<section id="HDEEDAEC5BC5D4BDA96E44C14190B2346" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pretrial Integrity and Safety Act of 2021</short-title></quote>.</text></section> <section id="HCE851F1847514F80AA9E53601214416B"><enum>2.</enum><header>Purpose and findings</header> <subsection id="H70B7F0D499BC499098D7FCF1FF2ACD59"><enum>(a)</enum><header>Purpose</header><text>The purpose of this Act is to provide grants to States, units of local government, and Indian Tribes to reform their criminal justice system to encourage the replacement of the use of payment of money bail as a condition of pretrial release in criminal cases.</text></subsection> 
<subsection id="H7A95BB963D35466EABF490321D800E2C"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="H01F8935401594CD2ACF27E723D6FFFD5"><enum>(1)</enum><text>The justice system of the United States, a cornerstone of our free society, is built on the ideals that all accused people are presumed innocent unless and until proven guilty, that all accused people have the right to assert their innocence in a trial, that liberty should not be denied absent due process of law, that rich and poor people should be treated equally, and that people should be judged by their own individual actions, and not prejudged based on the actions of others.</text></paragraph> 
<paragraph id="HDC20A11CDDBD41719702D1E59125CA8D"><enum>(2)</enum><text>Pretrial detention and the money bail systems prevalent in most States undermine these ideals by jailing people unnecessarily before a finding of guilt and with minimal due process, and by establishing a system that allows wealthy people to pay for their liberty, while poor people remain in jail.</text></paragraph> <paragraph id="HC10A08CCA34D4678AD28ACEE5ACA6B23"><enum>(3)</enum><text>The inability to post money bail may result in innocent people pleading guilty to low-level crimes they did not commit so they can be released.</text></paragraph> 
<paragraph id="HF3300EA9E93E4098B44B5A08EFDF9C99"><enum>(4)</enum><text>Money bail systems have resulted in disparate harms to poor people and communities of color. Compared to white men charged with the same crime and with the same criminal histories, African-American men receive bail amounts that are 35 percent higher, and for Latino men, bail is set 19 percent higher than for white men.</text></paragraph> <paragraph id="H4703300641344B9D81D0E9609535745D"><enum>(5)</enum><text>African Americans are 24 percent more likely to be denied bail and 21 percent less likely to be granted non-financial release than whites with similar legal characteristics. Latinos are 25 percent less likely to be granted nonfinancial conditions of release.</text></paragraph> 
<paragraph id="H9C5174CC4F4149249649AE5488BA868D"><enum>(6)</enum><text>Although most women in jail are charged with nonviolent crimes, women are less likely to be able to afford money bail, and women in jail before trial earn scarcely more per year than the average bail amount of $10,000.</text></paragraph> <paragraph id="H54E9871C0086483193D82E79446727AE"><enum>(7)</enum><text>Detaining people who would otherwise be highly likely to succeed in pretrial compliance, even just for a few days, is strongly correlated with higher rates of new criminal activity both during the pretrial period and years after case disposition.</text></paragraph> 
<paragraph id="H602AC7DACB6A44E7AD2F9991CE250882"><enum>(8)</enum><text>When held for 2 to 3 days, people who would have been highly likely to succeed in their communities are almost 40 percent more likely to be arrested for new crimes before trial than similarly situated defendants held no more than 24 hours.</text></paragraph> <paragraph id="H8E1F1859F16B475CBE492C9D81F9F2D7"><enum>(9)</enum><text display-inline="yes-display-inline">Court reminder programs are a low-cost, highly effective way of improving court appearance rates. One review of different forms of court reminders found failure-to-appear rates were reduced by 23 to 43 percent with the use of reminders.</text></paragraph> 
<paragraph id="H8C85DB7E511A4DAB89A673118A0A82F3"><enum>(10)</enum><text>Pretrial supervision is most effective for people with a decreased probability of appearing in court, reducing failures to appear by 33 to 38 percent.</text></paragraph> <paragraph id="H3C4D544E571A46C29BCC798BEFB532A6"><enum>(11)</enum><text>Jailing individuals before trial is the greatest expense generated by current pretrial justice practice. Unconvicted detainees account for 95 percent of jail population growth, nationally, since 2000. Taxpayers now spend approximately $38,000,000 per day to jail individuals who are awaiting trial. Annually, this adds up to $14,000,000,000 used to detain individuals.</text></paragraph></subsection></section> 
