which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Federal Communications Commission to study the current and projected demands on rural broadband networks associated with services offered by edge providers, and for other purposes.</official-title></form><legis-body id="H1CC82AE237184A4A969B7596386305C3" style="OLC"><section section-type="section-one" id="H127A1324E2A847DFA697F0CE725EF820"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H68832B338C914590A8AC4EC1DDAB7421"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="H7017D23EE08444A79A9E34062AA3C31A"><enum>(2)</enum><header>Edge provider</header><text>The term <term>edge provider</term>—</text><subparagraph id="H6FDFFCF6CD8E4487A3E886D005842B8D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">means an entity that provides (through, but as a separate product from, the broadband internet service of a user) a service or content—</text><clause id="HD5CF5845A4934035AD173280A7A035DC" commented="no"><enum>(i)</enum><text>for which the entity requires the user to subscribe or establish an account in order to use the service;</text></clause><clause id="H8AE3EAA45CE048B0B307A013DF6060A0" commented="no"><enum>(ii)</enum><text>through which the user purchases, downloads, or accesses content, applications, or services from the entity without a subscription or account;</text></clause><clause id="HA5168229D57640B982A92326D5D531F2" commented="no"><enum>(iii)</enum><text>by which a program searches for and identifies items in a database that correspond to keywords or characters specified by the user, used especially for finding particular sites on the World Wide Web; or</text></clause><clause id="HDED2E178E98742DA99E7FB015A55F532" commented="no"><enum>(iv)</enum><text>by which the user divulges sensitive information of the user; </text></clause></subparagraph><subparagraph id="H40E8E7DA066E4B0C99EB31A83513095C"><enum>(B)</enum><text>includes an entity that provides a service described in subparagraph (A) through a software program, including a mobile application; and</text></subparagraph><subparagraph id="HA7BF249992584C9FBD3060DE2133C298"><enum>(C)</enum><text>does not include an entity that solely provides broadband internet service. </text></subparagraph></paragraph><paragraph id="H1D5369562DC04CBF95F56852A20A852C" commented="no"><enum>(3)</enum><header>Edge provider data</header><text display-inline="yes-display-inline">The term <term>edge provider data</term> means data associated with services or content offered by edge providers.</text></paragraph><paragraph id="H9E819889725D4D2A90DE889B050FB27A"><enum>(4)</enum><header>High-cost rural area</header><text>The term <term>high-cost rural area</term> means an area of the United States that—</text><subparagraph id="H7FD46D68AD0046759D518E6D81F3EE75"><enum>(A)</enum><text>is not contained within an incorporated city or town; and</text></subparagraph><subparagraph id="HB3ED38A91119481AA444B6437F1C5B5F"><enum>(B)</enum><text>has a population of fewer than 20,000 inhabitants.</text></subparagraph></paragraph><paragraph id="H8C4CEEB36D9D4AA1AC2B40C66A00B611"><enum>(5)</enum><header>Qualifying broadband service</header><text>The term <term>qualifying broadband service</term> means broad­band internet service with measurable speeds of not less than the speeds required for the Commission to determine the service is advanced telecommunications capability, as that term is defined in section 706(d) of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302(d)</external-xref>).</text></paragraph><paragraph id="HF770F38C2E144EE4BC1DB631F5720073" commented="no"><enum>(6)</enum><header>Rural broadband network</header><text>The term <term>rural broadband network</term> means the plant, equipment, components, facilities, hardware, and software used by a rural broadband provider to provide qualifying broadband service in a high-cost rural area.</text></paragraph><paragraph id="H8C260995B0C84CDBBB6CEEA53E43C921"><enum>(7)</enum><header>Rural broadband provider</header><text>The term <term>rural broadband provider</term> means an entity that—</text><subparagraph id="H4D3D6BF211304D118CEEA828FB4A3D80"><enum>(A)</enum><text>provides qualifying broadband service in a high-cost rural area using any technology, including a fixed or mobile wireless or wireline network; and</text></subparagraph><subparagraph id="HC230F25941184CAF829DCB32B009B78C" commented="no"><enum>(B)</enum><text>provides qualifying broadband service to fewer than 250,000 customers.</text></subparagraph></paragraph></section><section id="H2DF3BC6FA976447AB9212F73A4809DFF"><enum>2.