which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to provide coverage for infertility treatment and standard fertility preservation services, and for other purposes.</official-title></form><legis-body id="H7C2CBC5E5B0940D6BBDC525D23C6D6B1" style="OLC"><section id="HF2B3BD5CA7ED4A7897A7453788597A4D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Infertility Treatment Act of 2021</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" id="H23AC659DD4D4401D93905C4177F4016B"><enum>2.</enum><header display-inline="yes-display-inline">Infertility treatments for veterans</header><subsection commented="no" display-inline="no-display-inline" id="HBF615A78C431415781E41B282C343379"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HA44FDD3F3DFC4C04B67EA9BE0FE20C0A" style="USC"><section commented="no" display-inline="no-display-inline" id="H49B6A96EC7894F6EAFACD384FFE9B230" section-type="subsequent-section"><enum>1720K.</enum><header display-inline="yes-display-inline">Infertility treatment and standard fertility preservation services</header><subsection commented="no" display-inline="no-display-inline" id="HCA5C4B69376842F88361A37ACB5675EF"><enum>(a)</enum><header display-inline="yes-display-inline">Treatment and services</header><paragraph commented="no" display-inline="yes-display-inline" id="H6708283347F74B9CAE9ABCFBEF50C21C"><enum>(1)</enum><text display-inline="yes-display-inline">In furnishing medical services under this chapter, the Secretary shall furnish infertility treatments (including through the use of assisted reproductive technology), standard fertility preservation services, or both, to a covered veteran or a partner of a covered veteran, if the veteran and the partner of the veteran apply jointly for such treatments or services, or both, through a process prescribed by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD6CC7CCC45B44219012EACE484F47BF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of in vitro fertilization treatment furnished under paragraph (1), the Secretary may furnish not more than three completed cycles that result in live birth or six attempted cycles of in vitro fertilization, whichever occurs first, to an individual under such paragraph.</text></paragraph><paragraph id="H7CBBA49553934E618969C254567C7249" indent="up1"><enum>(3)</enum><text>The Secretary may furnish in vitro ferilization treatment under paragraph (1) using donated gametes or embryos.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0874979D66DD4E6C8F06354AE139414F"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require the Secretary to furnish maternity care to a covered veteran or partner of a covered veteran, in addition to what is otherwise required by section 1786 of this title or other provisions of law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H89C0E08E9AE040B69B098FA519ACDB06"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HDF85C29C15394C36B397CD7EF06D8111" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>assisted reproductive technology</term> includes in vitro fertilization and other fertility treatments in which both eggs and sperm are handled when clinically appropriate.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEFEA03ECB2E48119623EA4E03CE9B24"><enum>(2)</enum><text>The term <term>covered veteran</term> means a veteran who—</text><subparagraph id="H3D2541A6D35C49879C32E24095104761"><enum>(A)</enum><text>has infertility; and</text></subparagraph><subparagraph id="H740DC97B236A402FB852297F65E1E6BB"><enum>(B)</enum><text>is enrolled in the system of annual patient enrollment established under section 1705(a) of this title.</text></subparagraph></paragraph><paragraph id="HD9AF0AA5975C49D6A1BC65CE092697D2"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>infertility</term>—</text><subparagraph id="H7BF82FC56BA94D779233EC0723D29E2B"><enum>(A)</enum><text>means a disease or condition characterized by—</text><clause id="HD47EC8E57BF649E38802CC16D18C7D53"><enum>(i)</enum><text>the failure to conceive a pregnancy or to carry a pregnancy to live birth after one year of regular, unprotected sexual intercourse; or</text></clause><clause id="H0E76C274EEF54B0C89326D842342073E"><enum>(ii)</enum><text>the inability of a person to reproduce either as an individual or with the partner of the individual; and</text></clause></subparagraph><subparagraph id="HC54937D2E7FC48C69810EB5173BEDA51"><enum>(B)</enum><text display-inline="yes-display-inline">includes instances in which a person is at risk of being described in clauses (i) or (ii) of subparagraph (A), as determined by a licensed physician based on—</text><clause id="HDD222E729A914A678755555404D769B5"><enum>(i)</enum><text>the medical, sexual, and reproductive history, age, physical findings, or diagnostic testing, or a combination thereof, of the person; or</text></clause><clause id="H652B03F068C3414F84FC81109A34F320"><enum>(ii)</enum><text>any planned medication therapy, surgery, radiation, chemotherapy, or other medical treatment.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD1FC1A169574BA4AACBED57344DEFBA"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>partner</term>, with respect to a veteran, means an individual selected by the veteran who agrees to share with the veteran the parental responsibilities with respect to any child born as a result of the use of any infertility treatment under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HEA331D1533884E348C224694977FC871"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 17 of such title is amended by inserting after the item relating to section 1720J the following new item:</text><quoted-block display-inline="no-display-inline" id="HD0E013B4AF3F4AA0A383E4B54A44F17A" style="OLC"><toc><toc-entry bold="off" level="section">1720K. Infertility treatment and standard fertility preservation services.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H804B3059D67A4F64913441B125E82C55" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Regulations on furnishing of infertility treatment by Department of Veterans Affairs</header><subsection id="HA51BD68C8FA64462B0B8F4AD83D32A10"><enum>(a)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of Veterans Affairs shall prescribe regulations to carry out section 1720K of title 38, United States Code, as added by section 2.</text></subsection><subsection id="HE9FAB460996A4F75A7856A5ABAB6D462" commented="no"><enum>(b)</enum><header>Interim policies</header><text display-inline="yes-display-inline">During the period beginning 180 days after the date of the enactment of this Act and the date on which the regulations are prescribed under subsection (a), the Secretary shall ensure that fertility counseling and treatment furnished pursuant to section 234(a)(1) of the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2021 (division J of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) or other provisions of law administered by the Secretary include the following elements:</text><paragraph id="HB36D7709DD4C4F4793B80D7C6B512F96" commented="no"><enum>(1)</enum><text>The Secretary may furnish such counseling and treatment to the partner of a veteran covered by such provision without regard to whether the partner and veteran are married.</text></paragraph><paragraph id="H2B53809DC85B4A9DACF79976F4585AEB" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may furnish such counseling and treatment using donated gametes or embryos.</text></paragraph></subsection><subsection id="HAA48567E57D24A5D957469CE6AC69197" commented="no"><enum>(c)</enum><header>Partner defined</header><text display-inline="yes-display-inline">In this section, the term <term>partner</term> has the meaning given that term in section 1720K of title 38, United States Code, as added by section 2.</text></subsection></section></legis-body></bill>
