R. 2527</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210414">April 14, 2021</action-date><action-desc><sponsor name-id="M001180">Mr. McKinley</sponsor> (for himself and <cosponsor name-id="K000009">Ms. Kaptur</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program to provide certain eligible entities engaged in food recovery with grants to support certain costs.</official-title></form><legis-body id="H2E3E9BE5810449F99ABB1C1A409B47B0" style="OLC"><section id="H1C056E41EE0F48B680A47BFC84616B8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Recovery Transportation Act</short-title></quote>. </text></section><section id="H1B9FF280B13843C1844B28A1BA138CE1"><enum>2.</enum><header>Food waste recovery transportation grants</header><subsection id="HB545A7FA15E14979A29FF647F02E2F39"><enum>(a)</enum><header>Authority To provide assistance</header><paragraph id="HAD5B81E5348F42A780827AB9FE35B374"><enum>(1)</enum><header>In general</header><text>From amounts made available to carry out this section, the Secretary of Agriculture shall make grants to assist an eligible entity with—</text><subparagraph id="H9B4E28BA4DEF4620B2B854E45BB458F9"><enum>(A)</enum><text>purchasing, leasing, or otherwise acquiring vehicles, including refrigerated vehicles, or other equipment to carry out activities related to food recovery;</text></subparagraph><subparagraph id="H015A1CB9A21C4541BCC60CEE5C913845"><enum>(B)</enum><text>reimbursing travel costs related to food recovery at the per mile rate established by the Commissioner of the Internal Revenue Service; and</text></subparagraph><subparagraph id="HE8C1213C5CA94BD2A43043E10BF77874"><enum>(C)</enum><text display-inline="yes-display-inline">the costs of preparing, storing, and transporting donated food.</text></subparagraph></paragraph><paragraph id="H6AF922DB51214BA8BC7F6BA12D31D184"><enum>(2)</enum><header>Limitation</header><text>An eligible entity may only receive one grant under this section.</text></paragraph></subsection><subsection id="HD4AD38BBA358441694B739235AB89D81"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a grant under subsection (a), an eligible entity shall submit an application to the Secretary of Agriculture, at such time, in such manner, and containing such information as the Secretary of Agriculture may require.</text></subsection><subsection id="H9F4FADF31E3840FEAB48726645EA32B7"><enum>(c)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">To be eligible for a grant under subsection (a), a public food program service provider, a tribal organization, or a private nonprofit entity (including a gleaner) shall—</text><paragraph id="HF973149B7E94405298F55A00FD310932"><enum>(1)</enum><text>have experience in the area of—</text><subparagraph id="HE16ABE0E013A47418DC71A8079CE0B3F"><enum>(A)</enum><text>food recovery and distribution, particularly concerning small and medium-sized farms;</text></subparagraph><subparagraph id="H80A52B32AF6C4964AB5E7DF01A3A71CE"><enum>(B)</enum><text>job training and business development activities for food-related activities in low-income communities; or</text></subparagraph><subparagraph id="H18252EAEE27E435A970147481BC1DB10"><enum>(C)</enum><text>efforts to reduce food insecurity in the community, including food recovery and distribution, improving access to services, or coordinating services and programs; and</text></subparagraph></paragraph><paragraph id="HD81806C717B548D1A5828159F6B59464"><enum>(2)</enum><text>demonstrate competency to implement a project, provide fiscal accountability, collect data, and prepare reports and other necessary documentation.</text></paragraph></subsection><subsection id="HC12490A1612F4DC098721505A90B8C17"><enum>(d)</enum><header>Gleaner defined</header><text>In this section, the term <term>gleaner</term> has the meaning given the term in section 25(a)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034(a)(2)</external-xref>).</text></subsection><subsection commented="no" id="H49EA55E3D5C8465AAA25D79F5EC6D707"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to carry out this section $10,000,000 for fiscal year 2022.</text></subsection></section></legis-body></bill>
