71C81"><enum>(1)</enum><text>serve a disadvantaged community;</text></paragraph><paragraph id="HE473E1D568A845AB88181D6BCD643B19"><enum>(2)</enum><text>will provide at least a 10-percent cost share for the cost of implementing an eligible treatment technology; or</text></paragraph><paragraph id="HE5199A2961D3428C9B580BCDD7F47667"><enum>(3)</enum><text>demonstrate the capacity to maintain the eligible treatment technology to be implemented using the grant.</text></paragraph></subsection><subsection id="H19977735DAEA478DB9C10DB35A0B0E69"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="HEB45CCA6F0CB4C4AADA77611A24919B3"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section not more than $500,000,000 for each of the fiscal years 2022 through 2031.</text></paragraph><paragraph id="H71F458DB2E5448B0A23B5FFCD0FE6409"><enum>(2)</enum><header>Special rule</header><text>Of the amounts authorized to be appropriated by paragraph (1), $25,000,000 are authorized to be appropriated for each of fiscal years 2022 and 2023 for grants under subsection (a) to pay for capital costs associated with the implementation of eligible treatment technologies during the period beginning on October 1, 2014, and ending on the date of enactment of this section.</text></paragraph></subsection><subsection id="HCF6FB2FB38FB4B34A3B4F6A6647AE642"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA6F4DF4DB19144729BB91FADB10B924A"><enum>(1)</enum><header>Affected community water system</header><text display-inline="yes-display-inline">The term <term>affected community water system</term> means a community water system that is affected by the presence of a perfluoroalkyl or polyfluoroalkyl substance in the water in the community water system.</text></paragraph><paragraph id="HA9D64C5E8A274545BBCF25959B019EA9"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> has the meaning given that term in section 1452.</text></paragraph><paragraph id="HB427864B01C045C88B0D2C4A34048E90"><enum>(3)</enum><header>Eligible treatment technology</header><text>The term <term>eligible treatment technology</term> means a treatment technology included on the list published under subsection (c).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H262D978AF23D46F897FA63465BD5266F"><enum>108.</enum><header>Voluntary school and child care program lead testing grant program</header><text display-inline="no-display-inline">Section 1464(d)(8) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24(d)(8)</external-xref>) is amended by striking <quote>and 2021</quote> and inserting <quote>through 2031</quote>.</text></section><section id="H50D931FD8A83424FA1B197D238514604"><enum>109.</enum><header>Drinking water fountain replacement for schools</header><text display-inline="no-display-inline">Section 1465(d) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25(d)</external-xref>) is amended by striking <quote>2021</quote> and inserting <quote>2031</quote>.</text></section><section id="H4DAAE9F301964EF8B574040A87AD8C8A"><enum>110.</enum><header>Indian reservation drinking water program</header><text display-inline="no-display-inline">Section 2001(d) of America’s Water Infrastructure Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>) is amended by striking <quote>2022</quote> and inserting <quote>2031</quote>.</text></section><section id="H524CDFEF4D504605AA31E0229D049FE7" section-type="subsequent-section"><enum>111.</enum><header>Assistance for areas affected by natural disasters</header><text display-inline="no-display-inline">Section 2020 of America’s Water Infrastructure Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>) is amended—</text><paragraph id="HC8527854B02147FC9F8038A41F8D5899"><enum>(1)</enum><text>in subsection (b)(1), by striking <quote>subsection (e)(1)</quote> and inserting <quote>subsection (f)(1)</quote>;</text></paragraph><paragraph id="H5D65C0F5AA864AFEBC31FCE848B87A12"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (d) through (f), for the purposes of providing assistance to eligible systems to restore or increase compliance with national primary drinking water regulations.