which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Pittman-Robertson Wildlife Restoration Act to make supplemental funds available for management of fish and wildlife species of greatest conservation need as determined by State fish and wildlife agencies, and for other purposes.</official-title></form><legis-body id="HCCB59579280441F4A5000BEFA3F83D9D" style="OLC"><section id="H9BAC63030AD24FFD8E7467AB014F2287" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recovering America’s Wildlife Act of 2021</short-title></quote>. </text></section><title id="H7E7422449F754FD69AF1D97633496DE3"><enum>I</enum><header>Wildlife Conservation and Restoration</header><section id="H575000C2D397485F84894CAD8324BBEE"><enum>101.</enum><header>Wildlife conservation and restoration subaccount</header><subsection id="HE2813ADA8FD24779B890369FC63371FC"><enum>(a)</enum><header>In general</header><text>Section 3 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669b">16 U.S.C. 669b</external-xref>) is amended in subsection (c)—</text><paragraph id="H67F62ED7D19941EAA07CA7A92F2BB915"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (9) and (10); and</text></paragraph><paragraph id="H6968F39B727E4E87B92B493BE692A725"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block id="H4D8453659616428EA867AD140D26E285" style="OLC"><paragraph id="H33F04BF8C0FE416B91C0FAD5710533CD"><enum>(1)</enum><header>Establishment of subaccount</header><subparagraph id="H3007115D518D4C9886C09B233ADC55F1"><enum>(A)</enum><header>In general</header><text>There is established in the fund a subaccount to be known as the <quote>Wildlife Conservation and Restoration Subaccount</quote> (referred to in this section as the <quote>Subaccount</quote>).</text></subparagraph><subparagraph id="H6E0782DD609049E0A2B82156E2E3C84B"><enum>(B)</enum><header>Availability</header><text>Amounts in the Subaccount shall be available without further appropriation, for each fiscal year, for apportionment in accordance with this Act.</text></subparagraph><subparagraph id="HA063E8E6CE324588A348E67FDB3FAC26"><enum>(C)</enum><header>Deposits into subaccount</header><text>Beginning in fiscal year 2022, the Secretary of the Treasury shall transfer $1,300,000,000 from the general fund of the treasury each fiscal year to the fund for deposit in the Subaccount.</text></subparagraph></paragraph><paragraph id="H10EA1637B723426A882015054144E9C7"><enum>(2)</enum><header>Supplement not supplant</header><text>Amounts transferred to the Subaccount shall supplement, but not replace, existing funds available to the States from—</text><subparagraph id="HE6DF55C48E8145C59CABEFC69BB526F3"><enum>(A)</enum><text>the funds distributed pursuant to the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777">16 U.S.C. 777</external-xref> et seq.); and</text></subparagraph><subparagraph id="H186A2A3A554B47CD982CAAB6DBACA297"><enum>(B)</enum><text>the fund.</text></subparagraph></paragraph><paragraph id="HCAE7DA8CB8104031A61DDD5C4510592A"><enum>(3)</enum><header>Innovation grants</header><subparagraph id="H67C830FE553342CD8E01262030A76071"><enum>(A)</enum><header>In general</header><text>The Secretary shall distribute 10 percent of funds apportioned from the Subaccount through a competitive grant program to State fish and wildlife departments, the District of Columbia fish and wildlife department, fish and wildlife departments of territories, or to regional associations of fish and wildlife departments (or any group composed of more than 1 such entity).</text></subparagraph><subparagraph id="H4649F8D7498C4243ACE7C4F3F1852C6F"><enum>(B)</enum><header>Purpose</header><text>Such grants shall be provided for the purpose of catalyzing innovation of techniques, tools, strategies, or collaborative partnerships that accelerate, expand, or replicate effective and measurable recovery efforts for species of greatest conservation need and species listed under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/15/1531">15 U.S.C. 1531</external-xref> et seq.) and the habitats of such species.