Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020, and for other purposes.</official-title></form><legis-body id="H5B4F38F0F12546C3A18CA17768048FA1" style="OLC"><section id="H6E5B53E394ED49A2BFD80EB047DABB63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Training in High-demand Roles to Improve Veteran Employment Act</short-title></quote> or the <quote><short-title>THRIVE Act</short-title></quote>. </text></section><section id="H5B7978910AF74A1597E2556F3503E80F"><enum>2.</enum><header>Improvements to COVID–19 veteran rapid retraining assistance program</header><text display-inline="no-display-inline">Section 8006 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) is amended—</text><paragraph id="H6407005DD79E4DB987632ED6460FB440" commented="no"><enum>(1)</enum><text>by striking paragraph (3) of subsection (c) and inserting the following new paragraph (3):</text><quoted-block style="OLC" id="H419B592A25A54DC59BECDBBA64089B63" display-inline="no-display-inline"><paragraph id="H76AA31E7951B433D8A4A8AE4F9F676C5" commented="no"><enum>(3)</enum><header>Determination of high-demand occupations</header><subparagraph id="H317F05E4284F40F48E6A7FF58E94D9DE" commented="no"><enum>(A)</enum><header>Initial implementation</header><text>In carrying out this section, the Secretary shall use the list of high-demand occupations prepared in conjunction with the Secretary of Labor.</text></subparagraph><subparagraph id="HFAB39A6AB050454D8210158C32B3DC70" commented="no"><enum>(B)</enum><header>Modifications</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may add and remove occupations from the list under subparagraph (A) as the Secretary determines appropriate.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HEF94857EE4C646D2A5C33E3773F3C94E" commented="no"><enum>(2)</enum><text>in subsection (d)(3)—</text><subparagraph id="H8171786587154F50B197BCD4C0D869E3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>(other than such a program pursued solely through distance learning on a half-time basis or less)</quote> after <quote>a covered program of education under the retraining assistance program under this section</quote>; and</text></subparagraph><subparagraph id="HB554943DC05D4387A8CF24FEED9D01F1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>less than a half-time basis</quote> and inserting <quote>a half-time basis or less</quote>;</text></subparagraph></paragraph><paragraph id="HE9EA4E5A6C7B47548CEE7E3BF222FBAD"><enum>(3)</enum><text>by redesignating subsections (f), (g), and (h) as subsections (k), (l), and (m), respectively;</text></paragraph><paragraph id="H62A7EDC37437444082D7E9A6532CEA7F"><enum>(4)</enum><text>by inserting after subsection (e) the following new subsections:</text><quoted-block style="OLC" id="HACC79691784246409026902DA45592C9" display-inline="no-display-inline"><subsection id="H0511D4E5D2EC42F3934FE16265679EFD"><enum>(f)</enum><header>Employee assistance</header><text>The Secretary of Veterans Affairs, in consultation with the Secretary of Labor, shall contact each veteran who pursues a covered program of education under this section—</text><paragraph id="H63EB0EE7C7434859BBF69801A23F88F4"><enum>(1)</enum><text>not later than 30 days after the date on which the veteran begins the program of education to notify the veteran of the availability of employment placement services upon completion of the program; and</text></paragraph><paragraph id="H932451E69D224A7C8FE4C6FAB1221628"><enum>(2)</enum><text>not later than 14 days after the date on which the veteran completes, or terminates participation in, such program to facilitate the provision of employment placement services to such veteran.</text></paragraph></subsection><subsection id="HC1EA910B957A43FBBEA78381B9CE8871" commented="no"><enum>(g)</enum><header>Nonprofit organization</header><paragraph id="H82123A92079546038B2645E45331D1E1" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall seek to enter into a memorandum of understanding with one or more qualified nonprofit organizations for the purpose of facilitating the employment of veterans who participate in the retraining assistance program under this section.</text></paragraph><paragraph id="H07B50AAF6AF24F24BFE1CDE47CF483C5" commented="no"><enum>(2)</enum><header>Qualified nonprofit organization</header><text>For purposes of this subsection, a qualified nonprofit organization is a nonprofit organization that—</text><subparagraph id="H357A941A5E41484F9E58713B88F00B5A" commented="no"><enum>(A)</enum><text>is an association of businesses; and</text></subparagraph><subparagraph id="HBE3C10C1C29D4B52A100D9DE8753E1FE" commented="no"><enum>(B)</enum><text>has at least two years of experience providing job placement services for veterans.