R. 1920</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="G000577">Mr. Graves of Louisiana</sponsor> (for himself and <cosponsor name-id="C001063">Mr. Cuellar</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for Federal agency accountability and improve the effectiveness of major rules in accomplishing their regulatory objectives by requiring retrospective review and report, and for other purposes.</official-title></form><legis-body id="H04D1E00A05E946CFBB30CE7C1CAA05AF" style="OLC"><section id="HF3D22F9331CA4EA88B70022D5D066485" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Retrospective Observations Validating Economics and Increasing Transparency Act of 2021</short-title></quote> or as the <quote><short-title>PROVE IT Act of 2021</short-title></quote>.</text></section><section id="HBD5223D53ADA4823B0E09F687D289A5F"><enum>2.</enum><header>Incorporating retrospective review for new major rules</header><subsection id="HA026774F8DD440C795C649E46819AE3F"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, is amended—</text><paragraph id="H24F748973A8F43339F8B4DDE5C4B139C"><enum>(1)</enum><text>in section 551—</text><subparagraph id="H7246F83EE7C54D2BAA163F6E2864AF61"><enum>(A)</enum><text>in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HFA7DD3DB825045F59BD591534F1A32B6"><enum>(B)</enum><text>in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H978DADDB3F0F468FB3F3CDBE69EB0B03"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H599F6118576147FCBDF28483629E6485"><paragraph id="HAE8DEC5052E8437DBED73EA5FB437FA5"><enum>(15)</enum><text><quote>Administrator</quote> means the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget; and</text></paragraph><paragraph id="H80535E709F2348B7AA9E4E443951BC0F"><enum>(16)</enum><text><quote>major rule</quote> means any rule that the Administrator finds has resulted in or is likely to result in—</text><subparagraph id="H0D500E9D3F9740168ACC8EE520169E6C"><enum>(A)</enum><text>an annual effect on the economy of $100,000,000 or more;</text></subparagraph><subparagraph id="H9A43FE14288F499799635375662B8E22"><enum>(B)</enum><text>a major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions; or</text></subparagraph><subparagraph id="H355665C132494846AC7AB27C2A9F6C17"><enum>(C)</enum><text>significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1394CE6318DF43CF801B27594A9C9E16"><enum>(2)</enum><text>in section 553, by adding at the end the following:</text><quoted-block id="H960C3E2DB37E409FA6AEC349AD8A7D2B"><subsection id="HDF046CB79F3D43BB81B3BE33C1228EDF"><enum>(f)</enum><header>Regulation-Specific frameworks</header><paragraph id="H4889AF235C4149D89B54575B77214075"><enum>(1)</enum><header>In general</header><text>Beginning 180 days after the date of enactment of this subsection, when an agency publishes a final major rule in the Federal Register, the agency shall publish a report on the benefits and costs of the final rule on entities whose conduct is regulated by the rule in the Federal Register biannually thereafter while the rule remains in effect. The report shall—</text><subparagraph id="H5E235FC3BD09401BAA793F571AB6B5CD"><enum>(A)</enum><text>assess the impacts, including any costs, of the major rule on regulated entities;</text></subparagraph><subparagraph id="H64B49A219C5C4000BAA2B8199D0B8313"><enum>(B)</enum><text>include a determination about how the actual benefits and costs of the major rule has varied from those anticipated at the time the major rule was issued;</text></subparagraph><subparagraph id="H18F2FB6B75E24C909655F85CC4801075"><enum>(C)</enum><text>assess the effectiveness and benefits of the major rule in producing the regulatory objectives of the major rule; and</text></subparagraph><subparagraph id="HF46B71A5C92E4997BC459AA75791E43A"><enum>(D)</enum><text display-inline="yes-display-inline">be reviewed by the Administrator when required under Executive order.</text></subparagraph></paragraph><paragraph id="HE162D310AEFB472C93CF9A4CE2A6D9E4"><enum>(2)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The agency shall provide a report to Congress not later than 90 days after the agency makes any determination under paragraph (1)(C) that the cost to regulated entities has exceeded the anticipated cost at the time the final rule was issued. Agencies shall assess in their report—</text><subparagraph id="H75D6430D84E143D19F97220EE6B73B4C"><enum>(A)</enum><text>whether the major rule is accomplishing its regulatory objective; and</text></subparagraph><subparagraph id="H175A7183F9C940FEA91AE289539243BB"><enum>(B)</enum><text>whether the major rule has been rendered unnecessary, taking into consideration—</text><clause id="H2FCDB886638E4E57978E076217C5C437"><enum>(i)</enum><text>changes in the subject area affected by the major rule;</text></clause><clause id="HEF8B06C3BB8C4357B128A92704755756"><enum>(ii)</enum><text>whether the major rule overlaps, duplicates, or conflicts with other rules or, to the extent feasible, State and local government regulations; and</text></clause><clause id="HF0876B27FA93456595B5CF7D409B2628"><enum>(iii)</enum><text>other alternatives to the major rule or modification of the major rule could achieve better results while imposing a smaller burden on society or at a lower cost, taking into consideration any cost already incurred.</text></clause></subparagraph></paragraph><paragraph id="H0F72D8FAE2EF460C9A08CBA78BAB7F18"><enum>(3)</enum><header>Reopening of public docket</header><text>Upon delivery of the report required in paragraph (2) the agency shall—</text><subparagraph id="H7625B6785ED1475A932CE727FFB95501"><enum>(A)</enum><text>reopen the public docket for 60 days to receive additional comments; and</text></subparagraph><subparagraph id="HDF0A71A7E0714432BD0FBFBA6FE0D0D8"><enum>(B)</enum><text>consider modifications or alternatives that reduce costs and increase benefits to regulated entities or individuals.</text></subparagraph></paragraph><paragraph id="H15D14F91AFE94D12ACEC501B2B647660"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to affect any other provision of law that requires an agency to conduct retrospective reviews of rules issued by the agency.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
