<official-title display="yes">To require the Secretary of Health and Human Services to establish a demonstration project to increase access to biosimilar biological products under the Medicare program.</official-title>

<section id="H10668595749D4899832A10B7FFBFB819" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Access to Biosimilars Act of 2021</short-title></quote>. </text></section> <section id="HD7BF34EBD34D407697C20B37F49E520D"><enum>2.</enum><header>Demonstration project to increase access to biosimilar biological products under the Medicare program</header> <subsection id="HA0CBB1B8A5B54CC89C89AA490D0B9CB6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall establish and implement a 3-year nationwide demonstration project under part B of title XVIII of the Social Security Act to evaluate the benefits of providing a shared savings payment for biosimilar biological products furnished under such part. </text></subsection>
<subsection id="H8178DC53B9274ED8A01FEA35C416B19C"><enum>(b)</enum><header>Participation</header>
<paragraph id="H85D1F69C8D7446EFBC936101F4071A70"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Participation under the demonstration project shall be voluntary, and a participating provider may terminate participation at any time and the Secretary may terminate the participation of such a provider at any time. </text></paragraph> <paragraph id="HC84815AC0E5D4A1A8094B1F01202D934"><enum>(2)</enum><header>Application and selection</header><text display-inline="yes-display-inline">To participate under the demonstration project, an eligible provider shall submit to the Secretary an application in such form and manner and containing such information as specified by the Secretary. Each eligible provider who submits such an application shall be selected by the Secretary for participation under the demonstration project.</text></paragraph>
<paragraph id="H35AC041F84B1499995D1628AA921569B"><enum>(3)</enum><header>Clarification</header><text display-inline="yes-display-inline">Participation under the demonstration project shall not preclude eligible providers from also participating in any model authorized under section 1115A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a</external-xref>), including the Oncology Care Model and Oncology Care First Model, or impact eligible providers metrics or expenditures within other models authorized under such section.</text></paragraph></subsection> <subsection id="H75C9D39CBE8345C7A52003026162AC03"><enum>(c)</enum><header>Coverage</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, payment may be made under the demonstration project for a biosimlar biological product only if such product is covered under part B of title XVIII of the Social Security Act and such payment shall be made in the same manner as payment is provided for such a product under such part.</text></subsection>
<subsection id="HD6205A29ECF143CC8DEF2CDCA3287207"><enum>(d)</enum><header>Additional payment</header>
<paragraph id="H7ECC12419A314ECD99B32A13FDB8110F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Under the demonstration project, subject to paragraph (3), in addition to the payment that would otherwise be made under part B of title XVIII of the Social Security Act for a biosimilar biological product furnished or dispensed by a participating provider to a Medicare beneficiary, there shall be made an additional payment, in an amount determined by the Secretary, that is based on the difference, if any, (or portion of such difference) between the costs to the provider in furnishing the biosimilar biological product and the costs to the provider if the provider had furnished the reference biological product.</text></paragraph> <paragraph id="H141BAA84795C43AC9CEE4BAAFA86C2A2"><enum>(2)</enum><header>No increase to Medicare coinsurance</header><text display-inline="yes-display-inline">The additional payment described under paragraph (1) shall not increase a Medicare beneficiary’s cost-sharing liability, as described in section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>). </text></paragraph>
<paragraph id="H111A5E01F4B34DE1A021E5BA9D34886E"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">An eligible provider may only receive the additional payment described in paragraph (1), with respect to a biosimilar biological product, if the payment amount under section 1847A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3a">42 U.S.C. 1395w–3a</external-xref>) for such product is less than the payment amount under part B of title XVIII of such Act for the reference biological product.</text></paragraph></subsection> <subsection id="H0FE6F5CDB43A4478904FCE1203C85B6F"><enum>(e)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The Secretary may waive such requirements of title XVIII of the Social Security Act as may be necessary to carry out the demonstration project, except the Secretary may not increase the cost-sharing that would otherwise, without application of this section, be applied to an individual under section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>).</text></subsection>
<subsection id="H7BB0625F0A4C41D49E7FB4E5A3DDB1B1"><enum>(f)</enum><header>Reports</header>
<paragraph id="H729AF8BAB8CF4333B75D743EBD5FBD7B"><enum>(1)</enum><header>Interim evaluation and report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that contains an analysis of the appropriateness of expanding or extending the demonstration project and, to the extent such analysis determines such an expansion or extension appropriate, recommendations for such expansion or extension, respectively.</text></paragraph> <paragraph id="H75006B7F20FF4753B7E02242965D6015"><enum>(2)</enum><header>Final evaluation and report</header><text display-inline="yes-display-inline">Not later than one year after the date of completion of the demonstration project, the Secretary shall submit to Congress a report that contains a final analysis of the project and recommendations described in paragraph (1).</text></paragraph></subsection>
<subsection id="H47FF82D825634852BF34D5244F999930"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HCF3BE96686FD47D98D30C86461FC50ED"><enum>(1)</enum><header>Demonstration project</header><text>The term <term>demonstration project</term> means the demonstration project conducted under this Act.</text></paragraph>
<paragraph id="HA7763CCE2BED4447A014D16CFBACB3B6"><enum>(2)</enum><header>Biosimilar biological product</header><text display-inline="yes-display-inline">The term <term>biosimilar biological product</term> means a biological product approved under an abbreviated application for a license of a biological product that relies in part on data or information in an application for another biological product licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>).</text></paragraph> <paragraph id="HC09A10AC0ED74756BE5D31785ECB9AED"><enum>(3)</enum><header>Eligible provider</header><text display-inline="yes-display-inline">The term <term>eligible provider</term> means a provider of services or supplier that is eligible to receive payment under part B of title XVIII of the Social Security Act for furnishing or dispensing biosimilar biological products.</text></paragraph>
<paragraph id="H99A8C169BA7043BBA5E8B505AC4D4039"><enum>(4)</enum><header>Medicare beneficiary</header><text>The term <term>Medicare beneficiary</term> means an individual who is enrolled for benefits under part B of title XVIII of the Social Security Act.</text></paragraph> <paragraph id="H0975DE85FA8043E99E23AEDC45FF5FC8"><enum>(5)</enum><header>Participating provider</header><text>The term <term>participating provider</term> means an eligible provider that has been selected for participation under the project under subsection (b)(2) and with respect to whom such participation has not been terminated.</text></paragraph>
<paragraph id="HE246FB71471B41ECA13F9C1D8884AE89"><enum>(6)</enum><header>Reference biological product</header><text display-inline="yes-display-inline">The term <term>reference biological product</term> means the biological product licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) that is referred to in the application described in paragraph (2) of the biosimilar biological product.</text></paragraph></subsection></section> </legis-body> </bill>
