R. 2376</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210405">April 5, 2021</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> (for himself, <cosponsor name-id="C001080">Ms. Chu</cosponsor>, <cosponsor name-id="L000593">Mr. Levin of California</cosponsor>, and <cosponsor name-id="M001180">Mr. McKinley</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title V of the Public Health Service Act to provide for increased oversight of recovery housing, and for other purposes.</official-title></form><legis-body id="HA1172A8037834DE687BE348093B95175" style="OLC"><section id="H70BA442180F24A7CBD4CB65FF8E5A4AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Excellence in Recovery Housing Act</short-title></quote>.</text></section><section id="H655E05A51E184FD0BAF8621050E77AAA" commented="no"><enum>2.</enum><header>Clarifying the role of SAMHSA in promoting the availability of high-quality recovery housing</header><text display-inline="no-display-inline">Section 501(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref>) is amended—</text><paragraph id="H42386FC0524942E2BBA6C3251F0D2F89" commented="no"><enum>(1)</enum><text>in paragraph (24)(E), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H0B6A2CF44FE740EF8CF8212DD380989C" commented="no"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF3C1D0DBE293440085D1E3EAB8F6738D" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HAEAB75FA13354CE4BB9F3F7B27F3A8D5" display-inline="no-display-inline"><paragraph id="H117137E296954A2AB257642C9AE930FE" commented="no"><enum>(26)</enum><text display-inline="yes-display-inline">collaborate with national accrediting entities and reputable providers and analysts of recovery housing services and all relevant Federal agencies, including the Centers for Medicare &amp; Medicaid Services, the Health Resources and Services Administration, other offices and agencies within the Department of Health and Human Services, the Office of National Drug Control Policy, the Department of Justice, the Department of Housing and Urban Development, and the Department of Agriculture, to promote the availability of high-quality recovery housing for individuals with a substance use disorder. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HBCF0E34B94784893A00906AF01401E77"><enum>3.</enum><header>Developing guidelines for States to promote the availability of high-quality recovery housing</header><text display-inline="no-display-inline">Title V of the Public Health Service Act is amended by inserting after section 550 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>) the following:</text><quoted-block style="OLC" id="H647243C960C141E98398E46529C93C6D" display-inline="no-display-inline"><section id="HE9A24A63667143288463C30DBACC9248" commented="no"><enum>550A.</enum><header>Developing guidelines for States to promote the availability of high-quality recovery housing</header><subsection id="HF1E0F94ECAFC4775A615601C397D0410"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this section, the Secretary, acting through the Assistant Secretary, shall develop, and publish on the internet website of the Substance Abuse and Mental Health Services Administration, consensus-based guidelines and nationally recognized standards for States to promote the availability of high-quality recovery housing for individuals with a substance use disorder. Such guidelines shall—</text><paragraph id="HF2D163CA6FC8473C96CA1EF70032910B"><enum>(1)</enum><text display-inline="yes-display-inline">be developed in consultation with national accrediting entities, reputable providers and analysts of recovery housing services, and States and be consistent with the best practices developed under section 550; and</text></paragraph><paragraph id="H964C8811CC25482292E5ACC0BDF2E1C5"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, build on existing best practices and suggested guidelines developed previously by the Substance Abuse and Mental Health Services Administration.</text></paragraph></subsection><subsection id="HCBBE5418D12F4DD9B69100890EFABC0C"><enum>(b)</enum><header>Public comment period</header><text>Before finalizing guidelines under subsection (a), the Secretary of Health and Human Services shall provide for a public comment period.</text></subsection><subsection id="HF787FBFB8C04483AAEE14487D233B32F"><enum>(c)</enum><header>Exclusion of guideline on treatment services</header><text>In developing the guidelines under subsection (a), the Secretary may not include any guideline or standard with respect to substance use disorder treatment services.