addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide health insurance benefits for outpatient and inpatient items and services related to the diagnosis and treatment of a congenital anomaly or birth defect.</official-title></form><legis-body id="HE4080C2C04DE475DB357B384CED4888C" style="OLC"><section section-type="section-one" id="H56128D5CF5E54A25867E75DCEF0E9D63"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Lasting Smiles Act</short-title></quote>.</text></section><section id="HEB13863634E94E53BC3DF5912D58C68E"><enum>2.</enum><header>Coverage of congenital anomaly or birth defect</header><subsection id="HE9D4E75785844328899986C4C5944F97"><enum>(a)</enum><header>Public Health Service Act Amendments</header><text>Part D of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3775B67AB3204CD6A91B994DF563419B"><section id="HFC9CF5F1E8634846B2D7B160A3A8B998"><enum>2799A–11.</enum><header>Standards relating to benefits for congenital anomaly or birth defect</header><subsection id="HD871A97717B645F4ACEDFC518B3FB833"><enum>(a)</enum><header>Requirements for care and Reconstructive Treatment</header><paragraph id="HAF87C5CF40BD459E989E365BE026C1C0"><enum>(1)</enum><header>In general</header><text>A group health plan, and a health insurance issuer offering group or individual health insurance coverage, shall provide coverage for outpatient and inpatient items and services related to the diagnosis and treatment of a congenital anomaly or birth defect.</text></paragraph><paragraph id="HB67B4FB7A729486993F8C2EC8093D9CB"><enum>(2)</enum><header>Requirements</header><subparagraph id="HA2C5AAF5738946689A47EC4F1E19EC6E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Coverage provided under paragraph (1) shall include any medically necessary item or service to functionally improve, repair, or restore any body part to achieve normal body functioning or appearance, as determined by the treating physician (as defined in section 1861(r) of the Social Security Act), due to congenital anomaly or birth defect.</text></subparagraph><subparagraph id="HA40AE41EBC4042CC993606ADE85ED163"><enum>(B)</enum><header>Financial requirements and treatment requirements</header><text display-inline="yes-display-inline">Any coverage provided under paragraph (1) under a group health plan or individual or group health insurance coverage offered by a health insurance issuer may be subject to coverage limits (such as medical necessity, pre-authorization, or pre-certification) and cost-sharing requirements (such as coinsurance, copayments, and deductibles), as required by the plan or issuer, that are no more restrictive than the predominant coverage limits and cost-sharing requirements, respectively, applied to substantially all medical and surgical benefits covered by the plan (or coverage).</text></subparagraph></paragraph><paragraph id="H08D79E6F673D40CB8A94D1481D38BA9E"><enum>(3)</enum><header>Treatment defined</header><text display-inline="yes-display-inline">In this section:</text><subparagraph id="HF450DA35E3A44B2EB79E84A4D1EBB538"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>treatment</term> includes, with respect to a group health plan or group or individual health insurance coverage offered by a health insurance issuer, inpatient and outpatient items and services performed to improve, repair, or restore bodily function (or performed to approximate a normal appearance), due to a congenital anomaly or birth defect, and includes treatment to any and all missing or abnormal body parts (including teeth, the oral cavity, and their associated structures) that would otherwise be provided under the plan or coverage for any other injury or sickness, including—</text><clause id="H129FB2EB2A1141509F42325827A513AB"><enum>(i)</enum><text display-inline="yes-display-inline">any items or services, including inpatient and outpatient care, reconstructive services and procedures, and complications thereof;</text></clause><clause id="H6437D8B927BE482084432F70C0E3B2B6"><enum>(ii)</enum><text>adjunctive dental, orthodontic, or prosthodontic support from birth until the medical or surgical treatment of the defect or anomaly has been completed, including ongoing or subsequent treatment required to maintain function or approximate a normal appearance;</text></clause><clause id="H571E61EE31E24E2D9987F83C15791B6E"><enum>(iii)</enum><text display-inline="yes-display-inline">procedures that materially improve, repair, or restore bodily function; and</text></clause><clause id="H34F78DA712A541088A2B805A11AA687D"><enum>(iv)</enum><text>procedures for secondary conditions and follow-up treatment associated with the underlying congenital anomaly or birth defect.</text></clause></subparagraph><subparagraph id="H06A732BE1D134B45B0E585A7231DEA83"><enum>(B)</enum><header>Exception</header><text>The term <term>treatment</term> shall not include cosmetic surgery performed to reshape normal structures of the body to improve appearance or self-esteem.</text></subparagraph></paragraph></subsection><subsection id="HBF670A456F9C44068853DF32B4C48DF2"><enum>(b)</enum><header>Notice</header><text>A group health plan under this part shall comply with the notice requirement under section 714(c) of the Employee Retirement Income Security Act of 1974 with respect to the requirements of this section as if such section applied to such plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE1815F1D32024344A9815D1AE2064D98"><enum>(b)</enum><header>ERISA amendments</header><paragraph id="H11B37C047B6B4FFA8E2D88F2FA8E74C6"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2AD4B1F4F0354FF491F29F18BB5B7920"><section id="H24B1B59A944B44D3B35DEA0E09F166B9"><enum>726.