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8AE4667B66BC418D9E9C4A92E0DA0A3A"><enum>(4)</enum><text>in subsection (f), as so redesignated—</text><subparagraph id="HA440CED56D0E43ED9BEC7005235E3260"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">State revolving fund capitalization</header-in-text></quote>; and</text></subparagraph><subparagraph id="HAFB0A270E6BD488B8037272E0057BA88"><enum>(B)</enum><text>in paragraph (1)—</text><clause water contaminants</header><text display-inline="no-display-inline">Section 1412(b)(6) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(6)</external-xref>) is repealed. </text></section><section commented="no" display-inline="no-display-inline" id="HADD91B9CA3A3484F8A652429262A6352" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">National primary drinking water regulations for PFAS</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block act-name="" display-inline="no-display-inline" id="HD5A313AB2D344D56BE086BDF4854BC88" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H84266AF9459749438A1DAE8EB5C1FF17"><enum>(16)</enum><header display-inline="yes-display-inline">Perfluoroalkyl and polyfluoroalkyl substances</header><subparagraph commented="no" display-inline="no-display-inline" id="H432B716BFE9440169A8977571AFAEEDF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Administrator shall, after notice and opportunity for public comment, promulgate a national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances, which shall, at a minimum, include standards for—</text><clause commented="no" display-inline="no-display-inline" id="H6FCD20D77D214C4F9AC84E9EA3FF66D4"><enum>(i)</enum><text display-inline="yes-display-inline">perfluorooctanoic acid (commonly referred to as <quote>PFOA</quote>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H752E12585B9D4CFD93E953E4AA24762E"><enum>(ii)</enum><text display-inline="yes-display-inline">perfluorooctane sulfonic acid (commonly referred to as <quote>PFOS</quote>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B4814F3855A4D13B921B4BB0658F643"><enum>(B)</enum><header display-inline="yes-display-inline">Alternative procedures</header><clause commented="no" display-inline="no-display-inline" id="H1A24CCF1CC1C49EBB860699A8A86F10F"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the validation by the Administrator of an equally effective quality control and testing procedure to ensure compliance with the national primary drinking water regulation promulgated under subparagraph (A) to measure the levels described in clause (ii) or other methods to detect and monitor perfluoroalkyl and polyfluoroalkyl substances in drinking water, the Administrator shall add the procedure or method as an alternative to the quality control and testing procedure described in such national primary drinking water regulation by publishing the procedure or method in the Federal Register in accordance with section 1401(1)(D).</text></clause><clause commented="no" display-inline="no-display-inline" id="H0C9AD581EAF94461835236750571AB59"><enum>(ii)</enum><header display-inline="yes-display-inline">Levels described</header><text display-inline="yes-display-inline">The levels referred to in clause (i) are—</text><subclause commented="no" display-inline="no-display-inline" id="H92626203C4954A298642E2B3358B1ECD"><enum>(I)</enum><text display-inline="yes-display-inline">the level of a perfluoroalkyl or polyfluoroalkyl substance;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H4CA86AC2E5604034829E5B9AC83ED24D"><enum>(II)</enum><text display-inline="yes-display-inline">the total levels of perfluoroalkyl and polyfluoroalkyl substances; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE91373FEE5544E06B894EF1B2C3FC743"><enum>(III)</enum><text display-inline="yes-display-inline">the total levels of organic fluorine.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFEBF80CA637F4E29BDCFC9D83E0976CD"><enum>(C)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The Administrator may include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances on—</text><clause commented="no" display-inline="no-display-inline" id="HC51FE0A8DD244D76B8D99CC0D00FC24D"><enum>(i)</enum><text display-inline="yes-display-inline">the list of contaminants for consideration of regulation under paragraph (1)(B)(i), in accordance with such paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H131F7073A8A14DA08B718AB459FF566A"><enum>(ii)</enum><text display-inline="yes-display-inline">the list of unregulated contaminants to be monitored under section 1445(a)(2)(B)(i), in accordance with such section.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2F9CD603B4154219A047D170C551A7B5"><enum>(D)</enum><header display-inline="yes-display-inline">Monitoring</header><text display-inline="yes-display-inline">When establishing monitoring requirements for public water systems as part of a national primary drinking water regulation under subparagraph (A) or subparagraph (G)(ii), the Administrator shall tailor the monitoring requirements for public water systems that do not detect or are reliably and consistently below the maximum contaminant level (as defined in section 1418(b)(2)(B)) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances subject to the national primary drinking water regulation.