</text></subsection><subsection id="H3A669AB4E40D43179710003A27A49CBF"><enum>(d)</enum><header>Substance use disorder treatment services</header><text display-inline="yes-display-inline">In this section, the term <term>substance use disorder treatment services</term> means items or services furnished for the treatment of a substance use disorder, including—</text><paragraph id="H87646056AF4C4D42BD0B3F4CC89646C5"><enum>(1)</enum><text display-inline="yes-display-inline">medications approved by the Food and Drug Administration for use in such treatment, excluding each such medication used to prevent or treat a drug overdose;</text></paragraph><paragraph id="H8B5051BE835A400BA14B98D6C0C81192" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the administering of such medications;</text></paragraph><paragraph id="H74D0EDA9FB5C48B492F6F3CE65351E34"><enum>(3)</enum><text>recommendations for such treatment;</text></paragraph><paragraph id="H606AEDC2A6434CB19862BF0D6A5BBB56"><enum>(4)</enum><text>clinical assessments and referrals;</text></paragraph><paragraph id="HD72C640344FE4B1995DEA422B114B959"><enum>(5)</enum><text>counseling with a physician, psychologist, or mental health professional (including individual and group therapy); and</text></paragraph><paragraph id="HE096673A79354D78B896EC9A3F1D0949"><enum>(6)</enum><text>toxicology testing.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2468A548E9B641E2BA344B142AC90DAA"><enum>4.</enum><header>Coordination of Federal activities to promote the availability of high-quality recovery housing</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>) is amended—</text><paragraph id="H17347AE6CA1245B68CE2E62521365504"><enum>(1)</enum><text>by redesignating subsections (e), (f), and (g) as subsections (g), (h), and (i), respectively; and</text></paragraph><paragraph id="H7968A9D6372E4B8F88CD15021D31678E"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" id="HEF25AF40BABC4AA7B7B8A5451042D850" display-inline="no-display-inline"><subsection id="HEAD2BE201E65438AB10BFCB2A93EFDBD"><enum>(e)</enum><header>Coordination of Federal activities To promote the availability of high-Quality recovery housing for individuals with a substance use disorder</header><paragraph id="HB1C027DA947248A6AA0139B9417FC1FE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary, and the Secretary of the Department of Housing and Urban Development shall convene and serve as the co-chairs of an interagency working group composed of representatives of each of the Federal agencies described in paragraph (2) (referred to in this section as the <quote>working group</quote>) for the following purposes:</text><subparagraph id="HF4B2556FDD5C4AA78AF5AB28ACE99AE6"><enum>(A)</enum><text display-inline="yes-display-inline">To increase collaboration, cooperation, and consultation among such Federal agencies, with respect to promoting the availability of high-quality recovery housing.</text></subparagraph><subparagraph id="H3FE7BF5D89AC4115B9815DF5A653D85F"><enum>(B)</enum><text display-inline="yes-display-inline">To align the efforts of such agencies and avoid duplication of such efforts by such agencies.</text></subparagraph><subparagraph id="HB8991B3CCF52481C899FB0C4697C3A0F"><enum>(C)</enum><text display-inline="yes-display-inline">To develop objectives, priorities, and a long-term plan for supporting State, Tribal, and local efforts with respect to the operation of high-quality recovery housing that is consistent with the best practices developed under this section.</text></subparagraph><subparagraph id="HE14EA9DBADBA447F866AF6F92F1626BB"><enum>(D)</enum><text display-inline="yes-display-inline">To coordinate inspection and enforcement among Federal and State agencies.</text></subparagraph><subparagraph id="H1C08D7B2C13848A1AC20DFCFC72E53E1"><enum>(E)</enum><text>To coordinate data collection on the quality of recovery housing.</text></subparagraph></paragraph><paragraph id="HE9DBA985510E4817BAEB114F595C6FCD"><enum>(2)</enum><header>Federal agencies described</header><text display-inline="yes-display-inline">The Federal agencies described in this paragraph are the following:</text><subparagraph id="H0060F89AEA914C8484E3413463B72D16"><enum>(A)</enum><text>The Department of Health and Human Services.</text></subparagraph><subparagraph id="H867EA621AC57470FB5D5A383E33C5247"><enum>(B)</enum><text>The Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="H1E4670B20C854B90ACFADC7B6F541DD4"><enum>(C)</enum><text>The Substance Abuse and Mental Health Services Administration.</text></subparagraph><subparagraph id="H488D24C6EAFA4390B2505EEB06671911"><enum>(D)</enum><text>The Health Resources and Services Administration.