<congress display="no">117th CONGRESS</congress><session display="no">1st Session</session><legis-num display="no">H.R. 1868</legis-num><current-chamber display="yes">In the Senate of the United States,</current-chamber><action><action-date date="20210325">March 25, 2021.</action-date></action><legis-type display="yes">Amendment:</legis-type></engrossed-amendment-form><engrossed-amendment-body><section id="idb2561f2ec7b24cb4a233674fe2c33ee7" section-type="resolved"><text>That the bill from the House of Representatives (H.R. 1868) entitled <quote>An Act to prevent across-the-board direct spending cuts, and for other purposes.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text> Strike all after the enacting clause and insert the following: </text></amendment-instruction><amendment-block style="OLC" blank-lines-after="1" changed="added" reported-display-style="italic"><section id="H2B0155984881421B9B5CED3864A8E993" section-type="section-one"><enum>1.</enum><header>Extension of temporary suspension of medicare sequestration</header><subsection id="H77350C9DB126498EA1F1436278288BF7"><enum>(a)</enum><header>Extension</header><paragraph id="id70ED681059694C9F80F0490F734162C6"><enum>(1)</enum><header>In general</header><text>Section 3709(a) of division A of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a</external-xref> note) is amended by striking <quote>March 31, 2021</quote> and inserting <quote>December 31, 2021</quote>.</text></paragraph><paragraph id="HE3282C951672435FA0820F1C1FAA56BE"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect as if enacted as part of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></paragraph></subsection><subsection id="idA6D6BB9A9DD24C5EABCDAEEAB6773944"><enum>(b)</enum><header>Offset</header><text>Section 251A(6)(C) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a(6)(C)</external-xref>) is amended—</text><paragraph id="id6F16BA91C3D74FB5B5FC13E41CF3A5F8"><enum>(1)</enum><text>in clause (i)— </text><subparagraph id="id6E7FCA0A12624CF8858B3EC30D1F4A22"><enum>(A)</enum><text>by striking <quote>first 6 months</quote> and inserting <quote>first 5 <fraction>1/2</fraction> months</quote>; </text></subparagraph><subparagraph id="idCCF3466B8330498FB7825F86B1F28B4A"><enum>(B)</enum><text>by striking <quote>4.0 percent</quote> and inserting <quote>2.0 percent</quote>; and</text></subparagraph><subparagraph id="idB51BF66CE827423494D44877E27145B6"><enum>(C)</enum><text>by striking <quote>and</quote> at the end; </text></subparagraph></paragraph><paragraph id="idE6D28A94558C43F9A53D063E553BF895"><enum>(2)</enum><text>in clause (ii)—</text><subparagraph id="idB05B40A6C4774B148539DD2C6087D67D"><enum>(A)</enum><text>by striking <quote>second 6 months</quote> and inserting <quote>6-month period beginning on the day after the last day of the period described in clause (i)</quote>; and</text></subparagraph><subparagraph id="id30B59610D5C14BC0B0A45F777F1ED628"><enum>(B)</enum><text>by striking <quote>0.0 percent.</quote> and inserting <quote>4.0 percent; and</quote>; and</text></subparagraph></paragraph><paragraph id="idC36F68F3CB384BBEAAAAB1C4F6E76B71"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD6842417341C401EA77001713680FCA6"><clause commented="no" display-inline="no-display-inline" id="HF08B5BEE3EC242FDB947CD5FB8F40F31" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to the remaining <fraction>1/2</fraction> month in which such order is so effective for such fiscal year, the payment reduction shall be 0.0 percent.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idBA0BDB84B7B041F8ACCF43BC73558729"><enum>2.</enum><header>Technical corrections</header><subsection id="HABC8CB562CB943B68A9C7FB08DD8B988"><enum>(a)</enum><header>Rural health clinic payments</header><paragraph id="H7D948D39D1A74684958733B22CE0DF54"><enum>(1)</enum><header>In general</header><text>Section 1833(f)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(f)(3)</external-xref>) is amended—</text><subparagraph id="HE9CA940DD7E845FD9D5E097C89ED50B7"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HBFECBDA3AECB4138AFEE2BBF12E61E51"><enum>(i)</enum><text>in clause (i), by striking subclauses (I) and (II) and inserting the following:</text><quoted-block id="H65855790D75B43C8AE9A48F694E52D36" style="OLC"><subclause id="H42F105CC7A4F488D9CB377B39185E1AC" indent="up1"><enum>(I)</enum><text>with