which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to modify the authority for pay and work schedules of border patrol agents, and for other purposes.</official-title></form><legis-body id="H6C04F8455056467183272646BC61F948" style="OLC"><section id="HB1A4E5CBCD2A4EF5A13524D89B144BC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Agent Pay Reform Amendments Act of 2021</short-title></quote>.</text></section><section id="H794A05B0973B41C4BF7C2B077AB1454D"><enum>2.</enum><header>Amendments to the Border Patrol Agent Pay Reform Act of 2014</header><subsection id="HB913912E3987401F81C9BC1ECA1CEC11"><enum>(a)</enum><header>Border patrol agent pay</header><text display-inline="yes-display-inline">Section 5550 of title 5, United States Code, is amended—</text><paragraph id="H9F8C8131E2174B1FBBC9FA580F6336C4"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by inserting <quote>agent</quote> after <quote>applicable border patrol</quote>;</text></paragraph><paragraph id="H0F95FC2DEECB4C4DAC531A7521A78441"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text><subparagraph id="H4E323B1141584E3A89246417981A250B"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>Not later than 30 days before the first day of each year beginning after the date of enactment of this section, a border patrol agent shall make an election whether the border patrol agent shall, for that year, be assigned to</quote> and inserting <quote>Not later than December 1 of each year, a border patrol agent shall make an election whether the border patrol agent shall, for the next annual period beginning on the first day of the first pay period that commences on or after January 1, be assigned to</quote>;</text></subparagraph><subparagraph id="HA69CD2F9564E4000B7D89CB21A2AB907"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>Not later than 60 days before the first day of each year beginning after the date of enactment of this section</quote> and inserting in its place <quote>Not later than November 1 of each year</quote>;</text></subparagraph><subparagraph id="H80C4CC1512D343BBB0311549F27C95CD"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text><clause id="H1D7520C60B064736B5ABF1D6052926C4"><enum>(i)</enum><text>by amending clause (iv) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HD1B961C5320848D9B00B55B221436FBC" style="OLC"><clause id="HC5C57B64BB694B1F9C9A66C86C805670"><enum>(iv)</enum><text display-inline="yes-display-inline">a border patrol agent shall be assigned a basic border patrol rate of pay during the period of initial training (including initial orientation sessions, basic training, and other preparatory activities) prior to the agent’s first regular work assignment; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H4089C34F9DBE4C13BCDF8E16FB3165FB"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (v), by striking <quote>or the level 2 border patrol rate of pay</quote>;</text></clause></subparagraph><subparagraph id="HE49D06500E564702A177911DF236504D"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (E)—</text><clause id="H8C0F9703E66946C1906718E4763D94E5"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>or the level 2 border patrol rate of pay</quote>;</text></clause><clause id="HE35829F044DE40B98714962C58E32747"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>the analysis conducted under section 2(e) of the Border Patrol Agent Pay Reform Act of 2014</quote> and inserting in its place <quote>a written staffing analysis</quote>; and</text></clause><clause id="HB8D61A6294024A8BB9A34CDCBDE48B3F"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3D7F28473F7E49DF9B44BDD5B509B9C3" style="OLC"><clause id="H0BB723AF65654EE7B6356108A256A496"><enum>(iv)</enum><header>Exclusion of certain employees</header><text display-inline="yes-display-inline">In applying any percentage limit under clause (i) or (ii) to a location population, U.S. Customs and Border Protection shall exclude from such population any border patrol agent who is assigned a basic border patrol rate of pay under subparagraph (D)(iii) or (D)(iv) or who would reach the premium pay cap under section 5547 if assigned a level 1 border patrol rate of pay.</text></clause><clause id="H7A6C9520116441BA8C942018D0BCA6F1"><enum>(v)</enum><header>Application frequency</header><text display-inline="yes-display-inline">The 10 percent limit under clause (i) or an alternative percentage limit under a waiver under clause (ii) shall be applied at the beginning of the first pay period beginning on or after January 1 each year.