R. 3262</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210514">May 14, 2021</action-date><action-desc><sponsor name-id="U000031">Mr. Upton</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Transportation to submit a report on cybersecurity risks to motor vehicle safety, and for other purposes.</official-title></form><legis-body id="H1CF2577353394551B70856EC050B221B" style="OLC"><section id="HA9F0E396D47F462CABAEDD700CFC3FC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarding against Unauthorized Attacks Related to Driving Act</short-title></quote> or the <quote><short-title>GUARD Act</short-title></quote>. </text></section><section id="HA727F5AEC47E41CCA0A77B6E52D2F443"><enum>2.</enum><header>Cybersecurity risks to motor vehicle safety study and report required</header><subsection id="H5FA64233930644D68ADBE7C02FBCA4BB"><enum>(a)</enum><header>Study required</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Transportation, in coordination with any other appropriate Federal agency, shall conduct a study on the state of cybersecurity regarding motor vehicles. In conducting such study, the Secretary shall—</text><paragraph id="HEE801D97FCCC43AB83325E46D64B049C"><enum>(1)</enum><text>develop a comprehensive list of Federal agencies with jurisdiction over cybersecurity and a brief description of such jurisdiction or expertise of such agencies;</text></paragraph><paragraph id="HC8AA9DC499F24ACCBE19E3430B702765"><enum>(2)</enum><text>identify all interagency activities taking place among Federal agencies related to cybersecurity regarding motor vehicles, including working groups or any other relevant coordinated effort;</text></paragraph><paragraph id="HBDBAE1BD87C341878B28B0FE33AF73C6"><enum>(3)</enum><text>develop a comprehensive list of public-private partnerships focused on cybersecurity regarding motor vehicles, as well as any industry-based bodies, including international bodies, which have developed, or are developing, mandatory or voluntary standards for cybersecurity and the status of such standards;</text></paragraph><paragraph id="H8928DF081502442F9BC31E0CF1126F87"><enum>(4)</enum><text>identify each regulation, guideline, mandatory standard, voluntary standard, and other policy implemented by each Federal agency identified under this subsection and each guideline, mandatory standard, voluntary standard, and other policy implemented by industry-based and recognized international bodies;</text></paragraph><paragraph id="H39BABB98FFE844C5A657881397714C20"><enum>(5)</enum><text>review the technology, measures, guidelines, or practices used across the motor vehicle industry as of the date of the enactment of this Act to identify, protect, detect, respond to, or recover from cyber security incidents affecting the safety of a motor vehicle, focusing on the most advanced vehicle security solutions such as AI-driven vehicle security software;</text></paragraph><paragraph id="HFD2D36AA77EF4A5583834B6718874D4B"><enum>(6)</enum><text>identify existing cybersecurity resources to assist individuals in maintaining awareness of cybersecurity risks associated with motor vehicle safety and mechanisms for alerting a human driver or operator regarding cybersecurity vulnerabilities;</text></paragraph><paragraph id="H9BC5F0301E994FE5BA69415F9822AB5D"><enum>(7)</enum><text>identify means to protect vehicle occupants from cybersecurity incidents affecting safety that may arise while the motor vehicle is operating; and</text></paragraph><paragraph id="H7EBB5E81743A4B3DB741EF0A84231B20"><enum>(8)</enum><text>identify pervasive industry vehicle software security solutions, such as, embedded in at least 150 million vehicles and 50 percent of the electric vehicle marketplace at the time of enactment.</text></paragraph></subsection><subsection id="H855BD291604C4841B510753EC5AB0A0C"><enum>(b)</enum><header>Report required</header><text>Not later than 6 months after completion of the study required pursuant to subsection (a), the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that contains—</text><paragraph id="HB570851BE4E54E5380954E6262ADA8FA"><enum>(1)</enum><text>the results of the study;</text></paragraph><paragraph id="H660DB49F4E6F4BDFAA26A760ECEABAF8"><enum>(2)</enum><text>recommendations to enable the exchange of information and lessons learned across the industry, and across relevant Federal agencies, regarding cybersecurity incidents, threats, and potential vulnerabilities in a timely manner; and</text></paragraph><paragraph id="H39659924B44444FE99B661B62DAC7DC3"><enum>(3)</enum><text>recommendations for other measures deemed reasonable, appropriate, and practicable with respect to cybersecurity related to motor vehicle safety.</text></paragraph></subsection><subsection id="HA8588BF81D124E59A8038CDE78F44730"><enum>(c)</enum><header>Motor vehicle defined</header><text>The term <quote>motor vehicle</quote> has the meaning given that term in section 30102 of title 49, United States Code.</text></subsection></section></legis-body></bill>
