R. 1619</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="C000537">Mr. Clyburn</sponsor> (for himself, <cosponsor name-id="A000370">Ms. Adams</cosponsor>, <cosponsor name-id="B001251">Mr. Butterfield</cosponsor>, <cosponsor name-id="P000523">Mr. Price of North Carolina</cosponsor>, <cosponsor name-id="T000480">Mr. Timmons</cosponsor>, and <cosponsor name-id="W000795">Mr. Wilson of South Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To clarify the status of gaming conducted by the Catawba Indian Nation, and for other purposes.</official-title></form><legis-body id="H3FC53277B7DE430FB5F8DDC0D2793A42" style="OLC"><section id="H57EEAA9E9F45406494C27B557FCBCEA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Catawba Indian Nation Lands Act</short-title></quote>.</text></section><section id="HEE7A9B6E3BE940AAB89B808AE8CF64CA"><enum>2.</enum><header>Application of current law</header><subsection id="H719B7A85C9844D048D7DB653D029D5F0"><enum>(a)</enum><header>Lands in South Carolina</header><text>Section 14 of the Catawba Indian Tribe of South Carolina Claims Settlement Act of 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/103/116">Public Law 103–116</external-xref>) shall only apply to gaming conducted by the Catawba Indian Nation on lands located in South Carolina.</text></subsection><subsection id="H814407CC031D4C6CB5EC08804D34743E"><enum>(b)</enum><header>Lands in States other than South Carolina</header><text display-inline="yes-display-inline">Gaming conducted by the Catawba Indian Nation on lands located in States other than South Carolina shall be subject to the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701</external-xref> et seq.) and sections 1166 through 1168 of title 18, United States Code.</text></subsection></section><section id="H1AEC363ADB2049FE8B466EF9C70EB9B3"><enum>3.</enum><header>Reaffirmation of status and actions</header><subsection id="HA7D020FDA44C45398FA94C308FF4EF69"><enum>(a)</enum><header>Ratification of trust status</header><text>The action taken by the Secretary on July 10, 2020, to place approximately 17 acres of land located in Cleveland County, North Carolina, into trust for the benefit of the Catawba Indian Nation is hereby ratified and confirmed as if that action had been taken under a Federal law specifically authorizing or directing that action.</text></subsection><subsection id="H5665F0AC2B3B4CBFB1178EEF201E85BC"><enum>(b)</enum><header>Administration</header><text>The land placed into trust for the benefit of the Catawba Indian Nation by the Secretary on July 10, 2020, shall—</text><paragraph id="H735C4981E8D34A639B218F9DF63AE7FD"><enum>(1)</enum><text>be a part of the Catawba Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for an Indian Tribe; and</text></paragraph><paragraph id="H84BEF1F8DA0D41FDAA7C612583006DA3"><enum>(2)</enum><text display-inline="yes-display-inline">be deemed to have been acquired and taken into trust as part of the restoration of lands for an Indian tribe that is restored to Federal recognition pursuant to section 20(b)(1)(B)(iii) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2719">25 U.S.C. 2719(b)(1)(B)(iii)</external-xref>).</text></paragraph></subsection><subsection id="H4247EB0C4D92400BA2D3A14E8E6F6E36"><enum>(c)</enum><header>Rules of construction</header><text>Nothing in this Act shall—</text><paragraph id="HAD2AFC2D4B49497DB5B36B60959A834D"><enum>(1)</enum><text>enlarge, impair, or otherwise affect any right or claim of the Catawba Indian Nation to any land or interest in land in existence before the date of the enactment of this Act;</text></paragraph><paragraph id="HF9C5547220BB4F7384B997A2DF097347"><enum>(2)</enum><text>affect any water right of the Catawba Indian Nation in existence before the date of the enactment of this Act;</text></paragraph><paragraph id="HA0CEA09D621541C2B6078EB3F528C766"><enum>(3)</enum><text>terminate or limit any access in any way to any right-of-way or right-of-use issued, granted, or permitted before the date of the enactment of this Act; or</text></paragraph><paragraph id="HE894E8EF9EC64100AF3B1C3DE5D95219"><enum>(4)</enum><text>alter or diminish the right of the Catawba Indian Nation to seek to have additional land taken into trust by the United States for the benefit of the Catawba Indian Nation.</text></paragraph></subsection></section></legis-body></bill>
