which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Department of Energy Organization Act to secure the supply of critical energy resources, including critical minerals and other materials, and for other purposes.</official-title></form><legis-body id="H3CE65CE2611B4896A25B59D4A0E8CD45" style="OLC"><section id="HCBA72763418247BD8CAB84E0339876CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing America’s Critical Minerals Supply Act</short-title></quote>.</text></section><section id="H42444D6132CD4B309CF8136BD4EE7101"><enum>2.</enum><header>Amendment to the Department of Energy Organization Act</header><text display-inline="no-display-inline">The Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101</external-xref> et seq.) is amended—</text><paragraph id="HA525BF719C0A43A1A7CAD21DB9C5F774"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2, by adding at the end the following:</text><quoted-block style="OLC" id="H4F19B095D1D7445580E941D60999966B" display-inline="no-display-inline"><subsection id="H35DFC8256087436E9B8DE3AAAC9E12BB"><enum>(d)</enum><text display-inline="yes-display-inline">As used in sections 102(20) and 203(a)(12), the term <term>critical energy resource</term> means any energy resource that—</text><paragraph id="H5A622FDE87FF4502931566B5CE611C2C"><enum>(1)</enum><text display-inline="yes-display-inline">is essential to the energy sector and energy systems of the United States; and</text></paragraph><paragraph id="HABB6835C93ED408585A5F9876A1CBD3B"><enum>(2)</enum><text>the supply chain of which is vulnerable to disruption.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H71D53684B4E34D6DA73ECB98A8FAC40F"><enum>(2)</enum><text>in section 102, by adding at the end the following:</text><quoted-block style="OLC" id="HA2163B98D996469393B3E8B73BEBFF50" display-inline="no-display-inline"><paragraph id="H2077BF0D4C5E40878EDAE651A85B7E1B"><enum>(20)</enum><text display-inline="yes-display-inline">To ensure there is an adequate and reliable supply of critical energy resources that are essential to the energy security of the United States.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5C957C08FFCD4B22BDE007EF811542F9"><enum>(3)</enum><text>in section 203(a), by adding at the end the following:</text><quoted-block style="OLC" id="H8F12A678A9704B36B85A866C8E109958" display-inline="no-display-inline"><paragraph id="H82F94978049A4767869E29DEBB38D45B"><enum>(12)</enum><text display-inline="yes-display-inline">Functions that relate to securing the supply of critical energy resources, including identifying and mitigating the effects of a disruption of such supply on—</text><subparagraph id="H0E87935A381740CEB90AD753B42AE7F8"><enum>(A)</enum><text>the development and use of energy technologies; and</text></subparagraph><subparagraph id="H73BE46F564BB478EAD09BC5E8F234429"><enum>(B)</enum><text>the operation of energy systems.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB9D974B10BBB4A80BA22DB3D156A3841"><enum>3.</enum><header>Securing critical energy resource supply chains</header><subsection id="H3D24DEDB14D64D969006425581AFB15D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the requirements of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101</external-xref> et seq.), the Secretary of Energy, in consultation with the appropriate Federal agencies, representatives of the energy sector, States, and other stakeholders, shall—</text><paragraph id="H5527EE9126424B71955CBD037A0C69C1"><enum>(1)</enum><text>conduct ongoing assessments of—</text><subparagraph id="HB4EB010581144D6FB911E2C3D09F1E2E"><enum>(A)</enum><text display-inline="yes-display-inline">energy resource criticality based on the importance of critical energy resources to the development of energy technologies and the supply of energy;</text></subparagraph><subparagraph id="H47F6278C4FFD4FBDBAB90D90DD742FB0"><enum>(B)</enum><text display-inline="yes-display-inline">the critical energy resource supply chain of the United States; and</text></subparagraph><subparagraph id="H7EE744B131A741DB8B0FB5A96BDE55D7"><enum>(C)</enum><text>the vulnerability of such supply chain;</text></subparagraph></paragraph><paragraph id="H937CF1C905E045D4876659AF20E4B221"><enum>(2)</enum><text display-inline="yes-display-inline">strengthen critical energy resource supply chains in the United States, including by—</text><subparagraph id="H1E66FD852ACC4311AE533FE2B8F6D265"><enum>(A)</enum><text display-inline="yes-display-inline">diversifying the sources of the supply of critical energy resources; and</text></subparagraph><subparagraph id="H0A54F1FA0DCA4518B14C5E153BCFB5F6"><enum>(B)</enum><text display-inline="yes-display-inline">increasing domestic production, separation, and processing of critical energy resources;</text></subparagraph></paragraph><paragraph id="H1CF36EF85AC54A5083DB89A56595076B"><enum>(3)</enum><text display-inline="yes-display-inline">develop substitutes and alternatives to critical energy resources;</text></paragraph><paragraph id="HC7C98F9E7096466FB1312A0590F4E597"><enum>(4)</enum><text display-inline="yes-display-inline">improve technology that reuses and recycles critical energy resources; and</text></paragraph><paragraph id="HB58879CCBD244A719A2D37F14F7A3A6E"><enum>(5)</enum><text display-inline="yes-display-inline">evaluate how the energy security of the United States is affected by the reliance of the United States on importing critical energy resources.</text></paragraph></subsection><subsection id="HB33EBEC19EB44491949A0CBD8BD8F4FB"><enum>(b)</enum><header>Critical energy resource defined</header><text display-inline="yes-display-inline">In this section, the term <term>critical energy resource</term> has the meaning given such term in section 2 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101</external-xref>).</text></subsection></section></legis-body></bill>
