committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To enhance the preparedness of the Transportation Security Administration for public health threats to the transportation security system of the United States, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H12E871E51E3C444791CEDEFB8EB510E6" style="OLC"><section id="H7A225FAE2D254157AFF4A2BF7D57A45B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Security Public Health Threat Preparedness Act of 2021</short-title></quote>.</text></section><section id="H7276174A9F014163B0ECBC9888111ADD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text><paragraph id="H032F06B1D38E4A12B667240EB58C7CD2"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Transportation Security Administration.</text></paragraph><paragraph id="H756347BF1D5E4071BD44BB1C48220DC5"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="HFEFE715CFD0C4AA484A488B276E1C6C3"><enum>(A)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></subparagraph><subparagraph id="HF0539BB3E5DA40E79E3E19438DE260F3"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph><paragraph id="H24953A5E96094CF4BD80C9013DEF471F"><enum>(3)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Homeland Security.</text></paragraph><paragraph id="H582E862EBAEE4EF4A97B6552759C56AA"><enum>(4)</enum><header>Sterile area</header><text display-inline="yes-display-inline">The term <quote>sterile area</quote> has the meaning given such term in section 1540.5 of title 49, Code of Federal Regulations.</text></paragraph><paragraph id="HD91FB3E5B9FE439895CAA112B58750EA"><enum>(5)</enum><header>TSA</header><text>The term <quote>TSA</quote> means the Transportation Security Administration.</text></paragraph></section><section id="H0CDFCD98F8F34633AFCEFB048ED6E551"><enum>3.</enum><header>Authorization of TSA personnel details</header><subsection id="H4FD586C4607E4BD59FA6FB87521D1891"><enum>(a)</enum><header>Coordination</header><text>Pursuant to sections 106(m) and 114(m) of title 49, United States Code, the Administrator may provide TSA personnel, who are not engaged in front line transportation security efforts, to other components of the Department and other Federal agencies to improve coordination with such components and agencies to prepare for, protect against, and respond to public health threats to the transportation security system of the United States.</text></subsection><subsection id="HD6A11B75A2E944CFB9B5121779631952"><enum>(b)</enum><header>Briefing</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator shall brief the appropriate congressional committees regarding efforts to improve coordination with other components of the Department and other Federal agencies to prepare for, protect against, and respond to public health threats to the transportation security system of the United States.</text></subsection></section><section id="H026BFA9970C049EB8235CC141759AEE7"><enum>4.</enum><header>TSA preparedness</header><subsection id="H637AD9C97A024AB29A575A897FC433F0"><enum>(a)</enum><header>Analysis</header><paragraph id="H739E0CE13825451EBD9072A301E19E78"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall conduct an analysis of preparedness of the transportation security system of the United States for public health threats. Such analysis shall assess, at a minimum, the following:</text><subparagraph id="HD81FCA0519F5441B96344C9D9E7AFFEF"><enum>(A)</enum><text>The risks of public health threats to the transportation security system of the United States, including to transportation hubs, transportation security stakeholders, TSA personnel, and passengers.</text></subparagraph><subparagraph id="H63194D94009E4990B0EA58F6DB53A8A0"><enum>(B)</enum><text>Information sharing challenges among relevant components of the Department, other Federal agencies, international entities, and transportation security stakeholders.</text></subparagraph><subparagraph id="H9ED2DFDADEA9484F9C9A79C1AB8CC4B3"><enum>(C)</enum><text>Impacts to TSA policies and procedures for securing the transportation security system.</text></subparagraph></paragraph><paragraph id="HF4D7B395B76C40348B15343A0BF46215"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">The analysis conducted of the risks described in paragraph (1)(A) shall be conducted in coordination with the Chief Medical Officer of the Department of Homeland Security, the Secretary of Health and Human Services, and transportation security stakeholders.</text></paragraph></subsection><subsection id="H5536262B22044C1DA5A20CE5F4457640"><enum>(b)</enum><header>Briefing</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator shall brief the appropriate congressional committees on the following:</text><paragraph id="H1BCE4162F704400BAA5508261553983D"><enum>(1)</enum><text>The analysis required under subsection (a).</text></paragraph><paragraph id="HB01CB4EF11BE43C4AF00695319EAF8A2"><enum>(2)</enum><text>Technologies necessary to combat public health threats at security screening checkpoints to better protect from future public health threats TSA personnel, passengers, aviation workers, and other personnel authorized to access the sterile area of an airport through such checkpoints, and the estimated cost of technology investments needed to fully implement across the aviation system solutions to such threats.</text></paragraph><paragraph id="H7089FEBBCF15493EACFC786107C42084"><enum>(3)</enum><text>Policies and procedures implemented by TSA and transportation security stakeholders to protect from public health threats TSA personnel, passengers, aviation workers, and other personnel authorized to access the sterile area through the security screening checkpoints, as well as future plans for additional measures relating to such protection.</text></paragraph><paragraph id="H3E26519F2D11459086FEACD3A5862ECA"><enum>(4)</enum><text>The role of TSA in establishing priorities, developing solutions, and coordinating and sharing information with relevant domestic and international entities during a public health threat to the transportation security system, and how TSA can improve its leadership role in such areas.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>April 30, 2021</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