</text></subparagraph></paragraph></subsection><subsection id="HEAB4568FFA6A48198D2874203D630FB7"><enum>(h)</enum><header>Follow up outreach</header><text>The Secretary of Veterans Affairs, in coordination with the Secretary of Labor, shall contact each veteran who completes a covered program of education under the retraining assistance program under this section 30, 60, 90, and 180 days after the veteran completes such program of education to ask the veteran about the experience of the veteran in the retraining assistance program and the veteran’s employment status.</text></subsection><subsection id="HC0C80F3DAF2F49BFBF0E31CC1864A6BB"><enum>(i)</enum><header>Quarterly reports</header><text>Not later than the date that is one year after the date of the enactment of this Act, and quarterly thereafter, the Secretary of Labor shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report containing the following information about veterans who participate in the retraining assistance program under this section:</text><paragraph id="H5B04945E3C724185B86165C44E8F2024"><enum>(1)</enum><text>The percentage of such veterans who found employment before the end of the second calendar quarter after exiting the program.</text></paragraph><paragraph id="H3C8913A578924976827A82324D5EBE93"><enum>(2)</enum><text>The percentage of such veterans who found employment before the end of the fourth calendar quarter after exiting the program.</text></paragraph><paragraph id="HD57ABD5855374DA6A9BBE3930A459702"><enum>(3)</enum><text>The median earnings of all such veterans for the second quarter after exiting the program.</text></paragraph><paragraph id="H1FD8BED5A92C466F9317AF928F92294A"><enum>(4)</enum><text>The percentage of such veterans who attain a recognized postsecondary credential during the 12-month period after exiting the program.</text></paragraph></subsection><subsection id="H389D49D684FF489BA34A53EDADB2169F"><enum>(j)</enum><header>Comptroller General report</header><text>Not later than 180 days after the termination of the retraining assistance program under subsection (l), the Comptroller General shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the outcomes and effectiveness of the program.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H51271507975F412A9ABB46A095F374B4"><enum>(5)</enum><text>in subsection (l), as so redesignated, by striking <quote>No retraining assistance may be paid under this section after the date that is 21 months after the date of the enactment of this Act</quote> and inserting <quote>No retraining assistance may be paid under this section for a covered program of education that begins on or after December 11, 2022</quote>;</text></paragraph><paragraph id="HBF2A78F3A7B74C5B959E6FD9A740A901"><enum>(6)</enum><text>in subsection (m), as so redesignated, by inserting at the end the following new sentences: <quote>Amounts made available to carry out this section shall be deposited in the Department of Veterans Affairs, Veterans Benefits Administration, Readjustment Benefits account. If any amounts so appropriated are deposited into a different account of the Department, the Secretary shall transfer an amount equal to such deposited amounts from the account to which the amounts were deposited to the Department of Veterans Affairs, Veterans Benefits Administration, Readjustment Benefits account. Not more than $386,000,000 may be obligated or expended to carry out this section.</quote>; and</text></paragraph><paragraph id="HC72C8C04C4AF45CDB043957DB724F35A"><enum>(7)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H6F0B34F100684986A0E4EB036C633BE0" display-inline="no-display-inline"><subsection id="H97AEE86DB3CE444CAFFBECD9E7FDBBE4" commented="no"><enum>(n)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H62FD478DF2B544D3A7DB32DDD221A8BC" commented="no"><enum>(1)</enum><text>The term <term>covered public health emergency</term> means the declaration—</text><subparagraph id="HEF36D190EF3B45819FE580F6935D84D2" commented="no"><enum>(A)</enum><text>of a public health emergency, based on an outbreak of COVID–19 by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); or</text></subparagraph><subparagraph id="H242142B7660946B2B3B0FE1A633C3B0F" commented="no"><enum>(B)</enum><text>of a domestic emergency, based on an outbreak of COVID–19 by the President, the Secretary of Homeland Security, or State, or local authority.