R. 2039</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="L000583">Mr. Loudermilk</sponsor> (for himself, <cosponsor name-id="H001058">Mr. Huizenga</cosponsor>, <cosponsor name-id="H001072">Mr. Hill</cosponsor>, <cosponsor name-id="D000626">Mr. Davidson</cosponsor>, and <cosponsor name-id="B001305">Mr. Budd</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Securities and Exchange Commission from requiring that personally identifiable information be collected under consolidated audit trail reporting requirements, and for other purposes.</official-title></form><legis-body id="H8E81E69AD4B04025BDC7045463096B69" style="OLC"><section id="H9F7B195782214B81AD1E0A34119B7459" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Investors’ Personally Identifiable Information Act</short-title></quote>. </text></section><section id="H47E7D70F25F34223B981677491D3DE52"><enum>2.</enum><header>Personally identifiable information excluded from consolidated audit trail reporting requirements</header><subsection id="H7C34EF4474884F2EAE6E7D1DD00B7655"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Securities and Exchange Commission may not require a national securities exchange, a national securities association, or a member of such an exchange or association to provide personally identifiable information with respect to a market participant to meet the requirements relating to an order or a reportable event under section 242.613(c)(7) of title 17, Code of Federal Regulations (or successor regulations). </text></subsection><subsection id="H823A818C71C14EC284256BF30B1D1359"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The Securities and Exchange Commission may only require a national securities exchange, a national securities association, or a member of such an exchange or association to provide personally identifiable information with respect to a market participant if the Commission makes a request for such information.</text></subsection><subsection id="H282284C42C4E4BCF958F93C0329517F8"><enum>(c)</enum><header>Request for extension</header><text display-inline="yes-display-inline">At the request of the Securities and Exchange Commission under subsection (b), a national securities exchange, a national securities association, or a member of such an exchange or association shall provide the personally identifiable information subject to such request not later than 24 hours after receiving such request, unless, at the request of such national securities exchange, a national securities association, or a member of such an exchange or association, the Securities and Exchange Commission provides a reasonable extension.</text></subsection><subsection id="HFDA568A1F88D42D8931FCB758945D5FA"><enum>(d)</enum><header>Destruction of personally identifiable information</header><text>In the case of personally identifiable information provided to the Securities and Exchange Commission under subsection (b), the Securities and Exchange Commission shall destroy such information not later than 1 day after the investigation or other matter for which such information was required is concluded. </text></subsection><subsection id="HA5AEA16517F749FCA784B3FB81ABCCBD"><enum>(e)</enum><header>Definition of personally identifiable information</header><text display-inline="yes-display-inline">In this section, the term <term>personally identifiable information</term>—</text><paragraph id="H9FA40443F6414AD5BA41EEDEE48A8D72"><enum>(1)</enum><text>means information that can be used to distinguish or trace an individual’s identity, either alone or when combined with other personal or identifying information that is linked or linkable to a specific individual, including an individual’s name, address, date or year of birth, Social Security number, telephone number, and email address; and</text></paragraph><paragraph id="HFF3731613A854A1D8A026D1EB925B707"><enum>(2)</enum><text display-inline="yes-display-inline">does not include a CAT-Order-ID or CAT-Reporter-ID, as such terms are defined in section 242.613(j) of title 17, Code of Federal Regulations (or successor regulations). </text></paragraph></subsection></section></legis-body></bill>