<section id="HCC40B9DD89CE43D4ACF2F761035F21F4"><enum>3.</enum><header>Pretrial integrity and safety</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101</external-xref> et seq.) is amended by adding at the end the following:</text> <quoted-block id="H005B391BF167413B9571A907C3A3103D" style="OLC"> <part id="HEDD7E3ED1FD54B18816224694455E0FB"><enum>OO</enum><header>PRETRIAL INTEGRITY AND SAFETY</header></part> <section id="HAA49E96498F541E0A9BB7CC93BA049E1"><enum>3051.</enum><header>Grants and conditions</header> <subsection id="H6E0FBD246A3447E8A9BCF7B89458FBB2"><enum>(a)</enum><header>Grants authorized</header> <paragraph id="HDD7A8CAAA6A5456F843906172CB46F17"><enum>(1)</enum><header>Replacement of money bail</header><text>The Assistant Attorney General may make grants to eligible entities for the replacement of the use of payment of money bail as a condition of pretrial release with respect to criminal cases.</text></paragraph> 
<paragraph id="HE50628A7676043BEBB44B95C6E07A5C9"><enum>(2)</enum><header>National pretrial reporting program</header><text>The Assistant Attorney General may make grants to eligible entities to implement a National Pretrial Reporting Program to collect data on the processing of defendants by courts of States, units of local government, and Indian Tribes.</text></paragraph></subsection> <subsection id="HE86A0CC5574C44FCB2DDB13E77B05219"><enum>(b)</enum><header>Terms and conditions</header> <paragraph id="HC4C4171608B44BBFB24CBE2F70F1CF15"><enum>(1)</enum><header>Duration of grants</header><text>A grant under subsection (a) shall be for a period of 3 fiscal years.</text></paragraph> 
<paragraph id="H5FF7A8A29EB74C3E9221068DD7B907A5"><enum>(2)</enum><header>Maximums</header> 
<subparagraph id="H0EE27702A9E64FD196678E13CE3CB3D5"><enum>(A)</enum><header>Replacement of money bail</header> 
<clause id="H865D1183F0EF4EA7932407895F3AC12B"><enum>(i)</enum><header>Maximum numbers</header><text>During each fiscal year for which amounts are made available to carry out subsection (a)(1), the Assistant Attorney General may award not more than 6 grants under such subsection to eligible entities for the 3-year grant period beginning in such fiscal year.</text></clause> <clause id="HF6F757054774437C8E5976966612A059"><enum>(ii)</enum><header>Maximum amounts</header><text>In making grants under subsection (a)(1) for a 3-year grant period beginning in a fiscal year, the Assistant Attorney General shall ensure that the total amount awarded under all grants for the duration of such period does not exceed $10,000,000, of which—</text> 
<subclause id="H85F5A2422E0B4BFE8AEBCCA4A043747D"><enum>(I)</enum><text>not more than $6,500,000 shall be grants to State, local, or Tribal court systems; and</text></subclause> <subclause id="H95CD663C69D44515A43139169E0D1FDA"><enum>(II)</enum><text>not more than $3,500,000 shall be grants to eligible entities that are not a State, local, or Tribal court system to provide technical assistance, training, and performance evaluation.</text></subclause></clause></subparagraph> 
<subparagraph id="H45BB946289B64DBF98821FA874874D66"><enum>(B)</enum><header>National pretrial reporting program</header><text>The Assistant Attorney General may not make more than $5,000,000 in grants under subsection (a)(2) for any 3-year period.</text></subparagraph></paragraph></subsection> <subsection id="H50A7ABCA397142A899476D2B3BDBF2C5"><enum>(c)</enum><header>Use of funds for replacement of money bail grants</header> <paragraph id="H58790C314EAB4215ADCA61DC7CC27BD3"><enum>(1)</enum><header>Activities</header><text>Amounts received under a grant under subsection (a)(1)—</text> 
<subparagraph id="H159A6F258A3B448A9C1714D154A2729A"><enum>(A)</enum><text>shall be used for developing the long-term, sustainable capacity to perform more effective pretrial practices that include system analysis, training and technical assistance, meeting facilitation, research and performance evaluation, and information technology reprogramming; and</text></subparagraph> <subparagraph id="HA9C1BABA72844A5DB004318E876D496F"><enum>(B)</enum><text>in carrying out pretrial practices, shall seek to incorporate and implement the elements described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H7327704168F242F8953CBAE7AD553A1C"><enum>(2)</enum><header>Elements</header><text>The elements described in this paragraph are—</text> <subparagraph id="H7A8972ACB6E04DF5BD6D1582017ECA27"><enum>(A)</enum><text>expanding the use of citations instead of custodial arrest;</text></subparagraph> 
