which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Assistant Secretary of Commerce for Communications and Information to establish a State Digital Equity Capacity Grant Program, and for other purposes.</official-title></form><legis-body id="H392C241BA53F43EDA46D6C636CF344D1" style="OLC"><section commented="no" id="H7025C48CD6AF46B98B53EE51DD2AA064" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Digital Equity Act of 2021</short-title></quote>.</text></section><section id="H9FA9E14EDF3140249C6B5DEF8F364F35"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H586EBC260B5D46B583B278FD7D8CBDE1"><enum>(1)</enum><header>Adoption of broadband</header><text>The term <term>adoption of broadband</term> means the process by which an individual obtains daily access to the internet—</text><subparagraph id="HC085CDF04FBF45B0830FB830D225B965"><enum>(A)</enum><text>at a speed, quality, and capacity—</text><clause id="HEC45AB0860E74CDDBB10B5D505BAA786"><enum>(i)</enum><text>that is necessary for the individual to accomplish common tasks; and</text></clause><clause id="HB0DD8F0BA8AC485786E24A112F73CAB0"><enum>(ii)</enum><text>such that the access qualifies as an advanced telecommunications capability;</text></clause></subparagraph><subparagraph id="H0308EF1AB4394B5B9712523B482A39D0"><enum>(B)</enum><text>with the digital skills that are necessary for the individual to participate online; and</text></subparagraph><subparagraph id="H8233FF48B15C4F0AA90843785E47CA90"><enum>(C)</enum><text>on a—</text><clause id="HB4E6B9364F0E49E6BC4367A32BE46ED2"><enum>(i)</enum><text>personal device; and</text></clause><clause id="HD281A58D0FDC4910BA34A2F028073550"><enum>(ii)</enum><text>secure and convenient network.</text></clause></subparagraph></paragraph><paragraph id="HAC22FE5F3B4844768C532477DCFD71FE"><enum>(2)</enum><header>Advanced telecommunications capability</header><text>The term <term>advanced telecommunications capability</term> has the meaning given the term in section 706(d) of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302(d)</external-xref>).</text></paragraph><paragraph id="HD2C146AA2C134AAFBE03A4D424F5EF80"><enum>(3)</enum><header>Aging individual</header><text>The term <term>aging individual</term> has the meaning given the term <term>older individual</term> in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>).</text></paragraph><paragraph id="HED0AE42BB94F4BD19D0BF08EA7D35C2C"><enum>(4)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" id="H689AC156CA364786878796859BE47F01"><enum>(A)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph commented="no" id="H0F9D9FB1E94845DF8BBE8FCFBFE3AA46"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph commented="no" id="HDAD89C78ED0D42E3B303A40387C8F5AD"><enum>(C)</enum><text>the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB1E3921F8DE4C53AD0A807379AEA6F8"><enum>(D)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HBE18E40B807340E89608B7AF956A08AF"><enum>(5)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="HA04DD6E889D34221B65B8DFC74D3C53F"><enum>(6)</enum><header>Community anchor institution</header><text>The term <term>community anchor institution</term> means a public school, a library, a medical or healthcare provider, a community college or other institution of higher education, a State library agency, and any other nonprofit or governmental community support organization.</text></paragraph><paragraph id="HF6F5A5D1C2534BA99057A57CCB07A10E"><enum>(7)</enum><header>Covered household</header><text>The term <term>covered household</term> means a household, the taxable income of which for the most recently completed taxable year is not more than 150 percent of an amount equal to the poverty level, as determined by using criteria of poverty established by the Bureau of the Census.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E713BE0DAAF482CBE83277AA2A611F5"><enum>(8)</enum><header>Covered populations</header><text>The term <term>covered populations</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5A9C5E1D68AF4C2EAEC4FBE612BAAEE0"><enum>(A)</enum><text>individuals who live in covered households;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36B7B0B3181C49FE8F4C3E69B1AB7C1B"><enum>(B)</enum><text>aging individuals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF6DCA04E43C34279976335B28E53FA85"><enum>(C)</enum><text>incarcerated individuals, other than individuals who are incarcerated in a Federal correctional facility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H28664C432B3F49F298E3F863E8E4E79F"><enum>(D)</enum><text>veterans;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H478A24072D0C473AAEEC58B3E66A0B54"><enum>(E)</enum><text>individuals with disabilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB83142F3829B4A4EA2727FA9EA317D7E"><enum>(F)</enum><text>individuals with a language barrier, including individuals who—</text><clause commented="no" display-inline="no-display-inline" id="HBA58E1D062FD41A3B161A510CC022EDC"><enum>(i)</enum><text>are English learners; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB0E66641EA00435193AFAF2C6D478481"><enum>(ii)</enum><text>have low levels of literacy;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6E0808A0CEF94DAB897214A067B7963C"><enum>(G)</enum><text>individuals who are members of a racial or ethnic minority group; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEEB5490F5B454442B9F441B0AF3E9D46"><enum>(H)</enum><text>individuals who primarily reside in a rural area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD79BDBE05B544CCF86D810954860D248"><enum>(9)</enum><header>Covered programs</header><text>The term <term>covered programs</term> means the State Digital Equity Capacity Grant Program established under section 4 and the Digital Equity Competitive Grant Program established under section 5.</text></paragraph><paragraph id="HBE58C1CE2C54400C8C08EBFA8656A41E"><enum>(10)</enum><header>Digital equity</header><text>The term <term>digital equity</term> means the condition in which individuals and communities have the information technology capacity that is needed for full participation in the society and economy of the United States.</text></paragraph><paragraph id="HD12582FBA7F94E16B3E6BD3A29E8BFFE"><enum>(11)</enum><header>Digital inclusion</header><text>The term <term>digital inclusion</term>—</text><subparagraph id="HE11D89F24C014036ACC128403CD61552"><enum>(A)</enum><text>means the activities that are necessary to ensure that all individuals in the United States have access to, and the use of, affordable information and communication technologies, such as—</text><clause id="H5125352F827A42E78C87C7D7B6553579"><enum>(i)</enum><text>reliable broadband internet service;</text></clause><clause id="H6DE336BA03254EEFB7798819794FBEC5"><enum>(ii)</enum><text>internet-enabled devices that meet the needs of the user; and</text></clause><clause id="HDFEC28026B714BD5B173F37E413568E4"><enum>(iii)</enum><text>applications and online content designed to enable and encourage self-sufficiency, participation, and collaboration; and</text></clause></subparagraph><subparagraph id="H308ECF9F4A254DE1B79A8850B9EC585B"><enum>(B)</enum><text>includes—</text><clause id="H52DE62ECDE714A7F8FF395CE08C2A93B"><enum>(i)</enum><text>obtaining access to digital literacy training;</text></clause><clause id="HAF75A268804B44F0AE629DBCB4E5D46F"><enum>(ii)</enum><text>the provision of quality technical support; and</text></clause><clause id="HCEBA3742BD344DD6B8262A506B00F954"><enum>(iii)</enum><text>obtaining basic awareness of measures to ensure online privacy and cybersecurity.</text></clause></subparagraph></paragraph><paragraph id="H10FBDAF76C104099AD18EB58948D90B5"><enum>(12)</enum><header>Digital literacy</header><text>The term <term>digital literacy</term> means the skills associated with using technology to enable users to find, evaluate, organize, create, and communicate information.</text></paragraph><paragraph id="HFF043E6C9F124CD88613447F191CBD6C"><enum>(13)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph id="H4E195C4A2CB440D1B21457D7BD1BBD86"><enum>(14)</enum><header>Eligible State</header><text>The term <term>eligible State</term> means—</text><subparagraph id="H7C9B74C6555D41C1BC8E5444BB2C2AB4"><enum>(A)</enum><text>with respect to planning grants made available under section 4(c)(3), a State with respect to which the Assistant Secretary has approved an application submitted to the Assistant Secretary under section 4(c)(3)(C); and</text></subparagraph><subparagraph id="H017674D155C845418A8AB564E615BF9C"><enum>(B)</enum><text>with respect to capacity grants awarded under section 4(d), a State with respect to which the Assistant Secretary has approved an application submitted to the Assistant Secretary under section 4(d)(2), including approval of the State Digital Equity Plan developed by the State under section 4(c).</text></subparagraph></paragraph><paragraph id="H00BB42C0ADD64708A57E096533A27404"><enum>(15)</enum><header>Gender identity</header><text>The term <term>gender identity</term> has the meaning given the term in section 249(c) of title 18, United States Code.</text></paragraph><paragraph id="H1043DB662F254F9FBD2B90F6F93C70C3"><enum>(16)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph><paragraph id="H4F337F6AB3B842E1B50DF7CA66D4DE14"><enum>(17)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term>—</text><subparagraph id="H0031F93CE329493A8206238BB3439895"><enum>(A)</enum><text>has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>); and</text></subparagraph><subparagraph id="HA1A17E3785B24DFCA22E752230AE4AE9"><enum>(B)</enum><text>includes a postsecondary vocational institution.</text></subparagraph></paragraph><paragraph id="H5EBE4DD3DC9C479C860B644721759206"><enum>(18)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101(30) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(30)</external-xref>).</text></paragraph><paragraph id="H2492DCE2C20740DABA458475BA7ECB53"><enum>(19)</enum><header>Postsecondary vocational institution</header><text>The term <term>postsecondary vocational institution</term> has the meaning given the term in section 102(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>).</text></paragraph><paragraph id="H165B5E4454B14BF68C91F1F50D53CB25"><enum>(20)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in section 601(b)(3) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(b)(3)</external-xref>).</text></paragraph><paragraph id="H02F7D63AE7054D67BF853CE14718AB45"><enum>(21)</enum><header>Socially and economically disadvantaged small business concern</header><text>The term <term>socially and economically disadvantaged small business concern</term> has the meaning given the term in section 8(a)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(4)</external-xref>).