</text></subparagraph><subparagraph id="H7FD43EE5D5BF4A75916DC4DE7462A5CB"><enum>(C)</enum><header>Review committee</header><text>The Secretary shall appoint a review committee comprised of—</text><clause id="H9C424EEC6D144119AD5FF58F5F5FDFAD"><enum>(i)</enum><text>a State Director from each regional association of State fish and wildlife departments;</text></clause><clause id="HC4364A28E52A486681977409157759D7"><enum>(ii)</enum><text>the head of a department responsible for fish and wildlife management in a territory; and</text></clause><clause id="HB524056492214847ACABBB9CF3831EBB"><enum>(iii)</enum><text>four individuals representing four different nonprofit organizations each of which is actively participating in carrying out wildlife conservation restoration activities using funds apportioned from the Subaccount.</text></clause></subparagraph><subparagraph id="HF336255E44FD40B28ABB5E1774682759"><enum>(D)</enum><header>Support from united states fish and wildlife service</header><text>The United States Fish and Wildlife Service shall provide any personnel or administrative support services necessary for such Committee to carry out its responsibilities under this Act.</text></subparagraph><subparagraph id="H882B67EE26B74F1A8D7877CEB151939C"><enum>(E)</enum><header>Evaluation</header><text>Such committee shall evaluate each proposal submitted under this paragraph and recommend projects for funding, giving preference to solutions that accelerate the recovery of species identified as priorities through regional scientific assessments of species of greatest conservation need.</text></subparagraph></paragraph><paragraph id="HF4907184D9CC43558E278E24DB71086B"><enum>(4)</enum><header>Use of funds</header><text>Funds apportioned from the Subaccount—</text><subparagraph id="HF8D708FB15C94371A6F53D2E7FE1B337"><enum>(A)</enum><text>shall be used to implement the Wildlife Conservation Strategy of a State, territory, or the District of Columbia, as required under section 4(d), by carrying out, revising, or enhancing existing wildlife and habitat conservation and restoration programs and developing and implementing new wildlife conservation and restoration programs to recover and manage species of greatest conservation need and the key habitats and plant community types essential to the conservation of those species as determined by the appropriate State fish and wildlife department;</text></subparagraph><subparagraph id="H90FEF70986434874A0B183E1BD27040D"><enum>(B)</enum><text>shall be used to develop, revise, and enhance the Wildlife Conservation Strategy of a State, territory, or the District of Columbia, as may be required by this Act;</text></subparagraph><subparagraph id="H32D71BD748BD426EB329325244E0DC04"><enum>(C)</enum><text>shall be used to assist in the recovery of species found in the State, territory, or the District of Columbia that are listed as endangered species, threatened species, candidate species or species proposed for listing, or species petitioned for listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) or under State law;</text></subparagraph><subparagraph id="H985620D424E24D56A711DE6857B19C6F"><enum>(D)</enum><text display-inline="yes-display-inline">may be used for wildlife conservation education and wildlife-associated recreation projects, especially in historically underserved communities;</text></subparagraph><subparagraph id="H9C74240D66C94000B6BBAFDD29B19174"><enum>(E)</enum><text>may be used to manage a species of greatest conservation need whose range is shared with another State, territory, Indian Tribe, or foreign government and for the conservation of the habitat of such species;</text></subparagraph><subparagraph id="H8E06129A9D98488FAEB7411686D5DA28"><enum>(F)</enum><text>may be used to manage, control, and prevent invasive species, disease, and other risks to species of greatest conservation need; and</text></subparagraph><subparagraph id="HFE17312163C14334AC77DB4D9C2C0B6A"><enum>(G)</enum><text>may be used for law enforcement activities that are directly related to the protection and conservation of a species of greatest conservation need and the habitat of such species.</text></subparagraph></paragraph><paragraph id="H337B3A021D27431C8D0DA6713A3336D8"><enum>(5)</enum><header>Minimum required spending for endangered species recovery</header><text>Not less than an average of 15 percent over a 5-year period of amounts apportioned to a State, territory, or the District of Columbia from the Subaccount shall be used for purposes described in paragraph (4)(C). The Secretary may reduce the minimum requirement of a State, territory, or the District of Columbia on an annual basis if the Secretary determines that the State, territory, or the District of Columbia is meeting the conservation and recovery needs of all species described in paragraph (4)(C).