<subparagraph id="H6FC3956D60604CD4B67042EC63C5E09A"><enum>(B)</enum><text>replacing the use of payment of money as a condition of pretrial release;</text></subparagraph> <subparagraph id="HD85B3A5F6E334C84A5F6983938442714"><enum>(C)</enum><text display-inline="yes-display-inline">requiring representation by counsel with adequate training in representing defendants at pretrial detention hearing for all defendants as soon as feasible after custodial restraint, but not later than the first hearing at which a defendant’s liberty is subject to restriction;</text></subparagraph> 
<subparagraph id="H79A02A5F3B9C4778828DDC8A525B0C5E"><enum>(D)</enum><text>providing for—</text> <clause id="H9B40843F12FB4BED9BC5853D3F0A3C0A"><enum>(i)</enum><text>a presumption of release in all cases; and</text></clause> 
<clause id="HD5124D494978484ABBEA3218659709C9"><enum>(ii)</enum><text>limiting the authority to request pretrial detention to those defendants who have been charged with—</text> <subclause id="H653CF10E49934E1FB6FDE08FD7349796"><enum>(I)</enum><text>felony offenses involving actual violence against another person or punishable by a maximum term of life imprisonment;</text></subclause> 
<subclause id="H6AAA4B0417AD4F9A82A27182DC899DC5"><enum>(II)</enum><text>misdemeanor crimes of domestic violence;</text></subclause> <subclause id="HEB17A62B42CA41CD8FB3498719082F41"><enum>(III)</enum><text display-inline="yes-display-inline">misdemeanor crimes of stalking; or</text></subclause> 
<subclause id="H88E2EA96793C4BA6BBD58B2324BB7313"><enum>(IV)</enum><text display-inline="yes-display-inline">misdemeanor hate crimes;</text></subclause></clause></subparagraph> <subparagraph id="HEB7F1D962CED4406B486A8446ADD197C"><enum>(E)</enum><text>ensuring that before detention or any condition of pretrial release more restrictive than release on recognizance is imposed, there is a pretrial release hearing that—</text> 
<clause id="HBC89693967E742D69FBAE924F2A1ADD2"><enum>(i)</enum><text>provides for the right to present evidence, the right to cross-examine adverse witnesses, and the right to testify or remain silent;</text></clause> <clause id="H0A457EB11810469A909439825EF01696"><enum>(ii)</enum><text>results in a written record explaining the clear and convincing evidence relied on by the judicial officer to justify a detention order or additional condition of release; and</text></clause> 
<clause id="H7A54D2B8517F446FA0A990C18EBB62AD"><enum>(iii)</enum><text>occurs as soon as feasible after custodial restraint, but not later than 24 hours after custodial restraint if the individual is being detained, unless the defendant requests a continuance;</text></clause></subparagraph> <subparagraph id="H54735CC8F5BA431890B99299246A6331"><enum>(F)</enum><text>ensuring that before pretrial detention is imposed—</text> 
<clause id="HEB10B7EB76A748008EA3843C4BF5AEF8"><enum>(i)</enum><text>a judicial officer determines by clear and convincing evidence that the individual poses a high risk of intentional avoidance of prosecution or of seriously physically harming another reasonably identifiable person during the adjudication period;</text></clause> <clause id="H4B853399FFD04DB9BF787F0102EE3080"><enum>(ii)</enum><text>a judicial officer determines by clear and convincing evidence that no condition, or combination of conditions, can sufficiently mitigate a high risk of intentional avoidance of prosecution or of seriously physically harming another reasonably identifiable person during the adjudication period; and</text></clause> 
<clause id="H81275113575D49DFBA5ACC2C7A619E71"><enum>(iii)</enum><text>no less restrictive condition is adequate to address the specific risk or risks identified;</text></clause></subparagraph> <subparagraph id="HD4AE6F609B54498E992395AF21B8254A"><enum>(G)</enum><text>ensuring that before any condition of pretrial release more restrictive than release on recognizance is imposed—</text> 