</text></subparagraph></paragraph><paragraph id="H5464B03E455844499F87A83194244EFA" commented="no"><enum>(2)</enum><text>The term <term>veteran</term> means—</text><subparagraph id="H87245746075F4799B7CB580289A3B5FE" commented="no"><enum>(A)</enum><text>a person who served in the active military, naval, or air service, and who was discharged or released therefrom under conditions other than dishonorable; or</text></subparagraph><subparagraph id="HA178B49F11C44B6E930EAC08C88C3CB3" commented="no"><enum>(B)</enum><text>a member of a reserve component of the Armed Forces who performs active service for a period of 30 days or longer by reason of the covered public health emergency.</text></subparagraph></paragraph><paragraph id="H04CB0CF3EDBF47ADAA2052B92798CF88" commented="no"><enum>(3)</enum><text>The term <term>active service</term> has the meaning given such term in section 101 of title 10, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H62A6AB65501348D99DCD468A692484BE"><enum>3.</enum><header>Information provided by Department of Veterans Affairs about postsecondary educational institutions</header><subsection id="HB3E62FFCDD044EDE9B1B539E9985231A"><enum>(a)</enum><header>Additional information To be provided</header><text display-inline="yes-display-inline">Subsection (c) of section 3698 of title 38, United States Code, is amended—</text><paragraph id="H4EB436A505CF4C048B0A52A81BBC5838"><enum>(1)</enum><text>in paragraph (1)(C)—</text><subparagraph id="HB072ECE848EA48C981514DF1CF19616F"><enum>(A)</enum><text>in clause (xi), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H415411BCE19A42F589E9AB91DC82772A"><enum>(B)</enum><text>in clause (xii), by striking the period and inserting a semicolon; and</text></subparagraph><subparagraph id="H57F7982550224A689E6978D13E089AF7"><enum>(C)</enum><text>by adding at the end the following new clauses:</text><quoted-block display-inline="no-display-inline" id="H6D85F879CF37485492604C1B4BA77E24" style="USC"><clause id="H38A3BAD4F4794688B5A8E0FC1EF41F59" indent="up1"><enum>(xiii)</enum><text display-inline="yes-display-inline">whether the institution is listed on the College Navigator website as affiliated with a religion and, if so, which religious denomination;</text></clause><clause id="H97E847BCB9CE4BFABF4233225FC9E2AA" indent="up1"><enum>(xiv)</enum><text display-inline="yes-display-inline">whether the Secretary of Education or other head of a department or agency of the Federal Government has determined that the institution is a minority serving institution and, if so, which one or more types of minority serving institutions; and</text></clause><clause id="HF706B1235BAB45878B8AC5F51338E50E" indent="up1"><enum>(xv)</enum><text>whether the institution is gender specific.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6225952A91F14A5099F8620DF13D8F5D"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following new sentence: <quote>To the extent practicable, the Secretary shall ensure that such information is provided in a searchable format.</quote>.</text></paragraph></subsection><subsection id="H2A2F6AF9A15A4DA4999959631F790931"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Subsection (f) of such section is amended by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H0552AD863FEE4BCE8F03BCAFFD92576A" style="USC"><paragraph id="H09F3D35EB6304A209FA40C9352F9C692"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>College Navigator website</term> has the meaning given that term in section 132 of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1015a">20 U.S.C. 1015a</external-xref>).</text></paragraph><paragraph id="H2EF6BBD227CA442CA2917BBE0FF61FAA"><enum>(4)</enum><text>The term <term>minority serving institution</term> means any of the following:</text><subparagraph id="H42C0205303624C93ACD4CE1826AD2B2C"><enum>(A)</enum><text>A part B institution, as such term is defined in section 322(2) of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>).</text></subparagraph><subparagraph id="H5F5D61556F2C482893F689698683A72B"><enum>(B)</enum><text>A Hispanic-serving institution, as such term is defined in section 502(a)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(5)</external-xref>).