which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to provide that children who have relocated from Puerto Rico to the States are fully considered for purposes of State allotments under the English Language Acquisition grants.</official-title></form><legis-body id="H7C8000EAD3C34423A90D334D47E13F6E" style="OLC"><section section-type="section-one" id="H05053B77E5294915932E9FA2B4EA2453"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Linguistic Excellence and Vocational Aptitude by Teaching English Act</short-title></quote> or the <quote><short-title>ELEVATE Act</short-title></quote>.</text></section><section id="HF574D2E4DF254770A432D4AF3777AE61"><enum>2.</enum><header>Treatment of Puerto Rico with respect to allotments for English Language Acquisition grants</header><subsection id="H9F8AF8B1DB1A45F5AD2E4DBE18E1A216"><enum>(a)</enum><header>Change in definition</header><text display-inline="yes-display-inline">Section 3201(5) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7011">20 U.S.C. 7011(5)</external-xref>) is amended—</text><paragraph id="H05F278E913884FC59E21025B0670A674"><enum>(1)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">and migrants from Puerto Rico</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">youth</header-in-text></quote>;</text></paragraph><paragraph id="HC0AB8BAE67D94140A1F246F3CB8ECC19"><enum>(2)</enum><text>in the matter preceding subparagraph (A), by striking <quote>immigrant children and youth</quote> and inserting <quote>immigrant children and youth and migrants from Puerto Rico</quote>;</text></paragraph><paragraph id="H68F0F49A0098408C80253B44F919FA3D"><enum>(3)</enum><text>in subparagraph (B), by inserting <quote>in which the primary language of instruction in public elementary schools and secondary schools is English</quote> after <quote>any State</quote>; and</text></paragraph><paragraph id="HFAA1D156ACA54921AFEB1F1198A4422E"><enum>(4)</enum><text>in subparagraph (C), by inserting <quote>, other than Puerto Rico,</quote> after <quote>States</quote>.</text></paragraph></subsection><subsection id="HA85F25FA7EE54FE0AE490D8B43A7A0C3"><enum>(b)</enum><header>Conforming amendments</header><text>Part A of title III of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6811">20 U.S.C. 6811</external-xref> et seq.) is amended—</text><paragraph id="HACDB663E87264D93B0AC63BC8E5B8DAF"><enum>(1)</enum><text>in each of sections 3102 and 3114 (<external-xref legal-doc="usc" parsable-cite="usc/20/6812">20 U.S.C. 6812</external-xref> and 6824), by striking <quote>immigrant children and youth</quote> each place the term appears and inserting <quote>immigrant children and youth and migrants from Puerto Rico</quote>;</text></paragraph><paragraph id="H187A10CE32E240AFA94042E28CF39C08"><enum>(2)</enum><text>in section 3111 (<external-xref legal-doc="usc" parsable-cite="usc/20/6821">20 U.S.C. 6821</external-xref>)—</text><subparagraph id="HC6652C46445D4D9FB37EFCC4422C4063"><enum>(A)</enum><text>by striking <quote>immigrant children and youth</quote> each place the term appears and inserting <quote>immigrant children and youth and migrants from Puerto Rico</quote>; and</text></subparagraph><subparagraph id="H455835FA64064D55AC12389716F07EB7"><enum>(B)</enum><text>in subsection (c)(2)(A)(ii), by inserting <quote>and migrants</quote> after <quote>such children and youth</quote>;</text></subparagraph></paragraph><paragraph id="H58B8AD1B270D47D5B49FB42F17D368B4"><enum>(3)</enum><text>in section 3113(b)(7) (<external-xref legal-doc="usc" parsable-cite="usc/20/6823">20 U.S.C. 6823(b)(7)</external-xref>), by striking <quote>children and youth</quote> and inserting <quote>immigrant children and youth and migrants from Puerto Rico</quote>; and</text></paragraph><paragraph id="H3723E40C45E64097B1EBCF4DD631D11B"><enum>(4)</enum><text>in section 3115 (<external-xref legal-doc="usc" parsable-cite="usc/20/6825">20 U.S.C. 6825</external-xref>)—</text><subparagraph id="H68655434A56F4C46AF8F0CDDBEAA601E"><enum>(A)</enum><text>in the subsection heading of subsection (e), by inserting <quote><header-in-text level="subsection" style="OLC">and migrants from Puerto Rico</header-in-text></quote>; and</text></subparagraph><subparagraph id="HCCF9010553C849DDA1C7AABF32DFA38B"><enum>(B)</enum><text>by striking <quote>immigrant children and youth</quote> each place the term appears and inserting <quote>immigrant children and youth and migrants from Puerto Rico</quote>.</text></subparagraph></paragraph></subsection><subsection id="H211B299809974AF9AE6F036AD2E4BC3B"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1 of the first fiscal year the begins on or after the date of enactment of this Act, except that if the application of such amendments would result in a State receiving an allotment under title III of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6801">20 U.S.C. 6801</external-xref> et seq.) for such first fiscal year that is less than the allotment such State received under such title for the fiscal year preceding such first fiscal year, such amendments shall take effect on October 1 of the second fiscal year that begins on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
