<section id="HC9AF59E09805479C924BB2615AB10139" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Focused Reduction of Effluence and Stormwater runoff through Hydrofracking Environmental Regulation Act of 2021</short-title></quote> or the <quote><short-title>FRESHER Act of 2021</short-title></quote>.</text></section> <section id="H72B74641DD2D417A9F58785EDD4AE30B"><enum>2.</enum><header>Stormwater runoff from oil, gas, and mining operations</header> <subsection id="H1EAD2BDB324E4EC796C7C4662B93D6F3"><enum>(a)</enum><header>Limitation on permit requirement</header><text display-inline="yes-display-inline">Section 402(l) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by striking paragraph (2) and redesignating paragraph (3) as paragraph (2).</text></subsection>
<subsection id="H315D357D5EAC471581E0691D9BD6D9B0"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended—</text> <paragraph id="H67528542855345898EDD46804309A3E3"><enum>(1)</enum><text>by striking paragraph (24); and</text></paragraph>
<paragraph id="HB060A7520D9842C1A599CC6FC9ED7F38"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (25) through (27) as paragraphs (24) through (26), respectively.</text></paragraph></subsection> <subsection id="H4029F06CA2344E2F91558F800CF4D08C"><enum>(c)</enum><header>Study</header> <paragraph id="H5CCBA57E86714E8B9D13E556C1DA07E2"><enum>(1)</enum><header>In general</header><text>The Secretary of the Interior shall conduct a study of stormwater impacts with respect to any area that the Secretary determines may be contaminated by stormwater runoff associated with oil or gas operations, which shall include—</text>
<subparagraph id="H1E32B2ECCD204D39B77ECBF92E95452D"><enum>(A)</enum><text>an analysis of measurable contamination in such area;</text></subparagraph> <subparagraph id="H23C86C5765F443D6971B146CCAF1F663"><enum>(B)</enum><text>an analysis of ground water resources in such area; and</text></subparagraph>
<subparagraph id="HA468D87D311747E1817B8A55AD8C22B7"><enum>(C)</enum><text>an analysis of the susceptibility of aquifers in such area to contamination from stormwater runoff associated with such operations.</text></subparagraph></paragraph> <paragraph id="HAADDA4373F4F4D64A4E5FFDB70556E2B"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall submit to Congress a report on the results of studies conducted under paragraph (1).</text></paragraph></subsection></section>