</text></subparagraph><subparagraph id="H9436AF5056A343AEBCF717A04072B37B"><enum>(E)</enum><text>The Indian Health Service.</text></subparagraph><subparagraph id="H505DFB8863A8416E8A78AAC5B292A589"><enum>(F)</enum><text display-inline="yes-display-inline">The Department of Housing and Urban Development.</text></subparagraph><subparagraph id="H175A7E7F76D84F6B8BFD4909420D7BB5"><enum>(G)</enum><text display-inline="yes-display-inline">The Department of Agriculture.</text></subparagraph><subparagraph id="HB77A7072EFE04849AF239275A8E7292D"><enum>(H)</enum><text>The Department of Justice.</text></subparagraph><subparagraph id="H3B67B4F29C094A4A85AD8CE830FEC0E3"><enum>(I)</enum><text>The Office of National Drug Control Policy.</text></subparagraph><subparagraph id="H28FF12DDAC624F9D9446A82E38F75069"><enum>(J)</enum><text display-inline="yes-display-inline">The Bureau of Indian Affairs.</text></subparagraph><subparagraph id="HA1494AA5E9444522A64AE1B09A611F3D"><enum>(K)</enum><text>The Department of Labor.</text></subparagraph><subparagraph id="H6665FDDDCB704BD5A880728879820075"><enum>(L)</enum><text display-inline="yes-display-inline">Any other Federal agency as the co-chairs determine appropriate.</text></subparagraph></paragraph><paragraph id="H2D6A07039A364D67889201D2E6DE5A40"><enum>(3)</enum><header>Meetings</header><text>The working group shall meet on a quarterly basis.</text></paragraph><paragraph id="HEE5F882FBB6C4CF2BB241B5D4E602B56"><enum>(4)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of the enactment of this section and annually thereafter, the working group shall submit to the Committee on Energy and Commerce, the Committee on Ways and Means, the Committee on Agriculture, and the Committee on Financial Services of the House of Representatives and the Committee on Health, Education, Labor, and Pensions, the Committee on Agriculture, Nutrition, and Forestry, and the Committee on Finance of the Senate a report describing the work of the working group and any recommendations of the working group to improve Federal, State, and local policy with respect to recovery housing operations.</text></paragraph><paragraph id="H6D215E1E23874CC58805519CC182D086"><enum>(5)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this subsection, there are authorized to be appropriated such sums as may be necessary for fiscal years 2022 through 2027.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE7F4ED2A79BB4F1CAFD8A174532D693A"><enum>5.</enum><header>NAS study and report</header><subsection id="H7E24B5FDC62F46AFBACA89D5A3ED106A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Assistant Secretary for Mental Health and Substance Use, shall enter into an arrangement with the National Academies of Sciences, Engineering, and Medicine to conduct a study, which may include a literature review and case studies as appropriate, on—</text><paragraph id="HB673D0C95CBC4C72AE3B87C2B3033D3E"><enum>(1)</enum><text>the quality and effectiveness of recovery housing in the United States, including the availability in the United States of high-quality recovery housing and whether that availability meets the demand for such housing in the United States; and</text></paragraph><paragraph id="H9BB7FDE575BC4568A2886A06F092A95E"><enum>(2)</enum><text>State, Tribal, and local regulation and oversight of recovery housing.</text></paragraph></subsection><subsection id="H4331E9876F5A4ED7BD4658F08E0D0693"><enum>(b)</enum><header>Topics</header><text>The study under subsection (a) shall include a literature review of studies that—</text><paragraph id="HF52DB4AB40BC49829B7AB87449C02FFF"><enum>(1)</enum><text>examine the quality of, and effectiveness outcomes for, the types and characteristics of covered recovery housing programs listed in subsection (c); and</text></paragraph><paragraph id="HACFEA926C9CF41B883B17F3319CA4B6F"><enum>(2)</enum><text>identify the research and data gaps that must be filled to better report on the quality of, and effectiveness outcomes related to, covered recovery housing.</text></paragraph></subsection><subsection id="HAD934B0B25954929929128529260C646"><enum>(c)</enum><header>Type and characteristics</header><text>The types and characteristics of covered recovery housing programs referred to in subsection (b) consist of the following:</text><paragraph id="H3D1CB3B5448B4CF09E48EE376AF8D96A"><enum>(1)</enum><text>Nonprofit and for-profit covered recovery housing.</text></paragraph><paragraph id="H54C9FBD54CAD444981691D9ABB81B650"><enum>(2)</enum><text>Private and public covered recovery housing.