</text></paragraph><paragraph id="H487A1DDFA6ED4075BB4EA0BAF735DF55"><enum>(6)</enum><header>Public access to private lands not required</header><text>Funds apportioned from the Subaccount shall not be conditioned upon the provision of public access to private lands, waters, or holdings.</text></paragraph><paragraph id="H1FF9B9CF566D4F5888ED2F0FE5258308"><enum>(7)</enum><header>Requirements for matching funds</header><subparagraph id="H7AADEEA37599418F8A88FDF9C12299B5"><enum>(A)</enum><text display-inline="yes-display-inline">For the purposes of the non-Federal fund matching requirement for a wildlife conservation or restoration program or project funded by the Subaccount, a State, territory, or the District of Columbia may use as matching non-Federal funds—</text><clause id="H4382426F6829437093A7CE4813A028F4"><enum>(i)</enum><text>funds from Federal agencies other than the Department of the Interior and the Department of Agriculture;</text></clause><clause id="HD7352BF1F4334A3F9C3C4900BFEA0023"><enum>(ii)</enum><text>donated private lands and waters, including privately owned easements;</text></clause><clause id="H9D2A056AAA6E4ABF86480DB27715E2FF"><enum>(iii)</enum><text>in circumstances described in subparagraph (B), revenue generated through the sale of State hunting and fishing licenses; and</text></clause><clause id="H12CAE655ABB845F0B3D2591968561156"><enum>(iv)</enum><text>other sources consistent with part 80 of title 50, Code of Federal Regulations, in effect on the date of enactment of the Recovering America’s Wildlife Act of 2021.</text></clause></subparagraph><subparagraph id="H3A77B8D72E6C4647B0A418E252E8D181"><enum>(B)</enum><text>Revenue described in subparagraph (A)(iii) may only be used to fulfill the requirements of such non-Federal fund matching requirement if—</text><clause id="HE2218883334E49918D047A8B1C12BCEA"><enum>(i)</enum><text>no Federal funds apportioned to the State fish and wildlife department of such State from the Wildlife Restoration Program or the Sport Fish Restoration Program have been reverted because of a failure to fulfill such non-Federal fund matching requirement by such State during the previous 2 years; and</text></clause><clause id="H770CBDDC81E149D68FCD8EAACA53C531"><enum>(ii)</enum><text>the project or program being funded benefits the habitat of a hunted or fished species and a species of greatest conservation need.</text></clause></subparagraph></paragraph><paragraph id="H1B77F9082B1A4ECDB6ADA274367A34F8"><enum>(8)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text><subparagraph id="H1ECD692E69CA424188777A058634518A"><enum>(A)</enum><header>Partnerships</header><text display-inline="yes-display-inline">The term <quote>partnerships</quote> may include collaborative efforts with Federal agencies, State agencies, local agencies, Indian Tribes, nonprofit organizations, academic institutions, industry groups, and private individuals to implement a State’s Wildlife Conservation Strategy.</text></subparagraph><subparagraph id="HAFA638B635EC4747959FCC10E6F305B6"><enum>(B)</enum><header>Species of greatest conservation need</header><text display-inline="yes-display-inline">The term ‘species of greatest conservation need’ may be fauna or flora, and may include terrestrial, aquatic, marine, and invertebrate species that are of low population, declining, rare, or facing threats and in need of conservation attention, as determined by each State fish and wildlife department, with respect to funds apportioned to such State.</text></subparagraph><subparagraph id="HD077AD30DFDF437FA1D7E741A9AEFE08"><enum>(C)</enum><header>Territory and territories</header><text>The terms <term>territory</term> and <term>territories</term> mean the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></subparagraph><subparagraph id="H2A3C3763017942F9AC8B0A0852DE5CC7"><enum>(D)</enum><header>Wildlife</header><text>The term <term>wildlife</term> means any species of wild, freeranging fauna, including fish, and also fauna in captive breeding programs the object of which is to reintroduce individuals of a depleted indigenous species into previously occupied range.