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE1913099D51247E0AB5758EFAC0921F7"><enum>(E)</enum><text display-inline="yes-display-inline">by striking subparagraph (G);</text></subparagraph></paragraph><paragraph id="H3A57D077B5094E538019A31045AEEC3C"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)(2)—</text><subparagraph id="H11976AE7E1A64AEC8797529FEA8BC21D"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subparagraph (C)(i) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H976AA731E787466B87C0A2E8A36FCD5F" style="OLC"><clause id="H1794B7FA97EC4F78A6CDAA3439B7EC4F"><enum>(i)</enum><text display-inline="yes-display-inline">any compensation under this section or any other provision of law in addition to the compensation provided under subparagraph (B); or</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5A8CF4C76EB541A6B5343876EEDF26E2"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E)—</text><clause id="HAD10117A5D5D4C298895DEBFA79FD99B"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>paid leave</quote> and inserting <quote>leave</quote>; and</text></clause><clause id="HABA4573A06314E1FB7C7C7BBB9E5D302"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>absent from work</quote> and inserting <quote>excused from work</quote>;</text></clause></subparagraph><subparagraph id="H79E5AF9EA6404280B83A47E1E371140E"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (F)(ii), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="H3647C9F50F2C453D8C271F8CE649927E"><enum>(D)</enum><text display-inline="yes-display-inline">by amending subparagraph (G) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4C7EC8FF5CF6483DB2DFB43AAF6B0580" style="OLC"><subparagraph id="HC2E0FAA6D81D4792B69CCE1C46981396"><enum>(G)</enum><text display-inline="yes-display-inline">if the border patrol agent participates in a full day of advanced training but does not perform the entire required amount of scheduled overtime work under subparagraph (A)(ii) on that day, the border patrol agent shall be deemed to have performed scheduled overtime work during nonwork periods to the extent necessary to reach the required amount, but such deemed credit may be applied to no more than 180 hours in a calendar year; otherwise, the agent shall accrue a debt of hours for scheduled overtime not worked on such a day; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEEA50E41A30D4A7A864EFFA8A1E3146D"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAED115DDDE6249DB872B1589F254D207" style="OLC"><subparagraph id="H1454F5E1C29649CC966D85E00E05E3C9"><enum>(H)</enum><text display-inline="yes-display-inline">a border patrol agent may choose to reduce any debt of obligated overtime hours that the agent has incurred by applying any accrued compensatory time off for travel pursuant to section 5550b, and such compensatory time off for travel may be applied towards such debt only after other forms of overtime or earned compensatory time credited to the border patrol agent have been exhausted.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0822ECDC6CBD406EA850C7967980D64C"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (b)(3)—</text><subparagraph id="HF13D8741797D4266806512265C5B0A7B"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subparagraph (C)(i) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H497A82F546774472B9324775FDAB2A9C" style="OLC"><clause id="H86AC297D656E4D1D889C5635C0325F3D"><enum>(i)</enum><text display-inline="yes-display-inline">any compensation under this section or any other provision of law in addition to the compensation provided under subparagraph (B); or</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB662161DABFF4B72A283601D3D05AE7B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>paid leave</quote> and inserting <quote>leave</quote>;</text></subparagraph><subparagraph id="H18D9350149A146EFB53484E2C2FBD558"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (F)(ii), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="H23CB8EB192AC46A3A03B558B337EB564"><enum>(D)</enum><text>by amending subparagraph (G) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6868B75417B848AFA519F57986C9D085" style="OLC"><subparagraph id="H67A576A08A46477F9CE23E0855849D18"><enum>(G)</enum><text display-inline="yes-display-inline">if the border patrol agent participates in a full day of advanced training but does not perform the entire required amount of scheduled overtime work under subparagraph (A)(ii) on that day, the border patrol agent shall be deemed to have performed scheduled overtime work during nonwork periods to the extent necessary to reach the required amount, but such deemed credit may be applied to no more than 90 hours in a calendar year; otherwise, the agent shall accrue a debt of hours for scheduled overtime not worked on such a day; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB50DFE23B8BD414F9E01EC842268DD5B"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA33D3F9E4B9A4B199EBFB5ECCAB61DCC" style="OLC"><subparagraph id="HDC44D462CF0346A091BBD8C8613437BE"><enum>(H)</enum><text display-inline="yes-display-inline">a border patrol agent may choose to reduce any debt of obligated overtime hours that the agent has incurred by applying any accrued compensatory time off for travel pursuant to section 5550b; such compensatory time off for travel may be applied towards such debt only after other forms of overtime or earned compensatory time credited to the border patrol agent have been exhausted.