which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To restore the integrity of the Fifth Amendment to the Constitution of the United States, and for other purposes.</official-title></form><legis-body id="HA0C6A0B28F2542AB8269BF19C9CD27C0" style="OLC"><section id="H0C69787D81684550B06342B49063E713" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fifth Amendment Integrity Restoration Act of 2021</short-title></quote> or the <quote><short-title>FAIR Act</short-title></quote>.</text></section><section id="H04E08A9B7A754D47B8F25B11981AF582"><enum>2.</enum><header>Civil forfeiture proceedings</header><text display-inline="no-display-inline">Section 983 of title 18, United States Code, is amended—</text><paragraph id="H9AE3E06FD38A4209B07284C60D19B2A3"><enum>(1)</enum><text>in subsection (b)(2)(A)—</text><subparagraph id="H18C2ED5479C244E682BBF1454F086F90"><enum>(A)</enum><text>by striking <quote>, and the property subject to forfeiture is real property that is being used by the person as a primary residence,</quote>; and</text></subparagraph><subparagraph id="H7B48EEF78DDF4DFC82EE56E0EFDA8A06"><enum>(B)</enum><text>by striking <quote>, at the request of the person, shall insure</quote> and insert <quote>shall ensure</quote>;</text></subparagraph></paragraph><paragraph id="HF643C0798FBE4D64AF4DDBADA41D61AE"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H6E49A0B092B84664886C21DA4AE630D4"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>a preponderance of the evidence</quote> and inserting <quote>clear and convincing evidence</quote>;</text></subparagraph><subparagraph id="H3159AC78939D4B25ADEB1F4D92C3C33B"><enum>(B)</enum><text>in paragraph (2), by striking <quote>a preponderance of the evidence</quote> and inserting <quote>clear and convincing evidence</quote>; and</text></subparagraph><subparagraph id="H8EA461E35D5F493F862B13B174C8C31A"><enum>(C)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HF3A088B1826D4F2BBED071FB8A11F33F" style="OLC"><paragraph id="H319E60D3D9094DB684CE0D1F980AC3F0"><enum>(3)</enum><text>if the Government's theory of forfeiture is that the property was used to commit or facilitate the commission of a criminal offense, or was involved in the commission of a criminal offense, the Government shall establish, by clear and convincing evidence, that—</text><subparagraph id="HF3EBE3A22D4F4EB3AD3D850288A351FA"><enum>(A)</enum><text>there was a substantial connection between the property and the offense; and</text></subparagraph><subparagraph id="H1E2671268C2A4065B79A91F6DB03A0EF"><enum>(B)</enum><text>the owner of any interest in the seized property—</text><clause id="H935849B6269B4D349FE193C9B4CA8DC3"><enum>(i)</enum><text>used the property with intent to facilitate the offense; or</text></clause><clause id="H882C7B4DB07A4218A2DEB81018FF84F5"><enum>(ii)</enum><text>knowingly consented or was willfully blind to the use of the property by another in connection with the offense.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7566E4783DE543BFB6644AC79369C35F"><enum>(3)</enum><text>in subsection (d)(2)(A), by striking <quote>an owner who</quote> and all that follows through <quote>upon learning</quote> and inserting <quote>an owner who, upon learning</quote>.</text></paragraph></section><section id="H69B4D68D34F94F718C7ADC2BA3E3B0D3"><enum>3.</enum><header>Disposition of forfeited property</header><subsection id="H5EFEB48E98CC4863809296C6269C2960"><enum>(a)</enum><header>Revisions to Controlled Substances Act</header><text>Section 511(e) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/881">21 U.S.C. 881(e)</external-xref>) is amended—</text><paragraph id="H7D6F9BBA12BC4B8683AEF76171168EC9"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HDB7932C7E0E94EA395B979CA143BA7D0"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>civilly or</quote>;</text></subparagraph><subparagraph id="HA2AC440BBA5C47DB95C1EE49DA59D752"><enum>(B)</enum><text>by striking subparagraph (A); and</text></subparagraph><subparagraph id="H5F980162FE7B4CAC9E0DCB51C6D0C98D"><enum>(C)</enum><text>by redesignating