R. 1625</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="C001087">Mr. Crawford</sponsor> (for himself, <cosponsor name-id="T000463">Mr. Turner</cosponsor>, <cosponsor name-id="W000815">Mr. Wenstrup</cosponsor>, <cosponsor name-id="S001192">Mr. Stewart</cosponsor>, <cosponsor name-id="S001196">Ms. Stefanik</cosponsor>, <cosponsor name-id="A000372">Mr. Allen</cosponsor>, <cosponsor name-id="K000388">Mr. Kelly of Mississippi</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, <cosponsor name-id="B001307">Mr. Baird</cosponsor>, <cosponsor name-id="J000020">Mr. Jacobs of New York</cosponsor>, and <cosponsor name-id="B001306">Mr. Balderson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Permanent Select Committee on <committee-name committee-id="HIG00">Intelligence</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Office of Intelligence in the Department of Agriculture, and for other purposes.</official-title></form><legis-body id="H2FDE3F979CC74F09AE83983611C8615F" style="OLC"><section section-type="section-one" id="H2EF17516F73846E580754E2B12127313"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Intelligence Measures Act</short-title></quote> or the <quote><short-title>AIM Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6102976075CB492D9D8FFC888875F10A"><enum>2.</enum><header>Establishment of Office of Intelligence in Department of Agriculture</header><subsection id="H96FC32AF7B2D48869BB47A8E586217F7"><enum>(a)</enum><header>Establishment</header><paragraph id="H3C637A53A4F44A2683864F229B81F4A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6912">7 U.S.C. 6912</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H27E53C57C9B24144AFA19C0C5C68056F"><section id="H93DFEE300AA24899B5B971DDA6DDE45E"><enum>224B.</enum><header>Office of Intelligence</header><subsection id="H3645765F39BA4DD5B3021E411F1C8119"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Department an Office of Intelligence. The Office shall be under the National Intelligence Program.</text></subsection><subsection id="H51D405AED12640309E343BD1476D9554"><enum>(b)</enum><header>Director</header><paragraph id="H92C3B7B14A6941899F0B44ECEBED1865"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Office shall be headed by the Director of the Office of Intelligence, who shall be an employee in the Senior Executive Service and who shall be appointed by the Secretary. The Director shall report directly to the Secretary.</text></paragraph><paragraph id="H1413BC18DD6245D7B85ADF06FC46EFCD"><enum>(2)</enum><header>Qualifications</header><text display-inline="yes-display-inline">The Secretary shall select an individual to serve as the Director from among individuals who have significant experience serving in the intelligence community.</text></paragraph><paragraph id="HE4D1522621654E6FA52ADF006E58AAFC"><enum>(3)</enum><header>Staff</header><text display-inline="yes-display-inline">The Director may appoint and fix the compensation of such staff as the Director considers appropriate, except that the Director may not appoint more than 5 full-time equivalent positions at an annual rate of pay equal to or greater than the maximum rate of basic pay for GS–15 of the General Schedule.</text></paragraph><paragraph id="H4A29267346AC4655A5EF26F680994716"><enum>(4)</enum><header>Detail of personnel of intelligence community</header><text>Upon the request of the Director, the head of an element of the intelligence community may detail any of the personnel of such element to assist the Office in carrying out its duties. Any personnel detailed to assist the Office shall not be taken into account in determining the number of full-time equivalent positions of the Office under paragraph (3).</text></paragraph></subsection><subsection id="H7C20B52FBFED4E4E94ED656CC3D45E64"><enum>(c)</enum><header>Duties</header><text>The Office shall carry out the following duties:</text><paragraph id="HE4625593B146493E933FE9AB2A66CE32"><enum>(1)</enum><text display-inline="yes-display-inline">The Office shall be responsible for leveraging the capabilities of the intelligence community and National Laboratories intelligence-related research, to ensure that the Secretary is fully informed of threats by foreign actors to United States agriculture.</text></paragraph><paragraph id="H76B5680060394F0AA35F509C3B412F61"><enum>(2)</enum><text>The Office shall focus on understanding foreign efforts to—</text><subparagraph id="HCB605AD2D69C42E69018E4880D737611"><enum>(A)</enum><text>steal United States agriculture knowledge and technology; and</text></subparagraph><subparagraph id="H9082AFACB02C4ADF97C512B2E532906E"><enum>(B)</enum><text>develop or implement biological warfare attacks, cyber or clandestine operations, or other means of sabotaging and disrupting United States agriculture.</text></subparagraph></paragraph><paragraph id="H70D37D20FF354B55959B8B3B09928122"><enum>(3)</enum><text>The Office shall prepare, conduct, and facilitate intelligence briefings for the Secretary and appropriate officials of the Department.</text></paragraph><paragraph id="H6271E8EDAF6D4446B48533DCCFE1D430"><enum>(4)</enum><text>The Office shall operate as the liaison between the Secretary and the intelligence community, with the authority to request intelligence collection and analysis on matters related to United States agriculture.