which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require States receiving grants under the Byrne grant program and the COPS grant program to have in place laws requiring certain independent investigations of law enforcement officers’ use of deadly force, and for other purposes.</official-title></form><legis-body id="HC532CD1A275F48AEA476AA865DC88C32" style="OLC"><section id="H1A07A9943B5F458299676541B243EDC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Use of Force Accountability Act of 2021</short-title></quote>.</text></section><section id="HB104D7AFC81141E5BEAA1569F7703661"><enum>2.</enum><header>Independent investigation of law enforcement statutes condition for receipt of COPS and Byrne grant funding</header><text display-inline="no-display-inline">Beginning in the first fiscal year that begins after the date that is 3 years after the date of enactment of this Act, in order to be eligible for a grant under the Byrne grant program or the COPS grant program, a State or Indian Tribe shall have in effect—</text><paragraph id="HCD90BB8D385B41B59435C0A769036489"><enum>(1)</enum><text>an independent investigation of law enforcement statute; and</text></paragraph><paragraph id="H4BE042DCFDAE4A0FBBD781831A12F5D7"><enum>(2)</enum><text>a law or policy that upon the completion of an independent investigation, the findings are referred—</text><subparagraph id="HF4338C79D9E84740ACD56BFFD9620509"><enum>(A)</enum><text display-inline="yes-display-inline">to the internal affairs department of the employing law enforcement agency for review and possible disciplinary action; or</text></subparagraph><subparagraph id="HE3CDB5164F9E44878550CB2E90AE4443"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a law enforcement agency that does not have an internal affairs department, to the employing law enforcement agency for review and possible disciplinary action. </text></subparagraph></paragraph></section><section id="H816C11A66515478FAF0EBACDBBE827AC"><enum>3.</enum><header>Grant program for independent investigation of law enforcement statutes</header><subsection id="H32CE9494888042A085D8DD3FDD6AC714"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may award grants to eligible States and Indian Tribes to assist in implementing an independent investigation of law enforcement statute.</text></subsection><subsection id="HF558FBE657A6467281304FEB74EDAE1A"><enum>(b)</enum><header>Eligibility</header><text>To be eligible for a grant under this subsection, a State or Indian Tribe shall have in effect an independent investigation of law enforcement statute.</text></subsection><subsection id="HE7568A2C6D3E4B62A14FA6ADFF47455F"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General $750,000,000 for fiscal years 2022 through 2025 to carry out this subsection.</text></subsection></section><section id="H968BCE6DBBAA44B5BAE12469412460C3"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="H2205532D03F340C199BBAA45AEDFBCFE"><enum>(1)</enum><header>Byrne grant program</header><text>The term <term>Byrne grant program</term> means any grant program under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.), without regard to whether the funds are characterized as being made available under the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Local Government Law Enforcement Block Grants Program, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise.</text></paragraph><paragraph id="H8E19C31782F544EC969D902C2E993391"><enum>(2)</enum><header>Cops grant program</header><text>The term <term>COPS grant program</term> means the grant program authorized under section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>).</text></paragraph><paragraph id="H49DC8A809F3A4816B9DB4F6B4159EA22"><enum>(3)</enum><header>Independent investigation</header><text>The term <term>independent investigation</term> means a criminal investigation or prosecution of a law enforcement officer’s use of deadly force, including one or more of the following:</text><subparagraph id="HE720140144714AABA28961606A9B2050"><enum>(A)</enum><text>Using an agency or civilian review board that investigates and independently reviews all allegations of use of deadly force made against law enforcement officers in the jurisdiction.</text></subparagraph><subparagraph id="HE7D7FA83C20F453EAA00895A64FA5663"><enum>(B)</enum><text>Assigning of the attorney general of the State in which the alleged use of deadly force was committed to conduct the criminal investigation and prosecution.</text></subparagraph><subparagraph id="H616FC4F6FB5E4DABAA0B121F5678A895"><enum>(C)</enum><text>Adopting a procedure under which an independent prosecutor is assigned to investigate and prosecute the case, including a procedure under which an automatic referral is made to an independent prosecutor appointed and overseen by the attorney general of the State in which the alleged use of deadly force was committed.</text></subparagraph><subparagraph id="HF1D45474C5224878A6C0EA8CE836F2F0"><enum>(D)</enum><text>Adopting a procedure under which an independent prosecutor is assigned to investigate and prosecute the case.</text></subparagraph><subparagraph id="HABE7CB92E9354684886E4DDD44F60045"><enum>(E)</enum><text display-inline="yes-display-inline">Having law enforcement agencies agree to and implement memoranda of understanding with other law enforcement agencies under which the other law enforcement agencies—</text><clause id="HF56429C2098B43878D5E924311047A11"><enum>(i)</enum><text>shall conduct the criminal investigation into the alleged use of deadly force; and</text></clause><clause id="HD689F724CF4146AA9B10CB9BA7725AA3"><enum>(ii)</enum><text>upon conclusion of the criminal investigation, shall file a report with the attorney general of the State containing a determination regarding whether—</text><subclause id="HFAABED5CF85A41C587CAE214E71ECFE4"><enum>(I)</enum><text>the use of deadly force was appropriate; and</text></subclause><subclause id="HBF36C98C5C814DFC9135FA6AE82DD2B2"><enum>(II)</enum><text>any action should be taken by the attorney general of the State. </text></subclause></clause></subparagraph><subparagraph id="H2A0BE1738C7747788D50B47A27AF798D"><enum>(F)</enum><text>Any substantially similar procedure to ensure impartiality in the investigation or prosecution.</text></subparagraph></paragraph><paragraph id="HADEFE473BDD04650B40E4D86AB148430"><enum>(4)</enum><header>Independent investigation of law enforcement statute</header><text>The term <term>independent investigation of law enforcement statute</term> means a statute requiring an independent investigation in a criminal matter in which—</text><subparagraph id="HF455FA03B3D5457AB02B8D3E4EAAF60D"><enum>(A)</enum><text>one or more of the possible defendants is a law enforcement officer;</text></subparagraph><subparagraph id="H22A05F6944304D3A92290F5CA15BE26B"><enum>(B)</enum><text>one or more of the alleged offenses involves the law enforcement officer’s use of deadly force in the course of carrying out that officer’s duty; and</text></subparagraph><subparagraph id="HEE29467397CD4C0C8C650D0DDB411C0E"><enum>(C)</enum><text>the non-Federal law enforcement officer’s use of deadly force resulted in a death or injury.</text></subparagraph></paragraph><paragraph id="HB6A37FB2CECB45FB863F48ABC555A186"><enum>(5)</enum><header>Independent prosecutor</header><text>The term <term>independent prosecutor</term> means, with respect to a criminal investigation or prosecution of a law enforcement officer’s use of deadly force, a prosecutor who—</text><subparagraph id="H987EE3C78D9C440EBE6C5122DF7634F1"><enum>(A)</enum><text>does not oversee or regularly rely on the law enforcement agency by which the law enforcement officer under investigation is employed; and</text></subparagraph><subparagraph id="H32E89A5F4C314985A08A98D59CA58FE3"><enum>(B)</enum><text>would not be involved in the prosecution in the ordinary course of that prosecutor’s duties.</text></subparagraph></paragraph><paragraph id="H39FE2FC287E74C4795F6DFF25718277F"><enum>(6)</enum><header>State</header><text>The term <term>State</term> has the meaning given such term in section 901 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>). </text></paragraph></section></legis-body></bill>
