which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code to prohibit persons convicted of misdemeanor crimes against dating partners and persons subject to protection orders from possessing firearms, and for other purposes.</official-title></form><legis-body id="HF834C76AC40A4B11BFE2DAE64E6B92F6" style="OLC"><section id="HA99275D07DD64FC18510216C3B252913" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Domestic Violence and Stalking Victims Act of 2021</short-title></quote>.</text></section><section id="HF00D39DBA7464946BB525425FC79BD33"><enum>2.</enum><header>Prohibiting persons convicted of misdemeanor crimes against dating partners and persons subject to protection orders</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph display-inline="no-display-inline" id="H6B42E650D4374C018B87D4B09F321DF1"><enum>(1)</enum><text>in paragraph (32), by striking all that follows after <quote>The term <term>intimate partner</term></quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H527A155B300B425DA279F72357F0FB15" style="USC"><text>—</text><subparagraph id="H69079A6353F84EA2B058A27854BC67AA"><enum>(A)</enum><text display-inline="yes-display-inline">means, with respect to a person, the spouse of the person, a former spouse of the person, an individual who is a parent of a child of the person, and an individual who cohabitates or has cohabited with the person; and</text></subparagraph><subparagraph id="H53262DC1036D427B9A68BD3ACCE8C943"><enum>(B)</enum><text>includes—</text><clause id="HBB60297C64834AEE9827F2C93D32B36D"><enum>(i)</enum><text>a dating partner or former dating partner (as defined in section 2266); and</text></clause><clause id="H997D3F6F9F344959839F34C3B71EBC6C"><enum>(ii)</enum><text>any other person similarly situated to a spouse who is protected by the domestic or family violence laws of the State or Tribal jurisdiction in which the injury occurred or where the victim resides.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HD87804DD779B4709B5DAB86379A0706F"><enum>(2)</enum><text>in paragraph (33)(A)—</text><subparagraph id="H37561C643BB84BCD8301BC7EB09A616E"><enum>(A)</enum><text>in clause (i), by inserting after <quote>Federal, State,</quote> the following: <quote>municipal,</quote>; and</text></subparagraph><subparagraph id="HA997953A008141848C3EE586EE2DC3BA"><enum>(B)</enum><text>in clause (ii), by inserting <quote>intimate partner,</quote> after <quote>spouse,</quote> each place it appears;</text></subparagraph></paragraph><paragraph id="H6790FDD259874D6885E965D14562A0DB"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (34) and (35) as paragraphs (35) and (36) respectively; and</text></paragraph><paragraph id="H33474B9E0CA745F0A0B5D33A15E3CB33"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after paragraph (33) the following:</text><quoted-block display-inline="no-display-inline" id="H1E5B06E6B1F24E0E85F4DA6DD342C60F" style="OLC"><paragraph id="HF819644B33C1461CA3A3D62E26A25019" indent="up1"><enum>(34)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF17C6251A9974904B2282DA4B4BA6D5E"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>misdemeanor crime of stalking</term> means an offense that—</text><clause id="HD5AFBE8C8DA64326BBC844998955ADAF" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">is a misdemeanor crime of stalking under Federal, State, Tribal, or municipal law; and</text></clause><clause id="H2F1BF9852BDB4332A6EEFD8740E1CE84" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is a course of harassment, intimidation, or surveillance of another person that—</text><subclause id="HD1F2142DEEE043B0AD438CD111ECBE68"><enum>(I)</enum><text display-inline="yes-display-inline">places that person in reasonable fear of material harm to the health or safety of—</text><item id="H302F61BD9E5C4FF3B0989D47A7D8A618"><enum>(aa)</enum><text>that person;</text></item><item id="HC530E3B5BCC14EBDB9055102851D9098"><enum>(bb)</enum><text>an immediate family member (as defined in section 115) of that person;</text></item><item id="H75656E8FE6F44DAFA834B3276111FB39"><enum>(cc)</enum><text>a household member of that person; or</text></item><item id="HB49A089D4632414F8A9412846411D6A0"><enum>(dd)</enum><text>a spouse or intimate partner of that person; or</text></item></subclause><subclause id="HA8D1888EB8D243DC946DC3485C131419"><enum>(II)</enum><text display-inline="yes-display-inline">causes, attempts to cause, or would reasonably be expected to cause emotional distress to a person described in item (aa), (bb), (cc), or (dd) of subclause (I).</text></subclause></clause></subparagraph><subparagraph id="HCA0575F5415A4000A5D1255F6CAA6C5E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of such an offense for purposes of this chapter, unless—</text><clause id="HDA7668764F604F16B15A5EA379CEE026"><enum>(i)</enum><text display-inline="yes-display-inline">the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and</text></clause><clause id="HBF05C19C734C4E6BB077AB02582EE7B1"><enum>(ii)</enum><text>in the case of a prosecution for an offense described in this paragraph for which a person was entitled to a jury trial in the jurisdiction in which the case was tried, either—</text><subclause id="HD19445767EC54999A154CB6D0FE4DE15"><enum>(I)</enum><text>the case was tried by a jury; or</text></subclause><subclause id="HCEBBB9CCD29A4A21AFACBD85C5A9530A"><enum>(II)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise.</text></subclause></clause></subparagraph><subparagraph id="H0F0567ED26634E0FBFF53D9A2AAB3998" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="HB8F9CB0C7C06477E82222B003CE57F16"><enum>3.</enum><header>Prohibiting stalkers and individuals subject to court order from possessing a firearm</header><text display-inline="no-display-inline">Section 922 of title 18, United States Code, is amended—</text><paragraph commented="no" id="H8698CBA79CFD4E6584B22B88C7B88704"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="H4EDF05A07A2D47C8B74D3C292F88E156"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking <quote>that restrains such person</quote> and all that follows, and inserting <quote>described in subsection (g)(8);</quote>;</text></subparagraph><subparagraph commented="no" id="H97A54CA6021C4A3C8FCAA040CA497D2B"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" id="H63F5C79E8E8F4B73A0B9E7F90F78657D"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block display-inline="no-display-inline" id="H85CB9B11FA54411DBBC1D9F018739517" style="USC"><paragraph commented="no" id="HA2C06D91C6A14FA4BA69419B373A2F76"><enum>(10)</enum><text display-inline="yes-display-inline">who has been convicted in any court of a misdemeanor crime of stalking.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H36398F869F7D477291E71C31D93272C1"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph commented="no" id="HDF33571959C244BFB0633C9935C65C70"><enum>(A)</enum><text>by amending paragraph (8) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H65195B280F7242E2A738CEA9D0E33067" style="USC"><paragraph commented="no" id="H7B2D86A5668B4FFEB20556C418B37747"><enum>(8)</enum><text display-inline="yes-display-inline">who is subject to a court order—</text><subparagraph commented="no" id="H319AB8AF2FC64A6694497D84F937E1A0"><enum>(A)</enum><text>that was issued—</text><clause commented="no" id="HCC5FBAAFBFDA484FBED3C15F3B1AD623"><enum>(i)</enum><text>after a hearing of which such person received actual notice, and at which such person had an opportunity to participate; or</text></clause><clause commented="no" id="H2993460D48E44E499B43AC2F1B7F6BE0"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an ex parte order, relative to which notice and opportunity to be heard are provided—</text><subclause commented="no" id="H95C7389FE0A245FFAB317CF5C6883385"><enum>(I)</enum><text>within the time required by State, Tribal, or territorial law; and</text></subclause><subclause commented="no" id="HF9C10D0F9A3C43A48247E8CBFA443BC2"><enum>(II)</enum><text display-inline="yes-display-inline">in any event within a reasonable time after the order is issued, sufficient to protect the due process rights of the person;</text></subclause></clause></subparagraph><subparagraph commented="no" id="HF56331C44AE7445E9E50653F72FA1F6C"><enum>(B)</enum><text display-inline="yes-display-inline">that restrains such person from—</text><clause commented="no" id="H03EABDBF055F4876B1C4A4908B2790CA"><enum>(i)</enum><text display-inline="yes-display-inline">harassing, stalking, or threatening an intimate partner of such person or child of such intimate partner or person, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child; or</text></clause><clause commented="no" id="H49EC2333A69E433885B1843D99DDE5B6"><enum>(ii)</enum><text>intimidating or dissuading a witness from testifying in court; and</text></clause></subparagraph><subparagraph commented="no" id="H05C9F33369A94EF28F85BF6F9FDD49B4"><enum>(C)</enum><text>that—</text><clause commented="no" id="H449EFE52CE664B1EBE59C48A2CE65840"><enum>(i)</enum><text>includes a finding that such person represents a credible threat to the physical safety of such individual described in subparagraph (B); or</text></clause><clause commented="no" id="H8D8B702044A242A5B1D39AC5C8651259"><enum>(ii)</enum><text>by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such individual described in subparagraph (B) that would reasonably be expected to cause bodily injury;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="H69EB60540486435B9AADFD96BF866CB6"><enum>(B)</enum><text>in paragraph (9), by striking the comma at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" id="H469500C5D0EB4DB89854701D94D6A865"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block display-inline="no-display-inline" id="H2A7786C4F4394B4BABE0E2965A6010CF" style="USC"><paragraph commented="no" id="H4127968E58AC4CB494CA9ECF42691E52"><enum>(10)</enum><text display-inline="yes-display-inline">who has been convicted in any court of a misdemeanor crime of stalking,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
