<section id="H720EECC084C24567AE7C3B610F99176B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Toll Credit Marketplace Act of 2021</short-title></quote>.</text></section> <section id="H916DAA8C7F2C4C0DA83C910CE1EEE9FE" section-type="subsequent-section"><enum>2.</enum><header>Transfer and sale of toll credits</header> <subsection id="HB769373781834C2BA47A339DE4973F48"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H151875724A03495FBD0B61A7E29F2F6A"><enum>(1)</enum><header>Originating State</header><text>The term <quote>originating State</quote> means a State that—</text> <subparagraph id="HB62C0F2572A0456E8B4CFA68BCEE9B3B"><enum>(A)</enum><text>is eligible to use a credit under section 120(i) of title 23, United States Code; and</text></subparagraph>
<subparagraph id="HA5A569F12ABD4F0BBFB0C21AEF3698DC"><enum>(B)</enum><text>has been selected by the Secretary under subsection (d)(2).</text></subparagraph></paragraph> <paragraph id="HAE04DE90E539498AB707AE308377F962"><enum>(2)</enum><header>Pilot program</header><text display-inline="yes-display-inline">The term <quote>pilot program</quote> means the pilot program established under subsection (b).</text></paragraph>
<paragraph id="H23F3EBE42AFC48B19E10294D6C4BC406"><enum>(3)</enum><header>Recipient State</header><text display-inline="yes-display-inline">The term <quote>recipient State</quote> means a State that receives a credit by transfer or by sale under this section from an originating State.</text></paragraph> <paragraph id="HC00463D3F09246EC9C4D30441CB2AF28"><enum>(4)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given the term in section 101(a) of title 23, United States Code. </text></paragraph></subsection>
<subsection id="H4C7D5816EF6A4354A7432D2DE9BD5CAE"><enum>(b)</enum><header>Establishment of pilot program</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish and implement a toll credit exchange pilot program in accordance with this section.</text></subsection> <subsection id="HFEC80F1BBE624F87A83D5A623279726B"><enum>(c)</enum><header>Purposes</header><text>The purposes of the pilot program are—</text>
<paragraph id="H9E7568A1FA5241FDA3F18C06167C617F"><enum>(1)</enum><text display-inline="yes-display-inline">to identify the extent of the demand to purchase toll credits;</text></paragraph> <paragraph id="HABDE4BCC90054C72ABA7BCAC6A76FC2F"><enum>(2)</enum><text display-inline="yes-display-inline">to identify the cash price of toll credits through bilateral transactions between States;</text></paragraph>
<paragraph id="HC653816E04AE44FD89F503BD1EC94C4C"><enum>(3)</enum><text display-inline="yes-display-inline">to analyze the impact of the purchase or sale of toll credits on transportation expenditures;</text></paragraph> <paragraph id="HA3FE2E90FE2D483293A8B9027C29F3C9"><enum>(4)</enum><text display-inline="yes-display-inline">to test the feasibility of expanding the pilot program to allow all States to participate on a permanent basis; and</text></paragraph>
<paragraph id="HC6E038731D8646388B48685D6F768EDC"><enum>(5)</enum><text display-inline="yes-display-inline">to identify any other repercussions of the toll credit exchange.</text></paragraph></subsection> <subsection id="H197D113A2A274FCBB540DE12CFF56183"><enum>(d)</enum><header>Selection of originating States</header> <paragraph id="H6C48DE63C2EA46E4951967E4019083BC"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">In order to participate in the pilot program as an originating State, a State shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including, at a minimum, such information as is required for the Secretary to verify—</text>
<subparagraph id="H36266E69ECA24746B14D1560262AE8C9"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of unused toll credits for which the State has submitted certification to the Secretary that are available to be sold or transferred under the pilot program, including—</text> <clause id="HEFA0AC0EC49C40AFBA26F61305BB1494"><enum>(i)</enum><text display-inline="yes-display-inline">toll revenue generated and the sources of that revenue;</text></clause>