</enum><header>Standards relating to benefits for congenital anomaly or birth defect</header><subsection id="HAA8C0909508C4668897049BBC7583AC4"><enum>(a)</enum><header>Requirements for care and Reconstructive Treatment</header><paragraph id="HDFE4E02ADEE44452A7DEE784C8D9A2BB"><enum>(1)</enum><header>In a health insurance issuer, inpatient and outpatient items and services performed to improve, repair, or restore bodily function (or performed to approximate a normal appearance), due to a congenital anomaly or birth defect, and includes treatment to any and all missing or abnormal body parts (including teeth, the oral cavity, and their associated structures) that would otherwise be provided under the plan or coverage for any other injury or sickness, including—</text><clause id="HDB8EDAEE07F84514B966AB39A101AE08"><enum>(i)</enum><text display-inline="yes-display-inline">any items or services, including inpatient and outpatient care, reconstructive services and procedures, and complications thereof;</text></clause><clause id="HEA4D90BFC4F447B38DB8B82142CC4BEA"><enum>(ii)</enum><text>adjunctive dental, orthodontic, or prosthodontic support from birth until the medical or surgical treatment of the defect or anomaly has been completed, including ongoing or subsequent treatment required to maintain function or approximate a normal appearance;</text></clause><clause id="HB15D528EA1ED49FDAD4C514F9555C0EF"><enum>(iii)</enum><text display-inline="yes-display-inline">procedures that materially improve, repair, or restore bodily function; and</text></clause><clause id="H52EBF9960A894C1BBD4D4A2D85D99A05"><enum>(iv)</enum><text>procedures for secondary conditions and follow-up treatment associated with the underlying congenital anomaly or birth defect.</text></clause></subparagraph><subparagraph id="H77E1242F7B8344BEA74146C7463704E1"><enum>(B)</enum><header>Exception</header><text>The term <term>treatment</term> shall not include cosmetic surgery performed to reshape normal structures of the body to improve appearance or self-esteem.</text></subparagraph></paragraph></subsection><subsection id="H2A17F7BF9CDE4150AAF86F7D9DC8CA06"><enum>(b)</enum><header>Notice</header><text>A group health plan under this part shall comply with the notice requirement under section 714(c) with respect to the requirements of this section as if such section applied to such plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H95A351FE81304D7191BF421205A37B94"><enum>(2)</enum><header>Technical amendments</header><subparagraph id="H3256AF487C5749A7820D9EF4A832AF73"><enum>(A)</enum><text>Section 732(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191a">29 U.S.C. 1191a(a)</external-xref>) is amended by striking <quote>section 711</quote> and inserting <quote>sections 711 and 726</quote>.</text></subparagraph><subparagraph id="H9700F74690A84B22ACB93C0CEA21510E"><enum>(B)</enum><text>The table of contents in section 1 of such Act is amended by inserting after the item relating to section 725 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF8BC26BAEF74423E8F31EC7E23DC65FB"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 726. Standards relating to benefits for congential anomaly or birth defect.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2AFC24586D73445F8708C0C4C84D4FE8"><enum>(c)</enum><header>Internal Revenue Code amendments</header><paragraph commented="no" display-inline="no-display-inline" id="H60D34C2FBAF44F679605DA68D1E58575"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H58E6D8D0A9B0403B982288CCB1EE1CF9"><section id="H8197FD1062E042D09DFC0C9CF32F48FC"><enum>9826.</enum><header>Standards relating to benefits for congenital anomaly or birth defect</header><subsection id="HA39A865FD53A46C3842219588055D949"><enum>(a)</enum><header>Requirements for care and Reconstructive Treatment</header><paragraph id="H42B3D35839E0404184B423586D64BFDE"><enum>(1)</enum><header>In general</header><text>A group health plan shall provide coverage for outpatient and inpatient items and services related to the diagnosis and treatment of a congenital anomaly or birth defect.</text></paragraph><paragraph id="H60D8FD61BD714B34A485B367B9FC2463"><enum>(2)</enum><header>Requirements</header><subparagraph id="H4616F6138C9849C2AB22EA3A82C8D2F5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Coverage provided under paragraph (1) shall include any medically necessary item or service to functionally improve, repair, or restore any body part to achieve normal body functioning or appearance, as determined by the treating physician (as defined in section 1861(r) of the Social Security Act), due to congenital anomaly or birth defect.</text></subparagraph><subparagraph id="HB852A422137847F1A00FD7304FE2C937"><enum>(B)</enum><header>Financial requirements and treatment requirements</header><text display-inline="yes-display-inline">Any coverage provided under paragraph (1) under a group health plan may be subject to coverage limits (such as medical necessity, pre-authorization, or pre-certification) and cost-sharing requirements (such as coinsurance, copayments, and deductibles), as required by the plan, that are no more restrictive than the predominant coverage limits and cost-sharing requirements, respectively, applied to substantially all medical and surgical benefits covered by the plan.