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC5F8960A1B764534B5BEF1797E131FDD"><enum>(5)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H75C62FACECBC409BB86C16677B800B2A" style="OLC"><subsection id="HBCAE78FD183849A99679E48A6E895A36"><enum>(d)</enum><header>Treatment as basic pay</header><paragraph id="H84DE428D412647D69DBD088E990E295F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any overtime supplement in addition to the basic border patrol rate of pay for a border patrol agent resulting from application of the level 1 border patrol rate of pay or the level 2 border patrol rate of pay shall be treated as part of basic pay only—</text><subparagraph id="HB5C5FE0D6AF946379B45B197034CD9D3"><enum>(A)</enum><text display-inline="yes-display-inline">except as otherwise provided in paragraph (3), for purposes of the definitions in section 8331(3) and 8401(4) and the provisions in chapters 83 and 84 that rely on those definitions (consistent with section 8331(3)(I));</text></subparagraph><subparagraph id="H49A9DDEAB6804EBC8C65F341A11945F3"><enum>(B)</enum><text display-inline="yes-display-inline">except as otherwise provided in paragraph (3), for purposes of sections 5595(c) and 8704(c);</text></subparagraph><subparagraph id="HBB97F7CAA87F4A368095830BE197ABA1"><enum>(C)</enum><text display-inline="yes-display-inline">for the purpose of section 8114(e); and</text></subparagraph><subparagraph id="H52F9767666584F72A46771F5DF4684D5"><enum>(D)</enum><text display-inline="yes-display-inline">subject to paragraph (2) and any limitation established under paragraph (3), any other purpose that the Director of the Office of Personnel Management may by regulation prescribe.</text></subparagraph></paragraph><paragraph id="H6AD600CE01034BD68B5D6A095F2FE124"><enum>(2)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The overtime supplement described in paragraph (1) shall not be treated as part of basic pay for purposes not covered by that paragraph, including the purposes of calculating—</text><subparagraph id="HF868627920B047A1AB13E1B913B83878"><enum>(A)</enum><text display-inline="yes-display-inline">overtime pay, night pay, Sunday pay, or holiday pay under section 5542, 5545, or 5546;</text></subparagraph><subparagraph id="H727ECEC04DB14762BC0EA09EC81E0AE3"><enum>(B)</enum><text display-inline="yes-display-inline">locality-based comparability payments under section 5304 or special rate supplements under section 5305; or</text></subparagraph><subparagraph id="H508B4CF39A5F48C79A818188F25E063F"><enum>(C)</enum><text display-inline="yes-display-inline">cost-of-living allowances in nonforeign areas under section 5941.</text></subparagraph></paragraph><paragraph id="HF02F441946E54673A14270313B6956F3"><enum>(3)</enum><header>Limitations</header><subparagraph id="HAC57FE4AA0A04773B6C7D9CC867B028B"><enum>(A)</enum><header>In general</header><text>During the control period described in subparagraph (B), the amount of the overtime supplement that is considered basic pay under paragraphs (1)(A) and (1)(B) may not exceed the amount derived by multiplying the border patrol agent’s basic border patrol rate of pay by the percentage representing the agent’s career average of assigned overtime supplement percentages (including 0 percent for periods of time during which no overtime supplement was payable). That career average percentage is computed without regard to the effect of the limitation on premium pay under section 5547, but the premium pay limitation remains applicable in determining the dollar amount of any overtime supplement computed using the career average percentage.</text></subparagraph><subparagraph id="H4DC613E7FAF94588A20549148C327785"><enum>(B)</enum><header>Control period</header><text display-inline="yes-display-inline">For the purposes of applying subparagraph (A), the control period described in this subparagraph is the period that begins 3 years before the date a border patrol agent will meet age and service requirements associated with entitlement to an immediate annuity and continues throughout the remainder of the individual’s career as a border patrol agent.</text></subparagraph><subparagraph id="H22B1999FB2FE40A8884EA59FDE0B8BF8"><enum>(C)</enum><header>Assigned overtime supplement percentages</header><text display-inline="yes-display-inline">For the purpose of applying subparagraph (A), a border patrol agent’s initial career average of assigned overtime supplement percentages is the average for the border patrol agent’s career (excluding any period of initial training prior to the agent’s first regular work assignment) prior to the beginning of the control period described in subparagraph (B). During such control period, the career average shall be recomputed at the end of each annual period (as described in subsection (b)(1)(A)). In computing such career average, any periods of service as a border patrol agent prior to the first day of the first pay period beginning on or after January 1, 2016, shall be included, and the agent’s assigned overtime supplement during such periods shall be deemed to be 25 percent.