which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Surface Mining Control and Reclamation Act of 1977 to allow the Secretary of the Interior to delegate certain emergency reclamation activities to the States and Tribes, and for other purposes.</official-title></form><legis-body id="H9841A79D7F7E4FBF95FD7E9D8CB69849" style="OLC"><section id="H2A58BD82197941AA830F36C031B22536" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surface Mining Control and Reclamation Act Amendments of 2021</short-title></quote>.</text></section><section id="H8ECED26223584D84AF8335C825671397"><enum>2.</enum><header>Abandoned Mine Land Reclamation Fund</header><text display-inline="no-display-inline">Section 401(f)(2) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231(f)(2)</external-xref>) is amended—</text><paragraph id="HDD60CA7C061C465884207A4B9D460F9A"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H6907B03D34D24E818351A5A194D7850E"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">2022</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">2037</header-in-text></quote>; and</text></subparagraph><subparagraph id="HB709493B78B547BDB1BB8CAE1029A619"><enum>(B)</enum><text>by striking <quote>2022</quote> and substituting <quote>2037</quote>; and</text></subparagraph></paragraph><paragraph id="H6DC9555CBC7C4758B2C5D8D88B00ED7C"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H3473FC07CD6E476A9E58BD50F6B5E7C4"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">2023</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">2038</header-in-text></quote>;</text></subparagraph><subparagraph id="HA313938FBECB47CBAAD3E35BBB434BA2"><enum>(B)</enum><text>by striking <quote>2023</quote> and substituting <quote>2038</quote>; and</text></subparagraph><subparagraph id="H8C9C13F26E9B44F59305C08E5F247EE8"><enum>(C)</enum><text>by striking <quote>2022</quote> and inserting <quote>2037</quote>.</text></subparagraph></paragraph></section><section id="H828A08B4B9384872BE4414FCDB8198DB"><enum>3.</enum><header>Emergency Powers</header><subsection id="H9F57AF6DEBAE4132BEFA8E9A82800E65"><enum>(a)</enum><header>State reclamation program</header><text display-inline="yes-display-inline">Section 405(d) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1235">30 U.S.C. 1235(d)</external-xref>) is amended by striking <quote>sections 402 and 410 excepted</quote> and inserting <quote>section 402 excepted</quote>.</text></subsection><subsection id="H5463619910964961B22D415D6274A948"><enum>(b)</enum><header>Delegation</header><text display-inline="yes-display-inline">Section 410 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1240">30 U.S.C. 1240</external-xref>) is amended—</text><paragraph id="H015A42756F0643808FDD0204341DE19F"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, including through reimbursement to a State or Tribal Government described in subsection (c),</quote> after <quote>moneys</quote>; and</text></paragraph><paragraph id="H4073EA7260854250B85AA040BD93669E"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0A385646B7E0471287DAB457936A168A" style="OLC"><subsection id="HDBD281D27B3A4BB4AF26309A612125BE"><enum>(c)</enum><header>State or Tribal Government</header><text display-inline="yes-display-inline">A State or Tribal Government is eligible to receive reimbursement from the Secretary under subsection (a) if such State or Tribal Government has submitted, and the Secretary has approved, an Abandoned Mine Land Emergency Program as part of an approved State or Tribal Reclamation Plan under section 405.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H5A49FE7490C549348A4E14BAD7BD14A0"><enum>4.</enum><header>Reclamation fee</header><subsection id="H0D100BB5CCCA4AEDB4618D1F51BB03BA"><enum>(a)</enum><header>Duration</header><text>Effective 90 days after the date of enactment of this Act, section 402(b) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(b)</external-xref>) is amended by striking <quote>September 30, 2021</quote> and inserting <quote>September 30, 2036</quote>.</text></subsection><subsection id="H701F93D1519B4F07A794500A65560352"><enum>(b)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">Effective September 30, 2021, section 402(g) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(g)</external-xref>) is amended—</text><paragraph id="H7F15DBCE571E4C01B405A9C33C57F144"><enum>(1)</enum><text>in paragraph (6)(A), by striking <quote>paragraphs (1) and (5)</quote> and inserting <quote>paragraphs (1), (5), and (8)</quote>;</text></paragraph><paragraph id="H4E8394C8E38D4B3DB0E9D935C2A41BF5"><enum>(2)</enum><text>in paragraph (8)(A), by striking <quote>$3,000,000</quote> and inserting <quote>$5,000,000</quote>; and</text></paragraph><paragraph id="HC818D21135A945D7932424AD158306C9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H4AA8091F553E4984A556B10E925D3B33" style="OLC"><paragraph id="H79A065F3E88A4D5694055F4A67063475"><enum>(9)</enum><text display-inline="yes-display-inline">From amounts withheld pursuant to the Budget Control Act of 2011 from payments to States and Indian Tribes under this subsection and section 411(h) of the Surface Mining Control and Reclamation Act during fiscal years 2013 through 2021, the Secretary shall distribute for fiscal year 2022 an amount to each State and Indian Tribe equal to the total amount withheld.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H203A17447DFA4308AB4A68DEBA99032C"><enum>5.</enum><header>Exempt programs and activities</header><text display-inline="no-display-inline">Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by adding at the end the following: <quote>Payments to States and Indian Tribes from the Abandoned Mine Reclamation Fund and payments to States and Indian Tribes under section 402(i)(2) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(i)(2)</external-xref>).</quote>. </text></section></legis-body></bill>