</text></paragraph><paragraph id="H984D863FE2304825B95F88565A727886"><enum>(22)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="H0FCE409D66F14A6EA82C9CD8A1B5078F"><enum>(A)</enum><text>any State of the United States;</text></subparagraph><subparagraph id="H933D37804C6A4254813ECD153EE717DE"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="H4F62990F2DC34D3AB9122D4416AB778F"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph id="H7C1544D0172D4C4DBAC396768B801C54"><enum>(23)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text></paragraph><paragraph id="HC65CC835F13B426985F15FD8FBC9434A"><enum>(24)</enum><header>Workforce development program</header><text>The term <term>workforce development program</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph></section><section id="HF9ABF1823D2B494E8FDDF5DF178EE081"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H2DC684EAD92544C2A4E02A816F3A8A18"><enum>(1)</enum><text>a broadband connection and digital literacy are increasingly critical to how individuals—</text><subparagraph id="H7DA927A9C4DE44E991129C03C5C2913B"><enum>(A)</enum><text>participate in the society, economy, and civic institutions of the United States; and</text></subparagraph><subparagraph id="HABE851B844C34B2693C69FACBE6B86CD"><enum>(B)</enum><text>access health care and essential services, obtain education, and build careers;</text></subparagraph></paragraph><paragraph commented="no" id="H5EEAE940919C44E19036A26056193C3D"><enum>(2)</enum><text>digital exclusion—</text><subparagraph commented="no" id="H0EA5D4CCFACC436AAD86A4C424BBF37D"><enum>(A)</enum><text>carries a high societal and economic cost;</text></subparagraph><subparagraph commented="no" id="H956365D9E28B4468B806685023339C18"><enum>(B)</enum><text>materially harms the opportunity of an individual with respect to the economic success, educational achievement, positive health outcomes, social inclusion, and civic engagement of that individual; and</text></subparagraph><subparagraph commented="no" id="H9925DAF56696416AA16D7E59284DADDC"><enum>(C)</enum><text>exacerbates existing wealth and income gaps, especially those experienced by covered populations;</text></subparagraph></paragraph><paragraph id="HB748B9BB88E54B6EA4B7FFE20997CDB5"><enum>(3)</enum><text>achieving digital equity for all people of the United States requires additional and sustained investment and research efforts;</text></paragraph><paragraph id="HDC4ED16B63FD4FC9B67D63E9818B5749"><enum>(4)</enum><text>the Federal Government, as well as State, tribal, territorial, and local governments, have made social, legal, and economic obligations that necessarily extend to how the citizens and residents of those governments access and use the internet; and</text></paragraph><paragraph id="HB7C07C280FB94C449CFF0788997126FB"><enum>(5)</enum><text>achieving digital equity is a matter of social and economic justice and is worth pursuing.</text></paragraph></section><section id="H6306FFB8FF904E54AB846A8CA2D04D33"><enum>4.</enum><header>State Digital Equity Capacity Grant Program</header><subsection id="HD57B135EBBC54B44B5C93038AB82FAC1"><enum>(a)</enum><header>Establishment; purpose</header><paragraph id="H2FDBD8FDB4FA4949A47E91B029542943"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary shall establish in the Department of Commerce the State Digital Equity Capacity Grant Program (referred to in this section as the <quote>Program</quote>)—</text><subparagraph id="HE71EBCC0B6284615A1EE1530B09EE4B7"><enum>(A)</enum><text>the purpose of which is to promote the achievement of digital equity, support digital inclusion activities, and build capacity for efforts by States relating to the adoption of broadband by residents of those States;</text></subparagraph><subparagraph id="H610D6D5C0F3E40CC985FB5956CB5E8F8"><enum>(B)</enum><text>through which the Assistant Secretary shall make grants to States in accordance with the requirements of this section; and</text></subparagraph><subparagraph id="HB0F71A22F40C4BB99F9E64DC2FDAF5DB"><enum>(C)</enum><text>which shall ensure that States have the capacity to promote the achievement of digital equity and support digital inclusion activities.</text></subparagraph></paragraph><paragraph id="HB8C7BB8189BA4BE0BDF0B675285D2170"><enum>(2)</enum><header>Consultation with other Federal agencies; no conflict</header><text>In establishing the Program under paragraph (1), the Assistant Secretary shall—</text><subparagraph id="H70E344C98F90478BBAF512676552A243"><enum>(A)</enum><text>consult with—</text><clause id="H590B131AA9514BC19E10687F8D9C5CAC"><enum>(i)</enum><text>the Secretary of Agriculture;</text></clause><clause id="H0FA3FC58D89145F089690E89DADD006A"><enum>(ii)</enum><text>the Secretary of Housing and Urban Development;</text></clause><clause id="H973B441C0DFB4556A69A222A805672F0"><enum>(iii)</enum><text>the Secretary of Education;</text></clause><clause id="HDDE4E0EE4A89401A8FCB53B0ECD595EF"><enum>(iv)</enum><text>the Secretary of Labor;</text></clause><clause id="H734148E3A74641EA9DF6D387AD48A731"><enum>(v)</enum><text>the Secretary of Health and Human Services;</text></clause><clause id="H1FAB94894ADE474B8345514C15FEFA55"><enum>(vi)</enum><text>the Secretary of Veterans Affairs;</text></clause><clause id="HF249E15C42674A11AC9DF981D4BB5E12"><enum>(vii)</enum><text>the Secretary of the Interior;</text></clause><clause id="HC6A8E14C05FE410C8EF66D97416DF755"><enum>(viii)</enum><text>the Federal Communications Commission;</text></clause><clause id="H65D5063EB302430F95467A119E2D3FCF"><enum>(ix)</enum><text>the Federal Trade Commission;</text></clause><clause id="H0BBEA69F488C4EAC92DAAF686BD2A99F"><enum>(x)</enum><text>the Director of the Institute of Museum and Library Services;</text></clause><clause id="H714D8223374C4056A0F5E40B16A295E0"><enum>(xi)</enum><text>the Administrator of the Small Business Administration;</text></clause><clause id="HC056A33E77654081BDE9B9A53CF27C32"><enum>(xii)</enum><text>the Federal Cochairman of the Appalachian Regional Commission; and</text></clause><clause id="HF7FBC401C94E4E24B8700F343F9A4038"><enum>(xiii)</enum><text>the head of any other agency that the Assistant Secretary determines to be appropriate; and</text></clause></subparagraph><subparagraph id="HA1C05A4E4AD64441BAE28C22753E5888"><enum>(B)</enum><text>ensure that the Program complements and enhances, and does not conflict with, other Federal broadband initiatives and programs.</text></subparagraph></paragraph></subsection><subsection id="H93251A5FFC3C412B8E19CF04DFA69D0B"><enum>(b)</enum><header>Administering entity</header><paragraph id="H6FF578BC400D4F95AB19E8456EE1BE71"><enum>(1)</enum><header>Selection; function</header><text>The governor (or equivalent official) of a State that wishes to be awarded a grant under this section shall, from among entities that are eligible under paragraph (2), select an administering entity for that State, which shall—</text><subparagraph id="H707562C3C41D4A8EB5E8DBD1854E0174"><enum>(A)</enum><text>serve as the recipient of, and administering agent for, any grant awarded to the State under this section;</text></subparagraph><subparagraph id="HA7C9EE9638EF4E3997F8F2FA1F7DBCD4"><enum>(B)</enum><text>develop, implement, and oversee the State Digital Equity Plan for the State described in subsection (c);</text></subparagraph><subparagraph id="H3EF3B85445C74CD09480E3F0616D3C79"><enum>(C)</enum><text>make subgrants to any entity described in subsection (c)(1)(D) that is located in the State in support of—</text><clause id="H2FE3CDCE1F1A45A788D5295E23612ADB"><enum>(i)</enum><text>the State Digital Equity Plan for the State; and</text></clause><clause id="HC6A05BC682574A4F9B75371F15B6F43C"><enum>(ii)</enum><text>digital inclusion activities in the State generally; and</text></clause></subparagraph><subparagraph id="H4D561F22EEEB436BB4C1286CEA3C6003"><enum>(D)</enum><text>serve as—</text><clause id="HDB8CA71C65BC48D89867BCFE03D4FF58"><enum>(i)</enum><text>an advocate for digital equity policy and digital inclusion activities; and</text></clause><clause id="H0703C70FFF5044A5BB5AD6211075CF97"><enum>(ii)</enum><text>a repository of best practice materials regarding the policies and activities described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="H2BC7F806D7F543ED9FF34D169B5796FA"><enum>(2)</enum><header>Eligible entities</header><text>Any of the following entities may serve as the administering entity for a State for the purposes of this section if the entity has demonstrated a capacity to administer the Program on a statewide level:</text><subparagraph id="H011F35B6601E40BFAC0520E2D49E0DC8"><enum>(A)</enum><text>The State, a political subdivision, agency, or instrumentality of the State, an Indian tribe located in the State, an Alaska Native entity located in the State, or a Native Hawaiian organization located in the State.</text></subparagraph><subparagraph id="HB0A8C143A4AC4F01BE89BDB7C2968C72"><enum>(B)</enum><text>A foundation, corporation, institution, association, or coalition that is—</text><clause id="H71A8FB938A364D359D476B93FF8373A3"><enum>(i)</enum><text>a not-for-profit entity;</text></clause><clause id="H47833DE0B3284C549A55496A3BA0DC5E"><enum>(ii)</enum><text>located in the State; and</text></clause><clause id="HB02B545444E14A8BB97C8EE5C78C4EF2"><enum>(iii)</enum><text>not a school.</text></clause></subparagraph><subparagraph id="H693C7C6819E34DC8AA0F42C696EBA77F"><enum>(C)</enum><text>A community anchor institution, other than a school, that is located in the State.</text></subparagraph><subparagraph id="H59D813FD348343F7B9D8FBECAFE08E1F"><enum>(D)</enum><text>A local educational agency that is located in the State.</text></subparagraph><subparagraph id="H06193A14B62F47FE87B456DA751176FE"><enum>(E)</enum><text>An entity located in the State that carries out a workforce development program.</text></subparagraph><subparagraph id="HA7AA781781E64BF681981CE4166C70D4"><enum>(F)</enum><text>An agency of the State that is responsible for administering or supervising adult education and literacy activities in the State.</text></subparagraph><subparagraph id="H6D3D4E7FEC9143C19763C96A035BCBC3"><enum>(G)</enum><text>A public housing authority that is located in the State.</text></subparagraph><subparagraph id="HDEE650BD1F344FB880B7D0BEC8AD4AA5"><enum>(H)</enum><text>A partnership between any of the entities described in subparagraphs (A) through (G).</text></subparagraph></paragraph></subsection><subsection id="HACCCF239886940D489EC7B7F6394E652"><enum>(c)</enum><header>State Digital Equity Plan</header><paragraph id="H5AE2402504D34C079F97352B470FCC6F"><enum>(1)</enum><header>Development; contents</header><text>A State that wishes to be awarded a grant under subsection (d) shall develop a State Digital Equity Plan for the State, which shall include—</text><subparagraph id="HD491C026863642E8BC9AC32DF03F1A4C"><enum>(A)</enum><text>the identification of the barriers to digital equity faced by covered populations in the State;</text></subparagraph><subparagraph id="H1E2EC3D3046B4BF393942519555F6CAD"><enum>(B)</enum><text>measurable objectives for documenting and promoting, among each group described in subparagraphs (A) through (H) of section 2(8) located in that State—</text><clause id="H9E07EBB40B994B49A01A1A8639593E88"><enum>(i)</enum><text>the availability of, and affordability of access to, broadband technology;</text></clause><clause id="H52725BB84D954F6187F186137FE41BDE"><enum>(ii)</enum><text>the online accessibility and inclusivity of public resources and services;</text></clause><clause id="HABE04506437D42329AFE7953CA514543"><enum>(iii)</enum><text>digital literacy;</text></clause><clause id="HF13AF9FCDD5C4CCD8A46EB7370032AA5"><enum>(iv)</enum><text>awareness of, and the use of, measures to secure the online privacy of, and cybersecurity with respect to, an individual; and</text></clause><clause id="H4490B11474C94F90ADA983C79419D4DB"><enum>(v)</enum><text>the availability and affordability of consumer devices and technical support for those devices;</text></clause></subparagraph><subparagraph id="HD0584C23B2EB42D6A48B6420DAA7B6CE"><enum>(C)</enum><text>an assessment of how the objectives described in subparagraph (B) will impact and interact with the State’s—</text><clause id="HE373A122BACE475AB2BAD7FDD4B629BC"><enum>(i)</enum><text>economic and workforce development goals, plans, and outcomes;</text></clause><clause id="H7542D67A7075437B8032DC45E371CD88"><enum>(ii)</enum><text>educational outcomes;</text></clause><clause id="HCEC93A571E6C4E47AB06BE3BA7885DB9"><enum>(iii)</enum><text>health outcomes;</text></clause><clause id="HF8C97558094D40B9AD08D2C8C1A728E1"><enum>(iv)</enum><text>civic and social engagement; and</text></clause><clause id="H19DD80A10EC446B58424B55F8F48C2E9"><enum>(v)</enum><text>delivery of other essential services;</text></clause></subparagraph><subparagraph id="HE7B80A8792BD4BB9890DDE9B09DB2097"><enum>(D)</enum><text>in order to achieve the objectives described in subparagraph (B), a description of how the State plans to collaborate with key stakeholders in the State, which may include—</text><clause id="H39AABC904DBF4ABA95B20DBB75170E80"><enum>(i)</enum><text>community anchor institutions;</text></clause><clause