which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reimburse the States for border security expenses, and for other purposes.</official-title></form><legis-body id="H9C8E4495EA954420ADB2CAFFA06DC7E2" style="OLC"><section id="H4FA000E10919415DBB0DB7FF36AF6781" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Border Security Reimbursement Act of 2021</short-title></quote>.</text></section><section id="H7E2A98BEDEA3452DB85887F48634C7FA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HD99F7F15C97A4952B73DE849F46E0668"><enum>(1)</enum><text display-inline="yes-display-inline">Border security is primarily a Federal responsibility.</text></paragraph><paragraph id="HC05DF2955DAF4CF7A500120A24CE1CA7"><enum>(2)</enum><text>Due to failures of the Federal Government, the State of Texas has been forced to provide resources for border security.</text></paragraph><paragraph id="HE96B4A1C5F5041DE86B40FC9DA4AFC5B"><enum>(3)</enum><text>Since the 2008–2009 biennium budget, Texas has allocated more than $3,208,000,000 for border security in Texas’ biennium budget disaggregated, as follows:</text><subparagraph id="H51D1FEAF93BF4A0189FDEA1E7D8F2855"><enum>(A)</enum><text>In 2008–2009, Texas allocated more than $110,000,000 for border security.</text></subparagraph><subparagraph id="H722DE4287E3E4697AC5DE1307A383689"><enum>(B)</enum><text>In 2010–2011, Texas allocated more than $120,000,000 for border security.</text></subparagraph><subparagraph id="H80B458D646FF40B5A9E0BA969DEF53A6"><enum>(C)</enum><text>In 2012–2013, Texas allocated more than $222,100,000 for border security.</text></subparagraph><subparagraph id="H63067CC0FE204A24BE20B351BF1E4E8C"><enum>(D)</enum><text>In 2014–2015, Texas allocated more than $510,000,000 for border security.</text></subparagraph><subparagraph id="HC421C4E52A8645CA95F2CD13DAA91898"><enum>(E)</enum><text>In 2016–2017, Texas allocated more than $800,000,000 for border security.</text></subparagraph><subparagraph id="H9BADCC0A2D4141969960283628016C7D"><enum>(F)</enum><text>In 2018–2019, Texas allocated more than $663,100,000 for border security. </text></subparagraph><subparagraph id="HB34C6ACD95634E76A25BFF9E12CF9410"><enum>(G)</enum><text>In 2020–2021, Texas allocated more than $782,800,000 for border security.</text></subparagraph><subparagraph id="H8B6BAD2A47674F22B65A7A3D7A5D4CF6"><enum>(H)</enum><text>For 2022–2023, the State of Texas Legislative Budget Board is currently recommending an additional $797,100,000 for border security.</text></subparagraph></paragraph><paragraph id="HFE371DFF926B45E8B6EEBA0F0B9A0CF5"><enum>(4)</enum><text>Citizens of border States are being taxed twice for the same purpose.</text></paragraph><paragraph id="HA7D69956D2CA49178585A6460E79DB79"><enum>(5)</enum><text>States using their taxpayer dollars and allocating State budgets to meet public safety obligations, which fall under Federal responsibilities, imposes an undue burden on the State.</text></paragraph></section><section id="HBBDE299D35314B7FB0C7F25C070612CD"><enum>3.</enum><header>Reimbursement</header><subsection id="H3954184EF69F4BDE9748F8B3B9A0DBC5"><enum>(a)</enum><header>Qualification</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, States that have expended more than $2,500,000,000 on border security and enforcement in support of Federal efforts in the ten years prior to the date of the enactment of this Act shall have all associated expenses reimbursed.</text></subsection><subsection id="H9F2BF4430B544CC7984D8A0446BE53C6"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Governors of eligible States shall submit—</text><paragraph id="H8530923A7C134C0BBC32C31EFFB36EA8"><enum>(1)</enum><text>an accounting of all non-federally funded border security expenses incurred by the State and its municipalities; and</text></paragraph><paragraph id="HFCC521F08494478092B1A13D0D104DA1"><enum>(2)</enum><text>the total sum of such expenses.</text></paragraph></subsection><subsection id="H21EFEE90F86B466B8299C7E5694BF4C7"><enum>(c)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the State submits the application pursuant to subsection (b), the Federal Government shall reimburse such expenses pursuant to subsection (a). </text></subsection></section></legis-body></bill>