</text></subparagraph><subparagraph id="HDB480CE07AE8404F897CF07511D36433"><enum>(C)</enum><text>A Tribal College or University, as such term is defined in section 316(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>).</text></subparagraph><subparagraph id="H247655AFEB0C4FDF9BC1BF73BE0B4422"><enum>(D)</enum><text>A predominantly Black institution, as such term is defined in section 318(b)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e(b)(6)</external-xref>).</text></subparagraph><subparagraph id="H0CF2CC20E54C417B9617911D7D55CD49"><enum>(E)</enum><text>A Native American-serving, nontribal institution, as such term is defined in section 319(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059f">20 U.S.C. 1059f(b)(6)</external-xref>).</text></subparagraph><subparagraph id="H553CB3DFF0CA4AB38F3193E4923AF95A"><enum>(F)</enum><text>An Alaska Native-serving institution or Native Hawaiian-serving institution, as such terms are defined in section 317(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>).</text></subparagraph><subparagraph id="HBBD852ACAE0444E6A0F11D7408F4AE8F"><enum>(G)</enum><text display-inline="yes-display-inline">An Asian American and Native American Pacific Islander-serving institution, as such term is defined in section 320(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g(b)</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H35044B9FD56E40A7B5B7F114653A6632"><enum>(c)</enum><header>Application</header><text>The amendments made by this section shall apply with respect to the information provided under section 3698 of title 38, United States Code, beginning on the date that is two years after the date of the enactment of this Act.</text></subsection></section><section id="HFC9008B608834EE2AAF1D2BB196AA57E"><enum>4.</enum><header>Delay of effective date for limitation on colocation and administration of State approving agencies</header><text display-inline="no-display-inline">Section 1024 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H561C5089C5A246CA87FDD94C75B68AAE" display-inline="no-display-inline"><section id="H707D91BB3BB64B80AA3F3DC5F76B59F2"><enum>1024.</enum><header>Limitation on colocation and administration of State approving agencies</header><subsection id="H23F55FF216CD425DA95422BFE289A73E"><enum>(a)</enum><header>In general</header><text>Section 3671 of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block id="H1034C072473D4F6FAF5E6813ECA892B9" style="OLC"><subsection id="H9A5C00BC078E4B819369340E7C4A5C4A"><enum>(c)</enum><text>The Secretary may not recognize a State department or agency as the State approving agency for a State for purposes of this chapter if such department or agency is administered at, or colocated with, a university or university system that offers courses or programs of education that are subject to approval under this chapter by the State approving agency for that State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5064E76ADE14415995B4051BF938323D"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEFC7DB10FA964EDDB470B28DF0341695"><enum>5.</enum><header>Clarification of applicability of treatment of certain for-profit educational institutions</header><subsection id="HA11F385A2C404DC6BFC07CB89E343B68"><enum>(a)</enum><header>Clarification</header><text display-inline="yes-display-inline">Section 1022(c) of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended by inserting <quote>, or the conversion of a for-profit educational institution to a public educational institution,</quote> after <quote>nonprofit educational institution</quote>.</text></subsection><subsection id="HA01ACA6F06BF4321A4D1AF1F9034D8BA"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply as if included in the enactment of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>).</text></subsection></section><section id="H1FE3FBE29A6E4382B0D8B63742434ACE"><enum>6.</enum><header>Clarifications regarding requirements for educational institutions participating in the educational assistance programs of the Department of Veterans Affairs</header><text display-inline="no-display-inline">Subsection (f) of section 3679 of title 38, United States Code, as added by section 1018 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>), is amended—</text><paragraph id="HD0818267459A4F849390757F44E17874"><enum>(1)</enum><text>in paragraph (1)(E), by inserting <quote>, to the maximum extent practicable,</quote> after <quote>including</quote>; </text></paragraph><paragraph id="H6AC9DDC9DB2040D5A1CEEB3D98F27B2C"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HB7E1170AD98E49869BA3688D2FE4CA2A"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, or