id="H64FB64A0B0D743B1BFC3F997AA46DE83"><enum>(ii)</enum><text>county and municipal governments;</text></clause><clause id="HDE9EAC963B984E5FB7FDF733A6172796"><enum>(iii)</enum><text>local educational agencies;</text></clause><clause id="H0EB2536B6F5D4ED2A61BD50EFD6A3C2F"><enum>(iv)</enum><text>where applicable, Indian tribes, Alaska Native entities, or Native Hawaiian organizations;</text></clause><clause id="H1616607246D6498BBC69A4E556AEA4AB"><enum>(v)</enum><text>nonprofit organizations;</text></clause><clause id="H216855CB3DD748D4AE8A17FE51E7E999"><enum>(vi)</enum><text>organizations that represent—</text><subclause id="H3129FA5B83FC45389D5D59823E1A0E3F"><enum>(I)</enum><text>individuals with disabilities, including organizations that represent children with disabilities;</text></subclause><subclause id="HE481157949F44EDB9A256C18E5B2110B"><enum>(II)</enum><text>aging individuals;</text></subclause><subclause id="H580BC6EEF0F54A298126E27D6311F929"><enum>(III)</enum><text>individuals with language barriers, including—</text><item id="H7C7E1F008C7D4722AA855505EF45E460"><enum>(aa)</enum><text>individuals who are English learners; and</text></item><item id="HF704FA56E32B457FBAD5A5261C198920"><enum>(bb)</enum><text>individuals who have low levels of literacy;</text></item></subclause><subclause id="H280EEA9C9FF44EBA9F5D3625681CF360"><enum>(IV)</enum><text>veterans; and</text></subclause><subclause id="H2755CB8A5E744BBE8B0CD14BDE1B228A"><enum>(V)</enum><text>individuals in that State who are incarcerated in facilities other than Federal correctional facilities;</text></subclause></clause><clause id="H31FE8247A93043E08DF1871943C049F8"><enum>(vii)</enum><text>civil rights organizations;</text></clause><clause id="HE6F783681C784A508BCFAD64175AA5E7"><enum>(viii)</enum><text>entities that carry out workforce development programs;</text></clause><clause id="HF61BCAD089824810B472671A64569172"><enum>(ix)</enum><text>agencies of the State that are responsible for administering or supervising adult education and literacy activities in the State;</text></clause><clause id="H2BB59398A8B54CA0B94274581652D13F"><enum>(x)</enum><text>public housing authorities in the State; and</text></clause><clause id="H28DF05103B084432A88FFFFB44AC61E0"><enum>(xi)</enum><text>a partnership between any of the entities described in clauses (i) through (x); and</text></clause></subparagraph><subparagraph id="HBB16F33A26614873BCBDB5697B4AAE52"><enum>(E)</enum><text>a list of organizations with which the administering entity for the State collaborated in developing and implementing the Plan.</text></subparagraph></paragraph><paragraph id="H3224C67C34AF4B1E979BEC6509450F89"><enum>(2)</enum><header>Public availability</header><subparagraph id="HD78B3A09B9CC4DA8B0CB2C389982D04E"><enum>(A)</enum><header>In general</header><text>The administering entity for a State shall make the State Digital Equity Plan of the State available for public comment for a period of not less than 30 days before the date on which the State submits an application to the Assistant Secretary under subsection (d)(2).</text></subparagraph><subparagraph id="HD8A79D7B1E3E4E1A9FA61146170518D4"><enum>(B)</enum><header>Consideration of comments received</header><text>The administering entity for a State shall, with respect to an application submitted to the Assistant Secretary under subsection (d)(2)—</text><clause id="H7740190E6BAB431E8148B996CE944ED2"><enum>(i)</enum><text>before submitting the application—</text><subclause id="H4F2CB9B1291C4C74AB638D1321899C42"><enum>(I)</enum><text>consider all comments received during the comment period described in subparagraph (A) with respect to the application (referred to in this subparagraph as the <quote>comment period</quote>); and</text></subclause><subclause id="HC4F3A26219754EDD8BF8798614108746"><enum>(II)</enum><text>make any changes to the plan that the administering entity determines to be worthwhile; and</text></subclause></clause><clause id="HCAB0D0BCE38844E1B1C0174B029FC4E8"><enum>(ii)</enum><text>when submitting the application—</text><subclause id="H75B0276DF4544A2FB773945453AB68D4"><enum>(I)</enum><text>describe any changes pursued by the administering entity in response to comments received during the comment period; and</text></subclause><subclause id="HC0BBDBA042C74E60BB4C42F3BCEFE188"><enum>(II)</enum><text>include a written response to each comment received during the comment period.</text></subclause></clause></subparagraph></paragraph><paragraph id="HC09BC2B6F03A4C73A0DCE19C7146CBFC"><enum>(3)</enum><header>Planning grants</header><subparagraph id="H41E4F31996624091814A89CF06EC5C54"><enum>(A)</enum><header>In general</header><text>Beginning in the first fiscal year that begins after the date of enactment of this Act, the Assistant Secretary shall, in accordance with the requirements of this paragraph, award planning grants to States for the purpose of developing the State Digital Equity Plans of those States under this subsection.</text></subparagraph><subparagraph id="H75ED122CAE6F43B78676C89F2A3931FF"><enum>(B)</enum><header>Eligibility</header><text>In order to be awarded a planning grant under this paragraph, a State—</text><clause id="HF7D5E66E1AA64C9EBBD5BA1CEA905081"><enum>(i)</enum><text>shall submit to the Assistant Secretary an application under subparagraph (C); and</text></clause><clause id="H527761A2B1DD41A4A93D4BF6ABAFCA6E"><enum>(ii)</enum><text>may not have been awarded, at any time, a planning grant under this paragraph.</text></clause></subparagraph><subparagraph id="H3A9253FBACF04B7DBEDB85AF3730A976"><enum>(C)</enum><header>Application</header><text>A State that wishes to be awarded a planning grant under this paragraph shall, not later than 60 days after the date on which the notice of funding availability with respect to the grant is released, submit to the Assistant Secretary an application, in a format to be determined by the Assistant Secretary, that contains the following materials:</text><clause id="H9E314639B61444C9A417C03CC0F0783B"><enum>(i)</enum><text>A description of the entity selected to serve as the administering entity for the State, as described in subsection (b).</text></clause><clause id="H40E6B78958284B0A9EBDC3AF0F89623F"><enum>(ii)</enum><text>A certification from the State that, not later than 1 year after the date on which the Assistant Secretary awards the planning grant to the State, the administering entity for that State shall develop a State Digital Equity Plan under this subsection, which—</text><subclause id="HFE13FBB353D1419DB81B634419F65857"><enum>(I)</enum><text>the administering entity shall submit to the Assistant Secretary; and</text></subclause><subclause id="H15197DE00D444AA3BF8F77F1479C64F6"><enum>(II)</enum><text>shall comply with the requirements of this subsection, including the requirement under paragraph (2)(B).</text></subclause></clause><clause id="H6F591D26E27942A5AFED46EBDA035ECD"><enum>(iii)</enum><text>The assurances required under subsection (e).</text></clause></subparagraph><subparagraph id="H93A33FA9A66345DDAAB23D492CB3B5A9"><enum>(D)</enum><header>Awards</header><clause id="HED674B984D7A45FDBE73759474CAD5C5"><enum>(i)</enum><header>Amount of grant</header><text>A planning grant awarded to an eligible State under this paragraph shall be determined according to the formula under subsection (d)(3)(A)(i).</text></clause><clause id="H51985FF9CD284E34A4AD02A1F79310D0"><enum>(ii)</enum><header>Duration</header><subclause id="HD47D437BC88E4C4CB0D8361B85D9CF7C"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), with respect to a planning grant awarded to an eligible State under this paragraph, the State shall expend the grant funds during the 1-year period beginning on the date on which the State is awarded the grant funds.</text></subclause><subclause id="HF716D14FD93841D1B2CC61B49DD5086C"><enum>(II)</enum><header>Exception</header><text>The Assistant Secretary may grant an extension of not longer than 180 days with respect to the requirement under subclause (I).</text></subclause></clause><clause id="HE2A331AA3220411CA7AAFE75DEBD090D"><enum>(iii)</enum><header>Challenge mechanism</header><text>The Assistant Secretary shall ensure that any eligible State to which a planning grant is awarded under this paragraph may appeal or otherwise challenge in a timely fashion the amount of the grant awarded to the State, as determined under clause (i).</text></clause></subparagraph><subparagraph id="HFE340480482C4692A4F22611F0F40591"><enum>(E)</enum><header>Use of funds</header><text>An eligible State to which a planning grant is awarded under this paragraph shall, through the administering entity for that State, use the grant funds only for the following purposes:</text><clause id="H364CD55152194CA799E98A64561B415E"><enum>(i)</enum><text>To develop the State Digital Equity Plan of the State under this subsection.</text></clause><clause commented="no" display-inline="no-display-inline" id="H3F11204D2ED346D0B3D1E5A0C48C90E5"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H59938FCECD24454DA9DC5EF3F3F13052"><enum>(I)</enum><text>Subject to subclause (II), to make subgrants to any of the entities described in paragraph (1)(D) to assist in the development of the State Digital Equity Plan of the State under this subsection.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HAE9C7C94EB984EF3A9BCCFB48B7C5B27" indent="up1"><enum>(II)</enum><text>If the administering entity for a State makes a subgrant described in subclause (I), the administering entity shall, with respect to the subgrant, provide to the State the assurances required under subsection (e).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H4B9673AE9DED40E988D1A27D601B3DC6"><enum>(d)</enum><header>State capacity grants</header><paragraph id="H23C8BA3CB7F4484B8DA8187BA4BB4A4D"><enum>(1)</enum><header>In general</header><text>Beginning not later than 2 years after the date on which the Assistant Secretary begins awarding planning grants under subsection (c)(3), the Assistant Secretary shall each year award grants to eligible States to support—</text><subparagraph id="H92D8F2DAA86242A781B573BB3E2DCE1F"><enum>(A)</enum><text>the implementation of the State Digital Equity Plans of those States; and</text></subparagraph><subparagraph id="HA9144B7377544DAE8DD7E42C017D090A"><enum>(B)</enum><text>digital inclusion activities in those States.</text></subparagraph></paragraph><paragraph id="H4F65EFAE1DAC4A4FA48F5DDDB914A6DE"><enum>(2)</enum><header>Application</header><text>A State that wishes to be awarded a grant under this subsection shall, not later than 60 days after the date on which the notice of funding availability with respect to the grant is released, submit to the Assistant Secretary an application, in a format to be determined by the Assistant Secretary, that contains the following materials:</text><subparagraph id="H0D783DF5000547B3A83A1F73137BAB95"><enum>(A)</enum><text>A description of the entity selected to serve as the administering entity for the State, as described in subsection (b).</text></subparagraph><subparagraph id="H3FAF71E9394541C29DDFB9F8F88F3A0B"><enum>(B)</enum><text>The State Digital Equity Plan of that State, as described in subsection (c).</text></subparagraph><subparagraph id="H3959DEF6411141BD9FC0BEC46C2926A2"><enum>(C)</enum><text>A certification that the State, acting through the administering entity for the State, shall—</text><clause id="HBE4C1328D2594EC48CDC6F980A66B821"><enum>(i)</enum><text>implement the State Digital Equity Plan of the State; and</text></clause><clause id="HE0D15F7B87A540A3B06CA1DE2DB2CE56"><enum>(ii)</enum><text>make grants in a manner that is consistent with the aims of the Plan described in clause (i).</text></clause></subparagraph><subparagraph id="H1CA7FEE756AF41F99868B88B4A2F1CB9"><enum>(D)</enum><text>The assurances required under subsection (e).