</text></subparagraph><subparagraph commented="no" id="H6EBD5EC66136490B8C3F844F1DC836CC"><enum>(E)</enum><header>Health protection</header><text display-inline="yes-display-inline">The national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF312C0DE0E2B4C89BCAE21BAB73D9333"><enum>(F)</enum><header display-inline="yes-display-inline">Health risk reduction and cost analysis</header><text display-inline="yes-display-inline">In meeting the requirements of paragraph (3)(C), the Administrator may rely on information available to the Administrator with respect to one or more specific perfluoroalkyl or polyfluoroalkyl substances to extrapolate reasoned conclusions regarding the health risks and effects of a class of perfluoroalkyl or polyfluoroalkyl substances of which the specific perfluoroalkyl or polyfluoroalkyl substances are a part.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4CAE21CE30DB479AACEE606DA5F6CEE6"><enum>(G)</enum><header display-inline="yes-display-inline">Regulation of additional substances</header><clause commented="no" display-inline="no-display-inline" id="H2E1CBBBE46EF4F34AD7ACC62AFDD2974"><enum>(i)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">The Administrator shall make a determination under paragraph (1)(A), using the criteria described in clauses (i) through (iii) of that paragraph, whether to include a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances in the national primary drinking water regulation under subparagraph (A) not later than 18 months after the later of—</text><subclause commented="no" display-inline="no-display-inline" id="HBADD7DC077BD4C71BC43E90BA8124B52"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances is listed on the list of contaminants for consideration of regulation under paragraph (1)(B)(i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H676F80A410FE44D2AD6152F730D25ED0"><enum>(II)</enum><text display-inline="yes-display-inline">the date on which—</text><item commented="no" display-inline="no-display-inline" id="HFC96D8BBBC21453FBD8F1A8B076F0A61"><enum>(aa)</enum><text display-inline="yes-display-inline">the Administrator has received the results of monitoring under section 1445(a)(2)(B) for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; or</text></item><item commented="no" display-inline="no-display-inline" id="H4DD207EB13C74961A8C8AED0ED0FEF03"><enum>(bb)</enum><text display-inline="yes-display-inline">the Administrator has received reliable water data or water monitoring surveys for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances from a Federal or State agency that the Administrator determines to be of a quality sufficient to make a determination under paragraph (1)(A).</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE592D14E0F8D420D86E55296813F4375"><enum>(ii)</enum><header display-inline="yes-display-inline">Primary drinking water regulations</header><subclause commented="no" display-inline="no-display-inline" id="H4253C4A22E494A3F943442D6935211F5"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances that the Administrator determines to regulate under clause (i), the Administrator—</text><item commented="no" display-inline="no-display-inline" id="H5B7C1E0F8C124D56AD424DFEB279D29C"><enum>(aa)</enum><text display-inline="yes-display-inline">not later than 18 months after the date on which the Administrator makes the determination, shall propose a national primary drinking water regulation for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></item><item commented="no" display-inline="no-display-inline" id="H3F7D31ED5C434421AEA1D201240DD57C"><enum>(bb)</enum><text display-inline="yes-display-inline">may publish the proposed national primary drinking water regulation described in item (aa) concurrently with the publication of the determination to regulate the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H8BA4BCBBBFD547F59D1BA669B9778068"><enum>(II)</enum><header display-inline="yes-display-inline">Deadline</header><item commented="no" display-inline="no-display-inline" id="H0C356BC662E84362BA485D23F15E3FDA"><enum>(aa)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator publishes a proposed national primary drinking water regulation under clause (i)(I) and subject to item (bb), the Administrator shall take final action on the proposed national primary drinking water regulation.</text></item><item commented="no" display-inline="no-display-inline" id="H29E99A0E2BEF4AF2A569AA3842162818"><enum>(bb)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Administrator, on publication of notice in the Federal Register, may extend the deadline under item (aa) by not more than 6 months.