</enum><header>Rural broadband network advancement study</header><subsection id="H8C7ADAC7E87E4AE1BF671486B82AE256"><enum>(a)</enum><header>Proceeding by FCC</header><paragraph id="HCC7576C320C547288A8C6BF070EA1AE0"><enum>(1)</enum><header>In general</header><subparagraph id="H2512F5521E464AD495187B1E3920A278"><enum>(A)</enum><header>Initiation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission shall initiate a proceeding to analyze the demands that have been or will be placed on rural broadband networks during the covered period that are associated with edge provider data transmitted over such networks, including internet browsing data and data associated with video streaming services. </text></subparagraph><subparagraph id="H32BA92972B38409990E83737E7D566D8"><enum>(B)</enum><header>Conclusion</header><text>Not later than 1 year after initiating the proceeding under subparagraph (A), the Commission shall conclude the proceeding.</text></subparagraph></paragraph><paragraph id="H8358C4D21BEC41F881BD3A94EA1CCB95"><enum>(2)</enum><header>Matters for analysis</header><text>The analysis conducted under paragraph (1) shall include the following:</text><subparagraph id="HB9FDE47D89C64855AB5C98D8302FD565"><enum>(A)</enum><header>Estimation of edge provider data</header><text>An estimation of the quantity of edge provider data that has been or will be transmitted over rural broadband networks during the covered period.</text></subparagraph><subparagraph id="HF997AA517F0645A286F04C4C901579D8"><enum>(B)</enum><header>Calculation of costs</header><text display-inline="yes-display-inline">A calculation of the costs to rural broadband providers during the covered period associated with transmission by such providers of edge provider data over the rural broadband network that are not already recovered through—</text><clause id="HABA0E081A3CB476695E44D56AD126208"><enum>(i)</enum><text>user rates that are reasonably comparable to user rates in urban areas; or</text></clause><clause id="H59622701836E4F96984BC52E0CBBA8EA"><enum>(ii)</enum><text>Federal programs aimed at promoting rural broadband deployment or sustaining rural broadband networks, including Federal universal service support programs established under section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="HDE245A99AEBB43AC850BF928E8337911"><enum>(3)</enum><header>Costs described</header><text>The categories of costs to be calculated under paragraph (2)(B) shall include costs associated with—</text><subparagraph id="HBB52F272DA704C95B85639F3AC87CDCF"><enum>(A)</enum><text>the initial deployment of rural broad­band networks;</text></subparagraph><subparagraph id="H884204E022E240C4895AF92CF1192B6A"><enum>(B)</enum><text display-inline="yes-display-inline">the operation and maintenance of rural broadband networks; and</text></subparagraph><subparagraph id="H8EE168D71B49409AA992F4E9FC2E8EA9"><enum>(C)</enum><text display-inline="yes-display-inline">the delivery of services to users over rural broadband networks, including the transmission of data between high-cost rural areas and urban or suburban interconnection points.</text></subparagraph></paragraph><paragraph id="HAF2C3E9195C6435E9595617D622BAF29" commented="no"><enum>(4)</enum><header>Provision of information</header><subparagraph id="HB153EAA3E3EE435DBCA019FC0382E8E1" commented="no"><enum>(A)</enum><header>Use of data</header><text display-inline="yes-display-inline">To analyze the demands described under paragraph (1), the Commission shall—</text><clause id="H8E7AA9B368D64A87A38571AAEF65A949" commented="no"><enum>(i)</enum><text>use any existing commercial or government data or estimate concerning the covered time period; and</text></clause><clause id="H41DCF84F88DB45EDAB15FC9EC72A3142" commented="no"><enum>(ii)</enum><text>collect data concerning the covered time period from edge providers or rural broadband providers.</text></clause></subparagraph><subparagraph id="H33B427F669194AE78677D0BCF3187447" commented="no"><enum>(B)</enum><header>Requirement to submit information</header><text>In any case in which the Commission determines that it is necessary to collect data under subparagraph (A)(ii) from an edge provider or a rural broadband provider, such edge provider or rural broadband provider shall provide any information necessary for the Commission to complete the proceeding under paragraph (1). </text></subparagraph></paragraph><paragraph id="HB94D23A82ABE44FF939FA0D73F9C4055"><enum>(5)</enum><header>Covered period defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered period</term> means the 6-year period that—</text><subparagraph id="H11814A1865A246049663F26AAD3134FA"><enum>(A)</enum><text>begins on the date that is 3 years before the date on which the proceeding under paragraph (1) is initiated; and </text></subparagraph><subparagraph id="HE70E8B714A4E4C3E8E22B82A2D31E099"><enum>(B)</enum><text>ends on the date that is 3 years after the date on which the proceeding is initiated. </text></subparagraph></paragraph></subsection><subsection id="HC2A8F5469C2D4E97935F2C5292305AD2" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 120 days after concluding the proceeding under subsection (a)(1), the Commission shall publish on its website and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the findings of the proceeding.</text></subsection></section></legis-body></bill>
