which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Revised Statute to codify the defense of qualified immunity in the case of any action under section 1979, and for other purposes.</official-title></form><legis-body id="H733A845D8AD4400093DDD06077127164" style="OLC"><section id="H302AEAB1067540E29823E26593AD6BFF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Qualified Immunity Act of 2021</short-title></quote>.</text></section><section id="H4CA536EDB9F242C1A321534F324B79AD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H3A65A73989EF42EE86E00F94A23CB795"><enum>(1)</enum><text display-inline="yes-display-inline">Qualified immunity is intended for all but the plainly incompetent or those who knowingly violate the law and is meant to give government officials breathing room to make reasonable mistakes of fact and law.</text></paragraph><paragraph id="H7FCEB1EABF7F4B7BB31BCC88E50E396C"><enum>(2)</enum><text>The Supreme Court has observed that qualified immunity balances two important interests, the need to hold law enforcement officers accountable when they exercise power irresponsibly and the need to shield officers from harassment, distraction, and liability when they perform their duties reasonably.</text></paragraph></section><section id="HE3C55D4393D94AF2AD0B1376BD231A9E"><enum>3.</enum><header>Codification of qualified immunity</header><subsection id="H3F2FDABA883B4D33B6BC8349973FC525"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1979 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>) is amended—</text><paragraph id="H78E750516E894533AC4911B5B65DD9C7"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a) </enum-in-header>In general—</header-in-text></quote> before <quote>Every person</quote>; and</text></paragraph><paragraph id="H60A99D8C9ABC4F47AA21CA638444CA33"><enum>(2)</enum><text>by adding at the end the following new subsection: </text><quoted-block style="OLC" id="H960227AA54A94CAC82AB26E355DE1C45" display-inline="no-display-inline"><subsection id="H0268D2AB4FE44A898C58C33DB9A421D0"><enum>(b)</enum><header>Applicability to law enforcement officers</header><paragraph id="H38A169B195474F02ACB3F69AFC2CAC69"><enum>(1)</enum><text>A law enforcement officer subject to an action under this section in their individual capacity shall not be found liable if such law enforcement officer establishes that—</text><subparagraph id="H2629570C13F046349149276B31478C3B"><enum>(A)</enum><text display-inline="yes-display-inline">the right, privilege, or immunity secured by the Constitution or Federal law was not clearly established at the time of their deprivation by the law enforcement officer, or that at this time, the state of the law was not sufficiently clear that every reasonable law enforcement officer would have understood that the conduct alleged constituted a violation of the Constitution or Federal law; or </text></subparagraph><subparagraph id="HC1AB2795F83A46D9B62897413D47C513"><enum>(B)</enum><text display-inline="yes-display-inline">a court of competent jurisdiction had issued a final decision on the merits holding, without reversal, vacatur, or preemption, that the specific conduct alleged to be unlawful was consistent with the Constitution and Federal laws.</text></subparagraph></paragraph><paragraph id="H8382A8C789AC4B158F792869B165A40B"><enum>(2)</enum><text display-inline="yes-display-inline">A law enforcement agency or unit of local government who employed a law enforcement officer subject to an action under subsection (a), shall not be liable for such action if the law enforcement officer is found not liable under paragraph (1) and was acting within the scope of their employment.</text></paragraph></subsection><subsection id="H972A62888B124E038D4F227D57735A46"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HD61C7FA5E3814960A8A10C04648A24A0"><enum>(1)</enum><header>Law enforcement officer</header><text display-inline="yes-display-inline">The term <term>law enforcement officer</term> means any Federal, State, Tribal, or local official who is authorized by law to engage in or supervise the prevention, detection, investigation, or the incarceration of any person for any violation of law, and has statutory powers of arrest or apprehension, including police officers and other agents of a law enforcement agency.</text></paragraph><paragraph id="H49D78CC6C3E24A279C9BC65A83A16AB0"><enum>(2)</enum><header>Law enforcement agency</header><text display-inline="yes-display-inline">The term <term>law enforcement agency</term> means any Federal, State, Tribal, or local public agency engaged in supervision, prevention, detection, investigation, or the incarceration of any person for any violation of law, and has statutory powers of arrest or apprehension.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE18C3A6E0CFB47C19A200E510AD7EB28"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made under subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