</text></subparagraph><subparagraph id="HFDAB0C934B394787AC1FD3C0827F04CF"><enum>(E)</enum><text>In the case of a State to which the Assistant Secretary has previously awarded a grant under this subsection, any amendments to the State Digital Equity Plan of that State, as compared with the State Digital Equity Plan of the State previously submitted.</text></subparagraph></paragraph><paragraph id="H85F39E574A934A099B7A102A78AEB47F"><enum>(3)</enum><header>Awards</header><subparagraph id="H58981B425BC94E84AE2EC47D1F386932"><enum>(A)</enum><header>Amount of grant</header><clause id="HB37390FD1FD444A88E97F021F790FACE"><enum>(i)</enum><header>Formula</header><text>Subject to clauses (ii), (iii), and (iv), the Assistant Secretary shall calculate the amount of a grant awarded to an eligible State under this subsection in accordance with the following criteria, using the best available data for all States for the fiscal year in which the grant is awarded:</text><subclause id="HC5AB97B9AC094E9889EFC4E51739DBF2"><enum>(I)</enum><text>50 percent of the total grant amount shall be based on the population of the eligible State in proportion to the total population of all eligible States.</text></subclause><subclause id="HC8197CCA47BA43D5AA2A61DA86C10763"><enum>(II)</enum><text>25 percent of the total grant amount shall be based on the number of individuals in the eligible State who are covered populations in proportion to the total number of individuals in all eligible States who are covered populations.</text></subclause><subclause id="H8A5643D7B3B74FC690C388CCCC4719D9"><enum>(III)</enum><text>25 percent of the total grant amount shall be based on the comparative lack of availability and adoption of broadband in the eligible State in proportion to the lack of availability and adoption of broadband of all eligible States, which shall be determined according to data collected from—</text><item id="H2466D414B9744184ADEC0CFD07862786"><enum>(aa)</enum><text>the annual inquiry of the Federal Communications Commission conducted under section 706(b) of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302(b)</external-xref>);</text></item><item id="H4BB90AEF1E9F468F81B5FC84B3EB6603"><enum>(bb)</enum><text>the American Community Survey or, if necessary, other data collected by the Bureau of the Census;</text></item><item id="H2F637051668C4590A5D64901B2FA2C7A"><enum>(cc)</enum><text>the Internet and Computer Use Supplement to the Current Population Survey of the Bureau of the Census; and</text></item><item commented="no" display-inline="no-display-inline" id="H4CEDE24C7C884ADF8AB7F1CB7EFD4FD2"><enum>(dd)</enum><text>any other source that the Assistant Secretary, after appropriate notice and opportunity for public comment, determines to be appropriate.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HEC4D89C0BF104F6EA2FF8FFCF43318E9"><enum>(ii)</enum><header>Minimum award</header><text>The amount of a grant awarded to an eligible State under this subsection in a fiscal year shall be not less than 0.5 percent of the total amount made available to award grants to eligible States for that fiscal year.</text></clause><clause commented="no" display-inline="no-display-inline" id="HD96515B32B1E4AD782D77345C85DADA9"><enum>(iii)</enum><header>Additional amounts</header><text>If, after awarding planning grants to States under subsection (c)(3) and capacity grants to eligible States under this subsection in a fiscal year, there are amounts remaining to carry out this section, the Assistant Secretary shall distribute those amounts—</text><subclause commented="no" display-inline="no-display-inline" id="H980E5A7C6D694D239DA63C434586300B"><enum>(I)</enum><text>to eligible States to which the Assistant Secretary has awarded grants under this subsection for that fiscal year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF1822EAF70D74DC9A654D2632498FAFA"><enum>(II)</enum><text>in accordance with the formula described in clause (i).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HF3900E583BE045AB8BD744FD37AE3BAD"><enum>(iv)</enum><header>Data unavailable</header><text>If, in a fiscal year, the Commonwealth of Puerto Rico (referred to in this clause as <quote>Puerto Rico</quote>) is an eligible State and specific data for Puerto Rico is unavailable for a factor described in subclause (I), (II), or (III) of clause (i), the Assistant Secretary shall use the median data point with respect to that factor among all eligible States and assign it to Puerto Rico for the purposes of making any calculation under that clause for that fiscal year.</text></clause></subparagraph><subparagraph id="H3B19CA62CF1C45ADB667CD5B84724901"><enum>(B)</enum><header>Duration</header><text>With respect to a grant awarded to an eligible State under this subsection, the eligible State shall expend the grant funds during the 5-year period beginning on the date on which the eligible State is awarded the grant funds.</text></subparagraph><subparagraph id="HBCDE39FB450841A3910715AAC0AF0D18"><enum>(C)</enum><header>Challenge mechanism</header><text>The Assistant Secretary shall ensure that any eligible State to which a grant is awarded under this subsection may appeal or otherwise challenge in a timely fashion the amount of the grant awarded to the State, as determined under subparagraph (A).</text></subparagraph><subparagraph id="HD3E78386C2BD4BE696944895BC817260"><enum>(D)</enum><header>Use of funds</header><text>The administering entity for an eligible State to which a grant is awarded under this subsection shall use the grant amounts for the following purposes:</text><clause id="HF0572F332BB44808812A41C7D0541EED"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HC357137D9B3143BA98BD10C0AD981FE5"><enum>(I)</enum><text>Subject to subclause (II), to update or maintain the State Digital Equity Plan of the State.</text></subclause><subclause id="H8673049847DD48E79B83B0E7929AFED9" indent="up1"><enum>(II)</enum><text>An administering entity for an eligible State to which a grant is awarded under this subsection may use not more than 20 percent of the amount of the grant for the purpose described in subclause (I).</text></subclause></clause><clause id="H8E1179E2FDA74FF99D897EFDDD426C8E"><enum>(ii)</enum><text>To implement the State Digital Equity Plan of the State.</text></clause><clause id="HFF55D2299B9347D1896F35854883BFC6"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H093EBDDF6C974EE4AE85C8152709B912"><enum>(I)</enum><text>Subject to subclause (II), to award a grant to any entity that is described in section 5(b) and is located in the eligible State in order to—</text><item id="HE604298074A74642A79CB333A7F3B869" indent="up1"><enum>(aa)</enum><text>assist in the implementation of the State Digital Equity Plan of the State;</text></item><item id="HFB7703A3C9064C84B220C776DF7CC0F9" indent="up1"><enum>(bb)</enum><text>pursue digital inclusion activities in the State consistent with the State Digital Equity Plan of the State; and</text></item><item id="HDEFF6F06FCB2444693ACC090D53B352E" indent="up1"><enum>(cc)</enum><text>report to the State regarding the digital inclusion activities of the entity.</text></item></subclause><subclause id="H810D9AA97A0847CC8B6F183A620DC5A0" indent="up1"><enum>(II)</enum><text>Before an administering entity for an eligible State may award a grant under subclause (I), the administering entity shall require the entity to which the grant is awarded to certify that—</text><item id="H22A2D4D6C7AE4C61882D982E87BB074E"><enum>(aa)</enum><text>the entity shall carry out the activities required under items (aa), (bb), and (cc) of that subclause;</text></item><item id="HAE2690A09DAC445C98C70708333CFDBF"><enum>(bb)</enum><text>the receipt of the grant shall not result in unjust enrichment of the entity; and</text></item><item id="HBF83E711D2E74E528C24902D336E405C"><enum>(cc)</enum><text>the entity shall cooperate with any evaluation—</text><subitem id="H3A8CEAF843134AFF8F6FEF265ED54FD8"><enum>(AA)</enum><text>of any program that relates to a grant awarded to the entity; and</text></subitem><subitem id="HED5B2AD2C2CE41189B6F25A02458CB1D"><enum>(BB)</enum><text>that is carried out by or for the administering entity, the Assistant Secretary, or another Federal official.</text></subitem></item></subclause></clause><clause id="H0AAE7B27DB164931A165BC802E993F72"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="H9067188B4E134614BF63980354791C0D"><enum>(I)</enum><text>Subject to subclause (II), to evaluate the efficacy of the efforts funded by grants made under clause (iii).</text></subclause><subclause id="HDC927CB2B353421C98F801DA5C475BC2" indent="up1"><enum>(II)</enum><text>An administering entity for an eligible State to which a grant is awarded under this subsection may use not more than 5 percent of the amount of the grant for a purpose described in subclause (I).</text></subclause></clause><clause id="HBF5C10913306462F917A803ECF1E9ABF"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="H9784DCE2C94E45C8936A32B94B45D934"><enum>(I)</enum><text>Subject to subclause (II), for the administrative costs incurred in carrying out the activities described in clauses (i) through (iv).</text></subclause><subclause id="HB6F0C14F0141426D9E59C51C890B1DF5" indent="up1"><enum>(II)</enum><text>An administering entity for an eligible State to which a grant is awarded under this subsection may use not more than 3 percent of the amount of the grant for a purpose described in subclause (I).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H40BB810B2A36436C80711D8C9341F715"><enum>(e)</enum><header>Assurances</header><text>When applying for a grant under this section, a State shall include in the application for that grant assurances that—</text><paragraph id="H257E9A1E4DAC4333860AA0ED2D3CC9CC"><enum>(1)</enum><text>if an entity described in section 5(b) is awarded grant funds under this section (referred to in this subsection as a <quote>covered recipient</quote>), provide that—</text><subparagraph id="HBABE083763BB4539AF20D784CA2C2690"><enum>(A)</enum><text>the covered recipient shall use the grant funds in accordance with any applicable statute, regulation, and application procedure;</text></subparagraph><subparagraph id="H8ACCF4A10F8F4F809ED265E78AD16FBF"><enum>(B)</enum><text>the administering entity for that State shall adopt and use proper methods of administering any grant that the covered recipient is awarded, including by—</text><clause id="HE396BADF2A4B49ECA8757929009AEF98"><enum>(i)</enum><text>enforcing any obligation imposed under law on any agency, institution, organization, or other entity that is responsible for carrying out the program to which the grant relates;</text></clause><clause id="H62531CCE08CA49579C9DADA7C6EF2C2E"><enum>(ii)</enum><text>correcting any deficiency in the operation of a program to which the grant relates, as identified through an audit or another monitoring or evaluation procedure; and</text></clause><clause id="HA040067EEA4E43EAAF15519F296A7C80"><enum>(iii)</enum><text>adopting written procedures for the receipt and resolution of complaints alleging a violation of law with respect to a program to which the grant relates; and</text></clause></subparagraph><subparagraph id="H7B1EEC2CCDF24476B0C881AD5700E27E"><enum>(C)</enum><text>the administering entity for that State shall cooperate in carrying out any evaluation—</text><clause id="H9B425B0A0BE74EBBB54B3F59EE00C137"><enum>(i)</enum><text>of any program that relates to a grant awarded to the covered recipient; and</text></clause><clause id="H64F99CBC5F06480B934C1A792DB901E2"><enum>(ii)</enum><text>that is carried out by or for the Assistant Secretary or another Federal official;</text></clause></subparagraph></paragraph><paragraph id="H401B8D362C014CF6BE18B90BB43B6DAD"><enum>(2)</enum><text>the administering entity for that State shall—</text><subparagraph id="H4E79426A74544010B91A524AFEBCF4C5"><enum>(A)</enum><text>use fiscal control and fund accounting procedures that ensure the proper disbursement of, and accounting for, any Federal funds that the State is awarded under this section;</text></subparagraph><subparagraph id="H4C1537CF66AA4F64BEDB6AB988CF4630"><enum>(B)</enum><text>submit to the Assistant Secretary any reports that may be necessary to enable the Assistant Secretary to perform the duties of the Assistant Secretary under this section;</text></subparagraph><subparagraph id="H78F3B51D9A574724ADAC10E60728ED62"><enum>(C)</enum><text>maintain any records and provide any information to the Assistant Secretary, including those records, that the Assistant Secretary determines is necessary to enable the Assistant Secretary to perform the duties of the Assistant Secretary under this section; and</text></subparagraph><subparagraph id="H06A2503C8EA5429BAC9DBFEDB5DE82FA"><enum>(D)</enum><text>with respect to any significant proposed change or amendment to the State Digital Equity Plan for the State, make the change or amendment available for public comment in accordance with subsection (c)(2); and</text></subparagraph></paragraph><paragraph id="HD5652E8A1D0446DDB6C2858DCD79F3D1"><enum>(3)</enum><text>the State, before submitting to the Assistant Secretary the State Digital Equity Plan of the State, has complied with the requirements of subsection (c)(2).