</text></subparagraph></paragraph><paragraph id="H5F59FF6A0530474DA2300E4433B61F85"><enum>(4)</enum><header>Annual leave payment</header><text display-inline="yes-display-inline">For the purpose of computing an agent’s lump-sum annual leave payment under section 5551 or 5552, the pay the agent is projected to receive shall include a deemed overtime supplement derived under this paragraph. Such overtime supplement shall be based on the lower of the agent’s actual overtime supplement percentage in effect at separation or the average percentage of the agent’s overtime supplement over the 26 full biweekly pay periods immediately preceding that separation, and shall not exceed the amount that is or would be payable under the premium pay limitation in section 5547.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HBA132A83B5494BE19B0A41C1A27DE9EB"><enum>(6)</enum><text>in subsection (f)—</text><subparagraph commented="no" id="H9A350A78245F430996FD451C0CE321CC"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading of such subsection, by striking <quote><header-in-text level="subsection" style="USC">and substitution of hours</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">during regular time; absences during scheduled overtime</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" id="H3077FCB8D2354A149F11A2B3666B6782"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD1485FF4CBD24A91A4BE6EF07D7A7A0C" style="OLC"><paragraph commented="no" id="H029069C95F1243E490B5D34D1652BF24"><enum>(5)</enum><header>Application</header><subparagraph commented="no" id="H5E99342ADDD54857B82F7E3F9AB73D68"><enum>(A)</enum><header>Limitation on substitution</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), scheduled overtime (as described in paragraph (2)(A)(ii) or (3)(A)(ii) of subsection (b)) may not be substituted for leave without pay on a day when a border patrol agent has a full day of leave without pay.</text></subparagraph><subparagraph commented="no" id="HEDBC25007F8D494CBB7F93FDE5E1F647"><enum>(B)</enum><header>Leave without pay</header><text display-inline="yes-display-inline">As provided in paragraphs (2)(A)(ii) and (3)(A)(ii) of subsection (b), a border patrol agent shall incur no scheduled overtime obligation on a day when the agent has a full day of leave without pay.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H565977A99D8A4F6AB4DADD1D3CDBE6BE"><enum>(7)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD540FAB6C49544F5BCD8AEE2484EFCD5" style="OLC"><subsection id="HDA59CB0FCA45443EA1719F56ACB75E8F"><enum>(h)</enum><header>Alternative work schedules</header><paragraph id="H96A32F406BEC4DC699B8715EB73D83EC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision in this section or section 6101, U.S. Customs and Border Protection may assign a border patrol agent an alternative work schedule as described in this subsection, subject to any regulations prescribed by the Director of the Office of Personnel Management. No alternative work schedule may be established under subchapter II of chapter 61.</text></paragraph><paragraph id="HB2A4777FCE9A497ABE9FD0DD0713EBDB"><enum>(2)</enum><header>Level 2 border patrol agent</header><text display-inline="yes-display-inline">A border patrol agent receiving a level 2 border patrol rate of pay may, in lieu of the standard work schedule described in subsection (b)(3)(A), be assigned to an alternative work schedule under the following terms and conditions:</text><subparagraph id="H57A5BF9A74444E5882A2CBC04C762FBE"><enum>(A)</enum><text display-inline="yes-display-inline">The alternative work schedule shall be a regular tour of duty consisting of 9 workdays per biweekly pay period, with—</text><clause id="H99E9885F043743CC8FB8DC7B088E59A2"><enum>(i)</enum><text display-inline="yes-display-inline">8 workdays including 9 hours of regular time per workday and 1 additional hour of scheduled overtime for each day the agent performs work during regular time; and</text></clause><clause id="H9FF7ED5D935043A2BC5DEBD9AFAE9C38"><enum>(ii)</enum><text display-inline="yes-display-inline">1 workday including 8 hours of regular time per workday and 2 additional hours of scheduled overtime when the agent performs work during such regular time.</text></clause></subparagraph><subparagraph id="HDD5612E776204EAC93E6188BB1677ADB"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraphs (B) through (H) of subsection (b)(3) shall continue to apply to an agent assigned to an alternative work schedule under this paragraph. References in this section to regular time under subsection (b)(3)(A)(i) and scheduled overtime under subsection (b)(3)(A)(ii) shall be deemed to be references to regular time and scheduled overtime described in subparagraph (A), respectively.</text></subparagraph></paragraph><paragraph id="HD0D03B38EA4749C08435EE8B08B2859C"><enum>(3)</enum><header>Basic border patrol agent</header><text display-inline="yes-display-inline">A border patrol agent receiving a basic border patrol rate of pay may, in lieu of the standard work schedule described in subsection (b)(4)(A), be assigned to an alternative work schedule that is a regular tour of duty consisting of 4 workdays per week with 10 hours of regular time per workday.