<legis-type>A BILL</legis-type> 
<official-title display="yes">To provide for recovery by individuals who were stationed, lived, or worked at Camp Lejeune, for certain actions of omissions by the United States.</official-title>

<legis-body id="HCF0502EE5F434A0DB2F7A46A5ECB37FE" style="OLC"> 
<section id="HE9FADF705B6F4083ABAB803FA638B19D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Camp Lejeune Justice Act of 2021</short-title></quote>.</text></section> <section id="H9F5928C660134A60A1129FAFA82E2FAF"><enum>2.</enum><header>Federal cause of action relating to water at Camp Lejeune</header> <subsection id="HB665297608344BA3934CE695FE0A9CEF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An individual, including a veteran, or the legal representative of such an individual, who resided, worked, or was otherwise exposed (including in utero exposure) for not less than 30 days during the period beginning August 1, 1953, and ending December 31, 1987, to water at Camp Lejeune that was supplied by the United States or on its behalf may bring an action in the United States District Court for the Eastern District of North Carolina to obtain appropriate relief for harm which—</text> 
<paragraph id="H17F2A4AFF82D4A4F8DD8367B4AA0A701"><enum>(1)</enum><text>was caused by exposure to the water;</text></paragraph> <paragraph id="H50C4762C5CCE4D98B13698894505D258"><enum>(2)</enum><text>was associated with exposure to the water;</text></paragraph> 
<paragraph id="H9C744BF13344472CBE047DDE4423A739"><enum>(3)</enum><text>was linked to exposure to the water; or</text></paragraph> <paragraph id="H425B7AFFD7564203900EEC107AC14746"><enum>(4)</enum><text>the exposure to the water increased the likelihood of such harm. </text></paragraph></subsection> 
<subsection id="H676C681D5E3A45BBAC93295CA00E4170"><enum>(b)</enum><header>Burden and standard of proof</header> 
<paragraph id="HAF79FBD2D9F94A31880AF937DADF5855"><enum>(1)</enum><header>In general</header><text>The burden of proof shall be on the party filing the action to show one or more relationship between the water and the harm described in paragraphs (1) through (4) of subsection (a) by a preponderance of the evidence. </text></paragraph> <paragraph id="HD4878F66AF78487C9930D6CC144CD3BF"><enum>(2)</enum><header>Use of studies</header><text>A study conducted on humans or animals, or from an epidemiological study, which ruled out chance and bias with reasonable confidence and which concluded, with sufficient evidence, that exposure to the water described in subsection (a) is one possible cause of the harm, shall be sufficient to satisfy the burden of proof described under paragraph (1).</text></paragraph></subsection> 
<subsection id="H79C23A9DD97F415BB7494BEDD378FE01"><enum>(c)</enum><header>Exclusive jurisdiction and venue</header><text display-inline="yes-display-inline">The district court for the Eastern District of North Carolina shall have exclusive jurisdiction over any action under this section, and shall be the exclusive venue for such an action. Nothing in this subsection shall impair any party’s right to a trial by jury.</text></subsection> <subsection id="H82CD740E240446678EF9C00DBF2A72E3"><enum>(d)</enum><header>Exclusive remedy</header> <paragraph id="H2ADA7CCC0DCA4F66853B8BA2CD1B9D97"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who brings an action under this section for an injury, including a latent disease, may not thereafter bring a tort action pursuant to any other law against the United States for such harm. </text></paragraph> 
<paragraph id="H3B9E029805D541E1AEC3E4E82540FF60"><enum>(2)</enum><header>No effect on disability benefits</header><text display-inline="yes-display-inline">Any award under this section shall have not impede or limit the individual’s continued or future entitlement to disability awards, payments, or benefits under any Veteran’s Administration program. </text></paragraph></subsection> <subsection id="HC5F5D9A5A9AA4CBC968452D059639C40"><enum>(e)</enum><header>Immunity limitation</header><text>The United States may not assert any claim to immunity in an action under this section which would otherwise be available under section 2680(a) of title 28, United States Code.</text></subsection> 
<subsection id="HA17FE562668D408F99287CD915D03437"><enum>(f)</enum><header>No punitive damages</header><text>Punitive damages may not be awarded in any action under this Act.</text></subsection> <subsection id="HD3221A16E8DA4A73824BEEC871CCC7D4"><enum>(g)</enum><header>Disposition by federal agency required</header><text>An individual may not bring an action under this section prior to complying with section 2675 of title 28, United States Code.</text></subsection> 
<subsection id="H28FBAFCA831B4F6B9CCBF7135FC08D88"><enum>(h)</enum><header>Attorney fees</header><text>Attorney fees for services provided to an individual seeking a remedy under this section shall be in accordance with section 2678 of title 28, United States Code.</text></subsection> <subsection id="H50CFB4F2D577453EABC09F97E61B8254"><enum>(i)</enum><header>Exception for combatant activities</header><text>This section does not apply to any claim or action arising out of the combatant activities of the Armed Forces.</text></subsection> 
<subsection id="H60AD55CCCAA9431DAD9184399BD11C83"><enum>(j)</enum><header>Period for filing</header> 
<paragraph id="H703FBDEAAB864240B90CA2A716E32BAA"><enum>(1)</enum><header>In general</header><text>The statute of limitations for an action under this section is the later of—</text> <subparagraph id="H3564444341234B17AC61EAAC600ADEC6"><enum>(A)</enum><text>2 years from the date on which the harm occurred or was discovered, whichever is later; or</text></subparagraph> 
<subparagraph id="H9B95D27436734814B17139B98A1BEC3F"><enum>(B)</enum><text>180 days from the date on which the claim is denied under section 2675 of title 28, United States Code.</text></subparagraph></paragraph> <paragraph id="H0C506E44031A42F48DC60C8A83A8A903"><enum>(2)</enum><header>Special rule</header><text>In the case of harm which was discovered prior to the date of the enactment of this section, the statute of limitations is the later of—</text> 
<subparagraph id="H3C70391B04DF4CDD8C0065A899F54476"><enum>(A)</enum><text>2 years after the date of the enactment of this section; or</text></subparagraph> <subparagraph id="H444FB5B9633A4CF796B31256DF7D7682"><enum>(B)</enum><text>180 days from the date on which the claim is denied under section 2675 of title 28, United States Code.</text></subparagraph></paragraph> 
<paragraph id="HA83BA7E1E5A847FBAFCA4A00BD83B416"><enum>(3)</enum><header>Statute of repose</header><text display-inline="yes-display-inline">Any applicable statute of repose does not apply to claims under this Act.</text></paragraph></subsection> <subsection id="H7F8F484B2F984CECB045BBE2EC5C121E"><enum>(k)</enum><header>Effective date</header><text>This Act shall apply to—</text> 
<paragraph id="H374A3F2042BD471E94C193B7BAE94D97"><enum>(1)</enum><text>a claim arising on or after the date of the enactment of this Act; and</text></paragraph> <paragraph id="H6DE0405D50434BA290049254FEFD1A30"><enum>(2)</enum><text>a claim arising before the date of the enactment of this Act, if filed within two years of the date of enactment.</text></paragraph></subsection></section>