</text></paragraph></subsection><subsection id="H6B1FF2217F8C4AB0B4CD01ADBB41F707"><enum>(f)</enum><header>Termination of grant</header><paragraph id="HE9C0E749870E4D20B920CE816101514F"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary shall terminate a grant awarded to an eligible State under this section if, after notice to the State and opportunity for a hearing, the Assistant Secretary—</text><subparagraph id="HD55C2665266F4A079E21C930149AC7E0"><enum>(A)</enum><text>presents to the State a rationale and supporting information that clearly demonstrates that—</text><clause id="HEA3EECB3B0D9493E85D797E15F37EF58"><enum>(i)</enum><text>the grant funds are not contributing to the development or execution of the State Digital Equity Plan of the State, as applicable; and</text></clause><clause id="H611B47BE6B64462683D6FBD7809F9F9C"><enum>(ii)</enum><text>the State is not upholding assurances made by the State to the Assistant Secretary under subsection (e); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3611B99F225F4E94A905E98D95E847E0"><enum>(B)</enum><text>determines that the grant is no longer necessary to achieve the original purpose for which Assistant Secretary awarded the grant.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE763DC6838DE4B608A21B1E5617C2900"><enum>(2)</enum><header>Redistribution</header><text>If the Assistant Secretary, in a fiscal year, terminates a grant under paragraph (1), the Assistant Secretary shall redistribute the unspent grant amounts—</text><subparagraph commented="no" display-inline="no-display-inline" id="H64844CB3329647C59881D6843535D907"><enum>(A)</enum><text>to eligible States to which the Assistant Secretary has awarded grants under subsection (d) for that fiscal year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCE376250232845B98C50DA3EF143E565"><enum>(B)</enum><text>in accordance with the formula described in subsection (d)(3)(A)(i).</text></subparagraph></paragraph></subsection><subsection id="H90D91951A9104382A412B4701728F8CF"><enum>(g)</enum><header>Reporting and information requirements; Internet disclosure</header><text>The Assistant Secretary—</text><paragraph id="H32CDB196B6C540BE9EEB0D2F0AE53B53"><enum>(1)</enum><text>shall—</text><subparagraph id="H8B3596A214F849E88F65F1F45F875E92"><enum>(A)</enum><text>require any entity to which a grant, including a subgrant, is awarded under this section to publicly report, for each year during the period described in subsection (c)(3)(D)(ii) or (d)(3)(B), as applicable, with respect to the grant, and in a format specified by the Assistant Secretary, on—</text><clause id="HB006C865F2DD46ACA3A2475B87062588"><enum>(i)</enum><text>the use of that grant by the entity;</text></clause><clause id="H58E43CF7785E490492A3D66DB582603C"><enum>(ii)</enum><text>the progress of the entity towards fulfilling the objectives for which the grant was awarded; and</text></clause><clause id="HD1D416927509401F93515C29E06E941C"><enum>(iii)</enum><text>the implementation of the State Digital Equity Plan of the State;</text></clause></subparagraph><subparagraph id="H11E2295B3939489AAE40E4AF2D458037"><enum>(B)</enum><text>establish appropriate mechanisms to ensure that each eligible State to which a grant is awarded under this section—</text><clause id="H6F6FD683B5524F92A7D93CEB55A762F7"><enum>(i)</enum><text>uses the grant amounts in an appropriate manner; and</text></clause><clause id="H77E13801492943628AED9D3DE4143E68"><enum>(ii)</enum><text>complies with all terms with respect to the use of the grant amounts; and</text></clause></subparagraph><subparagraph id="HF6163D0D1D7749B9B65B7B90B53074AA"><enum>(C)</enum><text>create and maintain a fully searchable database, which shall be accessible on the internet at no cost to the public, that contains, at a minimum—</text><clause id="H64504669330A40F7BBC7C86F74EF7F2E"><enum>(i)</enum><text>the application of each State that has applied for a grant under this section;</text></clause><clause id="HA223531F3F404653BAAE2DD36C32705C"><enum>(ii)</enum><text>the status of each application described in clause (i);</text></clause><clause id="HE01F30EB1BE94798BDF673D5C4AE216E"><enum>(iii)</enum><text>each report submitted by an entity under subparagraph (A);</text></clause><clause id="H0BFFA3D811B448A7BA58D778A36F0C92"><enum>(iv)</enum><text>a record of public comments made regarding the State Digital Equity Plan of a State, as well as any written responses to or actions taken in as a result of those comments; and</text></clause><clause id="H1F3501C2D035468DB3F60E2692B2F778"><enum>(v)</enum><text>any other information that is sufficient to allow the public to understand and monitor grants awarded under this section; and</text></clause></subparagraph></paragraph><paragraph id="HC961E5BCC270428388660B583CB623DF"><enum>(2)</enum><text>may establish additional reporting and information requirements for any recipient of a grant under this section.</text></paragraph></subsection><subsection id="H8FB89EF22B3F45548A8CFEEC4ED122F2"><enum>(h)</enum><header>Supplement not supplant</header><text>A grant or subgrant awarded under this section shall supplement, not supplant, other Federal or State funds that have been made available to carry out activities described in this section.</text></subsection><subsection id="H47C2B2AB91C84BA1B74C18778D4DCB8E"><enum>(i)</enum><header>Set asides</header><text>From amounts made available in a fiscal year to carry out the Program, the Assistant Secretary shall reserve—</text><paragraph id="H4930C06315364458AD4300F36D60B2F3"><enum>(1)</enum><text>not more than 5 percent for the implementation and administration of the Program, which shall include—</text><subparagraph id="H6D596C222AC74A1FB57EDADD69B1FBCF"><enum>(A)</enum><text>providing technical support and assistance, including ensuring consistency in data reporting;</text></subparagraph><subparagraph id="H4F699BEBD5CD4A2F8D4AA487618E72E3"><enum>(B)</enum><text>providing assistance to—</text><clause id="HF89F282935F94471AB7886153F9C02CA"><enum>(i)</enum><text>States, or administering entities for States, to prepare the applications of those States; and</text></clause><clause id="H21B517DE17A64D198CFDC290244B9C36"><enum>(ii)</enum><text>administering entities with respect to grants awarded under this section; and</text></clause></subparagraph><subparagraph id="H087B90074B3640D19F2B96F631B7C2CC"><enum>(C)</enum><text>developing the report required under section 6(a);</text></subparagraph></paragraph><paragraph id="HE2752FF919A847A8B452C7BDD988BADE"><enum>(2)</enum><text>not less than 5 percent to award grants to, or enter into contracts or cooperative agreements with, Indian tribes, Alaska Native entities, and Native Hawaiian organizations to allow those tribes, entities, and organizations to carry out the activities described in this section; and</text></paragraph><paragraph id="HDE55C3CA5180444A8487B12FED4CA8B6"><enum>(3)</enum><text>not less than 1 percent to award grants to, or enter into contracts or cooperative agreements with, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States that is not a State to enable those entities to carry out the activities described in this section.</text></paragraph></subsection><subsection id="HD80A06F42CEA4ECA91DB07779190FF0E"><enum>(j)</enum><header>Rules</header><text>The Assistant Secretary may prescribe such rules as may be necessary to carry out this section.</text></subsection><subsection id="HC52609542B8D4DCBAAD1960BED9F70EA"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text><paragraph id="HF618B5D4E8294FB98C61D6681B708970"><enum>(1)</enum><text>$60,000,000 for the award of grants under subsection (c)(3), and such amount is authorized to remain available through fiscal year 2026; and</text></paragraph><paragraph id="H0065AF9FA19F4325B2FCDC9670F1B7EF"><enum>(2)</enum><text display-inline="yes-display-inline">$625,000,000 for fiscal year 2022 for the award of grants under subsection (d), and such amount is authorized to remain available through fiscal year 2026.</text></paragraph></subsection></section><section id="H490934AB2DF04D458AA9EB2C8CE9E774"><enum>5.</enum><header>Digital Equity Competitive Grant Program</header><subsection id="HACB1D1E33E544F26B82DD56B6FFB53FF"><enum>(a)</enum><header>Establishment</header><paragraph id="HCFD4E6EBC28A4E839A9D4C808465169D"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the Assistant Secretary begins awarding grants under section 4(d), and not before that date, the Assistant Secretary shall establish in the Department of Commerce the Digital Equity Competitive Grant Program (referred to in this section as the <quote>Program</quote>), the purpose of which is to award grants to support efforts to achieve digital equity, promote digital inclusion activities, and spur greater adoption of broadband among covered populations.</text></paragraph><paragraph id="H3BEB27198A7E41418152CB520FD076DA"><enum>(2)</enum><header>Consultation; no conflict</header><text>In establishing the Program under paragraph (1), the Assistant Secretary—</text><subparagraph id="H686CE4DC07C64C1C9B92C22F7E71F199"><enum>(A)</enum><text>may consult a State with respect to—</text><clause id="HD77337C7293D41488F43581EDDA2D2E3"><enum>(i)</enum><text>the identification of groups described in subparagraphs (A) through (H) of section 2(8) located in that State; and</text></clause><clause id="HB0F55F4125AF4B48A37BB6F53FD5D444"><enum>(ii)</enum><text>the allocation of grant funds within that State for projects in or affecting the State; and</text></clause></subparagraph><subparagraph id="H99696FFB02534BECA85D0A43DC5C9133"><enum>(B)</enum><text>shall—</text><clause id="H2DF7123A86A64FFFADA30B841B8CE4A1"><enum>(i)</enum><text>consult with—</text><subclause id="HF35BC35FD7574BE5A99B43A721906A62"><enum>(I)</enum><text>the Secretary of Agriculture;</text></subclause><subclause id="H9BAA1F2885884D62A72C83B9A225D71C"><enum>(II)</enum><text>the Secretary of Housing and Urban Development;</text></subclause><subclause id="H68419370DA7942B982529EACB27DD784"><enum>(III)</enum><text>the Secretary of Education;</text></subclause><subclause id="H782EDDE06B3B427BB34AE9BAFF6607B5"><enum>(IV)</enum><text>the Secretary of Labor;</text></subclause><subclause id="H48DF1938BF3A4E67AE513817B6CED362"><enum>(V)</enum><text>the Secretary of Health and Human Services;</text></subclause><subclause id="HB72BB2E579054A6B8FFB9085D475D29C"><enum>(VI)</enum><text>the Secretary of Veterans Affairs;</text></subclause><subclause id="H4AF58FD89C82463FB6078083A97B481D"><enum>(VII)</enum><text>the Secretary of the Interior;</text></subclause><subclause id="HE08E0BA64CC74BAAB9852CEB7CC82063"><enum>(VIII)</enum><text>the Federal Communications Commission;</text></subclause><subclause id="HA24F76F0882A4328BE2B6375DCA31470"><enum>(IX)</enum><text>the Federal Trade Commission;</text></subclause><subclause id="H826F9522D341477B93CF6ABAE375F67D"><enum>(X)</enum><text>the Director of the Institute of Museum and Library Services;</text></subclause><subclause id="H2B95C1D7E5D4420E8A390E05E9B652AC"><enum>(XI)</enum><text>the Administrator of the Small Business Administration;</text></subclause><subclause id="H5522FB54F6D64D78BC72065A876EE544"><enum>(XII)</enum><text>the Federal Cochairman of the Appalachian Regional Commission; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H72B8FCC986B24E6DBBBEE1FA0387DBB8"><enum>(XIII)</enum><text>the head of any other agency that the Assistant Secretary determines to be appropriate; and</text></subclause></clause><clause id="H901EFC1B683745B4B8745C2F81EE2C03"><enum>(ii)</enum><text>ensure that the Program complements and enhances, and does not conflict with, other Federal broadband initiatives and programs.