<clause id="HDD42D8F2EB8C4C2CB4C02114E43C2277"><enum>(i)</enum><text>a judicial officer determines by clear and convincing evidence that the individual poses a high risk of intentional avoidance of prosecution or of seriously physically harming another reasonably identifiable person during the adjudication period; and</text></clause> <clause id="HC522ADC2261E43EFA66A1C49A299632D"><enum>(ii)</enum><text>a judicial officer determines by clear and convincing evidence that no less restrictive conditions or pretrial supports can sufficiently mitigate a high risk of intentional avoidance of prosecution or of seriously physically harming another reasonably identifiable person during the adjudication period;</text></clause></subparagraph> 
<subparagraph id="H78C34298F5E44ABE8788A8F108062C80"><enum>(H)</enum><text>if pretrial release requires imposing additional conditions beyond release on recognizance, ensuring that these conditions—</text> <clause id="HBB0FA8C030714EE4873489E1F9BF2EDE"><enum>(i)</enum><text>are nonfinancial, pose no cost to the defendant, and are relevant only to the charge;</text></clause> 
<clause id="HC50DF56F74BC440FA72923325ADF9336"><enum>(ii)</enum><text>are the least restrictive conditions that would reasonably ensure the appearance of the defendant in court or that would reasonably ensure that the defendant does not present an imminent threat of serious physical harm to a reasonably identifiable person; and</text></clause> <clause id="HB7D61DC331C1434EA0223600C73AD609"><enum>(iii)</enum><text>were set without consideration of or with decreased weight given to criminal convictions older than 2 years;</text></clause></subparagraph> 
<subparagraph id="H6B17BC3F2DBD473080A7C5EB8B31901E"><enum>(I)</enum><text>ensuring supervision of the conditions of pretrial release is based on proven data outcomes;</text></subparagraph> <subparagraph id="H943A71F906084581B70CCF16068049E5"><enum>(J)</enum><text>improvements made to the applicable pretrial services agency that, among other functions—</text> 
<clause id="H6CE778DC328C4604980FED715E3E2D85"><enum>(i)</enum><text>provides support to defendants awaiting trial to effectively meet the conditions of release placed on them by the judicial officer;</text></clause> <clause id="H34BB9299ADC94AF191D4A5DD5865A04B"><enum>(ii)</enum><text>provides outreach to and partnership with community-based support structures to connect defendants with supportive services; and</text></clause> 
<clause id="H80A2BA18EC9B4F6EA74036E64CB9242B"><enum>(iii)</enum><text>provides data collection, analysis, and research capabilities to assist the jurisdiction in achieving the benchmarks listed in paragraph (3);</text></clause></subparagraph> <subparagraph id="H94C3637C18364E9A80FEEEF34094D9CF"><enum>(K)</enum><text>ensuring an officer of the State, unit of local government, or Indian Tribe that brought the charges against the defendant appears before a committing magistrate, judge, or other judicial officer at all hearings;</text></subparagraph> 
<subparagraph id="HF306C889E16F4753B98933277C66045A"><enum>(L)</enum><text>ensuring the constitutional right of a defendant to a speedy trial is effectuated, including—</text> <clause id="H982253CE7B9B4F7491008729DFC6D933"><enum>(i)</enum><text>setting specific limits on the time within which either the defendant shall be brought to trial or the case shall be resolved through a nontrial disposition;</text></clause> 
<clause id="H18F8709775DE4301AC7388BE4F351D16"><enum>(ii)</enum><text>providing guidelines for computing the time within which the trial must be commenced or the case otherwise resolved; and</text></clause> <clause id="HDFC8E5DFA2644D27A8D8D2BD88810C0F"><enum>(iii)</enum><text>establishing appropriate consequences in the event that the right of the defendant to a speedy trial is denied, and ensuring that under no circumstances a person is detained longer than the maximum sentence allowable if convicted of the charges;</text></clause></subparagraph> 
<subparagraph id="H0D8022276E3546A9B3BBA77E3566D3A4"><enum>(M)</enum><text>ensuring that the defendant and the State, unit of local government, or Indian Tribe that brought the charges against the defendant is entitled to an immediate, expedited appeal of a pretrial detention decision; and</text></subparagraph> <subparagraph id="H6A769F5AEC5542AB90081614F2D73211"><enum>(N)</enum><text>instituting a system of data collection and reporting to determine the effectiveness of the process replacing the money bail system.</text></subparagraph></paragraph> 
<paragraph id="HB693CBB1D0484857815B236F7FBC4E68"><enum>(3)</enum><header>Benchmarks</header><text>A State, local, or Tribal court system receiving a grant under subsection (a)(1) shall seek to achieve the following:</text> <subparagraph id="HBD392BE514EB4ED686D2DACED34F0591"><enum>(A)</enum><text>Defendants return to court rates are not less than 95 percent.</text></subparagraph> 
