<official-title display="yes">To amend title 18, United States Code, with respect to civil forfeitures relating to certain seized animals.</official-title>

<section id="H6C99AAF6365F422081ADDAF9D48B1646" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Extract Animals from Red Tape Act of 2021</short-title></quote> or the <quote><short-title>HEART Act of 2021</short-title></quote>.</text></section> <section id="HE51C859C3220416BBC27B90DAAF9D355"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline"> Congress finds the following:</text> 
<paragraph id="H0AE2B94EA9A849E6943C802CE41FB06D"><enum>(1)</enum><text>Animal fighting is one of the most heinous forms of animal cruelty.</text></paragraph> <paragraph id="HF259FF51E0B54B94BF808F2939F6907A"><enum>(2)</enum><text>Federal law prohibits sponsoring, exhibiting, or attending an animal fight, causing an individual under the age of 16 to attend an animal fight, using the postal service for promoting an animal fighting venture, as well as the interstate commerce in animal fighting paraphilia and animals for the participation in animal fights.</text></paragraph> 
<paragraph id="H1781D4E718FE4BCEBB1DC7F24D62EBA5"><enum>(3)</enum><text>Animal fighting is often associated with other forms of criminal activity including illegal gambling, drug trafficking, and domestic violence.</text></paragraph> <paragraph id="HE4E976A502E8470CA48F43BA3950D1C9"><enum>(4)</enum><text>In order to rescue animals from further cruelty, provide needed veterinary care, and protect communities, Federal agencies often seize animals suspected of being used in animal fighting ventures.</text></paragraph> 
<paragraph id="HC273F095F5FB400DB7E1085539586FE1"><enum>(5)</enum><text>Federal agencies tasked with enforcing the Federal animal fighting statutes often lack the infrastructure and expertise to hold animals after seizure and instead partner with animal welfare organizations and local animal shelters to hold animals until the final judgement of the seizure cases.</text></paragraph> <paragraph id="HB58E83F71E51498C8702A5EBF7999214"><enum>(6)</enum><text>The significant length of time animals are held before courts determine their disposition can result in serious physical and behavioral deterioration due to chronic stress, even when shelters provide high quality care.</text></paragraph> 
<paragraph id="H2E5D64D392604477A1F87B976CF0C13E"><enum>(7)</enum><text>Federal animal fighting cases often involve dozens, if not hundreds of seized animals.</text></paragraph> <paragraph id="H8D9EEA1D4A964438B08C6D2CD50BC07C"><enum>(8)</enum><text>Between 2016 and 2019, the United States Department of Justice seized over 1,000 dogs in animal fighting cases.</text></paragraph> 
<paragraph id="H8B94AD8BE47147BE980E199DF2692D45"><enum>(9)</enum><text>Holding times for animals seized in Federal animal fighting cases can stretch on for over a year. After 64 dogs were seized from twelve locations in a Federal animal fighting case in 2016, some animals were held for up to 436 days.</text></paragraph> <paragraph id="HEF8AC0A496AC46008B5AE43677142CBA"><enum>(10)</enum><text>Seizing 367 dogs in a Federal animal fighting case in 2013 required sheltering dogs for up to 390 days. Fifty-three percent of the dogs in that case declined behaviorally, with 30 percent of them deteriorating to such a degree that they had to be humanely euthanized.</text></paragraph> 
<paragraph id="H0A34BBD10D4049DA9F4B76105924279C"><enum>(11)</enum><text>Reducing the time that seized animals must be held before courts determine their legal disposition is the best way to minimize the trauma animals have experienced at the hands of their abusers.</text></paragraph> <paragraph id="HA24233C9E7244304AD6A00D358C3284D"><enum>(12)</enum><text>The unique nature of animals compared to other seized assets requires higher costs to the government and to partnering animal welfare organizations.</text></paragraph> 
<paragraph id="H94702917CDE04BD2AA480138B608D215"><enum>(13)</enum><text>Animal welfare organizations have sheltered animals for several Federal investigations at costs ranging from $900,000 to more than $3 million.</text></paragraph> <paragraph id="H5D89498115D64875A1073385853A94CB"><enum>(14)</enum><text>Uncertainty regarding who is ultimately responsible for the cost of care for the seized animals discourages future animal fighting investigations, which means fewer animals saved.</text></paragraph> 
<paragraph id="HCE42F3736FAC40199664D97CBC96DFC5"><enum>(15)</enum><text>Expediting the disposition process for animals seized in Federal animal fighting cases will provide better outcomes for animals, reduce financial burdens on animal welfare organizations partnering with Federal agencies, and will provide more space in shelters for other animals in need.</text></paragraph></section> <section id="H2E951E49652D4FFFA7B38E16F17F7EBB"><enum>3.</enum><header>Reduced notice period</header> <subsection id="H2910677505AE433FB2B2CB676ED7A352"><enum>(a)</enum><header>Notice timing for cases of animal seizure</header><text>Section 983(a)(1)(A) of title 18, United States Code, is amended by adding at the end the following new clause:</text> 
<quoted-block id="H2AEFF368E76D4529B2119F2440E0CF7C" style="OLC"> 
