which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to ensure that the time during which members of the Armed Forces serve on active duty for training qualifies for educational assistance under the Post-9/11 Educational Assistance Program of the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H28A123A91E4343D6882A5EE546093DB7" style="OLC"><section id="H80386185F4A1489D9155F21D55639D7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guard and Reserve GI Bill Parity Act of 2021</short-title></quote>.</text></section><section id="H325AFE4847EA4D44A255F9541FEE7904" section-type="subsequent-section"><enum>2.</enum><header>Addition of other duty statuses to qualify for Post-9/11 Educational Assistance Program</header><subsection id="HCD0468F0D49F4EB597F84EFBDF72BF9C"><enum>(a)</enum><header>Qualifying duty</header><text display-inline="yes-display-inline">Section 3311(b) of title 38, United States Code, is amended—</text><paragraph id="H386AA7CBB35041F3A25F270494A3FFA9"><enum>(1)</enum><text>by striking <quote>(including</quote> each place it appears and inserting <quote>(including other qualifying duty and</quote>;</text></paragraph><paragraph id="H307172DCA7844987AFAFC4F475FF1319"><enum>(2)</enum><text>by striking <quote>(excluding</quote> each place it appears and inserting <quote>(including other qualifying duty but excluding</quote>; and</text></paragraph><paragraph id="H38CD4E3D3D1942499FB5CFE5CA244650"><enum>(3)</enum><text>in paragraph (2)(A), by inserting <quote>or other qualifying duty</quote> after <quote>active duty</quote>.</text></paragraph></subsection><subsection id="HFA66A08C34534EED9905B3AA5DF9BEC5"><enum>(b)</enum><header>Other qualifying duty defined</header><text display-inline="yes-display-inline">Section 3301 of such title is amended—</text><paragraph id="H69694DACAE0D48D5AD38E129BF5D4DE7"><enum>(1)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></paragraph><paragraph id="H36B8E25840814BBF9BA28C023EB4F5AD"><enum>(2)</enum><text>by inserting after paragraph (2) the following new paragraph (3):</text><quoted-block style="USC" id="H8333F98108AA4C389F8ABDCCB6BB9E54" display-inline="no-display-inline"><paragraph id="H6298EDC699F3488A9AA207CDD5BF1E92"><enum>(3)</enum><text>The term <term>other qualifying duty</term> means the following:</text><subparagraph id="H68D737EB73324D8F8BC5F8AA7187EB31"><enum>(A)</enum><text>Duty under section 502 of title 32.</text></subparagraph><subparagraph id="H3B11EE1F657549E2A429D3B491DD40C9"><enum>(B)</enum><text>Duty for which a member is eligible to receive pay under section 204, 206, or 372 of title 37.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF15DDDBF476745F6B26A2EB9CB5009E4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on August 1, 2022, and shall apply with respect to—</text><paragraph id="HF378D157F1814595B40A13E1917AB85A"><enum>(1)</enum><text>academic years beginning on or after August 1, 2022; and</text></paragraph><paragraph id="HBB2432078EFE4300BCC4BA261109A5D8"><enum>(2)</enum><text>service performed before, on, or after the date of the enactment of this Act. </text></paragraph></subsection></section><section id="H44EB8C97E78542E6ADC3658C00008094" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Simplification of eligibility criteria for Department of Veterans Affairs Post-9/11 Educational Assistance</header><subsection id="H7F52DAFC71824E5C82E5070EAA4C35E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 3301 of title 38, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4D4BF8D1B493475E979DF15D37385394" style="OLC"><paragraph id="HE7DB4AFB3B004932B56AAC8A347B1693"><enum>(1)</enum><text>The term <term>active duty</term> has the meanings as follows (subject to the limitations specified in sections 3002(6) and 3311(b)):</text><subparagraph id="HC16A28D8389D41399EC82698BF656B85"><enum>(A)</enum><text>Active duty as described in section 101(21)(A) of this title.</text></subparagraph><subparagraph id="H1B5010970B6B4C688E6D7E9D9AEC0410" commented="no"><enum>(B)</enum><text>Active duty for training as described in section 101(22)(A), (C), and (E) of this title.</text></subparagraph><subparagraph id="HB41F6B9D878843638F9E950DE6DD8559"><enum>(C)</enum><text>Active duty as defined in section 101(12) of title 32.</text></subparagraph><subparagraph id="H87670B023542493BA872CB00F3424B32"><enum>(D)</enum><text>Full-time National Guard duty as defined in section 101(19) of title 32.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2799D58FD88E4D5D85D3CDFB0DAC7E4D"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on August 1, 2022, and shall apply with respect to—</text><paragraph id="H281FB75D1A0A49378726C54A5109561C"><enum>(1)</enum><text>academic years beginning on or after August 1, 2022; and</text></paragraph><paragraph id="HC3DD18ECD49A4AA0854EC622CA6BC0C1"><enum>(2)</enum><text>service performed before, on, or after the date of the enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