</text></paragraph><paragraph id="H33E331F2ACC743B1A45BF671421041E2"><enum>(3)</enum><text>Covered recovery housing programs that provide services to—</text><subparagraph id="HEB66283D230348BB98A3F0193A35A8F5"><enum>(A)</enum><text>residents on a voluntary basis; and</text></subparagraph><subparagraph id="HECB99A0E0AC14DADA4C8B2AA7F4AE701"><enum>(B)</enum><text>residents pursuant to a judicial order.</text></subparagraph></paragraph><paragraph id="H4D3BBE119ABD4B91B02E078EA45D24D6"><enum>(4)</enum><text>Number of clients served, disaggregated to the extent possible by covered recovery housing serving—</text><subparagraph id="H391A5DC3750A4F839B470324F6908FE1"><enum>(A)</enum><text>6 or fewer recovering residents;</text></subparagraph><subparagraph id="HAA410E7A7F564CE6B0CE63E962430A75"><enum>(B)</enum><text>10 to 13 recovering residents; and</text></subparagraph><subparagraph id="HABB58268BDB44184B1468C83E780F045"><enum>(C)</enum><text>18 or more recovering residents.</text></subparagraph></paragraph><paragraph id="HF993CCC3D3C24F83BA3FEC74DFFF7794"><enum>(5)</enum><text>Bedroom occupancy in a house, disaggregated to the extent possible by—</text><subparagraph id="HEAA4ED3E52434EA88B70822F598DCFAC"><enum>(A)</enum><text>single room occupancy;</text></subparagraph><subparagraph id="HF5DB921B82974EB18FC3BD4A8D2E38B2"><enum>(B)</enum><text>2 residents occupying 1 room; and</text></subparagraph><subparagraph id="HEE2F6A0BE4534F6E9E8D9E9F5BE17A37"><enum>(C)</enum><text>more than 2 residents occupying 1 room.</text></subparagraph></paragraph><paragraph id="HE2BB916C79BF46ECB69485E885F43905"><enum>(6)</enum><text>Duration of services received by clients, disaggregated to the extent possible according to whether the services were—</text><subparagraph id="H8627FF925CB64C5C949A526FB5A84815"><enum>(A)</enum><text>30 days or fewer;</text></subparagraph><subparagraph id="H18657609EC7F41AD869212389C1F9815"><enum>(B)</enum><text>31 to 90 days;</text></subparagraph><subparagraph id="HE2B0C2A39B4D4C6D8D687CCF0D75399D"><enum>(C)</enum><text>more than 90 days and fewer than 6 months; or</text></subparagraph><subparagraph id="H694402DC73AF4D37AF7EAB5536CEF3D9"><enum>(D)</enum><text>6 months or more.</text></subparagraph></paragraph><paragraph id="H1816E0E6274C4410AE21670B7FAFA4B7"><enum>(7)</enum><text>Certification levels of staff.</text></paragraph><paragraph id="H1E0A09EA30B2442A84AC37B9E4966F12"><enum>(8)</enum><text display-inline="yes-display-inline">Fraudulent and abusive practices by operators of covered recovery housing and inpatient and outpatient treatment facilities, both individually and in concert, including—</text><subparagraph id="HC718FC6CE91A4E0DA8C2A4EE3A6AC269"><enum>(A)</enum><text>deceptive or misleading marketing practices, including—</text><clause id="H6E53AC271ED5436F9850A2C673253F7B"><enum>(i)</enum><text>inaccurate outcomes-based marketing; and</text></clause><clause id="HE43C622E2326458CA503E07426DB19FA"><enum>(ii)</enum><text>marketing based on non-evidence-based practices;</text></clause></subparagraph><subparagraph id="HE889CB9BCCA549FDAED1E73FCC37ABA1"><enum>(B)</enum><text>illegal patient brokering;</text></subparagraph><subparagraph id="H0ECA4A021B56445394F2FEAA659ECC6D"><enum>(C)</enum><text>third-party recruiters;</text></subparagraph><subparagraph id="HCC8F6B170BAF4B4FBA1F72A97DD088BF"><enum>(D)</enum><text>deceptive or misleading marketing practices of treatment facility and recovery housing online aggregators; and</text></subparagraph><subparagraph id="HB54DCCF54CAC43D4B8A87C8BD9AA8124"><enum>(E)</enum><text>the impact of such practices on health care costs and recovery rates.</text></subparagraph></paragraph></subsection><subsection id="H2E77DAB80A9F421E8CB14572AF52ADD2"><enum>(d)</enum><header>Report</header><text>The arrangement under subsection (a) shall require, by not later than 18 months after the date of entering into the agreement—</text><paragraph id="H601CE3C708634E0A9BB7756F43EFACA1"><enum>(1)</enum><text>completing the study under such subsection; and</text></paragraph><paragraph id="HC57AECC434ED46F6A54286FB4AC0786F"><enum>(2)</enum><text>making publicly available (including through publication on the internet) a report that contains—</text><subparagraph id="H99CB867253DA4CDF9A94CAD25CD93F11"><enum>(A)</enum><text>the results of the study;</text></subparagraph><subparagraph id="H0DFF7488D6C04CB0A01AC6652FF298F4"><enum>(B)</enum><text>the National Academy’s recommendations for Federal, State, and local policies to promote the availability of high-quality recovery housing in the United States;</text></subparagraph><subparagraph id="H9E940AC9E9E24CB09B38438289D7A013"><enum>(C)</enum><text>research and data gaps;</text></subparagraph><subparagraph