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFE62AD8D67A84076A4FBE2B5205C6F90"><enum>(b)</enum><header>Allocation and Apportionment of available amounts</header><text>Section 4 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669c">16 U.S.C. 669c</external-xref>) is amended—</text><paragraph id="H7A75837A9331442088E05BC37C799759"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H9E3C7E8211724CAA89B34F47B2646165"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H0FEC7066AD3B408AA57777194F7B5A76"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>to the District of Columbia and to the Commonwealth of Puerto Rico, each</quote> and inserting <quote>To the District of Columbia</quote>;</text></clause><clause id="H87CCEE75639242ACBCC75674C90D94A7"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="HE6D8CADB674043BAAC820DBA6ED9C7F3"><enum>(I)</enum><text>by striking <quote>to Guam</quote> and inserting <quote>To Guam</quote>; and</text></subclause><subclause id="H3DDEDF56B02B4ECAAD8AF23D752BDFD7"><enum>(II)</enum><text>by striking <quote>not more than one-fourth of one percent</quote> and inserting <quote>not less than one-third of one percent</quote>; and</text></subclause></clause><clause id="H9C269558D24F4945BC11189CE1D093C0"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block id="HB193616B782346D7A16404FB5D42880D" style="OLC"><subparagraph id="H52C5D4E755DF4659900ED74A9C692D24"><enum>(C)</enum><text>To the Commonwealth of Puerto Rico, a sum equal to not less than 1 percent thereof.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H2975FE2A622740199EF4B3470B8A41AA"><enum>(B)</enum><text>in paragraph (2)(A)—</text><clause id="H5B172F547B85442A9A91595729782B2A"><enum>(i)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" id="HE48B748FBF1543DBB5D5856D8B4E4FA2" display-inline="no-display-inline"><clause id="HDACBF6AB15C4455ABA7374394F8E7CDC" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">one-half of which is based on the ratio to which the land and water area of such State bears to the total land and water area of all such States;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H0EDBB14B32D14A3F936E6B13287FEB14"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="H26E99EB608644216B78C0B3F2CCF412E"><enum>(I)</enum><text>by striking <quote>two-thirds</quote> and inserting <quote>one-quarter</quote>; and</text></subclause><subclause id="H7C5F9C3C1C6340F9B6AB723844085F0B"><enum>(II)</enum><text>by striking the period and inserting <quote>; and</quote>; and </text></subclause></clause><clause id="H124C5CE978B94691A1ACD85CAFC359D2"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block id="H6BDBDA77326D48D3A763531F31418027" style="OLC"><clause id="HD11F5F54EA074A659862921D628851FC" indent="up1"><enum>(iii)</enum><text>one-quarter of which is based upon the ratio to which the number of species listed as endangered or threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/15/1531">15 U.S.C. 1531</external-xref> et seq.) in such State bears to the total number of such species listed in all such States.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H3C901CA451384592AD4AF6885D2D89EE"><enum>(C)</enum><text display-inline="yes-display-inline">by amending paragraph (2)(B) to read as follows:</text><quoted-block style="OLC" id="HBF534F4DCA944FE6A04B23DFACAFAA0C" display-inline="no-display-inline"><subparagraph id="HA06B3B8E0A3D484E9FE559302DD2A458"><enum>(B)</enum><text display-inline="yes-display-inline">The amounts apportioned under this paragraph shall be adjusted equitably so that no such State, unless otherwise designated, shall be apportioned a sum which is less than 1 percent or more than 5 percent of the amount available for apportionment under—</text><clause id="HCFF9BFBBDADF42B6B0F98806523D4109"><enum>(i)</enum><text display-inline="yes-display-inline">subparagraph (A)(i);</text></clause><clause id="H2695DF54488148558F96A487E1600153"><enum>(ii)</enum><text>subparagraph (A)(ii); and</text></clause><clause id="HBD69CBF8291A4C35B5337C209484D780"><enum>(iii)</enum><text>the overall amount available for subparagraph (A).