which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to direct the Secretary of Health and Human Services to develop best practices for the establishment and use of behavioral intervention teams at schools, and for other purposes.</official-title></form><legis-body id="HFE63C1B7DB0D45669C3E954FEE43C9A3" style="OLC"><section section-type="section-one" id="HDD0A1008BA474B60AA7C32A482CC7B23"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Behavioral Intervention Guidelines Act of 2021</short-title></quote>.</text></section><section id="HD36514030B9F4C0983F6E9380C0E8C8B"><enum>2.</enum><header>Best practices for behavioral intervention teams</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 520G of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-38">42 U.S.C. 290bb–38</external-xref>) the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H194CFC411DF34B7F90698424A5DC80A8"><section id="H9233FE34BE47421188E20B5CD1C4BB07"><enum>520H.</enum><header>Best practices for behavioral intervention teams</header><subsection id="H8C50EDBB768D42F29D173E7A0E1C897A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall identify and facilitate the development of best practices to assist elementary schools, secondary schools, and institutions of higher education in establishing and using behavioral intervention teams.</text></subsection><subsection id="HF408E65F096E4D7EB796ACB2147F6388"><enum>(b)</enum><header>Elements</header><text>The best practices under subsection (a)(1) shall include guidance on the following:</text><paragraph id="H6D29116BE7AB49BAAA303A552908D403"><enum>(1)</enum><text display-inline="yes-display-inline">How behavioral intervention teams can operate effectively from an evidence-based, objective perspective while protecting the constitutional and civil rights of individuals.</text></paragraph><paragraph id="HE37E1C7F551B4C93A731230091B3F348"><enum>(2)</enum><text display-inline="yes-display-inline">The use of behavioral intervention teams to identify concerning behaviors, implement interventions, and manage risk through the framework of the school’s or institution’s rules or code of conduct, as applicable.</text></paragraph><paragraph id="H9B37746A3C44421DADAA5CD66CF0B9CE"><enum>(3)</enum><text display-inline="yes-display-inline">How behavioral intervention teams can, when assessing an individual—</text><subparagraph id="H58EB963C487F4BD9A3A6A1DCFF37F5E0"><enum>(A)</enum><text display-inline="yes-display-inline">access training on evidence-based, threat-assessment rubrics;</text></subparagraph><subparagraph id="H745BB6CE7B1A4BBA82526869D2FA44F1"><enum>(B)</enum><text>ensure that such teams—</text><clause id="HBF9B94197C0B4ADABED244EBCE4EAE8C"><enum>(i)</enum><text>have trained, diverse stakeholders with varied expertise; and</text></clause><clause id="H79AFCC53123C4784BCE14C0C13218684"><enum>(ii)</enum><text>use cross validation by a wide-range of individual perspectives on the team; and</text></clause></subparagraph><subparagraph id="HA3F51AF4408D46CA95549ED5CADCE555"><enum>(C)</enum><text display-inline="yes-display-inline">use violence risk assessment.</text></subparagraph></paragraph><paragraph id="H3F289FB329D9449DB3E3765DAAC9147A"><enum>(4)</enum><text>How behavioral intervention teams can help mitigate—</text><subparagraph id="HC261C2404BC746D390A735E8C791A7BC"><enum>(A)</enum><text>inappropriate use of a mental health assessment;</text></subparagraph><subparagraph id="HD6D43C90FEFC475C9520975A4A594AF7"><enum>(B)</enum><text>inappropriate limitations or restrictions on law enforcement’s jurisdiction over criminal matters;</text></subparagraph><subparagraph id="HEF2694F2C8B149E6A617DF35D2DE3F3A"><enum>(C)</enum><text>attempts to substitute the behavioral intervention process in place of a criminal process, or impede a criminal process, when an individual’s behavior has potential criminal implications;</text></subparagraph><subparagraph id="H267E2116EBFD45FEB0AA82D508BD54D9"><enum>(D)</enum><text>endangerment of an individual’s privacy by failing to ensure that all applicable Federal and State privacy laws are fully complied with; or</text></subparagraph><subparagraph id="H67848FF230DB4030B50CFD6FD2114A80"><enum>(E)</enum><text display-inline="yes-display-inline">inappropriate referrals to, or involvement of, law enforcement when an individual’s behavior does not warrant a criminal response.