</text></subparagraph></paragraph><paragraph id="H47C86BDB8A19451CAAE4DEFA2621E377"><enum>(3)</enum><header>Treatment defined</header><text display-inline="yes-display-inline">In this section:</text><subparagraph id="H3F7C10A668AB40E5B675B7E903687FED"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>treatment</term> includes, with respect to a group health plan, inpatient and outpatient items and services performed to improve, repair, or restore bodily function (or performed to approximate a normal appearance), due to a congenital anomaly or birth defect, and includes treatment to any and all missing or abnormal body parts (including teeth, the oral cavity, and their associated structures) that would otherwise be provided under the plan for any other injury or sickness, including—</text><clause id="HA04B48D6A02C4C5B87770CA913FC13F6"><enum>(i)</enum><text display-inline="yes-display-inline">any items or services, including inpatient and outpatient care, reconstructive services and procedures, and complications thereof;</text></clause><clause id="H7177BE38D1A54A5E99FB53994D933DE2"><enum>(ii)</enum><text>adjunctive dental, orthodontic, or prosthodontic support from birth until the medical or surgical treatment of the defect or anomaly has been completed, including ongoing or subsequent treatment required to maintain function or approximate a normal appearance;</text></clause><clause id="HCD5CBBB4CF144F7D9EF642E92150CBF5"><enum>(iii)</enum><text display-inline="yes-display-inline">procedures that materially improve, repair, or restore bodily function; and</text></clause><clause id="HF4E5C99EC6FF4DC4B9F161C80F9D7B2B"><enum>(iv)</enum><text>procedures for secondary conditions and follow-up treatment associated with the underlying congenital anomaly or birth defect.</text></clause></subparagraph><subparagraph id="H4EE9B598A70A471A92867C0BE7E5043B"><enum>(B)</enum><header>Exception</header><text>The term <term>treatment</term> shall not include cosmetic surgery performed to reshape normal structures of the body to improve appearance or self-esteem.</text></subparagraph></paragraph></subsection><subsection id="H64886EE6A64F4CCCA5FA96B665E28FF8"><enum>(b)</enum><header>Notice</header><text>A group health plan under this part shall comply with the notice requirement under section 714(c) of the Employee Retirement Income Security Act of 1974 with respect to the requirements of this section as if such section applied to such plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H3F7C0AC69CFF420EB9B5B4434D650EB8"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for such subchapter is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="H6F0936E6703D4B0983D4B648B608B9E4"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9826. Standards relating to benefits for congenital anomaly or birth defect.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBEA770E6F2374E34905C546A35F5542B"><enum>(d)</enum><header>Rule of construction</header><text>A group health plan or health insurance issuer shall provide the benefits described in section 2799A–11 of the Public Health Service Act (as added by subsection (a)), section 726 of the Employee Retirement Income Security Act of 1974 (as added by subsection (b)), and <external-xref legal-doc="usc" parsable-cite="usc/26/9826">section 9826</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (c)) under the terms of such plan or health insurance coverage offered by such issuer.</text></subsection><subsection id="H37E55C909DBA4AE7845136F072CB0669"><enum>(e)</enum><header>Clarifying amendment regarding application to grandfathered plans</header><text display-inline="yes-display-inline">Section 1251(a)(4)(A) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18011">42 U.S.C. 18011(a)(4)(A)</external-xref>), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC49504906250471192F36D4A18A39FEF"><clause id="H5B938557F853410DB0FD476302118479"><enum>(v)</enum><text display-inline="yes-display-inline">Section 2799A–11 (relating to standards relating to benefits for congenital anomaly or birth defect), as added by section 2(a) of the <short-title>Ensuring Lasting Smiles Act</short-title>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF70306968D8F49B08EE1140416BF1D18"><enum>(f)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to group health plans for plan years beginning on or after January 1, 2022, and with respect to health insurance coverage offered, sold, issued, renewed, in effect, or operated in the individual market on or after such date.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H1EBFD852CF4D4E9695A8BC57A47588B2"><enum>(g)</enum><header>Coordinated regulations</header><text>Section 104(1) of the Health Insurance Portability and Accountability Act of 1996 is amended by striking <quote>this subtitle (and the amendments made by this subtitle and section 401)</quote> and inserting <quote>the provisions of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974, the provisions of parts A, C, and D of title XXVII of the Public Health Service Act, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986</quote>.</text></subsection></section></legis-body></bill>