<subparagraph id="H889D17F7888F4F6B89408720ABEB4C69"><enum>(B)</enum><text>Not more than 10 percent of defendants are rearrested pending trial.</text></subparagraph> <subparagraph id="HB40B91055616425DBA89A92F8FC7576D"><enum>(C)</enum><text>Overall release rates of defendants pending trial are not less than 95 percent.</text></subparagraph> 
<subparagraph id="H018C7D8F884B4509AFBA8297091CDEC9"><enum>(D)</enum><text>100 percent of defendants have an attorney at the first appearance of the defendant before a magistrate, judge, or other judicial officer.</text></subparagraph> <subparagraph id="H8B2ADC0628AF4074BBC4011FCC8A6748"><enum>(E)</enum><text>100 percent of defendants preventively detained were detained after a pretrial release hearing that occurred not later than 24 hours after custodial restraint, unless the defendant requested a continuance.</text></subparagraph> 
<subparagraph id="H0F696C2EF108448991EA26991367548A"><enum>(F)</enum><text>To the extent feasible, charging decisions are made not later than 14 days after the date of the issuance of a citation or custodial arrest.</text></subparagraph> <subparagraph id="HCD999EB10D1F469D8ED08CB14000A29C"><enum>(G)</enum><text>To the extent feasible, the trial of the defendant begins not later than 30 days after the date of the issuance of a citation or custodial arrest.</text></subparagraph> 
<subparagraph id="H3E20B7B5D68D46C9ACA2FE39A013B7AA"><enum>(H)</enum><text>No defendants were detained during any portion of time from arrest through adjudication simply due to an inability to satisfy a legal financial obligation set by the court.</text></subparagraph></paragraph> <paragraph id="HE58CF5C57797476EB8DC8FF48AF5D613"><enum>(4)</enum><header>Alternative pretrial release mechanisms</header><text>Nothing in this part shall be construed to prohibit the consideration of alternative pretrial release mechanisms that replace money bail systems while furthering the principles described in this part.</text></paragraph></subsection> 
<subsection id="HF895A3F114AE4C92868A6BE7A64A97B9"><enum>(d)</enum><header>Annual report</header> 
<paragraph id="HC1BF07DF66474B7FA9AB787A7982B77F"><enum>(1)</enum><header>In general</header><text>Each entity receiving a grant under this section shall submit to the Assistant Attorney General, for each fiscal year during which the entity expends amounts received under the grant, a report, at such time and in such manner as the Assistant Attorney General may reasonably require, that contains—</text> <subparagraph id="H9F2A01636EF64FC5BCEE078702C12414"><enum>(A)</enum><text>a summary of the activities carried out using amounts made available under the grant;</text></subparagraph> 
<subparagraph id="H4E837990EC56447F9400DB232B4F9C5E"><enum>(B)</enum><text>an assessment of whether the activities are meeting the need for the program identified in the application for the grant;</text></subparagraph> <subparagraph id="H7B6EDA382804490CBD39781AE5CF4FAA"><enum>(C)</enum><text>for a grant under subsection (a)(1), data on the money bail program of the State, local, or Tribal court system; and</text></subparagraph> 
<subparagraph id="HB9173761D8C04E40A8105DCAEF9125CF"><enum>(D)</enum><text>such other information as the Assistant Attorney General may require.</text></subparagraph></paragraph> <paragraph id="H13B69F1E192D41CD921B5591842899D1"><enum>(2)</enum><header>Data</header><text>The data provided under paragraph (1)(C) shall—</text> 
<subparagraph id="H7E9F6604A2014D1C8EF1C41DF679286D"><enum>(A)</enum><text>be broken down by the demographic variables of age group, sex, race and ethnicity, disability, and charges filed;</text></subparagraph> <subparagraph id="H1DB8AA1D15964EA68311CE7ADEE70185"><enum>(B)</enum><text>include the percentage of defendants detained in jail or prison who are released from jail or prison prior to case disposition, broken down by demographic variables of age group, sex, race and ethnicity, charges filed, and release condition;</text></subparagraph> 
<subparagraph id="H07341B776A1F4C15A9FE3BC23C50B64A"><enum>(C)</enum><text>provide the average time to release from jail for defendants who are released pretrial, broken down by demographic variables of age group, sex, race and ethnicity, disability, charges filed, and release condition;</text></subparagraph> <subparagraph id="HEE7114B0C0BA4299A6F9FBCF036595C7"><enum>(D)</enum><text>provide the percentage of defendants who are detained for the entire duration of the pretrial phase of their case, broken down by demographic variables of age group, sex, race and ethnicity, disability, charges filed, and reason for detention;</text></subparagraph> 