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HCF272ABCBEFE4FF982B79026645B7FC1"><enum>(D)</enum><text>in paragraph (3), by striking <quote>3 percent</quote> and inserting <quote>1.85 percent</quote>; and</text></subparagraph></paragraph><paragraph id="H959EB64ECB39478CAE60D918E1433869"><enum>(2)</enum><text>in subsection (e)(4), as redesignated—</text><subparagraph id="HF8B04FC20ADA4A879EC6038BCFC32CB3"><enum>(A)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block id="H5ADE8FD10A964789A069B53ACCBD505C" style="OLC"><subparagraph id="HCEE67694040D42B78EC8A11163F93472" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not more than an average of 15 percent over a 5-year period of amounts apportioned to each State, territory, or the District of Columbia under this section for a wildlife conservation and restoration program may be used for wildlife conservation education and wildlife-associated recreation.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HEFF904129DAB45AA8858B5F6BBA81735"><enum>(B)</enum><text>by inserting after subparagraph (B), as so amended, the following:</text><quoted-block style="OLC" id="H87824DF386E54C2198C05F63DB420D85" display-inline="no-display-inline"><subparagraph id="H34976303FE064BD4872D1A810F2E0C2B"><enum>(C)</enum><text display-inline="yes-display-inline">$55 million shall be reserved for states and territories that include plants among their species of greatest conservation need and in the conservation planning and habitat prioritization efforts of their Wildlife Conservation Strategy. Each eligible State, territory, or the District of Columbia shall receive an additional 5 percent of their apportioned amount. Any unallocated resources shall be allocated proportionally among all states and territories under the formulas of this section. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8E4C212E0AE046E4AD4B7C590F913545"><enum>(3)</enum><text>by adding at the end following:</text><quoted-block id="H7227A7DD10754A8C855DE3C9C9A4EC76" style="OLC"><subsection id="H1E7A8DD747A14958AD5C41A9404203BC"><enum>(f)</enum><header>Minimization of planning and reporting</header><text>Nothing in this Act shall be interpreted to require a State to create a comprehensive strategy related to conservation education or outdoor recreation.</text></subsection><subsection id="H59163BFAF8F14BB7AEB6E21651B05FDB"><enum>(g)</enum><header>Accountability</header><text>Not more than one year after the date of enactment of the Recovering America’s Wildlife Act of 2021 and every 3 years thereafter, each State fish and wildlife department shall submit a 3-year work plan and budget for implementing its Wildlife Conservation Strategy and a report describing the results derived from activities accomplished under subsection (c)(4) during the previous 3 years to—</text><paragraph id="H1AD3CA9631BA48E18424E965BAB5A557"><enum>(1)</enum><text>the Committee on Environment and Public Works of the Senate;</text></paragraph><paragraph id="H71F9D0A0F33144ED8B078300F1F14731"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></paragraph><paragraph id="H26330CA9A5E84538BC191BF7A78A8EB1"><enum>(3)</enum><text>the United States Fish and Wildlife Service.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HCCA824FA0017451C8178360B31F89D3E"><enum>102.</enum><header>Technical amendments</header><subsection id="HBD05D4F39C834350A5EA00800E72416C"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>) is amended—</text><paragraph id="HEA2B992375C34784BE582CA4F015E244"><enum>(1)</enum><text>in paragraph (7), by striking <quote>including fish,</quote>;</text></paragraph><paragraph id="H78749B1B6C7D4FB8AAA39D4568CC36E7"><enum>(2)</enum><text>by redesignating paragraphs (6) through (9) as paragraphs (5) through (8), respectively; and</text></paragraph><paragraph id="HEB0B6D674EAC4502B42F81DB2975E7E9"><enum>(2)</enum><text>by inserting after section 12 the following:</text><quoted-block id="HBFD420E95A5647A98471E06C4ABD8E64" style="OLC"><section id="HDE9C96D0BEDB40C4AFE28C14623370CA"><enum>13.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to enlarge or diminish the authority, jurisdiction, or responsibility of a State to manage, control, or regulate fish and wildlife under the law and regulations of the State on lands and waters within the State, including on Federal lands and waters.</text></section><section id="H5292E04669EB445784655DA6206FB806"><enum>14.