R. 1804</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210311">March 11, 2021</action-date><action-desc><sponsor name-id="C001103">Mr. Carter of Georgia</sponsor> (for himself and <cosponsor name-id="B001303">Ms. Blunt Rochester</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the public participation requirements of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, and for other purposes.</official-title></form><legis-body id="H054EF68955284BC5B5DDD26F0D9AE0D3" style="OLC"><section id="H96347C53A51647FC8345710A7ED1A7F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Cleanup Act</short-title></quote>.</text></section><section id="HFB91ACDFB27948599904BE37ABF780B6"><enum>2.</enum><header>Public participation</header><subsection id="HFF88C68A184C407DA3DBD7911ECF26CE"><enum>(a)</enum><header>Proposed plan</header><text>Section 117(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9617">42 U.S.C. 9617(a)</external-xref>) is amended—</text><paragraph id="HE83DB66670E64246857FA5729E98DA75"><enum>(1)</enum><text>in paragraph (1), by striking <quote>.</quote> at the end and inserting <quote>, including the highest ranking official of the local government with jurisdiction over the facility subject to the plan.</quote>; and</text></paragraph><paragraph id="H265DEFDFAC2949688F779A4BE141BBC0"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>(including comments regarding use of the facility at issue after remedial action is taken)</quote> after <quote>written and oral comments</quote>.</text></paragraph></subsection><subsection id="HCE2C9FCB8136475BB64218036937ACAC"><enum>(b)</enum><header>Final plan</header><text>Section 117(b) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9617">42 U.S.C. 9617(b)</external-xref>) is amended by inserting <quote>, and transmitted to all local, elected officials with jurisdiction over the facility subject to the plan,</quote> after <quote>available to the public</quote>.</text></subsection><subsection id="H6CFF96322FF0408DB1D4A2F66084AB26"><enum>(c)</enum><header>Publication</header><text>Section 117(d) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9617">42 U.S.C. 9617(d)</external-xref>) is amended—</text><paragraph id="H10B5A6090C744E4DAF8A1D056B21767E"><enum>(1)</enum><text>by inserting <quote>and require</quote> after <quote>publication shall include</quote>; and</text></paragraph><paragraph id="H57AE4DFF3CB84422A68586D0E680B179"><enum>(2)</enum><text>by striking <quote>general circulation.</quote> and inserting <quote>general circulation (if available), announcement sent to a radio station, or television station, the broadcast area of which includes the community surrounding the facility at issue, relevant and appropriate digital or social media publications, and posting to the website of the President, State, or other person who, as appropriate, is proposing to adopt a plan for remediation under section 104, 106, 120, or 122.</quote>.</text></paragraph></subsection></section></legis-body></bill>
