R. 286</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210112">January 12, 2021</action-date><action-desc><sponsor name-id="T000165">Mr. Tiffany</sponsor> (for himself, <cosponsor name-id="C001109">Ms. Cheney</cosponsor>, <cosponsor name-id="G000576">Mr. Grothman</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="G000579">Mr. Gallagher</cosponsor>, and <cosponsor name-id="S001212">Mr. Stauber</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Endangered Species Act of 1973 to exclude the gray wolf from the authority of such Act, to remove the gray wolf from the lists of threatened species and endangered species published pursuant to such Act, and for other purposes.</official-title></form><legis-body id="H1369616A1E584B97A7204EC5503F0928" style="OLC"><section id="H4A17BC0707064558B05BC6F37EA222AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Managing Predators Act</short-title></quote>.</text></section><section id="HEC32A06AE7FE43C3BEF78BF2BC8E3E42"><enum>2.</enum><header>Gray wolf excluded</header><text display-inline="no-display-inline">Section 4(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(a)</external-xref>) is amended—</text><paragraph id="HCFEC4606025F4092BBF04CB30CA46B69"><enum>(1)</enum><text>in paragraph (1), by striking <quote>The Secretary shall by regulation</quote> and inserting <quote>Except as provided in paragraph (4), the Secretary shall by regulation</quote>; and</text></paragraph><paragraph id="H57040B77E2B347A9A67D29F7C1F67C96"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HF6BFF473D0A54DFAA3E6A683DFE3CD18" display-inline="no-display-inline"><paragraph id="HED832E972A4A492EB02948246FB2E51D" indent="up1"><enum>(4)</enum><header>Applicability to the gray wolf</header><subparagraph id="HAA333B8568414FD7A04E3710AFF694A9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, this Act does not apply to the gray wolf (Canis lupus) in Wisconsin, Michigan, Minnesota, and Wyoming.</text></subparagraph><subparagraph id="H9AFEF85F669441D08FC790B18E714CD7" commented="no"><enum>(B)</enum><header>Delisting</header><text>Notwithstanding any other provision of law, the gray wolf (Canis lupus) in Wisconsin, Michigan, Minnesota, and Wyoming is removed from the lists of threatened species and endangered species that are published pursuant to this Act.</text></subparagraph><subparagraph id="HD5A8AB1E2A064CEDB80C96E7D4D7A8D9"><enum>(C)</enum><header>Authority in other States</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to a State other than Wisconsin, Michigan, Minnesota, or Wyoming, if the population of the gray wolf (Canis lupus) in such State, as estimated by the agency of such State that has primary authority over wildlife management and conservation, is at or above a population goal established by such agency, the Secretary may not make a determination under paragraph (1) that the gray wolf (Canis lupus) in such State is an endangered species or threatened species.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA6E8E28B38554A8182F896EDA395C92E"><enum>3.</enum><header>Delisting of gray wolf in certain States</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the gray wolf (Canis lupus) in Wisconsin, Michigan, Minnesota, and Wyoming is removed from the lists of threatened species and endangered species that are published pursuant to the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></section></legis-body></bill>