<clause id="HA09BB8A8C4154922906B20432E55171C"><enum>(vi)</enum><text>With respect to an animal seized under section 26 of the Animal Welfare Act or under section 1955 of this title, clauses (i), (ii), (iii), and (v), shall be applied by substituting <quote>30-days</quote> for <quote>60-days</quote>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA6FE6AF7112F4845830E8653067BD35F"><enum>(b)</enum><header>Notice procedures for cases of animal seizure</header><text>Section 983(a)(1) of title 18, United States Code, as amended by this Act, is amended—</text> 
<paragraph id="HF81BDA9D553544DCAA8DFD3AC6A78FBA"><enum>(1)</enum><text>in subparagraph (B) by inserting <quote>and with respect to an animal seized under section 26 of the Animal Welfare Act or section 1955 of this title, that the delay is warranted in light of the criteria in subparagraph (G)</quote> after <quote>if the official determines that the conditions in subparagraph (D) are present,</quote>;</text></paragraph> <paragraph id="HA385618919A745AB887CDE447F908E79"><enum>(2)</enum><text>in subparagraph (C) by inserting <quote>and with respect to an animal seized under section 26 of the Animal Welfare Act or section 1955 of this title, that the delay is warranted in light of the criteria in subparagraph (G)</quote> after <quote>that the conditions in subparagraph (D) are present,</quote>; and</text></paragraph> 
<paragraph id="H9630B7BE8CA94EB2A1D8D911A8DD8FAF"><enum>(3)</enum><text>by adding after subparagraph (F), the following:</text> <quoted-block id="H38166176EF18453884F8A07322A51409" style="OLC"> <subparagraph id="HCA660842987F414CA2CDB8939F1AAA22"><enum>(G)</enum><text>With respect to an animal seized under section 26 of the Animal Welfare Act or section 1955 of this title, the period for sending notice under this paragraph may be extended only after consideration of the following:</text> 
<clause id="H6A430870D8EC4AC9B15F3CC7771DAC24"><enum>(i)</enum><text>The cost to the government of caring and providing shelter for the animal.</text></clause> <clause id="H45A7C486C22E42E585AFDC4E4BAB179E"><enum>(ii)</enum><text>The psychological and physical health of the animal and the effect the delay will have on its rehabilitation.</text></clause> 
<clause id="HE16E41E38F7341449807CF3048A7CB09"><enum>(iii)</enum><text>Any increased risk that the delay could necessitate the euthanasia of the animal.</text></clause> <clause id="H70ADFFFF6E9D4852B473C30E58580410"><enum>(iv)</enum><text>Any psychological harm incurred by the animals’ owner due to the delay in disposition.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H5261CF491C844F50AF6EA669621A8C6E"><enum>4.</enum><header>Seizures of animals</header> 
<subsection id="H04478310632948138A08D18045DEF717"><enum>(a)</enum><header>Payment for certain costs</header><text>Section 524(c)(1) of title 28, United States Code, is amended by adding after subparagraph (I), the following:</text> <quoted-block id="HF2140A2F6B3B469BB6490A918C786B9E" style="OLC"> <subparagraph id="H2F763FC6F8A541AD8ABB47037F0B9499"><enum>(J)</enum><text>payment for the transportation, shelter, care, veterinary services, and where appropriate, humane euthanasia of an animal seized under section 26 of the Animal Welfare Act or under section 1955 of title 18.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD030A566B6344781BAAACFEA4B439FA0"><enum>(b)</enum><header>Reimbursement and proportionality</header><text>Section 983(h) of title 18, United States Code, is amended by adding at the end, the following:</text> <quoted-block id="H325B4B7A6BE0422DB843CB1351038EE5" style="OLC"> <paragraph id="H2F01258238244DC79EA841885C5FE885"><enum>(4)</enum><text>In any civil forfeiture proceeding in which the Government prevails, the court shall require the claimant, to reimburse the United States for any actual and reasonable costs to the government for the transportation, shelter, care, veterinary services, or where appropriate, humane euthanasia of an animal that was the subject of the proceeding. The reimbursement shall be credited to the agency or fund that was used to pay the costs being reimbursed.</text></paragraph> 
<paragraph id="H26FDCECE5177400E9858F86B19777096"><enum>(5)</enum><text>In any civil forfeiture proceeding in which an animal is subject of the proceeding, the court may reduce the size of a reimbursement based on any of the following factors:</text> <subparagraph id="H7B09C06D772A4AAF9FB1D6CBDC43D4A5"><enum>(A)</enum><text>The seriousness of the offense.</text></subparagraph> 
<subparagraph id="HBC0B88F871624B05A1CCCEBE1CFA2071"><enum>(B)</enum><text>The culpability of the claimant.</text></subparagraph> <subparagraph id="HFFA3D53FCD724006901BFD084A143EDD"><enum>(C)</enum><text>The claimant’s prior record.</text></subparagraph> 
<subparagraph id="H3A01334AE3B14850A6D6C6CD1BE8A7A6"><enum>(D)</enum><text>The claimant’s financial condition and need to support a family.</text></subparagraph> <subparagraph id="HF6985574A63449D8BD3EDF3B94C33E39"><enum>(E)</enum><text>The purpose of the forfeiture statute in question.</text></subparagraph></paragraph> 
<paragraph id="H8B53B13725F94A9EA7520AC75ED10F98"><enum>(6)</enum><text>Nothing in this section should be interpreted to reimburse the United States for any costs other than for costs related to animals seized under section 26 of the Animal Welfare Act or under section 1955 of title 18.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body> </bill>
