R. 2284</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210329">March 29, 2021</action-date><action-desc><sponsor name-id="M001195">Mr. Mooney</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to clarify that gain or loss on the sale or exchange of certain coins or bullion is exempt from recognition.</official-title></form><legis-body id="H84680FA9A4EC4422A7BC2B738ADC10FD" style="OLC"><section id="H0D94B0E83FFB419E888320D45A2B47FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Monetary Metals Tax Neutrality Act of 2021</short-title></quote>.</text></section><section id="HF3C27083C2D14512BEB88B68DB65E978"><enum>2.</enum><header>Exemption from recognition of gain or loss from sale of certain coins or bullion</header><subsection id="H34B9D05872A144ECB3BA1327B4210DE9"><enum>(a)</enum><header>In general</header><text>Subchapter O of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after part IV the following new part:</text><quoted-block display-inline="no-display-inline" id="H9D2C91F82FC843D5B191155D7FA08AF1" style="OLC"><part id="H3C146F3B0111402FA8565935CFB2AE65"><enum>V</enum><header>Sale of Certain Coins or Bullion</header><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 1071. Sale of certain coins or bullion.</toc-entry></toc><section id="HFB6FF9E4CBC340EC925F9661F3ACE012"><enum>1071.</enum><header>Sale of certain coins or bullion</header><text display-inline="no-display-inline">No gain or loss shall be recognized on the sale or exchange of—</text><paragraph id="H0FB539D5B1A94EED8E16C899F34EDD9C"><enum>(1)</enum><text>gold, silver, platinum, or palladium coins minted and issued by the Secretary at any time, or</text></paragraph><paragraph id="H02676745CCB44F7A85F796286E6C374D"><enum>(2)</enum><text>refined gold or silver bullion, coins, bars, rounds, or ingots which are valued primarily based on their metal content and not their form.</text></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCFD7437AE58942CEA02D7FC7676DDF13"><enum>(b)</enum><header>Clerical amendment</header><text>The table of parts for subchapter O of chapter 1 of such Code is amended by inserting after the item relating to part IV the following new item:</text><quoted-block display-inline="no-display-inline" id="HFA4C940C1FDE4DA69831AED6328E056B" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="part">Part V—Sale of Certain Coins or Bullion</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDBABAC5904C84596A639A117665D9BBA"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to sales or exchanges after December 31, 2021.</text></subsection></section></legis-body></bill>