subparagraphs (B) through (E) as subparagraphs (A) through (D), respectively;</text></subparagraph></paragraph><paragraph id="H0477B3554F7A47BEB57E925CF8CAAFE1"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H4065F491AF3B4CE6AED495972D97ABE6"><enum>(A)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraph (B) of paragraph (1)</quote> and inserting <quote>paragraph (1)(A)</quote>; and</text></subparagraph><subparagraph id="H2A51A83C5A1C44329B15B9DD9553C9CB"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>accordance with section 524(c) of title 28,</quote> and inserting <quote>the General Fund of the Treasury of the United States</quote>;</text></subparagraph></paragraph><paragraph id="HE17054121C0F4983AB1F3CFEDAAC45A5"><enum>(3)</enum><text>by striking paragraph (3);</text></paragraph><paragraph id="HD3F760E33F9B41BCA29385BE4EEB0C40"><enum>(4)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text></paragraph><paragraph id="HC53707E44E834FC498B4669BEA0D6A4B"><enum>(5)</enum><text>in paragraph (3), as redesignated—</text><subparagraph id="HE668AAD34A2C4F75BAD4D0DF3E8C221D"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>paragraph (1)(B)</quote> and inserting <quote>paragraph (1)(A)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H038C36C0B278456C9B270A8F2C64EBA8"><enum>(B)</enum><text>in subparagraph (B), in the matter preceding clause (i), by striking <quote>paragraph (1)(B) that is civilly or</quote> and inserting paragraph <quote>(1)(A) that is</quote>.</text></subparagraph></paragraph></subsection><subsection id="HDF47C28C2C364CA6AF84256E9FB01CE9"><enum>(b)</enum><header>Revisions to title 18</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">Chapter 46</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HAB93A67445594FBAB3F711E4B3787D75"><enum>(1)</enum><text>in section 981(e)—</text><subparagraph id="H346CB5A2F5B84D029FDA0D7A19BFAA9A"><enum>(A)</enum><text>by striking <quote>is authorized</quote> and all that follows through <quote>or forfeiture of the property;</quote> and inserting <quote>shall forward to the Treasurer of the United States any proceeds of property forfeited pursuant to this section for deposit in the General Fund of the Treasury or transfer such property on such terms and conditions as such officer may determine—</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2CB74ED8607F4C5C9309CA468B6F98BF"><enum>(B)</enum><text>by redesignating paragraphs (3), (4), (5), (6), and (7) as paragraphs (1), (2), (3), (4), and (5), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H378A3E4789BC42BF8D9129ABADA4D981"><enum>(C)</enum><text>in the matter following paragraph (5), as so redesignated—</text><clause commented="no" display-inline="no-display-inline" id="H3103F34154AC447699276BAFFA3BA2B4"><enum>(i)</enum><text>by striking the first, second, third, sixth, and eighth sentences; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC13317DE27304B12B64613BE32766D97"><enum>(ii)</enum><text>by striking <quote>paragraph (3), (4), or (5)</quote> and inserting <quote>paragraph (1), (2), or (3)</quote>; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25A29069D9ED448AA42C8F8F523B9B9C"><enum>(2)</enum><text>in section 983(g)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB9F9FA484ABF4D00880421739B27E05F"><enum>(A)</enum><text>in paragraph (3), by striking <quote>grossly</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6599A2ADB9A443F982E2DC48E8C12583"><enum>(B)</enum><text>in paragraph (4), by striking <quote>grossly</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H93B5FB7B74104B7A8D258BB1AC33945C"><enum>(c)</enum><header>Tariff Act of 1930</header><text>The Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304</external-xref> et seq.) is amended—</text><paragraph commented="no" id="H820507FE89584561A133614EF1930A88"><enum>(1)</enum><text>in section 613A(a) (<external-xref legal-doc="usc" parsable-cite="usc/19/1613b">19 U.S.C. 1613b(a)</external-xref>)—</text><subparagraph commented="no" id="H997B3B16B86F4AA99AF04EC0BD139DF4"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" id="H6EB6F73B63D344C6B1B3A613C16AB87B"><enum>(i)</enum><text>in