</text></paragraph><paragraph id="H289A6FBF3F5744C7A3E9827242C5BADC"><enum>(4)</enum><header>Sunday pay; premium pay</header><text display-inline="yes-display-inline">A border patrol agent assigned to an alternative work schedule under this subsection, may receive, as applicable—</text><subparagraph id="HFAD79CDB5848422FB0FED6C1475949BC"><enum>(A)</enum><text display-inline="yes-display-inline">Sunday pay for no more than 8 hours of regular time associated with a given Sunday, consistent with section 5546(a);</text></subparagraph><subparagraph id="HAFD068F6BBE34113A41A864E4DC364F6"><enum>(B)</enum><text display-inline="yes-display-inline">premium pay for work on a holiday for no more than 8 hours of regular time associated with a given holiday, consistent with section 5546(b); and</text></subparagraph><subparagraph id="H23A8DFFF05DB4641B1DE7C7BA93E2A2E"><enum>(C)</enum><text display-inline="yes-display-inline">basic pay for all regular time hours that qualify for holiday time off pay when an agent is relieved or prevented from working during such regular time on a day designated as a holiday by Federal statute or Executive order.</text></subparagraph></paragraph><paragraph id="HD2EBC7187F35401E9CBAC11DBB495A96"><enum>(5)</enum><header>Application</header><text display-inline="yes-display-inline">For purposes of administering sections 6303(a), 6304, 6307(a) and (d), 6323, 6326, 6327, and 8339(m), in the case of an employee assigned to an alternative work schedule under this subsection, references to a day or workday (or to multiples or parts thereof) contained in such sections shall be considered to be references to 8 hours (or to the respective multiples or parts thereof).</text></paragraph></subsection><subsection id="H0BEFB7B010304AAAA83D6E5EA77691EF"><enum>(i)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall promulgate regulations to carry out this section, including regulations governing—</text><paragraph id="H1FE0856E17D6470B83333AC6C2AA64F5"><enum>(1)</enum><text display-inline="yes-display-inline">elections and assignments of a border patrol rate of pay for newly hired border patrol agents who complete initial training during an annual period;</text></paragraph><paragraph id="H5A40F969129743688DA5DDD0A65F807F"><enum>(2)</enum><text display-inline="yes-display-inline">situations in which an agent receives more than one type of border patrol rate of pay in a biweekly pay period or is employed as a border patrol agent for only part of a biweekly pay period; and</text></paragraph><paragraph id="H60D22899DF64411F80BF92E2A9BBB777"><enum>(3)</enum><text display-inline="yes-display-inline">the treatment of hours that are substituted for nonpay status hours during regular time.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA22D15CC9DC14F91B4061BB38FEA48BB"><enum>(b)</enum><header>Overtime rates</header><text display-inline="yes-display-inline">Section 5542(g)(5) of title 5, United States Code, is amended—</text><paragraph id="HB6B32E40E4A24066A759D6CA3781153A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>leave year</quote> and inserting <quote>an annual period, as described in section 5550(b)(1)(A)</quote>; and</text></paragraph><paragraph id="H4972E93C58A748C688DF6CAABE3AA517"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subparagraph (E) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H5349D8D6FAB84B5193282DE29A2B8C3F" style="USC"><subparagraph id="H004ED4A5E1394DB181533E17DCFF629F"><enum>(E)</enum><text display-inline="yes-display-inline">shall not receive credit towards computation of the border patrol agent’s annuity based on unused compensatory time off; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H58F4713620524B179A68ACA915C1B423"><enum>(c)</enum><header>Premium pay cap</header><text display-inline="yes-display-inline">Section 5547(c) of title 5, United States Code, is amended by inserting after <quote>duty,</quote> the following: <quote>or to border patrol agents who receive an overtime supplement for overtime hours within their regular tour of duty under section 5550,</quote>.</text></subsection><subsection id="HEAA8CAED618244E89CA2B75432433B57"><enum>(d)</enum><header>Basic pay for retirement</header><text display-inline="yes-display-inline">Section 8331(3)(I) of title 5, United States Code, is amended by adding before the semicolon at the end the following: <quote>, subject to the limitation prescribed in section 5550(d)(3)</quote>.</text></subsection><subsection id="HEA7737228B49401EBE7BF6A90E616227"><enum>(e)</enum><header>Scheduled overtime work</header><text display-inline="yes-display-inline">Section 2(c)(2) of the Border Patrol Agent Pay Reform Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/277">Public Law 113–277</external-xref>) is amended by inserting after <quote>scheduled overtime work</quote> the following: <quote>(other than scheduled overtime work within the regular tour of duty)</quote>.</text></subsection></section><section display-inline="no-display-inline" id="H4A3581C65DD3451C84679AAF8DDFE3B7" section-type="subsequent-section"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by section 2 shall take effect on the first day of the first pay period beginning on or after the day that is 90 days after the date of the enactment of this Act.</text></section></legis-body></bill>
