which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure that authorizations issued by the Secretary of Transportation to foreign air carriers do not undermine labor rights or standards, and for other purposes.</official-title></form><legis-body id="HC9C7F9E705B44EEFB8E229E989067120" style="OLC"><section id="H991E67286A4C45D7868ECBF0E8A5CF8C" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair and Open Skies Act</short-title></quote>.</text></section><section id="H12A092825E0B4FF08CAA7E8AC11892AC"><enum>2.</enum><header>Foreign air transportation under United States-European Union air transport agreement</header><text display-inline="no-display-inline">The Secretary of Transportation may not issue a permit under section 41302 of title 49, United States Code, or an exemption under section 40109 of such title, authorizing a person to provide foreign air transportation as a foreign air carrier under the United States-European Union Air Transport Agreement of April 2007 (as amended), unless the Secretary—</text><paragraph id="H1AA9796E0EFD412385C020938647367C"><enum>(1)</enum><text>finds that issuing the permit or exemption would be consistent with Article 17 bis of the Agreement; and</text></paragraph><paragraph id="H6499D877454B416790F4DA5CB33348BF"><enum>(2)</enum><text>imposes on the permit or exemption such conditions as may be necessary to ensure that the person complies with Article 17 bis.</text></paragraph></section><section id="HFD5BDDA0573C4756B1B1F67CA8E83481"><enum>3.</enum><header>Public interest test</header><text display-inline="no-display-inline">Section 41302(2) of title 49, United States Code, is amended—</text><paragraph id="H25804631A79440A98219C5ADD88EEF64"><enum>(1)</enum><text>in subparagraph (A) by striking <quote>under an agreement with the United States Government; or</quote> and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H00BB82F0FB004DED820AEDEFC85559AD"><enum>(2)</enum><text>in subparagraph (B) by striking <quote>the foreign air transportation</quote> and inserting <quote>after considering the totality of the circumstances, including the factors set forth in section 40101(a), the foreign air transportation</quote>.</text></paragraph></section><section id="H072BF7ACC52D4421903AE76D2A185755"><enum>4.</enum><header>Public interest requirements</header><subsection id="H4AFFB8350C7D47E8A96CF5BA760B6B91"><enum>(a)</enum><header>Policy</header><text>Section 40101(a) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H84E933CAE9A74E7DA0C950D76619085B" style="OLC"><paragraph id="H87A4084D56D14B58B12C51514626485B"><enum>(17)</enum><text>preventing entry into United States markets by flag of convenience carriers.</text></paragraph><paragraph id="H1430BB00FD0F4EFF98D1CF388A1F6126"><enum>(18)</enum><text>preventing the undermining of labor standards.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H67715C6E3C47460D834351B4EDF0A492"><enum>(b)</enum><header>International air transportation</header><text>Section 40101(e)(9) of title 49, United States Code, is amended—</text><paragraph id="HB1C148CBD2094E39BDAC312429BBEF40"><enum>(1)</enum><text>in subparagraph (D) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H5E8EAD39E2E544AE93445A026151B6B3"><enum>(2)</enum><text>in subparagraph (E) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HEF360D473E604E42B41DAEA6BB8A7709"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HCEAAB3EA52CA41539BB6230EB854896A" style="OLC"><subparagraph id="HF0D35105C1EE48568FC755D4E8C11269"><enum>(F)</enum><text>undermining labor standards.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H415929E820FD477E9E44146AEF5544A6"><enum>(c)</enum><header>Flag of convenience carrier defined</header><text>Section 40102(a) of title 49, United States Code, is amended—</text><paragraph id="HC226D65B6DE7415893EC3101C90CDDE7"><enum>(1)</enum><text>by redesignating paragraphs (21) through (47) as paragraphs (22) through (48), respectively; and</text></paragraph><paragraph id="H05E892554E3C4A019B3E9E6CFD0387DA"><enum>(2)</enum><text>by inserting after paragraph (20) the following:</text><quoted-block id="HCD50A962EE784854BB7E3736288924F2" style="OLC"><paragraph id="HF1E53E8E7FC147C9AF66E0F0290CC910"><enum>(21)</enum><text><quote>flag of convenience carrier</quote> means a foreign air carrier that is established in a country other than the home country of its majority owner or owners in order to avoid regulations of the home country.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