<subparagraph id="H49222CD36BD4487290B95C3877CB472D"><enum>(E)</enum><text>provide the average duration of the period defendants who are not released are in custody in a prison or jail before the disposition of their case, broken down by demographic variables of age group, sex, race and ethnicity, disability, charges filed, and reason for detention;</text></subparagraph> <subparagraph id="H9FCC377123654691A409D9D9F1483ADA"><enum>(F)</enum><text>provide the percentage of defendants released from custody before trial who appeared at all court appearances for which the court expected them to appear during the pretrial phase of their case, broken down by demographic variables of age group, sex, race and ethnicity, disability, charges filed, and release condition;</text></subparagraph> 
<subparagraph id="H3DD71B2012B54BA6857711CF04BD248B"><enum>(G)</enum><text>provide the percentage of defendants released from custody before trial who were not arrested for or charged with a new crime during the pretrial phase of their case, broken down by demographic variables of age group, sex, race and ethnicity, disability, charges filed, and release condition;</text></subparagraph> <subparagraph id="H6F053282729F40EF94D767EA7E0490A2"><enum>(H)</enum><text>provide data on the access of defendants to counsel, including the number of counsel appointments and the outcomes of pretrial release decisions in all cases where counsel was provided; and</text></subparagraph> 
<subparagraph id="HAE524298D5C94AB7AC7B2EA95E44BA6D"><enum>(I)</enum><text>provide data on the most serious offense with which defendants were charged and the classification of the offense.</text></subparagraph></paragraph></subsection> <subsection id="HA0AF06BDC80D4E909E7A4A3FA59653A0"><enum>(e)</enum><header>Allocation of funds</header> <paragraph id="HBA63CF8B3DA24B6894C0CA289D6A33FC"><enum>(1)</enum><header>In general</header><text>For fiscal year 2021, of the amounts appropriated to the Office, the Assistant Attorney General shall use $15,000,000 to carry out this part.</text></paragraph> 
<paragraph id="H215EB2A51EF048658DA06938F65ADD02"><enum>(2)</enum><header>Limitations; equitable distribution</header> 
<subparagraph id="H49A9C2C741A9450F86147B7FCB89785A"><enum>(A)</enum><header>Limitations</header><text>Of the amount made available to carry out this section in any fiscal year—</text> <clause id="H69B88809EA5B4A89A2A6C39648126923"><enum>(i)</enum><text>not more than 2 percent may be used by the Assistant Attorney General for salaries and administrative expenses; and</text></clause> 
<clause id="HDE76B371633E440D828E2993E4D4D5D6"><enum>(ii)</enum><text>not more than 25 percent may be used for technical assistance, training, and evaluation.</text></clause></subparagraph> <subparagraph id="HB43069FCA8A24B37806A9F90CBF51AFF"><enum>(B)</enum><header>Equitable distribution</header><text>The Assistant Attorney General shall ensure that grants awarded under this section are equitably distributed among the geographical regions and between urban and rural populations, including Indian Tribes, until all funds made available are expended, consistent with the objective of reducing recidivism among criminal offenders.</text></subparagraph></paragraph></subsection> 
<subsection id="H70552E811CCF4B1E8CFDC5AEFE565A6E"><enum>(f)</enum><header>Reallocation of appropriations</header><text>A recipient of a grant under subsection (a) shall return to the Assistant Attorney General any amounts received under a grant under subsection (a) that are not expended for a purpose described in this section.</text></subsection> <subsection id="H99B7CDD4E09B4718999BEE68F6E95883"><enum>(g)</enum><header>Ability to pay determination</header> <paragraph id="H2799C51097DD49FFAA930CF9144946E2"><enum>(1)</enum><header>In general</header><text>A recipient of a grant under subsection (a) may only impose a fee or fine in a criminal proceeding if a court makes a written determination that the defendant has sufficient resources or income to pay all or part of the fee, fine and costs. In making that determination, the court shall consider whether the defendant qualifies for a public defender or appointed counsel.</text></paragraph> 