</text></clause></subparagraph></paragraph></subsection><subsection id="H09BB0B21BD9445D6BE5C6A3D74A7786C"><enum>(b)</enum><header>Eligibility</header><text>The Assistant Secretary may award a grant under the Program to any of the following entities if the entity is not serving, and has not served, as the administering entity for a State under section 4(b):</text><paragraph id="HBA943DE51DC34EE4A8D6E3A0D09D3A48"><enum>(1)</enum><text>A political subdivision, agency, or instrumentality of a State, including an agency of a State that is responsible for administering or supervising adult education and literacy activities in the State.</text></paragraph><paragraph id="HF62EF9F59FEF4035BA841013020B7D7D"><enum>(2)</enum><text>An Indian tribe, an Alaska Native entity, or a Native Hawaiian organization.</text></paragraph><paragraph id="H5351129620F743348F2414D4FE4FC3C0"><enum>(3)</enum><text>A foundation, corporation, institution, or association that is—</text><subparagraph id="H757D094641A049EDB72F845F359859FC"><enum>(A)</enum><text>a not-for-profit entity; and</text></subparagraph><subparagraph id="H4EBCC2A24BDD4E06BC5313F870F5424C"><enum>(B)</enum><text>not a school.</text></subparagraph></paragraph><paragraph id="H1566B45EF1D7434C8BCCFD13A57BEA3B"><enum>(4)</enum><text>A community anchor institution.</text></paragraph><paragraph id="H71F869BC26DD4742A11BA1100E2F5F79"><enum>(5)</enum><text>A local educational agency.</text></paragraph><paragraph id="HF3BEA2A5DA0742E0B2FF8E97B87BD5A0"><enum>(6)</enum><text>An entity that carries out a workforce development program.</text></paragraph><paragraph id="HE2F209B5DB5940F7A5935DD753281598"><enum>(7)</enum><text>A partnership between any of the entities described in paragraphs (1) through (6).</text></paragraph><paragraph id="HA9745804E70A4ED89FE17925A5511273"><enum>(8)</enum><text>A partnership between—</text><subparagraph id="HD1475997EA764F6F906AD6536BBB3330"><enum>(A)</enum><text>an entity described in any of paragraphs (1) through (6); and</text></subparagraph><subparagraph id="HA957B25AEE4E46FD8055237D4B1C6E8D"><enum>(B)</enum><text>an entity that—</text><clause id="HAB6ABAE48EA647B695AF26A3AB43503B"><enum>(i)</enum><text>the Assistant Secretary, by rule, determines to be in the public interest; and</text></clause><clause id="H6FE0BF3C77ED434684789ACDD1430FA5"><enum>(ii)</enum><text>is not a school.</text></clause></subparagraph></paragraph></subsection><subsection id="H4C60EC879A1145E992517506D507231B"><enum>(c)</enum><header>Application</header><text>An entity that wishes to be awarded a grant under the Program shall submit to the Assistant Secretary an application—</text><paragraph id="HB1D1BBDFEEF146979922FBE752C56A18"><enum>(1)</enum><text>at such time, in such form, and containing such information as the Assistant Secretary may require; and</text></paragraph><paragraph id="H665EE21B269D4794A435991DC3E1F25D"><enum>(2)</enum><text>that—</text><subparagraph id="H8333940E5ECA4FF5B1AF7C6196F15930"><enum>(A)</enum><text>provides a detailed explanation of how the entity will use any grant amounts awarded under the Program to carry out the purposes of the Program in an efficient and expeditious manner;</text></subparagraph><subparagraph id="H0C6077AEB0544D77ACC8AD5C7EA0BA3A"><enum>(B)</enum><text>identifies the period in which the applicant will expend the grant funds awarded under the Program;</text></subparagraph><subparagraph id="H636FC3A89A684B4196EA28F47F06C4D5"><enum>(C)</enum><text>includes—</text><clause id="H30F81D2F17024922B0C732585CDCF34E"><enum>(i)</enum><text>a justification for the amount of the grant that the applicant is requesting; and</text></clause><clause id="H670D11539C6142E090C89C8613B620E5"><enum>(ii)</enum><text>for each fiscal year in which the applicant will expend the grant funds, a budget for the activities that the grant funds will support;</text></clause></subparagraph><subparagraph id="HC24643EA9ACA41A7A428C7D5D67FC47A"><enum>(D)</enum><text>demonstrates to the satisfaction of the Assistant Secretary that the entity—</text><clause id="H8023A24C06714C9ABCC7A3D9CCC49B04"><enum>(i)</enum><text>is capable of carrying out—</text><subclause id="H9448C66FFA0743E69A1167441DEDE9D7"><enum>(I)</enum><text>the project or function to which the application relates; and</text></subclause><subclause id="H25104C5614E44328BD31234B0CBF72B0"><enum>(II)</enum><text>the activities described in subsection (h)—</text><item id="HA422AC87B75B45409D4EB76B2B21838C"><enum>(aa)</enum><text>in a competent manner; and</text></item><item id="HD09F212DE7514FC7AFFD969115EC2C0F"><enum>(bb)</enum><text>in compliance with all applicable Federal, State, and local laws; and</text></item></subclause></clause><clause id="H0D9AF56CCC6E4CD6B9C05AA50319859F"><enum>(ii)</enum><text>if the applicant is an entity described in subsection (b)(1), shall appropriate or otherwise unconditionally obligate from non-Federal sources funds that are necessary to meet the requirements of subsection (e);</text></clause></subparagraph><subparagraph id="HA4D48FCF7BEC41D592738790DCF94880"><enum>(E)</enum><text>discloses to the Assistant Secretary the source and amount of other Federal, State, or outside funding sources from which the entity receives, or has applied for, funding for activities or projects to which the application relates; and</text></subparagraph><subparagraph id="HECC20BA7A9D54F9C996265DB08885241"><enum>(F)</enum><text>provides—</text><clause id="HAE3A24B9A3254E56B81146A49FDFDDE3"><enum>(i)</enum><text>the assurances that are required under subsection (f); and</text></clause><clause id="H858BC206873743E0B9E3541E4ED7A788"><enum>(ii)</enum><text>an assurance that the entity shall follow such additional procedures as the Assistant Secretary may require to ensure that grant funds are used and accounted for in an appropriate manner.</text></clause></subparagraph></paragraph></subsection><subsection id="H9FD4A68C260248189429B579D1671E9E"><enum>(d)</enum><header>Award of grants</header><paragraph id="HC91A51B4449F417690AF94894A8D5B75"><enum>(1)</enum><header>Factors considered in award of grants</header><text>In deciding whether to award a grant under the Program, the Assistant Secretary shall, to the extent practicable, consider—</text><subparagraph id="H62D87C2E8E8E4E9C95251546C592BD93"><enum>(A)</enum><text>whether—</text><clause id="HB0FD1689513A4C5089B2693704E45ACA"><enum>(i)</enum><text>an application shall, if approved—</text><subclause id="H31A6485FD09B461B94784B165CAEA5F9"><enum>(I)</enum><text>increase internet access and the adoption of broadband among covered populations to be served by the applicant; and</text></subclause><subclause id="H853088B36EBF4FAD8991873C1B8C7A8A"><enum>(II)</enum><text>not result in unjust enrichment; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HA9D700C139FF4991A5EE52E661297947"><enum>(ii)</enum><text>the applicant is, or plans to subcontract with, a socially and economically disadvantaged small business concern;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CC33EC202314885B59DB7C4DF23C38B"><enum>(B)</enum><text>the comparative geographic diversity of the application in relation to other eligible applications; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEE740FDE1244A8A823A87036EC5B7BC"><enum>(C)</enum><text>the extent to which an application may duplicate or conflict with another program.</text></subparagraph></paragraph><paragraph id="HAB10D6B670624356A5A022098D91B85D"><enum>(2)</enum><header>Use of funds</header><subparagraph id="HD161245B428C4289A5B60109E9FB18E7"><enum>(A)</enum><header>In general</header><text>In addition to the activities required under subparagraph (B), an entity to which the Assistant Secretary awards a grant under the Program shall use the grant amounts to support not less than 1 of the following activities:</text><clause id="H5E62DA31D5A24D37BA80AAF3CEA3FF1D"><enum>(i)</enum><text>To develop and implement digital inclusion activities that benefit covered populations.</text></clause><clause id="H3392937D69AA48EEB63510078A79D53D"><enum>(ii)</enum><text>To facilitate the adoption of broadband by covered populations in order to provide educational and employment opportunities to those populations.</text></clause><clause id="HB26C1B2912164268AE4DC4EDAA887C0E"><enum>(iii)</enum><text>To implement, consistent with the purposes of this Act—</text><subclause id="H13481D764B37475EACF655EF032F0356"><enum>(I)</enum><text>training programs for covered populations that cover basic, advanced, and applied skills; or</text></subclause><subclause id="H7278DE959C864D4B82DE59771C024BEE"><enum>(II)</enum><text>other workforce development programs.</text></subclause></clause><clause id="H0CE65B0AFBF440FEAFBB1DEBDF4EDED7"><enum>(iv)</enum><text>To make available equipment, instrumentation, networking capability, hardware and software, or digital network technology for broadband services to covered populations at low or no cost.</text></clause><clause id="H481571327D9B488C85A5456D7B21C13E"><enum>(v)</enum><text>To construct, upgrade, expend, or operate new or existing public access computing centers for covered populations through community anchor institutions.</text></clause><clause commented="no" display-inline="no-display-inline" id="HE4D670313E174A09B8AE63C6FC93DAD5"><enum>(vi)</enum><text>To undertake any other project and activity that the Assistant Secretary finds to be consistent with the purposes for which the Program is established.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0820E39C05B4BB3B6699EF19AD03FC4"><enum>(B)</enum><header>Evaluation</header><clause commented="no" display-inline="no-display-inline" id="HD0782D4BF63447FFB4E359868658393C"><enum>(i)</enum><header>In general</header><text>An entity to which the Assistant Secretary awards a grant under the Program shall use not more than 10 percent of the grant amounts to measure and evaluate the activities supported with the grant amounts.</text></clause><clause commented="no" display-inline="no-display-inline" id="H82907A66DE424566AD6BCFBEA63559A9"><enum>(ii)</enum><header>Submission to Assistant Secretary</header><text>An entity to which the Assistant Secretary awards a grant under the Program shall submit to the Assistant Secretary each measurement and evaluation performed under clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="HB1D41ED7426F402A9F6C154134E579CA"><enum>(I)</enum><text>in a manner specified by the Assistant Secretary;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H800C5395E10D4A4D9D33677F6A355B01"><enum>(II)</enum><text>not later than 15 months after the date on which the entity is awarded the grant amounts; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA2237C19F3174BC3B181A0C6E6F78CDB"><enum>(III)</enum><text>annually after the submission described in subclause (II) for any year in which the entity expends grant amounts.