</enum><header>Statutory construction with respect to Alaska</header><text display-inline="no-display-inline">If any conflict arises between any provision of this Act and any provision of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="public-law" parsable-cite="pl/46/487">Public Law 46–487</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/16/3101">16 U.S.C. 3101</external-xref> et seq.), then the provision in the Alaska National Interest Lands Conservation Act shall prevail.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H6B327C6EAB2D4AC1966FE03CCBAE5F1E"><enum>II</enum><header>Tribal Wildlife Conservation and Restoration</header><section id="HAE0FDF6D001E4328BBF855F14910B4F0"><enum>201.</enum><header>Indian Tribes</header><subsection id="H724200DD3F63438E80AF8E7283ADCB68"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H843006E526644F99BFEDD0D7FA09DE88"><enum>(1)</enum><header>Account</header><text>The term <term>Account</term> means the Tribal Wildlife Conservation and Restoration Account established by subsection (b)(1).</text></paragraph><paragraph id="H8FFF3119307345A88D2E7CDBFFEABF60"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H8A92782AAAC14F32A798EAE0B813FB64"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HCCB5521125EE40EFA5D8AA75921A9A16"><enum>(4)</enum><header>Tribal species of greatest conservation need</header><text>The term <term>Tribal species of greatest conservation need</term> means any species identified by an Indian Tribe as requiring conservation management because of declining population, habitat loss, or other threats, or because of their biological or cultural importance to such Tribe.</text></paragraph><paragraph id="HFCDEEF0D4F6B4C61A235AD1627B0DCA0"><enum>(5)</enum><header>Wildlife</header><text>The term <term>wildlife</term> means—</text><subparagraph id="H68DC5ED7EDB84D9B9017DBAB1BB16B34"><enum>(A)</enum><text>any species of wild flora or fauna including fish and marine mammals;</text></subparagraph><subparagraph id="HD46B5C7759C6430BAD913ED7726062E6"><enum>(B)</enum><text>flora or fauna in a captive breeding, rehabilitation, and holding or quarantine program, the object of which is to reintroduce individuals of a depleted indigenous species into previously occupied range or to maintain a species for conservation purposes; and</text></subparagraph><subparagraph id="HACA5E4D5E4D4490CB07E2313D5FE20E8"><enum>(C)</enum><text>does not include game farm animals.</text></subparagraph></paragraph></subsection><subsection id="H521F571FAF7F4DA3B90A2EE03745EC90"><enum>(b)</enum><header>Tribal wildlife conservation and restoration account</header><paragraph id="HB611955062ED4DAF9383966AAB707722"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury an account to be known as the <quote>Tribal Wildlife Conservation and Restoration Account</quote>.</text></paragraph><paragraph id="HF27C67815AD6463794DCEFAE2545FC03"><enum>(2)</enum><header>Availability</header><text>Amounts in the Account shall be available for each fiscal year without further appropriation for apportionment in accordance with this title.</text></paragraph><paragraph id="H7DFD2BCC52284B32BE300FFFA373539F"><enum>(3)</enum><header>Deposits</header><text>Beginning in fiscal year 2022, and each fiscal year thereafter, the Secretary of the Treasury shall transfer $97,500,000 to the Account.</text></paragraph></subsection><subsection id="H4E676055C0AA40B3A7334531A2C9AF9E"><enum>(c)</enum><header>Distribution of funds to Indian tribes</header><text display-inline="yes-display-inline">Each fiscal year, the Secretary of the Treasury shall deposit funds into the Account and distribute such funds through a noncompetitive application process according to guidelines and criteria, and reporting requirements determined by the Secretary of the Interior, acting through the Director of the Bureau of Indian Affairs, in consultation with Indian Tribes. Such funds shall remain available until expended.</text></subsection><subsection id="HFB9A32888B6941F5A5A1935FB5D50816"><enum>(d)</enum><header>Wildlife management responsibilities</header><text>The distribution guidelines and criteria described in subsection (c) shall be based, in part, upon Indian Tribes’ wildlife management responsibilities.