R. 2196</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210326">March 26, 2021</action-date><action-desc><sponsor name-id="C001084">Mr. Cicilline</sponsor> (for himself, <cosponsor name-id="T000472">Mr. Takano</cosponsor>, <cosponsor name-id="R000610">Mr. Reschenthaler</cosponsor>, and <cosponsor name-id="G000592">Mr. Golden</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 9 of the United States Code to prohibit predispute arbitration agreements that force arbitration of certain disputes arising from claims of servicemembers and veterans.</official-title></form><legis-body id="H44D0EF863BE64C35BCCB55165758E9B3" style="OLC"><section id="H6F5A634ECF884293B1D66EE7F3BAB64A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Servicemembers Act</short-title></quote>.</text></section><section id="HB04A8E97AD134979AB4650A1A4EDC7F6"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="H3AAC27FC70B945C59D6468D38E075BEE"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit predispute arbitration agreements that force arbitration of disputes arising from claims brought under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38 of the United States Code (relating to employment and reemployment rights of members of the uniformed services) and the Servicemembers Civil Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3901">50 U.S.C. 3901–4043</external-xref>); and</text></paragraph><paragraph id="H0685E27EA25049D9B39D11DA7E8FA6B2"><enum>(2)</enum><text>to prohibit agreements and practices that interfere with the right of persons to participate in a joint, class, or collective action related to disputes arising from claims brought under the provisions of such laws.</text></paragraph></section><section id="H4C62D995DB3C450EA7CF61F2D064CA62"><enum>3.</enum><header>Arbitration of disputes involving the rights of servicemembers and veterans</header><subsection id="HB327ED51B4FE417C936EDA759FCDD3AF"><enum>(a)</enum><header>In general</header><text>Title 9 of the United States Code is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4523AFA709D0446384136B5C49B3FAC2" style="USC"><chapter id="H9D47DBCE9A0948C69A08B28C49CBAAAA"><enum>4</enum><header>Arbitration of Servicemember and Veteran Disputes</header><toc container-level="chapter-container" idref="H9D47DBCE9A0948C69A08B28C49CBAAAA" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry level="section">Sec.</toc-entry><toc-entry idref="H7710C1BCEC6D40259DFDBC46E8017D75" level="section">401. Definitions.</toc-entry><toc-entry idref="H144197CA9ACA4A3C80EC407B29DFF86C" level="section">402. No validity or enforceability.</toc-entry></toc><section id="H7710C1BCEC6D40259DFDBC46E8017D75"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text><paragraph id="H3D3C85A0271E441B889C19645A6C27B6"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>predispute arbitration agreement</quote> means an agreement to arbitrate a dispute that has not yet arisen at the time of the making of the agreement; and</text></paragraph><paragraph id="HCE3CCB8BA4804FABA0B952456B082AA5"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>predispute joint-action waiver</quote> means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph></section><section id="H144197CA9ACA4A3C80EC407B29DFF86C"><enum>402.</enum><header>No validity or enforceability</header><subsection commented="no" id="H04443E5D8B644549982E8177F021F0E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a dispute relating to disputes arising under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38 or the Servicemembers Civil Relief Act.</text></subsection><subsection id="H09C2EDB039D6465B983EA3DE132497D1"><enum>(b)</enum><header>Applicability</header><paragraph id="HEBA1A2BCEB4C4BA99E87047F26F7E60E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></paragraph><paragraph id="H76E910B5B73648C6AEE074E272805EF7"><enum>(2)</enum><header>Collective bargaining agreements</header><text display-inline="yes-display-inline">Nothing in this chapter shall apply to any arbitration provision in a contract between an employer and a labor organization or between labor organizations, except that no such arbitration provision shall have the effect of waiving the right of a worker to seek judicial enforcement of a right arising under a provision of the Constitution of the United States, a State constitution, or a Federal or State statute, or public policy arising therefrom.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1D8C0D7DAB474FDE8B0771A5F96B76C2"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H2DB85180B3D04F85803ED0B3B622879D"><enum>(1)</enum><header>In general</header><text>Title 9 of the United States Code is amended—</text><subparagraph id="H9072DF9DEADA4D68BC0F28AE223104C4"><enum>(A)</enum><text>in section 1 by striking <quote>of seamen,</quote> and all that follows through <quote>interstate commerce</quote> and inserting <quote>persons and causes of action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38 or the Servicemembers Civil Relief Act</quote>;</text></subparagraph><subparagraph id="HCACF6FFA6E454260ACFEA25BE7D62199"><enum>(B)</enum><text>in section 2 by inserting <quote>or as otherwise provided in chapter 4</quote> before the period at the end;</text></subparagraph><subparagraph id="H127F9FD3A60948D68278BB26BA566FAB"><enum>(C)</enum><text>in section 208—</text><clause id="H18215A6A9A2C4F049711FC240B5E20C1"><enum>(i)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="H4C4EE7F06C7E435785DBF201B1FADAD6"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>; and</text></clause></subparagraph><subparagraph id="H59A8BD3D8B144867A9ED2FEB6395C17D"><enum>(D)</enum><text>in section 307—</text><clause id="HEE8D119DCF884D129ABB996B7609DF1D"><enum>(i)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="H875247F5D1644F4B92E708CA97F16A47"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>.</text></clause></subparagraph></paragraph><paragraph id="HE054E05F178D4CE0BA30D251A40CB7A5"><enum>(2)</enum><header>Table of sections</header><subparagraph id="HA44F65DA169C46228E845A9B627D331A"><enum>(A)</enum><header>Chapter 2</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/2">chapter 2</external-xref> of title 9, United States Code, is amended by striking the item relating to section 208 and inserting the following:</text><quoted-block id="H711165CC47B44C8FBA903684D63ABB9F" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">208. Application.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H047B92B5355C4DB4835ECCA00618E0AC"><enum>(3)</enum><header>Table of chapters</header><text>The table of chapters of title 9, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEBB02FE8AEC74804B871E68DCE390C1A" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">4. Arbitration of servicemember and veteran disputes</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HB8FB79948C1B448E99AFA2788499665D"><enum>4.</enum><header>Limitation on waiver of rights and protections under Servicemembers Civil Relief Act</header><subsection id="H130FC06CED55484EBE809359A54854E9"><enum>(a)</enum><header>Amendments</header><text>Section 107(a) of the Ser­vice­mem­bars Civil Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3918">50 U.S.C. 3918(a)</external-xref>) is amended—</text><paragraph id="H5A0973C99B644879B66427A2A8B67F46"><enum>(1)</enum><text>in the second sentence by inserting <quote>and if it is made after a specific dispute has arisen and the dispute is identified in the waiver</quote> before the period at the end; and</text></paragraph><paragraph id="H0247982073DE4082AEEDA130A2DCDCA6"><enum>(2)</enum><text>in the third sentence by inserting <quote>and if it is made after a specific dispute has arisen and the dispute is identified in the waiver</quote> before the period at the end.</text></paragraph></subsection><subsection id="HE39128F8FAF9420396C00E98A510CC1E"><enum>(b)</enum><header>Application of amendments</header><text>The amendments made by subsection (a) shall apply with respect to waivers made on or after the date of the enactment of this Act.</text></subsection></section><section id="HB4F56AB7CAED4D9EBFD94B07BB7390D2"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date of enactment of this Act and shall apply with respect to any dispute or claim that arises or accrues on or after such date.</text></section></legis-body></bill>