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFAD6EFF690FE44809B580920553D104F"><enum>(C)</enum><header>Administrative costs</header><text>An entity to which the Assistant Secretary awards a grant under the Program may use not more than 10 percent of the amount of the grant for administrative costs in carrying out any of the activities described in subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAD1CC15E68594A0294C9202A4C6BFC3C"><enum>(D)</enum><header>Time limitations</header><text>With respect to a grant awarded to an entity under the Program, the entity—</text><clause commented="no" display-inline="no-display-inline" id="H5E66882110824E6EA14AA813B77E4857"><enum>(i)</enum><text>except as provided in clause (ii), shall expend the grant amounts during the 4-year period beginning on the date on which the entity is awarded the grant amounts; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8BB17BA617D24751B6B2C184A8B80476"><enum>(ii)</enum><text>during the 1-year period beginning on the date that is 4 years after the date on which the entity is awarded the grant amounts, may continue to measure and evaluate the activities supported with the grant amounts, as required under subparagraph (B).</text></clause></subparagraph></paragraph></subsection><subsection id="HBF9EA6AED5254A4AB3C9695A07B25898"><enum>(e)</enum><header>Federal share</header><paragraph id="H66F6CDA17CAF46B5A6542000617FB4B6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Federal share of any project for which the Assistant Secretary awards a grant under the Program may not exceed 90 percent.</text></paragraph><paragraph id="HE763A11021CF4EC2B23B8E5F2E4919BE"><enum>(2)</enum><header>Exception</header><text>The Assistant Secretary may grant a waiver with respect to the limitation on the Federal share of a project described in paragraph (1) if—</text><subparagraph id="H4B95423CE5414245B4A680F45AA07A8C"><enum>(A)</enum><text>the applicant with respect to the project petitions the Assistant Secretary for the waiver; and</text></subparagraph><subparagraph id="H4F57DBA433EB4FC78EB62DE2E723C123"><enum>(B)</enum><text>the Assistant Secretary determines that the petition described in subparagraph (A) demonstrates financial need.</text></subparagraph></paragraph></subsection><subsection id="H3242391D0C2F4300A91CE685E94ECE4C"><enum>(f)</enum><header>Assurances</header><text>When applying for a grant under this section, an entity shall include in the application for that grant assurances that the entity shall—</text><paragraph id="H20A1BACC11E54122BD5ACAC1B016FDB0"><enum>(1)</enum><text>use any grant funds that the entity is awarded—</text><subparagraph id="H922FAF5F714C47319A9BFD05C4B24CEC"><enum>(A)</enum><text>in accordance with any applicable statute, regulation, and application procedure; and</text></subparagraph><subparagraph id="H1D3F73F727C74137A5E612726C7BA94C"><enum>(B)</enum><text>to the extent required under applicable law;</text></subparagraph></paragraph><paragraph id="HF280BC0EF75E42959B36CAF84A40B4AF"><enum>(2)</enum><text>adopt and use proper methods of administering any grant that the entity is awarded, including by—</text><subparagraph id="HB5708C6A8FEA40A2A1708888D5849611"><enum>(A)</enum><text>enforcing any obligation imposed under law on any agency, institution, organization, or other entity that is responsible for carrying out a program to which the grant relates;</text></subparagraph><subparagraph id="H9C6BBADC98AF484B800C26F907DD4399"><enum>(B)</enum><text>correcting any deficiency in the operation of a program to which the grant relates, as identified through an audit or another monitoring or evaluation procedure; and</text></subparagraph><subparagraph id="H17EC7447A55A4963A25B106B95D60BDE"><enum>(C)</enum><text>adopting written procedures for the receipt and resolution of complaints alleging a violation of law with respect to a program to which the grant relates;</text></subparagraph></paragraph><paragraph id="HC68DAFE589FD4608A07071DF136C6B52"><enum>(3)</enum><text>cooperate with respect to any evaluation—</text><subparagraph id="H8720FE75BAB042D8BDC22E5AC6FF39A6"><enum>(A)</enum><text>of any program that relates to a grant awarded to the entity; and</text></subparagraph><subparagraph id="HA74878652FD44B21A4135520F344806E"><enum>(B)</enum><text>that is carried out by or for the Assistant Secretary or another Federal official;</text></subparagraph></paragraph><paragraph id="HBD80BA055FA64A248CEAB6DA8BCF4F16"><enum>(4)</enum><text>use fiscal control and fund accounting procedures that ensure the proper disbursement of, and accounting for, any Federal funds that the entity is awarded under the Program;</text></paragraph><paragraph id="H92CACAB18117491A90D25F59B5D39B12"><enum>(5)</enum><text>submit to the Assistant Secretary any reports that may be necessary to enable the Assistant Secretary to perform the duties of the Assistant Secretary under the Program; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2DA2E03EC5842D7BE780B7F37D1C4C7"><enum>(6)</enum><text>maintain any records and provide any information to the Assistant Secretary, including those records, that the Assistant Secretary determines is necessary to enable the Assistant Secretary to perform the duties of the Assistant Secretary under the Program.</text></paragraph></subsection><subsection id="H1026960879C1462EBF3FA5FDD439F1EA"><enum>(g)</enum><header>Deobligation or termination of grant</header><text>In addition to other authority under applicable law, the Assistant Secretary may—</text><paragraph id="H25384B7F62CC4A7BA44A88888FF14548"><enum>(1)</enum><text>deobligate or terminate a grant awarded to an entity under this section if, after notice to the entity and opportunity for a hearing, the Assistant Secretary—</text><subparagraph id="HE4F72F83502F4520A04432B5B3BFA608"><enum>(A)</enum><text>presents to the entity a rationale and supporting information that clearly demonstrates that—</text><clause id="HF8C1FA6F28C349B39147E9B3B83E00E2"><enum>(i)</enum><text>the grant funds are not being used in a manner that is consistent with the application with respect to the grant submitted by the entity under subsection (c); and</text></clause><clause id="HE98692B5E08944CEBD7F20873C154D03"><enum>(ii)</enum><text>the entity is not upholding assurances made by the entity to the Assistant Secretary under subsection (f); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB523ABA2025C4D6D8EEFC1AA9CE26EE1"><enum>(B)</enum><text>determines that the grant is no longer necessary to achieve the original purpose for which Assistant Secretary awarded the grant; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H01F70049AB5445A1AEEDDA14A1DE2D9C"><enum>(2)</enum><text>with respect to any grant funds that the Assistant Secretary deobligates or terminates under paragraph (1), competitively award the grant funds to another applicant, consistent with the requirements of this section.</text></paragraph></subsection><subsection id="HD89247D929EE48E8B6A67F055AD4C2AE"><enum>(h)</enum><header>Reporting and information requirements; internet disclosure</header><text>The Assistant Secretary—</text><paragraph id="H7F8073715329413DA671291F7886B9A0"><enum>(1)</enum><text>shall—</text><subparagraph id="H62BFB7C54CF7402088306B2DE7097E82"><enum>(A)</enum><text>require any entity to which the Assistant Secretary awards a grant under the Program to, for each year during the period described in subsection (d)(2)(D) with respect to the grant, submit to the Assistant Secretary a report, in a format specified by the Assistant Secretary, regarding—</text><clause id="H78DCA35835C444C4B289F8B13C547E46"><enum>(i)</enum><text>the amount of the grant;</text></clause><clause id="H371278CC213447E6A4CF553A6D9B4416"><enum>(ii)</enum><text>the use by the entity of the grant amounts; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB6824706B9774C01A1C2EB9E93F0FF14"><enum>(iii)</enum><text>the progress of the entity towards fulfilling the objectives for which the grant was awarded;</text></clause></subparagraph><subparagraph id="H0DDFA7E01A654FEF89EC0429726AB964"><enum>(B)</enum><text>establish mechanisms to ensure appropriate use of, and compliance with respect to all terms regarding, grant funds awarded under the Program;</text></subparagraph><subparagraph id="H11111024EF8A4656A8D5CA6516A2E193"><enum>(C)</enum><text>create and maintain a fully searchable database, which shall be accessible on the internet at no cost to the public, that contains, at a minimum—</text><clause id="H0B4BD06663074C7EA307E0497ABB5F95"><enum>(i)</enum><text>a list of each entity that has applied for a grant under the Program;</text></clause><clause id="HE59AE12FD9B144DF9D6DAF1EC01A870E"><enum>(ii)</enum><text>a description of each application described in clause (i), including the proposed purpose of each grant described in that clause;</text></clause><clause id="HB519DE3C67A04331801449259294B933"><enum>(iii)</enum><text>the status of each application described in clause (i), including whether the Assistant Secretary has awarded a grant with respect to the application and, if so, the amount of the grant;</text></clause><clause id="HB0F2109698244177BC6133E4D7B6F5D3"><enum>(iv)</enum><text>each report submitted by an entity under subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H582C46530145449798A8E7A57AA28439"><enum>(v)</enum><text>any other information that is sufficient to allow the public to understand and monitor grants awarded under the Program; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A69A31D594446A48386F522AF1AD4B8"><enum>(D)</enum><text>ensure that any entity with respect to which an award is deobligated or terminated under subsection (g) may, in a timely manner, appeal or otherwise challenge that deobligation or termination, as applicable; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9EA22AF3B32B4631817E9605E9B566B2"><enum>(2)</enum><text display-inline="yes-display-inline">may establish additional reporting and information requirements for any recipient of a grant under the Program.</text></paragraph></subsection><subsection id="HF131DC36197E4D17B07444B3FC48BC53"><enum>(i)</enum><header>Supplement not supplant</header><text>A grant awarded to an entity under the Program shall supplement, not supplant, other Federal or State funds that have been made available to the entity to carry out activities described in this section.</text></subsection><subsection id="H4298B8F946924969AB8B3CD767BB9244"><enum>(j)</enum><header>Set asides</header><text>From amounts made available in a fiscal year to carry out the Program, the Assistant Secretary shall reserve—</text><paragraph id="HBC85D8ABF49146C3BB54CC953CDBF188"><enum>(1)</enum><text>5 percent for the implementation and administration of the Program, which shall include—</text><subparagraph id="HBA890079FD7646E682D6B98E901B89F5"><enum>(A)</enum><text>providing technical support and assistance, including ensuring consistency in data reporting;</text></subparagraph><subparagraph id="H578AF585A16A408FBDAECFBC9271F5ED"><enum>(B)</enum><text>providing assistance to entities to prepare the applications of those entities with respect to grants awarded under this section;</text></subparagraph><subparagraph id="H54341C9ADA9C45529050005739688C14"><enum>(C)</enum><text>developing the report required under section 6(a); and</text></subparagraph><subparagraph id="H56BC2A7F4EC3491ABD76810521250E54"><enum>(D)</enum><text>conducting outreach to entities that may be eligible to be awarded a grant under the Program regarding opportunities to apply for such a grant;</text></subparagraph></paragraph><paragraph id="H413F5E848E844AFD9B86FA4DB47B81A0"><enum>(2)</enum><text>5 percent to award grants to, or enter into contracts or cooperative agreements with, Indian tribes, Alaska Native entities, and Native Hawaiian organizations to allow those tribes, entities, and organizations to carry out the activities described in this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3AA2FF7F3C13416BB18162F180367940"><enum>(3)</enum><text>1 percent to award grants to, or enter into contracts or cooperative agreements with, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States that is not a State to enable those entities to carry out the activities described in this section.</text></paragraph></subsection><subsection id="H84AF6C12079048C3BB8B6AC6E79D6EE6"><enum>(k)</enum><header>Rules</header><text>The Assistant Secretary may prescribe such rules as may be necessary to carry out this section.