<paragraph id="H2C89707898B643448A8420CDB76E3875"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="HA965F106E1FC4E50A56E0C309A1A5F92"><enum>(A)</enum><text>The term <term>fees</term>—</text> 
<clause id="HAF1DF8F89F554B128B1A1A17A76D0D40"><enum>(i)</enum><text>means monetary fees that are imposed for the costs of fine surcharges or court administrative fees; and</text></clause> <clause id="H0A682907CCF941F6B548D5F9A3EE8317"><enum>(ii)</enum><text>includes additional late fees, payment-plan fees, interest added if an individual is unable to pay a fine in its entirety, collection fees, and any additional amounts that do not include the fine.</text></clause></subparagraph> 
<subparagraph id="HE3210DFB271B46BFA3D251822BEA7AE0"><enum>(B)</enum><text>The term <term>fines</term> means monetary fines imposed as punishment.</text></subparagraph></paragraph></subsection></section> <section id="H1243DD808D194DFCA31F70D70C971732"><enum>3052.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part—</text> 
<paragraph id="H8B707DB260D2459EADBBD7796C68DCE2"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>domestic violence</term> means a pattern of behavior involving the use or attempted use of physical, sexual, verbal, emotional, economic, or technological abuse or any other coercive behavior committed, enabled, or solicited to gain or maintain power and control over a victim, by a person who—</text> <subparagraph id="H743DA4F3865645FD93EB0F29E934A6DC"><enum>(A)</enum><text>is a current or former spouse or dating partner of the victim, or other person similarly situated to a spouse of the victim under the family or domestic violence laws of the jurisdiction;</text></subparagraph> 
<subparagraph id="HB5E354A1B3FD43B8810F9D06EAF9F562"><enum>(B)</enum><text>is cohabitating with or has cohabitated with the victim as a spouse or dating partner, or other person similarly situated to a spouse of the victim under the family or domestic violence laws of the jurisdiction;</text></subparagraph> <subparagraph id="H3CA7E06E17AD46E7AD3E2DE2CB32E135"><enum>(C)</enum><text>shares a child in common with the victim; </text></subparagraph> 
<subparagraph id="H45913ABE1D524B0EBA3AAE6E255392F7"><enum>(D)</enum><text>is an adult family member of, or paid or nonpaid caregiver for, a victim aged 50 or older or an adult victim with disabilities; or</text></subparagraph> <subparagraph id="H1E1847880C394DD7998B3BCE18E7C001"><enum>(E)</enum><text>commits acts against a youth or adult victim who is protected from those acts under the family or domestic violence laws of the jurisdiction.</text></subparagraph></paragraph> 
<paragraph id="HD2FEFA16B1A445D5B21D4CC26821DB7F"><enum>(2)</enum><text>the term <term>eligible entity</term> means a public or private entity, including—</text> <subparagraph id="HA03556F9F1784F10982E0EC2F08CA7DA"><enum>(A)</enum><text>a nonprofit entity (including a tribal nonprofit);</text></subparagraph> 
<subparagraph id="HAD43E914FAA944C18C7800A21DE983A2"><enum>(B)</enum><text>a faith-based or community organization;</text></subparagraph> <subparagraph id="H717DB94CF7354C07804ACCD98EFCADDA"><enum>(C)</enum><text>a State or Tribal court system;</text></subparagraph> 
<subparagraph id="H3C05AC53C214416C8FCA3FD87B19E1B4"><enum>(D)</enum><text>a unit of local government; and</text></subparagraph> <subparagraph id="H7F39F531349F48E982B6484614ED8A09"><enum>(E)</enum><text>an Indian Tribe;</text></subparagraph></paragraph> 
<paragraph id="HFD9697F390E24C1C8AD928E55A59943C"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>proven data outcomes</term>, with respect to supervision of the conditions of pretrial release, means intervention programs and supervision policies, procedures, programs, and practices that use data to identify the least restrictive conditions necessary to provide reasonable assurance that the individual does not pose a high risk of intentional avoidance of prosecution or of seriously physically harming another reasonably identifiable person during the adjudication period;</text></paragraph> <paragraph id="H8D2B1345337547D9A0F49596ACAB4629"><enum>(4)</enum><text>the term <term>least restrictive conditions</term>—</text> 
<subparagraph id="H91EF4903D4DC460F821FEC3424410BCB"><enum>(A)</enum><text>includes court date notifications by phone call, letter, postcard, text message, or in-person reminder or another nonrestrictive pretrial supervisory condition; and</text></subparagraph> <subparagraph id="H9D8EA0DECF30481A838F736213302D35"><enum>(B)</enum><text>does not include a condition that imposes additional financial obligations on the defendant, including charging the defendant for implementation of the conditions;</text></subparagraph></paragraph> 