id="HF6C88E0DA2A048AAB740B3EA73DB378A"><enum>(D)</enum><text>recommendations for recovery housing quality and effectiveness metrics;</text></subparagraph><subparagraph id="H6596811830C54207BFC72827B5E86C61"><enum>(E)</enum><text>recommended mechanisms to collect data on those metrics, including with respect to research and data gaps;</text></subparagraph><subparagraph id="HB4D2EE25163B420F80CAC053B2ECFA02"><enum>(F)</enum><text>recommendations to eliminate restrictions by recovery housing that exclude individuals who take prescribed medications for opioid use disorder; and</text></subparagraph><subparagraph id="H04A3885145C540FA8C1F9AA44A411C0B"><enum>(G)</enum><text>a summary of allegations, assertions, or formal legal actions on the State and local levels by governments and nongovernmental organizations with respect to the opening and operation of recovery housing.</text></subparagraph></paragraph></subsection><subsection id="HF9D770E4A94941E8A7AB8ADC290E0726"><enum>(e)</enum><header>Definitions</header><text>In this subsection:</text><paragraph id="H457B1AA5D7AD42D68FDABFEDF9E9F6F0"><enum>(1)</enum><text>The term <term>covered recovery housing</term> means recovery housing that utilizes compensated or volunteer onsite staff who are not health care professionals to support residents.</text></paragraph><paragraph id="HB1FFB6CA43D949B4910E058B0FAFD7BB"><enum>(2)</enum><text>The term <term>effectiveness outcomes</term> may include decreased substance use, reduced probability of relapse or reoccurrence, lower rates of incarceration, higher income, increased employment, and improved family functioning.</text></paragraph><paragraph id="H64881E54979247768F73491D95F6D1AD"><enum>(3)</enum><text>The term <term>health care professional</term> means an individual who is licensed or otherwise authorized by the State to provide health care services.</text></paragraph><paragraph id="HA1859006A28C42808B94DA67883BE6D1"><enum>(4)</enum><text>The term <term>recovery housing</term> means a shared living environment that is or purports to be—</text><subparagraph id="H88A7B11380E545288F1DF9BED93C9912"><enum>(A)</enum><text>free from alcohol and use of nonprescribed drugs; and</text></subparagraph><subparagraph id="HF457364526DD4746AC43FB4A5430FB60"><enum>(B)</enum><text>centered on connection to services that promote sustained recovery from substance use disorders.</text></subparagraph></paragraph></subsection><subsection id="HD3AE447068EC4BBDA82C780615FFE619"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there is authorized to be appropriated $1,500,000 for fiscal year 2022.</text></subsection></section><section id="H9F3E664A2C2B497FBC62F410F5A19DE2"><enum>6.</enum><header>Filling research and data gaps</header><text display-inline="no-display-inline">Not later than 60 days after the completion of the study under section 5, the Secretary of Health and Human Services shall enter into an agreement with an appropriate entity to conduct such research as may be necessary to fill the research and data gaps identified in reporting pursuant to such section.</text></section><section id="H264B856AE8564B29AC2F1745F2B818DD"><enum>7.</enum><header>Grants for States to promote the availability of high quality recovery housing</header><text display-inline="no-display-inline">Section 550 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5</external-xref>), as amended by section 4, is further amended by inserting after subsection (e) (as inserted by section 4) the following:</text><quoted-block style="OLC" id="H1A0F1CAE8CF047B083564718C9E5F8BB" display-inline="no-display-inline"><subsection id="HA29D30A32C40420A9CEC57B78CBA7D56"><enum>(f)</enum><header>Grants for implementing national recovery housing best practices</header><paragraph id="H776E50595FD24CE4B4B123312633022F"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to States (and political subdivisions thereof), Tribes, and territories—</text><subparagraph id="H6E65CA1887624A6CB83E6C83B00E8432"><enum>(A)</enum><text display-inline="yes-display-inline">for the provision of technical assistance by national accrediting entities and reputable providers and analysts of recovery housing services to implement the guidelines, nationally recognized standards, and recommendations developed under section 3 of the <short-title>Excellence in Recovery Housing Act</short-title> and this section; and</text></subparagraph><subparagraph id="HD55EDC8752A9444ABF92CAFDF4EFA824"><enum>(B)</enum><text display-inline="yes-display-inline">to promote the availability of high-quality recovery housing for individuals with a substance use disorder and practices to maintain housing quality long term.