subparagraph (D), by inserting <quote>and</quote> after the semicolon;</text></clause><clause commented="no" id="H8D40CF930978460FA271361128A081B9"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>; and</text></clause><clause commented="no" id="H0F6347C6F55A4D118F0B368B897528A3"><enum>(ii)</enum><text>by striking subparagraph (B); and</text></clause></subparagraph></paragraph><paragraph commented="no" id="H02817CA0FBB64854863211AB601481BD"><enum>(2)</enum><text>in section 616 (<external-xref legal-doc="usc" parsable-cite="usc/19/1616a">19 U.S.C. 1616a</external-xref>)—</text><subparagraph commented="no" id="H99F7FF67CB1E43DDBD1D41AE0B38637A"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Transfer of forfeited property</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Dismissal in favor of forfeiture under State law</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" id="HA27BCE37E661465BA17196AA815977BE"><enum>(B)</enum><text>in subsection (a), by striking <quote>(a) The Secretary</quote> and inserting <quote>The Secretary</quote>; and</text></subparagraph><subparagraph commented="no" id="H640E4B72D6D447A99F6A065FAA489037"><enum>(C)</enum><text>by striking subsections (b) through (d).</text></subparagraph></paragraph></subsection><subsection commented="no" id="H290043FF90E048EE979F4DD3CADD3027"><enum>(d)</enum><header>Title 31</header><text>Section 9705 of title 31, United States Code, is amended—</text><paragraph commented="no" id="H7FEF576C470F45038E12423364070871"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph commented="no" id="HC8FA75CD7EAA441EA16C6814B0E3DAEB"><enum>(A)</enum><text>by striking subparagraph (G); and</text></subparagraph><subparagraph commented="no" id="HC179ED5CECA74581B1EAE2DEDD82822D"><enum>(B)</enum><text>by redesignating subparagraphs (H) through (J) as subparagraphs (G) through (I), respectively; and</text></subparagraph></paragraph><paragraph commented="no" id="H0574E4AEFBAA4AFBA3CD6CE77E73EE59"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" id="H4E42DB70977E4C3BB4010FD50A769BB9"><enum>(A)</enum><text>by striking paragraphs (2) and (4); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8AEB89092E9C4AB3BC030E2EB44B43DA"><enum>(B)</enum><text>by redesignating paragraphs (3) and (5) as paragraphs (2) and (3), respectively.</text></subparagraph></paragraph></subsection></section><section id="HB8F51DFFCD0440FF82F00CE9A245F75C"><enum>4.</enum><header>Department of Justice Assets Forfeiture Fund deposits</header><text display-inline="no-display-inline">Section 524(c)(4) of title 28, United States Code, is amended—</text><paragraph id="HD0BB5482400A4E34B0EE85F7460F5E1B"><enum>(1)</enum><text>by striking subparagraphs (A) and (B); and</text></paragraph><paragraph id="H4C9BF25FB48B4E4D85632CEF1EC3D95A"><enum>(2)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (A) and (B), respectively.</text></paragraph></section><section id="H2E5635BEE214427B9E6161928C07C233"><enum>5.</enum><header>Structuring transactions to evade reporting requirement prohibited</header><subsection id="HBC4A9AA109AF465FA7129CCAD010C97D"><enum>(a)</enum><header>Amendments to Title 31</header><text display-inline="yes-display-inline">Section 5324 of title 31, United States Code, is amended—</text><paragraph id="H9FFB264CDABC4FC7923F934D1497046C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H10C52D0F382B469B8098581CEC0A013C"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>Public Law 91–508</quote>; and</text></subparagraph><subparagraph id="H0402C6EF10AC4422B797D110671B1688"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>of funds not derived from a legitimate source</quote> after <quote>any transaction</quote>;</text></subparagraph></paragraph><paragraph id="H33C7FF5E363B43B69A0D6128E5B0D2F3"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>such section</quote>; and</text></paragraph><paragraph id="HF66233950C904AB6B8E64EEBBFC8AADD"><enum>(3)</enum><text>in subsection (c), in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>section 5316</quote>.