<paragraph id="H7068F62F84104931ACA51FEE28F47FB5"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>misdemeanor crime of stalking</term> means an offense that—</text> <subparagraph id="HBC0A5379F66C4AD58389D536C20EA410"><enum>(A)</enum><text>is a misdemeanor crime of stalking under Federal, State, Tribal, or municipal law; and</text></subparagraph> 
<subparagraph id="HAB7F4F3B382145CA915A7E4662B3C709"><enum>(B)</enum><text>is a course of harassment, intimidation, or surveillance of another person that—</text> <clause id="HDEB5BA6322844CF68C4A878A232BF619"><enum>(i)</enum><text>places that person in reasonable fear of material harm to the health or safety of—</text> 
<subclause id="H1E8CDDFEDC1A46EFAD9C3E07BD03472E"><enum>(I)</enum><text>that person;</text></subclause> <subclause id="H51BB5C6EC59C4148B846AAEC04A3C8BB"><enum>(II)</enum><text display-inline="yes-display-inline">an immediate family member (as defined in section 115 of title 18, United States Code) of that person;</text></subclause> 
<subclause id="HCD739034FF654F27843147AECC92C2F9"><enum>(III)</enum><text>a household member of that person; or</text></subclause> <subclause id="H85B6B90335C048579BD9F4108785549D"><enum>(IV)</enum><text>a spouse or intimate partner of that person; or</text></subclause></clause> 
<clause id="HBC6E2D3CE2F24022B911DD550C3C22FC"><enum>(ii)</enum><text>causes, attempts to cause, or would reasonably be expected to cause emotional distress to a person described in items subclauses (I) through (IV) of clause (i);</text></clause></subparagraph></paragraph> <paragraph id="H1918633F4DD042008A2CAC2F9D223EB7"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>misdemeanor hate crime</term> means an offense that—</text> 
<subparagraph id="H5FE70A5CB72F47C08CD45560D8436917"><enum>(A)</enum><text>is a misdemeanor under Federal, State, or tribal law;</text></subparagraph> <subparagraph id="H2A815DFC318A4B47B5880D5E5C0D7868"><enum>(B)</enum><text>has, as an element, that the conduct of the offender was motivated by hate or bias because of the actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity, or disability of any person; and</text></subparagraph> 
<subparagraph id="H9B8D94131DA743AF82DA65A9E24C85C0"><enum>(C)</enum><text>involves the use or attempted use of physical force, the threatened use of a deadly weapon, or other credible threat to the physical safety of any person;</text></subparagraph></paragraph> <paragraph id="HD3C3E244CADD4E4492C6209482E5CC4B"><enum>(7)</enum><text>the term <term>money bail</term> means a secured monetary obligation that is imposed by a court as a condition of the initial release of a defendant or ongoing court conditions of release before the trial or adjudication of the criminal charges pending against the defendant;</text></paragraph> 
<paragraph id="H1510B14F940E4AF8884B57EB9E1EEACD"><enum>(8)</enum><text>the term <term>reason for detention</term> means whether a defendant was held without bond, held on another charge, or held for another reason;</text></paragraph> <paragraph id="HB5C0031027644FD09F9479C9FEE7F5BF"><enum>(9)</enum><text>the term <term>release condition</term> means whether a defendant was released—</text> 
<subparagraph id="HBAEC9083350249A28712F1507B2C7177"><enum>(A)</enum><text>based on nonfinancial, personal recognizance;</text></subparagraph> <subparagraph id="HCD06F0A2D919419BB57202F2E25C97EB"><enum>(B)</enum><text>with pretrial supervision;</text></subparagraph> 
<subparagraph id="H8552DDDA391844DE928590322603658C"><enum>(C)</enum><text>with an unsecured financial obligation;</text></subparagraph> <subparagraph id="HA170BF2C283E460CB08E45A3E05A436D"><enum>(D)</enum><text>with a secured financial obligation; or</text></subparagraph> 
<subparagraph id="H5BB03D19AD3342E180085D1F9AA38E9F"><enum>(E)</enum><text>with a combination of the conditions described in subparagraphs (A) through (D); and</text></subparagraph></paragraph> <paragraph id="H5BA6B0457E724ECD865A0987CABC2443"><enum>(10)</enum><text>the term <term>State, local, or Tribal court system</term> means the court, court system, administrative offices of the courts, or similarly situated agency of a State, unit of local government, or Indian Tribe.</text></paragraph></section> <after-quoted-block>.</after-quoted-block></quoted-block></section>