</text></subparagraph></paragraph></subsection><subsection id="HA275A80F52EC41AA979C6CDDFF074BAB"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out subsection (a)(1), the Secretary shall consult with—</text><paragraph id="H69EE8C1063A64F6399D8DA1AC6CDDF8B"><enum>(1)</enum><text>the Secretary of Education;</text></paragraph><paragraph id="H9B832E407D4A4D6997126F25FB0EDE71"><enum>(2)</enum><text>the Director of the National Threat Assessment Center of the United States Secretary Service;</text></paragraph><paragraph id="HD266072BC71D41F4956D33EAFD3DE2EB"><enum>(3)</enum><text>the Attorney General and the Director of the Bureau of Justice Assistance;</text></paragraph><paragraph id="H915B5013E96A45FD9707DC4292C1B443"><enum>(4)</enum><text>teachers and other educators, principals, school administrators, school board members, school psychologists, mental health professionals, and parents of students;</text></paragraph><paragraph id="H2BCF22476CBB4C5C8B6BC74665E3A8EE"><enum>(5)</enum><text>local law enforcement agencies and campus law enforcement administrators;</text></paragraph><paragraph id="HBFB1CFF085B94B73A2EA4584AE7988F8"><enum>(6)</enum><text>privacy experts; and</text></paragraph><paragraph id="HCDD9653AD1B64472BAE16EBC095935B9"><enum>(7)</enum><text>other education and mental health professionals as the Secretary deems appropriate.</text></paragraph></subsection><subsection id="H425EF5361C4A4F079098945DDA1C5169"><enum>(d)</enum><header>Publication</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall publish the best practices under subsection (a)(1) on the internet website of the Department of Health and Human Services.</text></subsection><subsection id="HF1124D9983374BE7858295DFB3FFAA61"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance to institutions of higher education, elementary schools, and secondary schools to assist such institutions and schools in implementing the best practices under subsection (a).</text></subsection><subsection id="H0F9234A2DB364851A28988D9EA8E1898"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H512146A117314F87B1D764DB83C13B87"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>behavioral intervention team</term> means a team of qualified individuals who—</text><subparagraph id="HA498ADA0FA634CBCB6DE09FBB7170916"><enum>(A)</enum><text>are responsible for identifying and assessing individuals exhibiting concerning behaviors, experiencing distress, or who are at risk of harm to self or others;</text></subparagraph><subparagraph id="H8E101CA98EFC410498B067131942C6B1"><enum>(B)</enum><text>develop and facilitate implementation of evidence-based interventions to mitigate the threat of harm to self or others posed by an individual and address the mental and behavioral health needs of individuals to reduce risk; and</text></subparagraph><subparagraph id="H5BEC4CCCD98547B3A6F971480CA05079"><enum>(C)</enum><text>provide information to students, parents, and school employees on recognizing behavior described in this subsection.</text></subparagraph></paragraph><paragraph id="H7AE7FBB9337643A1B56BA370318E2D81"><enum>(2)</enum><text display-inline="yes-display-inline">The terms <term>elementary school</term>, <term>parent</term>, and <term>secondary school</term> have the meanings given to such terms in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="HCC8694EA122F4D23907FC31D6179BF33"><enum>(3)</enum><text>The term <term>institution of higher education</term> has the meaning given to such term in section 102 of the Higher Education Act of 1965.</text></paragraph><paragraph id="HBD596561BA9647A9BE08B907CEDC4C64"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>mental health assessment</term> means an evaluation, primarily focused on diagnosis, determining the need for involuntary commitment, medication management, and on-going treatment recommendations.</text></paragraph><paragraph id="HDADF1F003779427BAB4F02E1BDB5CB13"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>violence risk assessment</term> means a broad determination of the potential risk of violence based on evidence-based literature.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
