Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make the Commonwealth of the Northern Mariana Islands eligible for the program of block grants to States for temporary assistance for needy families, and for other purposes.</official-title></form><legis-body id="H8BC78C3944904E88ADEF21C58F9DEDBF" style="OLC"><section id="H2701800223EC4685BF650436A0F232FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northern Marianas Family Assistance Act</short-title></quote>.</text></section><section id="H84D062E689F942DD9293705E146E9ADD"><enum>2.</enum><header>Eligibility of the Commonwealth of the Northern Mariana Islands for the TANF program</header><subsection id="HB02D9B1B0E11427DBE889B798A6A6DC8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 419(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/619">42 U.S.C. 619(5)</external-xref>) is amended by striking <quote>and American Samoa</quote> and inserting <quote>American Samoa, and the Commonwealth of the Northern Mariana Islands</quote>.</text></subsection><subsection id="HE7AC4D30DC8A4CF4872D97846553F89E"><enum>(b)</enum><header>Family assistance grant</header><paragraph id="H0A8A3A0892314257BC4248F8B75E4299"><enum>(1)</enum><header>In general</header><text>Section 403(a)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(1)(B)</external-xref>) is amended—</text><subparagraph id="H01F5633F063944BE8BD6AA6972A29325"><enum>(A)</enum><text>by striking <quote>specified in</quote> and inserting <quote>in effect for purposes of</quote>; and</text></subparagraph><subparagraph id="H80BE689029714620B1E8932BE13584B5"><enum>(B)</enum><text>by adding at the end the following: <quote>Notwithstanding the preceding sentence, the State family assistance grant for the Commonwealth of the Northern Mariana Islands for each fiscal year shall be the lesser of the amount that equals 80 percent of the total expenditures of the Commonwealth under the Commonwealth program funded under this part in the fiscal year, or the mandatory ceiling amount (as defined in section 1108) with respect to Guam.</quote>.</text></subparagraph></paragraph><paragraph id="HF7B2649A8E884068A766196BB9CF1374"><enum>(2)</enum><header>Appropriation</header><text display-inline="yes-display-inline">Section 403(a)(1)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(a)(1)(C)</external-xref>) is amended by adding at the end the following: <quote>The dollar amount in effect under this subparagraph for a fiscal year shall be the amount specified in the preceding sentence increased by the mandatory ceiling amount (as defined in section 1108) with respect to Guam, and an amount equal to that increase shall be reserved for a grant under this paragraph to the Commonwealth of the Northern Mariana Islands.</quote>.</text></paragraph></subsection><subsection id="H5A9A79854B804B2B85B6BD2FE2D3AC02"><enum>(c)</enum><header>Eligibility for the Contingency Fund</header><paragraph id="HCE069301661B4A81814F94CC51BCD745"><enum>(1)</enum><header>In general</header><text>Effective on October 1 of the 5th fiscal year immediately following the 1st fiscal year referred to in subsection (g):</text><subparagraph id="H858996664D8B475B8D9DEB2141FC5DCC"><enum>(A)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Section 403(b)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(b)(7)</external-xref>) is amended by striking <quote>States and the District of Columbia</quote> and inserting <quote>States, the District of Columbia, and the Commonwealth of the Northern Mariana Islands</quote>.</text></subparagraph><subparagraph id="HA7C5455EBE2F409DB7AFD487F6D35887"><enum>(B)</enum><header>Exclusion from limitation on payments to the territories</header><text>Section 1108(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(a)(2)</external-xref>) is amended by inserting <quote>, or any payment made to the Commonwealth of the Northern Mariana Islands under section 403(b)</quote> before the period.</text></subparagraph></paragraph><paragraph id="H10B6CFF27EDF437E98F06ED4D6ED9308"><enum>(2)</enum><header>Development of needy State criteria</header><text display-inline="yes-display-inline">As soon as is practicable but not later than the date paragraph (1) of this subsection takes effect, the Secretary of Health and Human Services shall work with the Government of the Commonwealth of the Northern Mariana Islands to develop the criteria to be used in determining whether, on or after such date, the Commonwealth is a needy State for purposes of section 403(b) of the Social Security Act, which shall not include the criteria used by the Bureau of Labor Statistics in determining unemployment or the caseload criteria used in the Supplemental Nutrition Assistance Program.</text></paragraph></subsection><subsection id="H43D33B5D7D154734AAB65DD20A03DDCD"><enum>(d)</enum><header>Inapplicability of certain requirements and prohibition</header><paragraph id="HFD88DB303FF14A66B3915C7056C17527"><enum>(1)</enum><header>State plan requirements relating to operation of child support enforcement and foster care and adoption assistance programs</header><text display-inline="yes-display-inline">Section 402(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)</external-xref>) is amended in each of paragraphs (2) and (3) by adding at the end the following: <quote>The preceding sentence shall not apply with respect to the Commonwealth of the Northern Mariana Islands.</quote>.</text></paragraph><paragraph id="HAD78FF56DA01453EA54F0FFCB0E34992"><enum>(2)</enum><header>Mandatory work requirements</header><text display-inline="yes-display-inline">Sections 407 and 409(a)(3) of such Act shall not apply to the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="HB4784DE0A514405AA4BF796FAAA070D9"><enum>(3)</enum><header>Ban on assistance for families not assigning certain support rights to the State</header><text display-inline="yes-display-inline">Section 408(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(3)</external-xref>) is amended by adding at the end the following: <quote>The preceding sentence shall not apply with respect to the Commonwealth of the Northern Mariana Islands.</quote>.</text></paragraph><paragraph id="H322ACB9F896E4CE3865E2FC3A0057583"><enum>(4)</enum><header>Maintenance of effort requirement</header><text display-inline="yes-display-inline">Section 409(a)(7) of such Act shall not apply to the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection><subsection id="H36AA2F41B37C4D36A6867B2D064FCC61"><enum>(e)</enum><header>Assessment of work, employment, and training program</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall seek to negotiate an agreement with the Commonwealth of the Northern Mariana Islands under which the performance of the work, employment, and training program of the Commonwealth will be assessed.</text></subsection><subsection id="H5BCC4316CBFF4197984A9B1EE015B193"><enum>(f)</enum><header>Transition provisions</header><text display-inline="yes-display-inline">With respect to each of the 4 fiscal years immediately following the 1st fiscal year referred to in subsection (g) of this section:</text><paragraph id="HA2B340DB78094DB6B27CE05C6331F988"><enum>(1)</enum><header>Exemption from limitation on use of grant for administrative expenditures</header><text>Section 404(b) of the Social Security Act shall not apply to the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="HE6F186B4C3FB47BBA762C4B42D3F3890"><enum>(2)</enum><header>Inapplicability of penalty for failure of state receiving amounts from contingency fund to maintain <enum-in-header>100</enum-in-header> percent of historic effort</header><text display-inline="yes-display-inline">Section 409(a)(10) of such Act shall not apply to the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection><subsection id="HC0942316F8724BE48F1835D1E975C58F"><enum>(g)</enum><header>Technical assistance</header><text>Not later than October 1 of the 1st fiscal year that begins after the date of the enactment of this Act, the Secretary of Health and Human Services shall provide the Commonwealth of the Northern Mariana Islands with technical assistance in developing a plan to meet the requirements of section 402 of the Social Security Act.</text></subsection><subsection id="H2ECBF454AF3144C0BD10E9981EEF964D"><enum>(h)</enum><header>Effective date</header><text display-inline="yes-display-inline">Except as provided in subsection (c), the amendments made by this section shall take effect on October 1 of the 2nd fiscal year that begins after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
