which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><action display="yes"><action-date date="20210722">July 22, 2021</action-date><action-desc>Additional sponsors: <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="Y000033">Mr. Young</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, and <cosponsor name-id="B001298">Mr. Bacon</cosponsor></action-desc></action><action display="yes"><action-date date="20210722">July 22, 2021</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on May 11, 2021</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to expand access to breastfeeding accommodations in the workplace, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="HA4A9BB872DD143ACA179FBAA77BC5306"><section id="H37471EAA4FCB4B0DAEBA56B07EB5B2D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Urgent Maternal Protections for Nursing Mothers Act</short-title></quote> or the <quote><short-title>PUMP for Nursing Mothers Act</short-title></quote>.</text></section><section id="H2F61823783264579BC49B4AC7A4B6042"><enum>2.</enum><header>Breastfeeding accommodations in the workplace</header><subsection id="H102CF0057B664878AE10645A67FD7FEE"><enum>(a)</enum><header>Expanding employee access to break time and place</header><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text><paragraph id="H119AACA8AF17427194BA49423AB34634"><enum>(1)</enum><text>in section 7, by striking subsection (r);</text></paragraph><paragraph id="HCAFF13346C984B4393D57EA38C1F48D2"><enum>(2)</enum><text>in section 15(a)—</text><subparagraph id="H5E504272721649A9A24DA2BC717FDD3D"><enum>(A)</enum><text>by striking the period at the end of paragraph (5) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA7FC729C7D104F7E82D1D3D8A6383562"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H367B8AC40B78449588BC5C20978CE14D" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="HC622F7C9C2FB4A1BA2CAFCADD1E82EAE"><enum>(6)</enum><text>to violate any of the provisions of section 18D.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8FDDE9A020184B84B205B62C7516129B"><enum>(3)</enum><text>in section 16(b) by striking <quote>7(r)</quote> each place the term appears and inserting <quote>18D of this title</quote>; and</text></paragraph><paragraph id="HCF0E933D7E2E41F19D1B5E6CBCC6DFFD"><enum>(4)</enum><text>by inserting after section 18C the following:</text><quoted-block style="OLC" id="H0EB3061B27B844E48F064A0FB351667A" changed="added" reported-display-style="italic" committee-id="HED00"><section id="H18B003D778294070897127E70314BE9E"><enum>18D.</enum><header>Breastfeeding accommodations in the workplace</header><subsection id="HF595FF05F3084C7FA72E7F65DE13155C"><enum>(a)</enum><text>An employer shall provide—</text><paragraph id="H56702CC41B974EF8B20432D4097F2DF5"><enum>(1)</enum><text>a reasonable break time for an employee to express breast milk each time such employee has need to express breast milk for the 2-year period beginning on the date on which the circumstances related to such need arise; and</text></paragraph><paragraph id="H1BDAA045C3884694A7B2372B6757D0C0"><enum>(2)</enum><text>a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.</text></paragraph></subsection><subsection id="HCD2B44B68A944ACF99071BA540DEBF49"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5601C695D85E410F8F971B37583FC81B"><enum>(1)</enum><text>Subject to paragraph (2), an employer shall not be required to compensate an employee receiving break time under subsection (a)(1) for any time spent during the workday for such purpose unless otherwise required by Federal or State law or municipal ordinance.</text></paragraph><paragraph id="H2455FB19C03C47CAB04C7EF1F58D2263" indent="up1"><enum>(2)</enum><text>Break time provided under subsection (a)(1) shall be considered hours worked if the employee is not completely relieved from duty during the entirety of such break.</text></paragraph></subsection><subsection id="H5B83CF3D9FA7497EBC4DB09F5535CB3D"><enum>(c)</enum><text>An employer that employs fewer than 25 employees shall not be subject to the requirements of this section, if such requirements would impose an undue hardship by causing the employer significant difficulty or expense when considered in relation to the size, financial resources, nature, or structure of the employer’s business.</text></subsection><subsection id="H2DF0B10C90A144A18AA10D6EB5514F42"><enum>(d)</enum><text display-inline="yes-display-inline">No provision of this section or of any order thereunder shall excuse noncompliance with any Federal or State law or municipal ordinance that provides greater protections to employees than the protections provided for under this section.</text></subsection><subsection id="H896BE928B48B4126A649E5F8FEC93277"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9D7B37F2E3FF44578250A4A2733484DB"><enum>(1)</enum><text>Subject to paragraph (2), before an employee commences an action to recover liability under section 16(b) for a violation of paragraph (a)(2), the employee shall inform the employer of the failure to provide adequate place and provide the employer with 10 calendar days after such notice is provided to come into compliance with subsection (a)(2) with respect to such employee.</text></paragraph><paragraph id="H2DBFA8120D5943C395A38C2193A429D4" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply in the case that—</text><subparagraph id="H695DA12BC05640CDB2DC2DB843B71AA6"><enum>(A)</enum><text display-inline="yes-display-inline">the employee has been discharged because the employee has made a request for break time or place under this section or has opposed any employer conduct related to this section; or </text></subparagraph><subparagraph id="H088B0BB8C8574A89B1D5583772D0D58B"><enum>(B)</enum><text>the employer has indicated that the employer has no intention of complying with subsection (a)(2).</text></subparagraph></paragraph></subsection><subsection id="H4F91040AE7754CBDA5077C49C8721C82"><enum>(f)</enum><text>The circumstances described in subsection (a)(1) arise if an employee—</text><paragraph id="HB34B084A687148DFB7B8C104BDB16596"><enum>(1)</enum><text>begins providing breast milk for a nursing child; or</text></paragraph><paragraph id="H27FC6C9790884DF08A5CADBBC71513C5"><enum>(2)</enum><text>gives birth, including to—</text><subparagraph id="HE119D4F3C1EF4ED1A6DF935384E179DC"><enum>(A)</enum><text display-inline="yes-display-inline">a stillborn child; or</text></subparagraph><subparagraph id="HD05673D3CC6C4D89A46FB0284197C7FF"><enum>(B)</enum><text>a child over whom the employee does not retain legal custody.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H36BF9E927E29401D83608F20D64AB214"><enum>(b)</enum><header>Clarifying remedies</header><text>Section 16(b) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(b)</external-xref>) is amended by striking <quote>15(a)(3)</quote> each place the term appears and inserting <quote>7(r) or 15(a)(3)</quote>.</text></subsection><subsection id="H70289272B2C34EFAB07E5E88A0C6BCD3"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Labor shall issue guidance with respect to employer compliance with section 18D of the Fair Labor Standards Act of 1938, as amended by this Act, which shall be similar, with respect to specific examples of compliance, to the guidance relating to <quote>Supporting Nursing Moms at Work</quote> published on the website of the Office on Women's Health of the Department of Health and Human Services as of such date of enactment.</text></subsection></section><section id="H1255F4753541490DB70EBAEC6FBD776F"><enum>3.</enum><header>Effective date</header><subsection id="H5466D59B934643F6810382B86FF1520B"><enum>(a)</enum><header>Expanding access</header><text>The amendments made under section 2(a) shall take effect on the date that is 120 days after the date of enactment of this Act.</text></subsection><subsection id="HF4185B21114D4CA18802EFFA389087E9"><enum>(b)</enum><header>Remedies and clarification</header><text>The amendments made under section 2(b) shall take effect on the date of enactment of this Act.</text></subsection></section></legis-body><endorsement display="yes"><action-date>July 22, 2021</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