</text></item></subclause></clause></subparagraph><subparagraph id="H8BE9E52F2AB6473DB18D1B50149BE6E3"><enum>(H)</enum><header>Health advisory</header><clause commented="no" id="H6514C04623114D2EB4A1EBB024EACDE6"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Administrator shall publish a health advisory under paragraph (1)(F) for a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances not subject to a national primary drinking water regulation not later than 1 year after the later of—</text><subclause commented="no" id="HAAA1B432F6364BCA969F8563F4B9E2BA"><enum>(I)</enum><text>the date on which the Administrator finalizes a toxicity value for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances; and</text></subclause><subclause commented="no" id="HC0D9B4F052B24761BC7388C0CA19A0BE"><enum>(II)</enum><text>the date on which the Administrator validates an effective quality control and testing procedure for the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause><clause id="H02FBACC19A9D4B06BF9F9CB4A0516987"><enum>(ii)</enum><header>Waiver</header><text>The Administrator may waive the requirements of clause (i) with respect to a perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl and polyfluoroalkyl substances if the Administrator determines that there is a substantial likelihood that the perfluoroalkyl or polyfluoroalkyl substance or class of perfluoroalkyl or polyfluoroalkyl substances will not occur in drinking water with sufficient frequency to justify the publication of a health advisory, and publishes such determination, including the information and analysis used, and basis for, such determination, in the Federal Register.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="H7FA9F2E2BBF8416BAFC6CA5F14A4750D"><enum>203.</enum><header>National primary drinking water regulations for microcystin toxin</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB2BE7CB0EA894D98AAC02AD6F2715AEB" style="OLC"><paragraph id="H9BB260E1423E4F1B9DF2BDD3CCA68F2C"><enum>(17)</enum><header>Microcystin toxin</header><subparagraph id="H582CA5BBA3594E1A966951AA4B6CB9E2"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other deadline established in this subsection, not later than 2 years after the date of enactment of the <short-title>Assistance, Quality, and Affordability Act of 2021</short-title>, the Administrator shall publish a maximum contaminant level goal and promulgate a national primary drinking water regulation for microcystin toxin.</text></subparagraph><subparagraph id="H78A90D3AE1F14E539D5EE7E0DD3BDA0C" commented="no"><enum>(B)</enum><header>Health protection</header><text display-inline="yes-display-inline">The maximum contaminant level goal and national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2528FB0B5FDF47269866B40E588DA924"><enum>204.</enum><header>National primary drinking water regulations for 1,4–dioxane</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HB9DB44EC375443F981F6C28D8A5E77B2" display-inline="no-display-inline"><paragraph id="H90C4193958004D7F9D53B4FCEDB26168"><enum>(18)</enum><header><enum-in-header>1,4</enum-in-header>–dioxane</header><subparagraph id="H9DA0A3D34CEF46DE9CEF276FF4713471"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other deadline established in this subsection, not later than 2 years after the date of enactment of the <short-title>Assistance, Quality, and Affordability Act of 2021</short-title>, the Administrator shall publish a maximum contaminant level goal and promulgate a national primary drinking water regulation for 1,4–dioxane.</text></subparagraph><subparagraph id="H880C44195F4D42288862149F3292198B" commented="no"><enum>(B)</enum><header>Health protection</header><text display-inline="yes-display-inline">The maximum contaminant level goal and national primary drinking water regulation promulgated under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3859F0086FC04A8EBF01668FC9A526B2"><enum>205.</enum><header>Elimination of small system variances</header><subsection id="HC1AE4DA36E064484ADE9803099C3ACFC"><enum>(a)</enum><header>Small system variances</header><text>Section 1415 (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-4">42 U.S.C. 300g–4</external-xref>) of the Safe Drinking Water Act is amended by striking subsection (e).</text></subsection><subsection id="HFA823824DF704F6E9F454AB12E337986"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H322D58434D5949FEA44E0F79DAFF0A23"><enum>(1)</enum><text>Section 1414(c)(1)(B) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-3">42 U.S.C. 300g–3(c)(1)(B)</external-xref>) is amended by striking <quote>, (a)(2), or (e)</quote> and inserting <quote>or (a)(2)</quote>.