committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to improve the equal employment opportunity functions of Department of Veterans Affairs, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H99B9F7CAC733487CABC616741D39449B" style="OLC"><section id="H0E2DF87550514D50831829390FA4DC78" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving VA Accountability To Prevent Sexual Harassment and Discrimination Act of 2021</short-title></quote>.</text></section><section id="HC5F01B4BC2794DA7AFB27A98285E0115" section-type="subsequent-section"><enum>2.</enum><header>Improvements to equal employment opportunity functions of Department of Veterans Affairs</header><subsection id="HFE9204E2F2F741A9B815D0A264F429C4"><enum>(a)</enum><header>Alignment of EEO Director</header><paragraph id="HEBA257174CFF4810901591F3EEAFE2D1"><enum>(1)</enum><header>Reporting and duties</header><text>Subsection (h) of section 516 of title 38, United States Code, is amended—</text><subparagraph id="H436839586C8545A79BD7A55A7C0BD0DC"><enum>(A)</enum><text>by striking <quote>The provisions</quote> and inserting <quote>(1) The provisions</quote>; and</text></subparagraph><subparagraph id="H5D6C406A2CBD407F8C9D2DFCA9513FAA"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HD611F4161B354522B470170A4E2BFD9F" display-inline="no-display-inline"><paragraph id="HB9CC039B941245CFBA580500709211CC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Beginning not later than 90 days after the date of the enactment of this paragraph, in carrying out paragraph (1), the Secretary shall ensure that the official of the Department who serves as the Equal Employment Opportunity Director of the Department—</text><subparagraph id="HE16D8BEB967340E7971DB8974C9FF83B"><enum>(A)</enum><text display-inline="yes-display-inline">reports directly to the Deputy Secretary with respect to the functions under this section; and</text></subparagraph><subparagraph id="H3A8B42AAC77A4A5B88B1A4B490052E56"><enum>(B)</enum><text>does not also serve in a position that has responsibility over personnel functions of the Department or other functions that conflict with the functions under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF2A25221C9324439AED85779FBDD5628" commented="no"><enum>(2)</enum><header>Conforming amendments</header><text>Such section is further amended—</text><subparagraph id="H85732EBCB27A44BEA1AB242A54016309"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by inserting <quote>, in accordance with subsection (h)(2),</quote> after <quote>an Assistant Secretary or a Deputy Assistant Secretary</quote>; and</text></subparagraph><subparagraph id="H59ABA664AD1141DAB773790B811693C6"><enum>(B)</enum><text>in subsection (e)(1)(A), by striking <quote>the Assistant Secretary for Human Resources and Administration</quote> and inserting <quote>the Secretary</quote>. </text></subparagraph></paragraph></subsection><subsection id="H92D843E5966E43088581EDD839899BDF"><enum>(b)</enum><header>Alignment of EEO program managers</header><text display-inline="yes-display-inline">Such section is further amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H9045A4C9258F4558AF0788D14E22B067" display-inline="no-display-inline"><subsection id="H1910D2ABC18B41698899086B4D19DAC6"><enum>(i)</enum><text display-inline="yes-display-inline">In accordance with subsection (b), not later than December 31, 2021, the Secretary of Veterans Affairs shall ensure that each Equal Employment Opportunity program manager of the Department at the facility level reports to the head of the Office of Resolution Management, or such successor office established pursuant to subsection (a), with respect to the equal employment functions of the program manager. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7D53F69E2A9F45FBA2587BC25D179F50"><enum>(c)</enum><header>Reporting harassment and employment discrimination complaints</header><text>Subsection (a) of such section 516 is amended—</text><paragraph id="HC3674A3D964F43DEAF2B995A9E31629B"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>(1) The Secretary</quote>; and</text></paragraph><paragraph id="H4FDC9E2B74234BF6A68EE7161E36FC0B"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H717C3C5609F245D2A8E4BCDCCD1B06ED" display-inline="no-display-inline"><paragraph id="HE1F05E54784A4719AB8E1C3B333D6840" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that the employment discrimination complaint resolution system established under paragraph (1) requires that any manager of the Department who receives a sexual or other harassment or employment discrimination complaint reports such complaint to the Office of Resolution Management, or such successor office, immediately, or if such immediate reporting is impracticable, not later than two business days after the date on which the manager receives the complaint.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF73BC5C19F5D41DDA0996AB27517ECA9"><enum>(d)</enum><header>Training</header><text>Subsection (c) of such section 516 is amended by adding at the end the following new sentence: <quote>Beginning not later than September 30, 2021, the Secretary shall provide to each employee of the Department mandatory annual training on identifying and addressing sexual and other harassment and employment discrimination, including with respect to processes under the Harassment Prevention Program of the Department, or such successor program. An employee of the Department who is hired on or after such date shall receive the first such mandatory annual training not later than 60 days after being hired.</quote>.</text></subsection><subsection id="HEA19DD76699F4A5797678C7BA19A6125"><enum>(e)</enum><header>Harassment and employment discrimination policies and directives</header><text>The Secretary of Veterans Affairs shall—</text><paragraph id="HBD5B53EC0A2B41338D5CD7C164B5580D"><enum>(1)</enum><text display-inline="yes-display-inline">by not later than September 30, 2021, and on a regular basis thereafter, review the policies relating to sexual and other harassment and employment discrimination of the Department of Veterans Affairs to ensure that such policies are complete and in accordance with the sexual and other harassment and employment discrimination policies established by the Office of Resolution Management of the Department, or such successor office; and</text></paragraph><paragraph id="HA412F86ABC8B4311A6E65E3799D30E7E"><enum>(2)</enum><text>by not later than 180 days after the date of the enactment of this Act, issue a final directive and a handbook for the Harassment Prevention Program of the Department.</text></paragraph></subsection><subsection id="H86DD30A0B881442B9A75913E9E5D6B19"><enum>(f)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and semiannually thereafter for one year, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report on the progress the Secretary has made in carrying out this section and section 516 of title 38, United States Code, as amended by this section, including with respect to reporting sexual and other harassment and employment discrimination complaints pursuant to subsection (a)(2) of such section 516.</text></subsection></section></legis-body><endorsement display="yes"><action-date>May 17, 2021</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