<clause id="HF2892C3C8FDD420EB92D6862F88F9457"><enum>(ii)</enum><text display-inline="yes-display-inline">toll revenue used by public, quasi-public, and private agencies to build, improve, or maintain highways, bridges, or tunnels that serve the public purpose of interstate commerce; and</text></clause> <clause id="H48969D8F75F343B49C5084216B2D3AFD"><enum>(iii)</enum><text display-inline="yes-display-inline">an accounting of any Federal funds used by the public, quasi-public, or private agency to build, improve, or maintain the toll facility, to validate that the credit has been reduced by a percentage equal to the percentage of the total cost of building, improving, or maintaining the facility that was derived from Federal funds;</text></clause></subparagraph>
<subparagraph id="H2B3D4331070B4560B09DF069B216B1E8"><enum>(B)</enum><text display-inline="yes-display-inline">the documentation of maintenance of effort for toll credits earned by the originating State; and</text></subparagraph> <subparagraph id="HB696ECAC34B84C159B1FD795A0C48A55"><enum>(C)</enum><text display-inline="yes-display-inline">the accuracy of the accounting system of the State to earn and track toll credits.</text></subparagraph></paragraph>
<paragraph id="H08554146A99B4C889E627AE9BD7B7A44"><enum>(2)</enum><header>Selection</header><text display-inline="yes-display-inline">Of the States that submit an application under paragraph (1), the Secretary may select not more than 10 States to be designated as an originating State.</text></paragraph> <paragraph id="HD72C25A9390241768332B4054B3C2DEB"><enum>(3)</enum><header>Limitation on sales</header><text display-inline="yes-display-inline">At any time, the Secretary may limit the amount of unused toll credits that may be offered for sale under the pilot program.</text></paragraph></subsection>
<subsection id="HA10F2787FEB7441FBF4126EC1893344F"><enum>(e)</enum><header>Transfer or sale of credits</header>
<paragraph id="H5682CEDAD97E45AFAEDB3B25DC3858E6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the pilot program, the Secretary shall provide that an originating State may transfer or sell to a recipient State a credit not previously used by the originating State under section 120(i) of title 23, United States Code.</text></paragraph> <paragraph id="HF48C7F5DACF643BF9D8E1EAAF589FEC6"><enum>(2)</enum><header>Website support</header><text display-inline="yes-display-inline">The Secretary shall make available a publicly accessible website on which originating States shall post the amount of toll credits, verified under subsection (d)(1)(A), that are available for sale or transfer to a recipient State.</text></paragraph>
<paragraph id="H21EB2CD69AF7439296A7DC8B88AB0B1A"><enum>(3)</enum><header>Bilateral transactions</header><text display-inline="yes-display-inline">An originating State and a recipient State may enter into a bilateral transaction to sell or transfer verified toll credits.</text></paragraph> <paragraph id="HB36460014A784745970B47A149D826DD"><enum>(4)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which a credit is transferred or sold, the originating State and the recipient State shall jointly submit to the Secretary a written notification of the transfer or sale, including details on—</text>
<subparagraph id="H04FE439BE30543B0B5C64ED074F1788D"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of toll credits that have been sold or transferred;</text></subparagraph> <subparagraph id="H9A4BBD7BCFF64F21BEAFCA1C05443842"><enum>(B)</enum><text display-inline="yes-display-inline">the price paid or other value transferred in exchange for the toll credits;</text></subparagraph>
<subparagraph id="HCDA8A26847F24FFDB3D5200F899BD5AF"><enum>(C)</enum><text display-inline="yes-display-inline">the intended use by the recipient State of the toll credits, if known;</text></subparagraph> <subparagraph id="HCA153893EC0D466DBFDDF29E04DAE606"><enum>(D)</enum><text display-inline="yes-display-inline">the intended use by the originating State of the cash or other value transferred;</text></subparagraph>
<subparagraph id="HF0B8642FAE6642AAB2D3C8C8E0EEA247"><enum>(E)</enum><text display-inline="yes-display-inline">an update on the toll credit balance of the originating State and the recipient State; and</text></subparagraph> <subparagraph id="HB42B64B07A5A4466A98A87654F45A1B2"><enum>(F)</enum><text display-inline="yes-display-inline">any other information about the transaction that the Secretary may require.</text></subparagraph></paragraph>
