which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for extensions of the time limitations for use of entitlement under Department of Veterans Affairs educational assistance programs by reason of school closures due to emergency and other situations, and for other purposes.</official-title></form><legis-body id="H3336F95C0BAD4AE086700173C44F8D19" style="OLC"><section id="H144FFAFE753F4614BE4200717D43E94A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>GI Bill National Emergency Extended Deadline Act</short-title></quote>. </text></section><section id="H328D193208664AEFABAB9638922D45E7"><enum>2.</enum><header>Extension of time limitation for use of entitlement under Department of Veterans Affairs educational assistance programs by reason of school closures due to emergency and other situations</header><subsection id="H5AAA90A12ABC4B298FAA5452A462D68D"><enum>(a)</enum><header>Montgomery GI Bill</header><text display-inline="yes-display-inline">Section 3031 of title 38, United States Code, is amended—</text><paragraph id="H8D4C21B86BA04C7385D22A8BEED4AAC6"><enum>(1)</enum><text>in subsection (a), by inserting <quote>and subsection (i)</quote> after <quote>through (g)</quote>; and</text></paragraph><paragraph id="HD20E688F9A794DC0B522A0BCDF35011C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" id="HC05E86D66C28462D89CC281AC3BBCC54" display-inline="no-display-inline"><subsection id="H10EEC7AEEE544E93A96ECDE94988D99A"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA87D00F069D34053A073497CD5A5A13D"><enum>(1)</enum><text>In the case of an individual eligible for educational assistance under this chapter who is prevented from pursuing the individual's chosen program of education before the expiration of the 10-year period for the use of entitlement under this chapter otherwise applicable under this section because of a covered reason, as determined by the Secretary, such 10-year period—</text><subparagraph id="HFE537BA984E94792846208E303BFA9DF" indent="up1"><enum>(A)</enum><text>shall not run during the period the individual is so prevented from pursuing such program; and</text></subparagraph><subparagraph id="HD434279D8D6C47C486007FBE706EC488" indent="up1"><enum>(B)</enum><text>shall again begin running on a date determined by the Secretary that is—</text><clause id="HE1CEF34A4BDD4340BA743F175120AA8A"><enum>(i)</enum><text>not earlier than the first day after the individual is able to resume pursuit of a program of education with educational assistance under this chapter; and</text></clause><clause id="H9F14F6C08D8C43A69AD41A0BF3715CFD"><enum>(ii)</enum><text>not later than 90 days after that day.</text></clause></subparagraph></paragraph><paragraph id="H431C2621C63D44658E1A50F929ED0EA6" indent="up1"><enum>(2)</enum><text>In this subsection, a covered reason is—</text><subparagraph id="H85F59773DE284E099B7384F2D2C22A2B"><enum>(A)</enum><text display-inline="yes-display-inline">the temporary or permanent closure of an educational institution by reason of an emergency situation; or</text></subparagraph><subparagraph id="H567B757113B24954BFE378659326145A"><enum>(B)</enum><text>another reason that prevents the individual from pursuing the individual’s chosen program of education, as determined by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H12E9E7E9A80F4A84824E0000E6A63930"><enum>(b)</enum><header>Post-9/11 Educational Assistance</header><text display-inline="yes-display-inline">Section 3321(b)(1) of such title is amended—</text><paragraph id="H1D334A14A4D6487393401E6F62E12734"><enum>(1)</enum><text>by inserting <quote>(A)</quote> before <quote>Subsections</quote>;</text></paragraph><paragraph id="HBDF2D35B5D7F4024AC06163C803C10A1"><enum>(2)</enum><text>by striking <quote>and (d)</quote> and inserting <quote>(d), and (i)</quote>; and</text></paragraph><paragraph id="H5D39FEC9FD9A4C779D21DBB40B9ED305"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="H04FB1115D6AA4A0EA3A17731BFA41F41" display-inline="no-display-inline"><subparagraph id="HDADCF2F492D044AAA18D34772C08FF2F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subsection (i) of section 3031 of this title shall apply with respect to the running of the 15-year period described in paragraphs (4)(A) and (5)(A) of this subsection in the same manner as such subsection applies under section 3031 with respect to the running of the 10-year period described in section 3031(a).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