</text></paragraph><paragraph id="HDABD7902479A403E90F1E60FACDB484C"><enum>(5)</enum><text>The Office shall collaborate with the intelligence community to downgrade intelligence assessments for broader dissemination within the Department.</text></paragraph><paragraph id="H03187E994D10480DA23B6D00197BAD86"><enum>(6)</enum><text>The Office shall facilitate sharing information on foreign activities related to agriculture, as acquired by the Department with the intelligence community.</text></paragraph></subsection><subsection id="H5B95D62E2EB249658F63C75B941DC99E"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Office $970,000 for fiscal year 2021.</text></subsection><subsection id="H00948DD814724C8B9AD8317629257059"><enum>(e)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H7FCB4B9BA33C438B8E718C36C9269BD6"><enum>(1)</enum><text>The term <term>Director</term> means the Director of the Office of Intelligence appointed under subsection (b).</text></paragraph><paragraph id="HC919A75DE6AD4EAAB2147BADC8F303A2"><enum>(2)</enum><text>The terms <term>intelligence community</term> and <term>National Intelligence Program</term> have the meaning given such terms in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph><paragraph id="H4F8BE2DF7B97463291DB0291228A5320"><enum>(3)</enum><text>The term <term>Office</term> means the Office of Intelligence of the Department established under subsection (a).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBD22A29104704A92903F1CE2484AD3B4"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="HA5783BEF389D4E0092171067675D74B4"><enum>(A)</enum><text>Subtitle A of the Department of Agriculture Reorganization Act of 1994 is amended by redesignating section 225 (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) as section 224A.</text></subparagraph><subparagraph id="H6702EAA8CA1149E49C7C6CE76E9A0300"><enum>(B)</enum><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBCF1DD74E2B44B37AA629FBCEF9F0598"><paragraph id="HFAF871E930D546879B97466FE1BA23E4"><enum>(11)</enum><text>The authority of the Secretary to carry out section 224B.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H5D30E8EEB8D14125B0ABDF045FF046A8"><enum>(b)</enum><header>Conforming amendments relating to existing functions and authorities</header><paragraph id="H7F4A296AD5964B80AD413B9B431B3050"><enum>(1)</enum><header>Existing functions of Office of Homeland Security of Department relating to intelligence on threats to food and agriculture critical infrastructure sector</header><subparagraph id="H5BAD217B24AA43BFBCAC1DBF1D8639B7"><enum>(A)</enum><header>In general</header><text>Section 221(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922(d)</external-xref>) is amended—</text><clause id="H36891D15BF754724884A60D5FA1ECFFF"><enum>(i)</enum><text>by striking paragraphs (4) and (5); and</text></clause><clause id="HFFDB1D596E3D4BF595E1747F4533C7B9"><enum>(ii)</enum><text>by redesignating paragraphs (6) through (8) as paragraphs (4) through (6), respectively.</text></clause></subparagraph><subparagraph id="H9D99FA8F1BEF4EAA9DF531A68A673425"><enum>(B)</enum><header>Transfer of related personnel and assets of Office of Homeland Security</header><text display-inline="yes-display-inline">The functions which the Office of Homeland Security of the Department of Agriculture exercised under paragraphs (4) and (5) of section 221(d) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922(d)</external-xref>) before the effective date of this paragraph, together with the funds, assets, and other resources used by the Director of the Office of Homeland Security of the Department of Agriculture to carry out such functions before the effective date of this paragraph, are transferred to the Director of the Office of Intelligence of the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H9FED1B69836F43DF9968EF315D956F79"><enum>(2)</enum><header>Carrying out interagency exchange program for defense of food and agriculture critical infrastructure sector</header><text>Section 221(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922(e)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD5F9ECA5DAF54F4292192D5F10A0B2CA"><paragraph id="H7D0501BDDCE3487597AA5628B10F79FC"><enum>(3)</enum><header>Authority of Director of Office of Intelligence and Counterintelligence</header><text display-inline="yes-display-inline">The Secretary shall carry out this subsection acting through the Director of the Office of Intelligence of the Department.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE88795357F38475BAB0A7E453EFDF310"><enum>(3)</enum><header>Coordinating with intelligence community on potential threats to agriculture</header><text>Section 335(a)(3) of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3354">7 U.S.C. 3354(a)(3)</external-xref>) is amended by striking <quote>strengthen coordination</quote> and inserting <quote>acting through the Director of the Office of Intelligence in the Department of Agriculture, strengthen coordination</quote>.</text></paragraph><paragraph id="H19A38875F4DD48AC9ED1D03A48B2589F"><enum>(4)</enum><header>Effective date</header><text display-inline="yes-display-inline">This subsection and the amendments made by this subsection shall take effect upon the appointment of the Director of the Office of Intelligence in the Department of Agriculture under section 224B(b) of the Department of Agriculture Reorganization Act of 1994 (as added by subsection (a)(1)).</text></paragraph></subsection></section></legis-body></bill>