respect to a rural health clinic that had a per visit payment amount established for services furnished in 2020—</text><item id="HC13854B7172A42748CD4E33E816354AC"><enum>(aa)</enum><text>the per visit payment amount applicable to such rural health clinic for rural health clinic services furnished in 2020, increased by the percentage increase in the MEI applicable to primary care services furnished as of the first day of 2021; or</text></item><item id="H93205566D65E4E38922C0BED0C03CA7D"><enum>(bb)</enum><text>the limit described in paragraph (2)(A); and</text></item></subclause><subclause id="H3E6A03E3329C47B48C3E3E1FDAE64949" indent="up1"><enum>(II)</enum><text>with respect to a rural health clinic that did not have a per visit payment amount established for services furnished in 2020—</text><item id="H29AEF62D4C56420DA6C29B4C5705F82C"><enum>(aa)</enum><text>the per visit payment amount applicable to such rural health clinic for rural health clinic services furnished in 2021; or</text></item><item id="H60C7DFA831344D41BC0345567A331CE4"><enum>(bb)</enum><text>the limit described in paragraph (2)(A); and</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H3759AE01DB2147F0AD71AC77E2A7DAB3"><enum>(ii)</enum><text>in clause (ii)(I), by striking <quote>under clause (i)(I)</quote> and inserting <quote>under subclause (I) or (II) of clause (i), as applicable,</quote>; and</text></clause></subparagraph><subparagraph id="H6DFB33E70B074F49AEFD0FA55CB90BA6"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCA6D74DD85454434817A0E1F771432CB"><subparagraph id="id27964E830DC748B3B527D55AC5237F28" indent="up2"><enum>(B)</enum><text>A rural health clinic described in this subparagraph is a rural health clinic that—</text><clause id="idF1E92D9C0B144C41A9A5B10A8B0667D8"><enum>(i)</enum><text>as of December 31, 2020, was in a hospital with less than 50 beds and after such date such hospital continues to have less than 50 beds (not taking into account any increase in the number of beds pursuant to a waiver under subsection (b)(1)(A) of section 1135 during the emergency period described in subsection (g)(1)(B) of such section); and</text></clause><clause id="id8663B11D50174EE4AF5ECCD7E8C79BE6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id72B533B6F43A4153A175FCD22D12C0A9"><enum>(I)</enum><text>as of December 31, 2020, was enrolled under section 1866(j) (including temporary enrollment during such emergency period for such emergency period); or</text></subclause><subclause indent="up1" id="idE4CAA2E81FB64915A55561D6277A4B25"><enum>(II)</enum><text>submitted an application for enrollment under section 1866(j) (or a request for such a temporary enrollment for such emergency period) that was received not later than December 31, 2020.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA25390023E2E4E8390EEEAEEE8621CA2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect as if included in the enactment of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>).</text></paragraph></subsection><subsection id="HCB84F221108C4786BE98F816DA950986"><enum>(b)</enum><header>Additional amount for certain hospitals with high disproportionate share</header><text>Effective as if included in the enactment of section 203(a) of title II of division CC of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>, subsection (g) of section 1923 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4</external-xref>), as amended by such section, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1037ADEA50324B93853A57EE4133F238"><paragraph id="HC6FF5DF6F8F5482F9D16455F58996361"><enum>(3)</enum><header>Continued application of grandfathered transition rule</header><text>Notwithstanding paragraph (2) of this subsection (as in effect on October 1, 2021), paragraph (2) of this subsection (as in effect on September 30, 2021, and as applied under section 4721(e) of the Balanced Budget Act of 1997, and amended by section 607 of the Medicare, Medicaid, and SCHIP Balanced Budget Refinement Act of 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/106/113">Public Law 106–113</external-xref>)) shall apply in determining whether a payment adjustment for a hospital in a State referenced in section 4721(e) of the Balanced Budget Act of 1997 during a State fiscal year shall be considered consistent with subsection (c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