any person with whom the institution has an agreement to provide educational programs, marketing, advertising, recruiting or admissions services,</quote> after <quote>educational institution</quote>;</text></subparagraph><subparagraph id="H95DCB6BC02424391888A80964FF1359F"><enum>(B)</enum><text>in paragraph (A)(ii), by striking <quote>1-month</quote> and inserting <quote>one-month</quote>; and</text></subparagraph><subparagraph id="H73F1AC09581749568DCBBC1705C4310B"><enum>(C)</enum><text>by striking subparagraph (B) and inserting the following new subparagraph (B):</text><quoted-block style="USC" id="HE2094497D5844A34AF5645FA7B7705A5" display-inline="no-display-inline"><subparagraph id="H40D378AF14A941CEB216BF7D22DE9377" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Provides a commission, bonus, or other incentive payment based directly or indirectly on success in securing enrollments or financial aid to any persons or entities engaged in any student recruiting or admission activities or in making decisions regarding the award of student financial assistance. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4C76618D5B8E4A2FBFEC76F9B829E799"><enum>(3)</enum><text>in paragraph (4)(A), by striking clause (ii) and inserting the following new clauses:</text><quoted-block style="USC" id="H049D33C7F62541738B18CBC8425845BE" display-inline="no-display-inline"><clause id="H399F6FF4953B47AD865C07B89637B227" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">Suspending the approval of the courses and programs of education offered by the educational institution by disapproving new enrollments of eligible veterans and eligible persons in each course or program of education offered by that educational institution.</text></clause><clause id="H2A96E5741B864B049814B7914E4B8EA8" indent="up2"><enum>(iii)</enum><text>Revoking the approval of the courses and programs of education offered by the educational institution by disapproving all enrollments of eligible veterans and eligible persons in each course or program of education offered by that educational institution</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H206F0CD42F4A46FDBD860999E085B998"><enum>(4)</enum><text>in paragraph (5)(A), by striking <quote>1-academic-year period</quote> and inserting <quote>one-academic-year period</quote>. </text></paragraph></section><section id="H9C5F88797AF24543AA93558EE5FD10FA"><enum>7.</enum><header>Technical corrections</header><subsection id="H7507FFD297F94C49B9B107D39BC349A5"><enum>(a)</enum><header>Title 38</header><text display-inline="yes-display-inline">Title 38, United States Code, is amended as follows:</text><paragraph id="HE8689F4E49BC49CE98CBC7250E3058CD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The second section 1164, as added by section 5501 the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>), is redesignated as section 1166 and transferred so as to appear after section 1165 (and the table of sections at the beginning of chapter 11 of such title is conformed accordingly).</text></paragraph><paragraph id="HECCFF7025CDA400486587A1023E14E62"><enum>(2)</enum><text>Subsection (l) of section 3313, as added by section 1010 of such Act (as effective on August 1, 2021), is amended to read as follows:</text><quoted-block style="USC" id="H3A005722EB8643B391D5583FF83DEE91" display-inline="no-display-inline"><subsection id="H52F5D8B8F3F447FFA91982C401A3E656"><enum>(l)</enum><header>Verification of enrollment</header><paragraph commented="no" display-inline="no-display-inline" id="H781A4A2128534179A42F65D0400B8737"><enum>(1)</enum><header>In general</header><text>The Secretary shall require—</text><subparagraph id="H44801DB0E40948D6B69335E686990872"><enum>(A)</enum><text display-inline="yes-display-inline">each educational institution to submit to the Secretary verification of each individual who is enrolled in a course or program of education at the educational institution and is receiving educational assistance under this chapter—</text><clause id="H433362496F714C86B234C57595E65C6C"><enum>(i)</enum><text>not later than such time as the Secretary determines reasonable after the date on which the individual is enrolled; and</text></clause><clause id="H621ABD9C0F9544DAA64000A71CCE3B57"><enum>(ii)</enum><text>not later than such time as the Secretary determines reasonable after the last date on which a student is able to withdraw from the course or program of education without penalty; and</text></clause></subparagraph><subparagraph id="H38CFEBB5E5E44F1F9525609690DBF7A7"><enum>(B)</enum><text display-inline="yes-display-inline">each individual who is enrolled in a course or program of education and is receiving educational assistance under this chapter to submit to the Secretary verification of such enrollment for each month during which the individual is so enrolled and receiving such educational assistance.