which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize the Highlands Conservation Act, to authorize States to use funds from that Act for administrative purposes, and for other purposes.</official-title></form><legis-body id="H0313E68B29BB43D6B497A26BC8F8EE71" style="OLC"><section section-type="section-one" id="HCEC950415F464F6181D7580D28897D83"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Highlands Conservation Reauthorization Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H0A18BFFB559A44D38008C92A5F74E521"><enum>2.</enum><header>Reauthorization of the Highlands Conservation Act</header><text display-inline="no-display-inline">The Highlands Conservation Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/421">Public Law 108–421</external-xref>; 118 Stat. 2375) is amended—</text><paragraph id="H81F80839ADC54C798C05667A2665B11C"><enum>(1)</enum><text>in section 3—</text><subparagraph id="HC929C01F51FD4C26A0E51B9D4E4ED7AB"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H18FFDE6D4BA54138B10C9ACA6E7F9DD5"><paragraph id="H0A4B9BD5D2704EE1ADFA3848ED5ECCF3"><enum>(1)</enum><header>Highlands region</header><text display-inline="yes-display-inline">The term <term>Highlands region</term> means—</text><subparagraph id="HD393BA9ED737407F9E58EF9B86FD062E"><enum>(A)</enum><text display-inline="yes-display-inline">the area depicted on the map entitled <quote>The Highlands Region</quote>, dated June 2004, updated after the date of enactment of the <short-title>Highlands Conservation Reauthorization Act of 2021</short-title> to comprise each municipality included on the list of municipalities included in the Highlands region as of that date of enactment, and maintained in the headquarters of the Forest Service in Washington, District of Columbia; and</text></subparagraph><subparagraph id="HE6444B7A82A54458A8CFD394E09BB63A"><enum>(B)</enum><text display-inline="yes-display-inline">a municipality approved by the Director of the United States Fish and Wildlife Service under section 4(e).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEEE95777F1E84D9DA16C9FBCF72FDE1E"><enum>(B)</enum><text>in paragraph (3), by amending subparagraph (B) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H05A78D7764E64791A7FE1807CDA0571B"><subparagraph id="HFD6D55EABDA44FE383E683389AD2EDFE"><enum>(B)</enum><text display-inline="yes-display-inline">identified by a Highlands State as having high conservation value using the best available science and geographic information systems; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H27CEF1D98A6242B2A3893B9D87BBFD10"><enum>(C)</enum><text>in paragraph (4)(A), by striking <quote>; or</quote> and inserting <quote>, including a political subdivision thereof; or</quote>; and</text></subparagraph><subparagraph id="H8F611A26B3D2457096B667A319DB72A0"><enum>(D)</enum><text>by striking paragraphs (5) through (7);</text></subparagraph></paragraph><paragraph id="HD46FD451B5A046149B2777F0C46AE98B"><enum>(2)</enum><text>in section 4—</text><subparagraph id="HAF9CABA33F004F90A6C202B7E4F44B83"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>in the Study</quote> and all that follows through the end of the paragraph and inserting <quote>using the best available science and geographic information systems; and</quote>;</text></subparagraph><subparagraph id="H6E8AECE8FC8340C29D5BCB7CEC8A372E"><enum>(B)</enum><text>in subsection (c), by amending paragraph (5) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFDFFDE8039034F199EDC7DED5A23FB45"><paragraph id="HFC54B30F599A4410B8341465EF68C66C"><enum>(5)</enum><text display-inline="yes-display-inline">provides that land conservation partnership projects will be consistent with areas identified as having high conservation value in accordance with the purposes described in section 2 in the Highlands region.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H10AB4F617E074D99ACF916C003C5E09C"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>$10,000,000 for each of fiscal years 2005 through 2021</quote> and inserting <quote>$20,000,000 for each of fiscal years 2022 through 2028</quote>;</text></subparagraph><subparagraph id="H2FAAA549BC7245F599C27218469540E6"><enum>(D)</enum><text>by redesignating subsection (e) as subsection (g); and</text></subparagraph><subparagraph id="H8DA782D804FB4B9B9BAAEA5F4679476E"><enum>(E)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB4D5C645AC494B4EA10DFFC7CBE4C7E4"><subsection id="HD29D71CA72594F3FB0EF7BD5BA0BD43E"><enum>(e)</enum><header>Request for inclusion of additional municipality</header><text display-inline="yes-display-inline">The Director of the United States Fish and Wildlife Service may, at the request of a Highlands State, approve the inclusion of a municipality within the State as part of the Highlands region.</text></subsection><subsection id="H34AB992B4EE343A5816BA11A026A6E39"><enum>(f)</enum><header>Limitation on administrative expenses</header><paragraph id="H6D7476415F4542D3812D47C47E2BAE8A"><enum>(1)</enum><header>Federal administration</header><text display-inline="yes-display-inline">The Secretary of the Interior may not expend more than $300,000 for the administration of this Act in each fiscal year.</text></paragraph><paragraph id="H87709EA6D90A4735A2BCB9A418241317"><enum>(2)</enum><header>State administration</header><text>A State that receives funds under this section for a land conservation partnership project may not use more than 5 percent of the funds to administer the land conservation partnership project.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H09D9C8D9D559499C983EDBDF4ED4A0B0"><enum>(3)</enum><text>in section 5—</text><subparagraph id="HB56D2A65E3E04389812C219774D36D1B"><enum>(A)</enum><text>in subsection (a), by striking <quote>the Study, Update, and any future study that the Forest Service may undertake in</quote>;</text></subparagraph><subparagraph id="HD6A5EFDC8C1D4397957B527D2239EC5E"><enum>(B)</enum><text>in subsection (b)—</text><clause id="H5F7FDB3014C14F2281E6DE8891DE3FFA"><enum>(i)</enum><text>in paragraph (1), by striking <quote>, including a Pennsylvania and Connecticut Update</quote>; and</text></clause><clause id="H375E683A559B4F27BD6EFEB3584A4CE8"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>the findings</quote> and all that follows through the end of the paragraph and inserting <quote>with stakeholders regarding implementation of the program; and</quote>; and</text></clause></subparagraph><subparagraph id="H689A6FFBE0674DF5956DBB926FCFEF92"><enum>(C)</enum><text>in subsection (c), by striking <quote>2005 through 2014</quote> and inserting <quote>2022 through 2028</quote>; and</text></subparagraph></paragraph><paragraph id="HA663CE9ECBB34C6DB566AE418D4C93EE"><enum>(4)</enum><text>in section 6, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H61668CD2C2C04969A8BD2077970E7405"><subsection id="H1ABAC69EA72E40AB8354E7858C92171B"><enum>(f)</enum><header>Appraisal methodology</header><paragraph id="H59685A1D424245D1A86F9B63DB644AF0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to an appraisal related to a land acquisition carried out under this Act, a Highlands State may use an appraisal methodology approved by the Secretary of the Interior.</text></paragraph><paragraph id="HA344C99B5D7E4DC8BD83BB878D388495"><enum>(2)</enum><header>Alternative appraisal methodology</header><text display-inline="yes-display-inline">A Highlands State may petition the Secretary of the Interior to consider an alternative appraisal methodology when there is a conflict, in any Highlands State, between—</text><subparagraph id="HF001A2C7C34144B785B1D3552E1EB058"><enum>(A)</enum><text display-inline="yes-display-inline">an appraisal methodology approved by the Secretary of the Interior under paragraph (1); and</text></subparagraph><subparagraph id="HB338F532D2A04D8884915676FD29E5F5"><enum>(B)</enum><text display-inline="yes-display-inline">applicable State law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
