R. 2726</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>June 16, 2021</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to establish a plan to reduce the backlog of requests for information made to the Department of Veterans Affairs pursuant to section 552 of title 5, United States Code, and for other purposes.</official-title></form><legis-body id="H804855C56825405EADCD7BEF3585B979" style="OLC"><section id="H9A963A477E124E0DB0D5140F6E0847C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA FOIA Reform Act of 2021</short-title></quote>. </text></section><section id="H8008786130B44D91ABF44379854EF200"><enum>2.</enum><header>Plan for reduction of backlog of FOIA requests</header><subsection id="HDCDF28B4C83942838B419E3042E117CC"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall establish and carry out a plan for the Secretary to meet, by not later than five years after the date of the enactment of this Act, the requirements of section 552 of title 5, United States Code, with respect to providing documents and information under such section within the timeframes required by such section. The plan shall include the following:</text><paragraph id="HCDE749B82BD147548227B7205547757D"><enum>(1)</enum><text>Improving and acquiring technology, including with respect to searching email and other electronic information, and the timelines for such improvement, to ensure that the information technology of the Department of Veterans Affairs is capable of carrying out the plan.</text></paragraph><paragraph id="H0CA46CB184C042BB9F8F6BD938B732B2"><enum>(2)</enum><text>Identification of efficient procedures, policies, and systems of the Department that could be developed to allow employees of the Department responsible for replying to requests under such section 552 to search and review documents rather than other employees of the Department.</text></paragraph><paragraph id="H1CD9FEC42C254727ABD1D6540AB92398"><enum>(3)</enum><text>A schedule for carrying out the plan, including key milestones and metrics.</text></paragraph></subsection><subsection id="H39D0CA0F5761453897CCB323A4110AB2"><enum>(b)</enum><header>Compliance assessment</header><text display-inline="yes-display-inline">The Secretary shall request the Director of the Office of Government Information Services of the National Archives and Records Administration to conduct an assessment of the compliance by the Department of Veterans Affairs with section 552 of title 5, United States Code.</text></subsection><subsection id="H4499420FF953467C9A7AB06A9612A93B"><enum>(c)</enum><header>Reports</header><paragraph id="HA43DA51E0FB84C43B36E980340E34D03"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report on implementing subsections (a) and (b). The report shall include the following:</text><subparagraph id="H1450A1F785A44D438381B3943F548020"><enum>(A)</enum><text>The plan established under subsection (a).</text></subparagraph><subparagraph id="HA5AD45307733402A83527FFC071339A7"><enum>(B)</enum><text display-inline="yes-display-inline">An analysis of the root causes of the backlog of FOIA requests.</text></subparagraph><subparagraph id="HC8AF81FFE59A42AE83807A9BB69749EC"><enum>(C)</enum><text>Recommendations with respect to any additional resources or legislative action the Secretary determines necessary for such implementation.</text></subparagraph></paragraph><paragraph id="HEE9861D44D2C496DBC10F75DAF6DF8BD"><enum>(2)</enum><header>Annual reports</header><text display-inline="yes-display-inline">During the five-year period following the date of the enactment of this Act, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate annual reports on—</text><subparagraph id="HE0D0F1310A8E4769861EEA1254F0D355"><enum>(A)</enum><text>carrying out the plan under subsection (a), including any updates or changes made to the plan; and</text></subparagraph><subparagraph id="HD460907D95B5498098899505BD513430"><enum>(B)</enum><text display-inline="yes-display-inline">the compliance by the Department as described in subsection (b).</text></subparagraph></paragraph><paragraph id="H32AE00724A2B4C4289E75BC94C55C2E9"><enum>(3)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall make publicly available on the internet website of the Department the reports under paragraphs (1) and (2) by not later than 30 days after the date on which the Secretary submits the reports to the Committees on Veterans’ Affairs of the House of Representatives and the Senate. </text></paragraph></subsection><subsection id="HC9F82EF4790B4C6FB4027EF384095910"><enum>(d)</enum><header>Backlog of FOIA requests defined</header><text display-inline="yes-display-inline">In this section, the term <term>backlog of FOIA requests</term> means the number of requests, as reported by the Secretary of Veterans Affairs to the Attorney General in the Annual FOIA Report, made by individuals to the Secretary pursuant to section 552 of title 5, United States Code, for documents <pagebreak></pagebreak>or information that the Secretary has not fulfilled or provided a response to the individual.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210615" chamber="House">Passed the House of Representatives June 15, 2021.</attestation-date><attestor display="yes">Cheryl L.