</text></subparagraph></paragraph><paragraph id="H2C301C434A5D427883D2F69EBD174E75" display-inline="no-display-inline"><enum>(2)</enum><header>Form of verification</header><text>Verification under this subsection shall be in an electronic form prescribed by the Secretary.</text></paragraph><paragraph id="H96A49A9EEEF342D7B4001DF74FB3CF65"><enum>(3)</enum><header>Failure to submit verification</header><text>If an individual fails to submit the verification required under paragraph (1)(B) for two consecutive months, the Secretary may not make a monthly housing stipend payment to the individual under this section until the individual submits such verification.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HAC40AF74FBFC468D833ADF077DEADECF"><enum>(3)</enum><text display-inline="yes-display-inline">Section 3673A, as added by section 1013 of such Act, is amended—</text><subparagraph id="H1AE6B75B7F4A4826B1E7BD33151DB7F0"><enum>(A)</enum><text>in subsection (a), by striking <quote>searchable</quote>; and</text></subparagraph><subparagraph id="HAB5D8DA524F945E39523A0F16A6E89A4"><enum>(B)</enum><text>in subsection (c), by inserting <quote>searchable</quote> before <quote>database</quote>.</text></subparagraph></paragraph><paragraph id="HC61AF80DC6134830B19187A3DAD94263"><enum>(4)</enum><text>The subsection (f) of section 3679, as added by section 1017 of such Act, is redesignated as paragraph (3) of subsection (a) of such section 3679 and is transferred so as to appear after paragraph (2) of such subsection.</text></paragraph><paragraph id="H9EF1A5EE54F8489C9B1B615F3D5C302E" commented="no"><enum>(5)</enum><text>Section 3696(g)(4)(A)(iii)(III), as amended by section 1020 of such Act, is amended by striking <quote>paragraph (3)(B) of this subsection</quote> and inserting <quote>paragraph (3)</quote>.</text></paragraph></subsection><subsection id="H4FD87C7F0E594B6B841885D7E2B58046" commented="no"><enum>(b)</enum><header>Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020</header><text display-inline="yes-display-inline">The Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended as follows:</text><paragraph id="HC13A2E1DE1BD43158B2E23C8CF79F900" commented="no"><enum>(1)</enum><text>In section 1013(a)(1), by inserting <quote>of title 38</quote> after <quote>of chapter 36</quote>.</text></paragraph><paragraph id="H329D1CAF93AB4F2A8095E56794ECBFF3"><enum>(2)</enum><text>In section 2205(c)—</text><subparagraph id="H9CA6320593EF4A8EB13F5E329ABFA454"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Effective date</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Applicability</header-in-text></quote>; and</text></subparagraph><subparagraph id="H4B89A4B7CEE1493C9244A2CE9BB46771"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the date that is two years after the date of the enactment of this Act</quote> and inserting <quote>the date of the enactment of this Act and shall apply with respect to grants applications submitted on or after the date that is two years after the date of the enactment of this Act.</quote></text></subparagraph></paragraph><paragraph id="H6EEFE68E01214AD1A351795F2335D384" commented="no"><enum>(3)</enum><text>In section 4101(b), by striking <quote>subchapter</quote> and inserting <quote>chapter</quote>. </text></paragraph><paragraph id="H16A12D83FE2D4604BB8F1A5AEA01206C" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">In section 5501—</text><subparagraph id="HBAA5DF2ACB2E4127B59FAA67AD2C5DD3"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>of such title</quote> and inserting <quote>of title 38, United States Code</quote>; and</text></subparagraph><subparagraph id="HB8EC069126BB41C1B7DEF613C9236CB3"><enum>(B)</enum><text>in subsection (b), by striking <quote>section 1164</quote> each place it appears and inserting <quote>section 1166</quote>. </text></subparagraph></paragraph></subsection></section><section id="H5AAC5405FD8C4BD9A651EE98A171B05F"><enum>8.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