</text></subsection><subsection id="H797FDAB14FA9454EB10CD30A88DE6F5D"><enum>(l)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $625,000,000 for fiscal year 2022, and such amount is authorized to remain available through fiscal year 2026.</text></subsection></section><section id="HDDD6132D0DEA44F69AFC25A0712A473F"><enum>6.</enum><header>Policy research, data collection, analysis and modeling, evaluation, and dissemination</header><subsection id="H7E8EBA57C3EC4E68B2DDACC6AAC89F56"><enum>(a)</enum><header>Reporting requirements</header><paragraph id="H8C2A361F134045B1A1EDB1330102976B"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the Assistant Secretary begins awarding grants under section 4(d)(1), and annually thereafter, the Assistant Secretary shall—</text><subparagraph id="H5B938A241CC3458DB0AE7BED98486403"><enum>(A)</enum><text>submit to the appropriate committees of Congress a report that documents, for the year covered by the report—</text><clause id="H09BF23FEDC054DE5A32BE15A9EA6D477"><enum>(i)</enum><text>the findings of each evaluation conducted under subparagraph (B);</text></clause><clause id="H6D27EFAFFFC142DCB99F6D407A636E48"><enum>(ii)</enum><text>a list of each grant awarded under each covered program, which shall include—</text><subclause id="H9015512916F241149D43ECBA03014777"><enum>(I)</enum><text>the amount of each such grant;</text></subclause><subclause id="HD3AD56CC144640949967924073EBFE2F"><enum>(II)</enum><text>the recipient of each such grant; and</text></subclause><subclause id="H2BA38F00E58E44E79107220946EF3356"><enum>(III)</enum><text>the purpose for which each such grant was awarded;</text></subclause></clause><clause id="H13A3BE8A1B1143A68567A583ADFB0FF9"><enum>(iii)</enum><text>any deobligation, termination, or modification of a grant awarded under the covered programs, which shall include a description of the subsequent usage of any funds to which such an action applies; and</text></clause><clause id="HA7218CC55DC5499F8EB5174A8B1A08AF"><enum>(iv)</enum><text>each challenge made by an applicant for, or a recipient of, a grant under the covered programs and the outcome of each such challenge; and</text></clause></subparagraph><subparagraph id="HFA4E8286BEB04FFFAE97AB7380117CDA"><enum>(B)</enum><text>conduct evaluations of the activities carried out under the covered programs, which shall include an evaluation of—</text><clause id="HD919BA848E1E4000BD4A3AB970A25C48"><enum>(i)</enum><text>whether eligible States to which grants are awarded under the program established under section 4 are—</text><subclause id="HDC0C4305234543B686F5B589C50AB580"><enum>(I)</enum><text>abiding by the assurances made by those States under subsection (e) of that section;</text></subclause><subclause id="HBED00F1AA773427FBC2B097854067554"><enum>(II)</enum><text>meeting, or have met, the stated goals of the Digital Equity Plans developed by the States under subsection (c) of that section;</text></subclause><subclause id="H6098197EF6A243818B27F0A88B576F7C"><enum>(III)</enum><text>satisfying the requirements imposed by the Assistant Secretary on those States under subsection (g) of that section; and</text></subclause><subclause id="HCC409E1E9C4F492C91A6C134B60FD46A"><enum>(IV)</enum><text>in compliance with any other rules, requirements, or regulations promulgated by the Assistant Secretary in implementing that program; and</text></subclause></clause><clause id="H3700642654764E44A67E74780763189B"><enum>(ii)</enum><text>whether entities to which grants are awarded under the program established under section 5 are—</text><subclause id="H0CE157B562954E319DD9281A980E980A"><enum>(I)</enum><text>abiding by the assurances made by those entities under subsection (f) of that section;</text></subclause><subclause id="HF8D975C7FF844B33A975FAED6C951944"><enum>(II)</enum><text>meeting, or have met, the stated goals of those entities with respect to the use of the grant amounts;</text></subclause><subclause id="H84C5FA0B062E49A4AB70F8212AC640C3"><enum>(III)</enum><text>satisfying the requirements imposed by the Assistant Secretary on those States under subsection (h) of that section; and</text></subclause><subclause id="HB07EBADD9FD34A4D876FCB928DC67DF6"><enum>(IV)</enum><text>in compliance with any other rules, requirements, or regulations promulgated by the Assistant Secretary in implementing that program.</text></subclause></clause></subparagraph></paragraph><paragraph id="H738C4BC09C9E4C30B9F2A9AD3804F351"><enum>(2)</enum><header>Public availability</header><text>The Assistant Secretary shall make each report submitted under paragraph (1)(A) publicly available in an online format that—</text><subparagraph id="HD84515619FC8489E8D39A3D5BCCDE5DC"><enum>(A)</enum><text>facilitates access and ease of use;</text></subparagraph><subparagraph id="H50F2CA5B508D4E3EB5433DBA14DE6602"><enum>(B)</enum><text>is searchable; and</text></subparagraph><subparagraph id="H43A3B94F8E3F4737AC65768321E8FF87"><enum>(C)</enum><text>is accessible—</text><clause id="HFAECC414FE904E7A9120A7126597ACBD"><enum>(i)</enum><text>to individuals with disabilities; and</text></clause><clause id="HB5DE53CC009E4B3DB0627A1056485401"><enum>(ii)</enum><text>in languages other than English.</text></clause></subparagraph></paragraph></subsection><subsection id="H9CB019ADDCB8451F92CAC34F8FFFA6B2"><enum>(b)</enum><header>Authority To contract and enter into other arrangements</header><text>The Assistant Secretary may award grants and enter into contracts, cooperative agreements, and other arrangements with Federal agencies, public and private organizations, and other entities with expertise that the Assistant Secretary determines appropriate in order to—</text><paragraph id="HC19C2B81A08048F4AC330BC54E5C1F3E"><enum>(1)</enum><text>evaluate the impact and efficacy of activities supported by grants awarded under the covered programs; and</text></paragraph><paragraph id="HBB38A92C05284F5CABAED14DAC3240C0"><enum>(2)</enum><text>develop, catalog, disseminate, and promote the exchange of best practices, both with respect to and independent of the covered programs, in order to achieve digital equity.</text></paragraph></subsection><subsection id="H55149860EC2240D387CDAA9091DCC91F"><enum>(c)</enum><header>Consultation and public engagement</header><text>In carrying out subsection (a), and to further the objectives described in paragraphs (1) and (2) of subsection (b), the Assistant Secretary shall conduct ongoing collaboration and consult with—</text><paragraph id="H86B70ACC4F8440A68A370003FDA4F305"><enum>(1)</enum><text>the Secretary of Agriculture;</text></paragraph><paragraph id="HDC9DE8D62C024A67855E7B5377A8A7AF"><enum>(2)</enum><text>the Secretary of Housing and Urban Development;</text></paragraph><paragraph id="H6B8E4B254A9E4C5E83AF2C03838CCFE9"><enum>(3)</enum><text>the Secretary of Education;</text></paragraph><paragraph id="HE0BF9EBBD2FC41BDA1E3BBADA47903C1"><enum>(4)</enum><text>the Secretary of Labor;</text></paragraph><paragraph id="H1445B72D52AD45CAA142EE0400658A07"><enum>(5)</enum><text>the Secretary of Health and Human Services;</text></paragraph><paragraph id="HFEDAB82C9F2341B387553FFCF7BBAFFA"><enum>(6)</enum><text>the Secretary of Veterans Affairs;</text></paragraph><paragraph id="H8D1F6612ACA84108B41206809878C1F2"><enum>(7)</enum><text>the Secretary of the Interior;</text></paragraph><paragraph id="H0A131365688D4984BEBF454AB0CDB82E"><enum>(8)</enum><text>the Federal Communications Commission;</text></paragraph><paragraph id="H52AFDDDDFAEE4F26BAA9886AACCD85A1"><enum>(9)</enum><text>the Federal Trade Commission;</text></paragraph><paragraph id="H444AB27E06094E9F8748074EF41566C6"><enum>(10)</enum><text>the Director of the Institute of Museum and Library Services;</text></paragraph><paragraph id="HD8870DE9554A43289AD9888BFFB70C1B"><enum>(11)</enum><text>the Administrator of the Small Business Administration;</text></paragraph><paragraph id="H0A697833D1F6436C85CEE547E3E48518"><enum>(12)</enum><text>the Federal Cochairman of the Appalachian Regional Commission;</text></paragraph><paragraph id="H6B0D2F001072473D8814B0445859D29A"><enum>(13)</enum><text>State agencies and governors of States (or equivalent officials);</text></paragraph><paragraph id="H3E162E62587C41B28B7392904FC44B62"><enum>(14)</enum><text>entities serving as administering entities for States under section 4(b);</text></paragraph><paragraph id="H3D7610A57D7C47CFA0C5C6F67C50028C"><enum>(15)</enum><text>national, State, tribal, and local organizations that provide digital inclusion, digital equity, or digital literacy services;</text></paragraph><paragraph id="H55C1A28590954A4D8E876EFBC04117D7"><enum>(16)</enum><text>researchers, academics, and philanthropic organizations; and</text></paragraph><paragraph id="HC8B8B2494C2B43F1A8147F63AEA09FB2"><enum>(17)</enum><text>other agencies, organizations (including international organizations), entities (including entities with expertise in the fields of data collection, analysis and modeling, and evaluation), and community stakeholders, as determined appropriate by the Assistant Secretary.</text></paragraph></subsection><subsection id="H5B735BAE620D4764AF0B97651B4CD39A"><enum>(d)</enum><header>Technical support and assistance</header><text>The Assistant Secretary shall provide technical support and assistance, assistance to entities to prepare the applications of those entities with respect to grants awarded under the covered programs, and other resources, to the extent practicable, to ensure consistency in data reporting and to meet the objectives of this section.</text></subsection><subsection id="HC6372A3EC3854CB580C7D547452CFD27"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section, which shall remain available until expended.</text></subsection></section><section id="HEDEDA8B74ABF432E8C582D792D32DA39"><enum>7.</enum><header>General provisions</header><subsection id="H8EF3EA42F1EB413FA309AA0A82C53E21"><enum>(a)</enum><header>Nondiscrimination</header><paragraph id="HC5144A47271D4406B77F5F32B805F16B"><enum>(1)</enum><header>In general</header><text>No individual in the United States may, on the basis of actual or perceived race, color, religion, national origin, sex, gender identity, sexual orientation, age, or disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity that is funded in whole or in part with funds made available under this Act.</text></paragraph><paragraph id="H73A8CCC0690645D9AE71C86B34E61BE3"><enum>(2)</enum><header>Enforcement</header><text>The Assistant Secretary shall effectuate paragraph (1) with respect to any program or activity described in that paragraph by issuing regulations and taking actions consistent with section 602 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-1">42 U.S.C. 2000d–1</external-xref>).</text></paragraph><paragraph id="HAB7EA4EA308746D58986ADF2C5B64F6E"><enum>(3)</enum><header>Judicial review</header><text>Judicial review of an action taken by the Assistant Secretary under paragraph (2) shall be available to the extent provided in section 603 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d-2">42 U.S.C. 2000d–2</external-xref>).</text></paragraph></subsection><subsection id="H86465439C6CC4EF6920179E63F8C6030"><enum>(b)</enum><header>Technological neutrality</header><text>The Assistant Secretary shall, to the extent practicable, carry out this Act in a technologically neutral manner.</text></subsection><subsection id="H2DC6FCA73D5849F882B6B22DC044BB18"><enum>(c)</enum><header>Audit and oversight</header><text>Beginning in the first fiscal year in which amounts are made available to carry out an activity authorized under this Act, and in each of the 4 fiscal years thereafter, there is authorized to be appropriated to the Office of Inspector General for the Department of Commerce $1,000,000 for audits and oversight of funds made available to carry out this Act, which shall remain available until expended.</text></subsection></section></legis-body></bill>