</text></paragraph><paragraph id="H1ADAE72C676848539FEC0B7ACA8F1F5B"><enum>(2)</enum><text>Section 1416(b)(2) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-5">42 U.S.C. 300g–5(b)(2)</external-xref>) is amended by striking subparagraph (D).</text></paragraph><paragraph id="H808911DA7A3D434E81E185E5B0E55FA3"><enum>(3)</enum><text>Section 1445(h) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-4">42 U.S.C. 300j–4(h)</external-xref>) is amended—</text><subparagraph id="H2E64B88BBA1441C983A99477166DEB47"><enum>(A)</enum><text>by striking <quote>sections 1412(b)(4)(E) and 1415(e) (relating to small system variance program)</quote> and inserting <quote>section 1412(b)(4)(E)</quote>; and</text></subparagraph><subparagraph id="HCF6FCBF29DC24CDB9CB48AC4E4391513"><enum>(B)</enum><text>by striking <quote>guidance under sections 1412(b)(4)(E) and 1415(e)</quote> and inserting <quote>guidance under section 1412(b)(4)(E)</quote>.</text></subparagraph></paragraph></subsection></section></title><title id="H505C7C3F36B84405B7C36760106DF63D" commented="no"><enum>III</enum><header>Affordability</header><section id="H8CB722FB4A5641CAAD061DE6660204AC" commented="no"><enum>301.</enum><header>Emergency relief program</header><text display-inline="no-display-inline">Part F of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-21">42 U.S.C. 300j–21 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HA2C336B2C35543579F3EDA7E0FAD7E53" style="OLC"><section id="HF5D55A4508ED4ED1B70DC0FD7F67DF7E" commented="no"><enum>1466.</enum><header>Emergency relief program</header><subsection id="HB833CCAD60EA406C8CC5D949005F8BE5" commented="no"><enum>(a)</enum><header>Emergency relief program</header><text display-inline="yes-display-inline">The Administrator shall establish and carry out a residential emergency relief program to provide payments to public water systems to reimburse such public water systems for providing forgiveness of arrearages and fees incurred by eligible residential customers before the date of enactment of this section to help such eligible residential customers retain water service.</text></subsection><subsection id="H42AC420DDAB342F69A2E984AB8DF3686" commented="no"><enum>(b)</enum><header>Conditions</header><text>To receive funds under this section, a public water system shall agree to—</text><paragraph id="H7C047D4DA6454D899EFF9B5C2597701E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), use such funds to forgive all arrearages and fees relating to nonpayment or arrearages incurred by eligible residential customers before the date of enactment of this section;</text></paragraph><paragraph id="HFA4ECC43B8094D1E8476805C0CE337C4" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">if forgiveness of all arrearages and fees described in paragraph (1) is not possible given the amount of funds received, use such funds to reduce such arrearages and fees for each eligible residential customer by, to the extent practicable, a consistent percentage;</text></paragraph><paragraph id="H2F4A7688CFB44F0B84BAAD644636CC10" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">take no action that negatively affects the credit score of an eligible residential customer, or pursue any type of collection action against such eligible residential customer, during the 5-year period that begins on the date on which the public water system receives such funds; and</text></paragraph><paragraph id="HAF1E087EDC31460396C52ABA7B4D53D7" commented="no"><enum>(4)</enum><text>not disconnect or interrupt the service of any eligible residential customer as a result of nonpayment or arrearages during such 5-year period.</text></paragraph></subsection><subsection id="H50826BDF91FE49F38CCF594E57C21004" commented="no"><enum>(c)</enum><header>Eligible customers</header><text>To be eligible for forgiveness or reduction of arrearages and fees pursuant to the program established under subsection (a), a residential customer of a public water system shall have accrued new arrearages on or after March 1, 2020.</text></subsection><subsection id="H58954F66BF554A4191B70F786537D8A6" commented="no"><enum>(d)</enum><header>Administrative expenses</header><text>The Administrator may authorize—</text><paragraph id="H41BA810637134C308EEAC4436D25E9CA" commented="no"><enum>(1)</enum><text>States to implement the program established under subsection (a); and</text></paragraph><paragraph id="H5D14302174F445218FC13DB5A090C12D" commented="no"><enum>(2)</enum><text>a State implementing such program to use up to 4 percent of funds made available to carry out such program in such State for administrative expenses.</text></paragraph></subsection><subsection id="HF33DC175ECE142F19A3E3DCB31DEA1C0" commented="no"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $4,000,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body></bill>