</text></paragraph></subsection><subsection id="H3A860F65EAA34A898CCE7A6A9456FE80"><enum>(b)</enum><header>Probable cause hearing in connection with property seizures relating to certain monetary instruments transactions</header><paragraph id="HDB550E579E664994895F2B0CC08AC106"><enum>(1)</enum><header>Amendment</header><text>Section 5317 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H50F110BA001C4F03B063F3F2D7EB62FC" style="OLC"><subsection id="H62F05F72C3C341FF9269C2A2B28968A2"><enum>(d)</enum><header>Probable cause hearing in connection with property seizures relating to certain monetary instruments transactions</header><paragraph id="HADC61A36E7D34AD89B8BD02C5F54F444"><enum>(1)</enum><header>In general</header><text>Not later than 14 days after the date on which notice is provided under paragraph (2)—</text><subparagraph id="H423790ACB20F434B998A9D3092322D92"><enum>(A)</enum><text>a court of competent jurisdiction shall conduct a hearing on any property seized or restrained under subsection (c)(2) with respect to an alleged violation of section 5324; and</text></subparagraph><subparagraph id="H46BB4B3CC79C4C2B81610463659E8B4B"><enum>(B)</enum><text>any property described in subparagraph (A) shall be returned unless the court finds that there is probable cause to believe that there is a violation of section 5324 involving the property.</text></subparagraph></paragraph><paragraph id="H3B3369521E6A4B3FA51BBC58E8F0E872"><enum>(2)</enum><header>Notice</header><text>Each person from whom property is seized or restrained under subsection (c)(2) with respect to an alleged violation of section 5324 shall be notified of the right of the person to a hearing under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H9D8C4237000D47E79AF0F80F429677B8"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply to property seized or restrained after the date of enactment of this Act.</text></paragraph></subsection></section><section id="H91675BC666004481B4FF82806B991237"><enum>6.</enum><header>Proportionality</header><text display-inline="no-display-inline">Section 983(g)(2) of title 18, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4EFE95AA159E44DD871EAB20AC906606" style="OLC"><paragraph id="HACE5472B9E67468098EF3532609225DF"><enum>(2)</enum><text>In making this determination, the court shall consider such factors as—</text><subparagraph id="H71023E50BCA843B7B585D8A27AE4380D"><enum>(A)</enum><text>the seriousness of the offense;</text></subparagraph><subparagraph id="H6B0E9733DA4242F9B47B184CEEE3101C"><enum>(B)</enum><text>the extent of the nexus of the property to the offense;</text></subparagraph><subparagraph id="H6CB990EFEDFB4FA8A684110F3E82C167"><enum>(C)</enum><text>the range of sentences available for the offense giving rise to forfeiture;</text></subparagraph><subparagraph id="H635A9B84F78145D5B8C5363D35C3F021"><enum>(D)</enum><text>the fair market value of the property; and</text></subparagraph><subparagraph id="H90A2B6875936483C8D60D3C3C2F7975C"><enum>(E)</enum><text>the hardship to the property owner and dependents.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1BB2E5BF5BD54E5CBB8848193F2F0A0F"><enum>7.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Section 524(c)(6)(A)(i) of title 28, United States Code, is amended by inserting <quote>from each type of forfeiture, and specifically identifying which funds were obtained from including criminal forfeitures and which were obtained from civil forfeitures,</quote> after <quote>deposits</quote>.</text></section><section id="HC1AEBDF3516748B198EBA301AFA24837"><enum>8.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to—</text><paragraph id="H9E69F2F88AE34DC6AC3A0A6C34ABA3D3"><enum>(1)</enum><text>any civil forfeiture proceeding pending on or filed on or after the date of enactment of this Act; and</text></paragraph><paragraph id="HE7DD46D3723047B394492460A707073F"><enum>(2)</enum><text>any amounts received from the forfeiture of property on or after the date of enactment of this Act.</text></paragraph></section></legis-body></bill>
