R. 2660</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210419">April 19, 2021</action-date><action-desc><sponsor name-id="L000566">Mr. Latta</sponsor> (for himself, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, <cosponsor name-id="A000375">Mr. Arrington</cosponsor>, <cosponsor name-id="W000812">Mrs. Wagner</cosponsor>, <cosponsor name-id="J000301">Mr. Johnson of South Dakota</cosponsor>, <cosponsor name-id="S001187">Mr. Stivers</cosponsor>, <cosponsor name-id="C001054">Mr. Carl</cosponsor>, <cosponsor name-id="C001115">Mr. Cloud</cosponsor>, <cosponsor name-id="J000302">Mr. Joyce of Pennsylvania</cosponsor>, <cosponsor name-id="M000194">Ms. Mace</cosponsor>, <cosponsor name-id="H001091">Mrs. Hinson</cosponsor>, <cosponsor name-id="W000798">Mr. Walberg</cosponsor>, <cosponsor name-id="B001248">Mr. Burgess</cosponsor>, <cosponsor name-id="M001180">Mr. McKinley</cosponsor>, <cosponsor name-id="M001136">Mrs. McClain</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson</cosponsor>, and <cosponsor name-id="P000615">Mr. Pence</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to codify the definition of the term <quote>waters of the United States</quote>, and for other purposes.</official-title></form><legis-body id="H797F7AC69A6843CAA62424FF07C2F766" style="OLC"><section id="HDC9CADD154DD432A9C727C31F8A4960F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Withstanding Attempts to Encroach on our Resources Act of 2021</short-title></quote> or the <quote><short-title>WATER Act</short-title></quote>.</text></section><section id="H087546404A744E0C94BC3DB91CE8BA06" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HCE98F0F5B94D4A3D8700A8FE3F02A211"><enum>(1)</enum><text display-inline="yes-display-inline">In June 2015, the Corps of Engineers and the Environmental Protection Agency published a final rule (hereinafter referred to as the <quote>2015 WOTUS rule</quote>) to revise regulations defining the scope of waters protected and regulated under the Clean Water Act.</text></paragraph><paragraph id="HE9A2D5C78D9A4EF2A89B954D24BD7150"><enum>(2)</enum><text display-inline="yes-display-inline">The 2015 WOTUS rule significantly expanded the scope of Federal jurisdiction under the Clean Water Act over virtually all waters and wet areas in the United States.</text></paragraph><paragraph id="H80DE81253D3440B082F36F736D1533F0"><enum>(3)</enum><text display-inline="yes-display-inline">On April 21, 2020, the Environmental Protection Agency and the Corps of Engineers revisited the 2015 WOTUS rule and finalized a revised definition of the term <quote>waters of the United States</quote> to address legal, economic, and jurisdictional concerns surrounding the previous definition.</text></paragraph><paragraph id="H87F6D59B983E4A6D9403566ECE0FD5E8"><enum>(4)</enum><text display-inline="yes-display-inline">The 2015 WOTUS rule infringed on the rights of property owners, particularly in agricultural communities, and represented an alarming regulatory overreach of the executive branch into policies that should be addressed by the legislative branch through the legislative process.</text></paragraph></section><section id="H8CCC954086854D73AF6BFA5BD4FBA372"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">Section 502(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(7)</external-xref>) is amended by striking <quote>, including the territorial seas.</quote> and inserting <quote>(as such term is defined in section 120.2 of title 40, Code of Federal Regulations, as in effect on June 22, 2020).</quote>. </text></section></legis-body></bill>