<paragraph id="HE3280C2D5C2941CDB4594F788E6B688F"><enum>(5)</enum><header>Use of credits by transferee or purchaser</header><text display-inline="yes-display-inline">A recipient State may use a credit received under paragraph (1) toward the non-Federal share requirement for any funds made available to carry out title 23 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, in accordance with section 120(i) of title 23, United States Code.</text></paragraph> <paragraph id="H5E2E62CFFD524217AFC3C267CFB555A3"><enum>(6)</enum><header>Use of proceeds from sale of credits</header><text display-inline="yes-display-inline">An originating State shall use the proceeds from the sale of a credit under paragraph (1) for the construction costs of any project in the originating State that is eligible under title 23, United States Code.</text></paragraph></subsection>
<subsection id="H5C26A59826AF43F1B296DE4CC7B35DE2"><enum>(f)</enum><header>Reporting requirements</header>
<paragraph id="HFC03FE71333D471E908D0DC65183053F"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the pilot program is established, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the progress of the pilot program.</text></paragraph> <paragraph id="H0E6BD605B76A43B1B23B64DF0B3BD736"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the pilot program is established, the Secretary shall—</text>
<subparagraph id="HF84920B178B04625AF6265A61306D744"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that—</text> <clause id="HCD0DDDB42ADC40339E705DB83A982AC3"><enum>(i)</enum><text display-inline="yes-display-inline">determines whether a toll credit marketplace is viable and cost-effective;</text></clause>
<clause id="H024E90FF0358476EA52A7F6DB0B4ED6E"><enum>(ii)</enum><text display-inline="yes-display-inline">describes the buying and selling activities under the pilot program;</text></clause> <clause id="HE73BC42DC64843EA907E2D901C29928F"><enum>(iii)</enum><text display-inline="yes-display-inline">describes the average sale price of toll credits;</text></clause>
<clause id="H883D4B44E0194B3581D58C9517A7F0E0"><enum>(iv)</enum><text display-inline="yes-display-inline">determines whether the pilot program could be expanded to more States or all States or to non-State operators of toll facilities;</text></clause> <clause id="H17F40091120447598A04219B32715F7D"><enum>(v)</enum><text display-inline="yes-display-inline">provides updated information on the toll credit balance accumulated by each State; and</text></clause>
<clause id="H04304ABEEE7F4882B02AEB59676E27DE"><enum>(vi)</enum><text display-inline="yes-display-inline">describes the list of projects that were assisted by the pilot program; and</text></clause></subparagraph> <subparagraph id="H17661E1D212741D188B7969395E1BC43"><enum>(B)</enum><text display-inline="yes-display-inline">make the report under subparagraph (A) publicly available on the website of the Department.</text></subparagraph></paragraph></subsection>
<subsection id="H17623B0FB9504977A12F28C2E09554DD"><enum>(g)</enum><header>Termination</header>
<paragraph id="H42358D26644C4E5FBBB32D4F6359165A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may terminate the pilot program or the participation of any State in the pilot program if the Secretary determines that—</text> <subparagraph id="H8A2418998D1C49D1B23377DFD028ED1D"><enum>(A)</enum><text>the pilot program is not serving a public benefit; or</text></subparagraph>
<subparagraph id="H5D33D615B59C4A5088BA8E1D1389AAD7"><enum>(B)</enum><text>it is not cost effective to carry out the pilot program.</text></subparagraph></paragraph> <paragraph id="HFDABD60082B54221997A9CB54CAE8250"><enum>(2)</enum><header>Procedures</header><text display-inline="yes-display-inline">The termination of the pilot program or the participation of a State in the pilot program shall be carried out consistent with Federal requirements for project closeout, adjustment, and continuing responsibilities.</text></paragraph></subsection></section>