</text></subparagraph></paragraph><paragraph id="HCE6166A13F74491CBB7DFB84D7FAE60F"><enum>(2)</enum><header>State enforcement plans</header><text display-inline="yes-display-inline">Beginning not later than 90 days after the date of the enactment of this paragraph and every 2 years thereafter, as a condition on the receipt of a grant under paragraph (1), each State (or political subdivisions thereof), Tribe, or territory receiving such a grant shall submit to the Secretary, and make publicly available on a publicly accessible Internet website of the State (or political subdivisions thereof), Tribe, or territory—</text><subparagraph id="H83A3EB0235934BC5AC71845EA64D4598"><enum>(A)</enum><text>the plan of the State (or political subdivisions thereof), Tribe, or territory, with respect to the promotion of high-quality recovery housing for individuals with a substance use disorder located within the jurisdiction of such State (or political subdivisions thereof), Tribe, or territory; and</text></subparagraph><subparagraph id="H548329D20E694BFDAF67D7664E6502D0"><enum>(B)</enum><text>a description of how such plan is consistent with the best practices developed under this section and guidelines developed under section 550A.</text></subparagraph></paragraph><paragraph id="H31212CF2DB94481B80882055F3F82B08"><enum>(3)</enum><header>Review of accrediting entities</header><text display-inline="yes-display-inline">The Secretary shall periodically review, by developing a rubric to evaluate accreditation, the accrediting entities providing technical assistance pursuant to paragraph (1)(A).</text></paragraph><paragraph id="HE57C2AE314B74E73A27416188C25AF89"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this subsection, there is authorized to be appropriated $10,000,000 for each of fiscal years 2023 through 2027.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE0F27E0AB17242D5B5FA34A2E14418B7"><enum>8.</enum><header>Reputable providers and analysts of recovery housing services definition</header><text display-inline="no-display-inline">Section 550(h) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-5">42 U.S.C. 290ee–5(i)</external-xref>), as redesignated by section 4, is amended by adding at the end the following: </text><quoted-block style="OLC" id="H2118743686CF4549A44FC8A76E8360CC" display-inline="no-display-inline"><paragraph id="HAA3A58F337184F688441023E56654A58"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>reputable providers and analysts of recovery housing services</term> means recovery housing service providers and analysts that—</text><subparagraph id="H4A332CB8963E4BCB9582F2A39B358D88"><enum>(A)</enum><text>use evidence-based approaches;</text></subparagraph><subparagraph id="HA0DB6325377F4F89AFEB744744C99613"><enum>(B)</enum><text>act in accordance with guidelines issued by the Assistant Secretary;</text></subparagraph><subparagraph id="HD0D1467010AF40DABA187DE9D2CE0DF1"><enum>(C)</enum><text display-inline="yes-display-inline">have not been found guilty of health care fraud, patient brokering, or false advertising by the Department of Justice, the Department of Health and Human Services, or a Medicaid Fraud Control Unit; </text></subparagraph><subparagraph id="H7BA7077157DA49D087A4D840AB09A4A5"><enum>(D)</enum><text>have not been found to have violated Federal, State, or local codes of conduct with respect to recovery housing for individuals with a substance use disorder; and</text></subparagraph><subparagraph id="H276B10EA986D419286CFB2E083AC5BA8"><enum>(E)</enum><text display-inline="yes-display-inline">do not employ individuals with a past conviction of criminal, domestic, or sexual violence, or significant drug distribution, in the care or supervision of individuals.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H76C71D2B961443689D73B9FC55BB0F1D"><enum>9.</enum><header>Technical correction</header><text display-inline="no-display-inline">Title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref> et seq.) is amended—</text><paragraph id="H0674585BE06E4590981F7B363771095E"><enum>(1)</enum><text>by redesignating section 550 (relating to Sobriety Treatment and Recovery Teams) (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-10">42 U.S.C. 290ee–10</external-xref>), as added by section 8214 of <external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>, as section 550B; and</text></paragraph><paragraph id="H906DB73928524600B021617FC6816B02"><enum>(2)</enum><text>moving such section so it appears after section 550A (added by section 3 of this Act).</text></paragraph></section></legis-body></bill>
