<section id="H5D6A25A79C9D4BE5A6052A957DEB8973" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Peer Support Enhancement for MST Survivors Act</short-title></quote>. </text></section> <section id="H9C79177137D442DEAD5F5A08A36AE3AD"><enum>2.</enum><header>Peer support specialists for claimants who are survivors of military sexual trauma</header> <subsection id="HD0CC397242D446BB978C67B8590E3893"><enum>(a)</enum><header>Peer support specialists for claimants who are survivors of military sexual trauma</header> <paragraph id="H1DF552C9D839495E8C8C13A6A285FB27"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/51">Chapter 51</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5109B">section 5109B</external-xref> the following new section:</text>

<section id="H5ADEF491E37347C483054C4FD47F9CE5"><enum>5109C.</enum><header>Peer support specialists for claimants who are survivors of military sexual trauma</header>
<subsection id="HB2DEC89E932048968F6C69E2420C1B56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall ensure that each claimant who files a claim relating to military sexual trauma is assigned a peer support specialist to provide the claimant with support during the claims process unless the claimant elects not to have a peer support specialist under this section.</text></subsection> <subsection id="H90F0A2C36DBD4E5A9E1002C459EE1C4F"><enum>(b)</enum><header>Qualifications</header><text>A peer support specialist under this section—</text>
<paragraph id="HE1F7993BBBC3471CBA522A623C1EB4CB"><enum>(1)</enum><text>shall be trained as a victims advocate; and</text></paragraph> <paragraph id="H48D156DFB21D4640AE46230D5E868C66"><enum>(2)</enum><text>may not be responsible for any part of adjudicating the claim of any claimant to which the specialist is providing support under this section.</text></paragraph></subsection>
<subsection id="H1D8197915A3E45499EF0D653E36B4B75"><enum>(c)</enum><header>Military sexual trauma</header><text>In this section, the term <quote>military sexual trauma</quote> has the meaning given such term in section 1165(c) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H8360654427D3441D95F6BB2D663EF12A"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5109B the following new item:</text>

<subsection id="HAC7780799308416FAD2D1B6D51C35B05"><enum>(b)</enum><header>Technical correction</header><text display-inline="yes-display-inline">The second section 1164 of title 38, United States Code, as added by section 5501 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>), is redesignated as section 1165 (and the table of sections at the beginning of chapter 11 of such title is conformed accordingly).</text></subsection></section> </legis-body> </bill>