</text></subsection><subsection id="H883A06191EFE42AD809823B2235B7724"><enum>(e)</enum><header>Use of funds</header><paragraph id="H2FD767CD95714ACDBA4F8A3097883F3A"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary may distribute funds from the Account to an Indian Tribe for any of the following purposes:</text><subparagraph id="HE84442AE40D142F0813ADC565D8AEC29"><enum>(A)</enum><text>To develop, carry out, revise, or enhance wildlife conservation and restoration programs to manage Tribal species of greatest conservation need and the habitats of such species as determined by the Indian Tribe.</text></subparagraph><subparagraph id="H3E088B8A124B4DB292044D65558D0BD0"><enum>(B)</enum><text>To assist in the recovery of species listed as an endangered or threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></subparagraph><subparagraph id="HA3C87D7C93D54763938DB319EE108F7B"><enum>(C)</enum><text>For wildlife conservation education and wildlife-associated recreation projects.</text></subparagraph><subparagraph id="HCCE167FE01044B74B0E5F6B3406EEA6A"><enum>(D)</enum><text>To manage a Tribal species of greatest conservation need and the habitat of such species, the range of which may be shared with a foreign country, State, or other Indian Tribe.</text></subparagraph><subparagraph id="H5B04C78213864AD0A7F9F610AFB8DEFF"><enum>(E)</enum><text>To manage, control, and prevent invasive species as well as diseases and other risks to wildlife.</text></subparagraph><subparagraph id="H1B3CA49EC263416DA6F2DF8550AB25A8"><enum>(F)</enum><text>For law enforcement activities that are directly related to the protection and conservation of wildlife.</text></subparagraph><subparagraph id="H12200A173C4F4D73B634A59D86C3D5CD"><enum>(G)</enum><text>To develop, revise, and implement comprehensive wildlife conservation strategies and plans for such Tribe.</text></subparagraph><subparagraph id="H7357F4688D3448FCAB5BB627DB226A10"><enum>(H)</enum><text>For the hiring and training of wildlife conservation and restoration program staff.</text></subparagraph></paragraph><paragraph id="HB0214D1A76184850BED2F118D8D5712B"><enum>(2)</enum><header>Conditions on the use of funds</header><subparagraph id="H9FC75B66AAEB4FAEA39884C392157682"><enum>(A)</enum><header>Required use of funds</header><text>In order to be eligible to receive funds under subsection (c), a Tribe’s application must include a proposal to use funds for at least one of the purposes described in subparagraphs (A) and (B) of paragraph (1).</text></subparagraph><subparagraph id="H3F28AFA5E4F04C079A2DE77F987C5420"><enum>(B)</enum><header>Imperiled species recovery</header><text>In distributing funds under this section, the Secretary shall distribute not less than 15 percent of the total funds distributed to proposals to fund the recovery of a species, subspecies, or distinct population segment listed as a threatened species, endangered species, or candidate species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) or Tribal law.</text></subparagraph><subparagraph id="HB005FB52AE484430A393EEE459EE0BBC"><enum>(C)</enum><header>Limitation</header><text>In distributing funds under this section, the Secretary shall distribute not more than 15 percent of all funds distributed under this section for the purpose described in paragraph (1)(C).</text></subparagraph></paragraph></subsection><subsection id="HCC4A36027B5A4BC08DCE99EB67AED12F"><enum>(f)</enum><header>No matching funds required</header><text>No Indian Tribe shall be required to provide matching funds to be eligible to receive funds under this Act.</text></subsection><subsection id="HCE89AF51A26649ADB2205E5010A73BD7"><enum>(g)</enum><header>Public access not required</header><text>Funds apportioned from the Tribal Wildlife Conservation and Restoration Account shall not be conditioned upon the provision of public or non-Tribal access to Tribal or private lands, waters, or holdings.</text></subsection><subsection id="HA33D8E53E1F34EF4B65B01F23394AD06"><enum>(h)</enum><header>Administrative costs</header><text>Of the funds deposited under subsection (b)(3) for each fiscal year, not more than 3 percent shall be used by the Secretary for administrative costs.</text></subsection><subsection id="H7915884031514529AE7482C3C031A4D2"><enum>(i)</enum><header>Savings clause</header><text>Nothing in this Act shall be construed as modifying or abrogating a treaty with any Indian Tribe, or as enlarging or diminishing the authority, jurisdiction, or responsibility of an Indian Tribe to manage, control, or regulate wildlife.</text></subsection></section></title></legis-body></bill>
